see the valve of a sidewalk that goes no where. If this property
was within a sidewalk benefit district, I believe it would be
most appropriate and insist on installation as a condition of
approval.

SORRY I MISSED YOU WHEN I STOPPED IN THE OTHER DAY TO TAKE A LOOK AT THE
NEW PROPOSED SITE PLAN FOR THE NEW STORE IN MCLEAN, I WILL NOT BE AVAILABLE TO
APPEAR IN PERSON AT THE HEARING, SO I AM SENDING YOU THESE COMMENTS,
IN GENERAL, THE ADDITIONAL ACQUISTITION GREATLY IMPROVES PROJECT, IN
PARTICULAR, THE CURB CUTS ARE NOW FARTHER BACK FROM THE INTERSECTION WHICH WILL
ALLOW SAFER ACCESS AND EGRESS FOR TRAFFIC. THE TRUCK CIRCULATION IS VASTLY
IMPROVED.
THIS LEAVES MY ONLY REMAINING CONCERN THAT OF A PEDESTRIAN WAY ALONG FALL
CREEK ROAD, I AM ENCLOSING A COPY OF A PETITION THAT WAS POSTED WITHOUT
ANNOUNCEMENT FOR ONLY TWO DAYS PRIOR TO THE LAST MEETING ON THIS SUBJECT THAT
COLLECTED 12 SIGNATURES IN THAT SHORT TIME. THE ORIGINAL PETITION WAS GIVEN TO
THE DEVELOPER AT THAT MEETING. I ENCLOSE THAT DOCUMENT NOT AS A PETITION, BUT

ROAD AS A PART OF THE PROPOSED CONVENIENCE STORE DEVELOPMENT AT THE CORNER OF
FALL CREEK ROAD AND PERUVILLE ROAD, WITH JUSTIFICATION AS FOLLOWS;
1, BOTH ROUTES ARE CURRENTLY HEAVILY TRAFFICKED, WITH INCREASING AMOUNTS OF TRUCK
TRAFFIC AND CORTLAND -TO -ITHACA "EXPRESS" TRAFFIC. THE CURRENTLY MODERATE, BUT
CONSISTENT PEDESTRIAN USE, INCLUDING SCHOOLCHILDREN, OF THE ROAD SHOULDER
PRESENTS AN ALREADY HAZARDOUS SITUATION WHICH SHOULD BE IMPROVED.

Gentlemen:
Benicor, inc. was granted a Special Permit in November of 1999 to construct
a warehousing facility in the RD Dryden Town Zoning District at the above
address. This facility was constricted and occupied by the owner for the use
as a soft drink distribution center. After three years, the operation ceased at
this location and the building vacated except for a year lease by the Deanco
electronic distribution firm who lost their Lansing site due to fire.
40 In view of the possibility of Benicor obtaining a lease with a local gun
company, we are requesting modification to the existing Special Permit to
include Warehousing, Light Manufacturing, and Assembly.
The proposed lease employs twelve people throughout the normal working
day. They have sold their original manufacturing equipment since they found
they could purchase components cheaper than manufacturing. Consequently
there will be little manufacturing on site with the productivity centered on
assembly of their only patented product along with repair and refurbishing
work.
The operation is small and will have less impact of traffic, noise, and delivery
in comparing to the soft drink operation. This company has had offers to
move out of state. We feel we should try to keep our local companies local.

IMPORTANT NOTICE TO:
All APPLICANTS of Building Permits, Special Permits, Zoning Variances
and All other Type of Required Reviews or Permits Issued by the Town of
Dryden. Effective Date: September 14th, 1988.

Sub: Violation of any Part or Parts of, The Town of Dryden Zoning Ordinance
or Title 19 N.Y.C.R.R. (Administration and Enforcement of the
Uniform Building & Fire Prevention Code).
Be Advised as;'Follows:
Due to the ongoing disregard of both the N.Y.S. Building & Fire
Prevention Code and the Dryden Town Zoning Ordinance, the Town of Dryden
will STRICTLY ENFORCE all REQUIREMENTS & REGULATIONS of both. The
following will be the general policy of the Town and this office:
1). No BUILDING PERMITS will be issued to any applicant until such time that
all other required permits, certificates and documents have been
submitted to this office and found to be acceptable and complete.
2). No PUBLIC HEARINGS or TOWN REVIEWS will be scheduled for any purpose
until this office has reviewed and found that all applications &
C• supporting documents are 100% complete and that all necessary supporting
documents are found to be accurate and complete.
3). If at any time prior to the issuance of any above permit or authority to
proceed has been granted, it is found that CONSTRUCTION or OCCUPANCY has
begun or taken place, the violator and property owner will be PROSECUTED
In a court of law-by this office or the Dryden Town Legal Authority.
4). After necessary permits have issued, if it is found that any holder of
any permit takes occupancy, opens its doors to the public or uses a
permitted device without obtaining a CERTIFICATE OF OCCUPANCY or
CERTIFICATE of COMPLIANCE, the holder of that permit will be PROSECUTED
in a court of law by this office or the Dryden Town Legal Authority.
5). In summary, no violation or noncompliance of either the Dryden Town
Zoning Ordinance or the New York State Building & Fire Prevention Code
will be tolerated by the Town of Dryden. No violation of any local,
county, state or federal law or regulation will be tolerated either.
Action will be taken against all violators. Penalties for such
violations are, $100.00 per day not more than 15 days in jail or both.
Each days breach shall constitute a new and additional violation.
6). All fees

To help extend the useful life of your disposal system, the septic tank should be
cleaned every 2 to 4 years depending upon the amount of solids such as greases, soap
scum, toilet wastes, and other solid materials discharged to the tank. If possible, the
sludge and scum depth should be checked every year. When combined depth of sludge and
scum equal 1/4 of the total liquid depth, cleaning is necessary. Septic tanks are best
cleaned in the spring or summer as they become readjusted more readily in warm weather.
Condition of the baffles in the tank should be checked at the time of cleaning.
A list of persons authorized to clean septic tanks in this County may be obtained
from the Health Department. It will be to your advantage to insist on a fixed cost for
cleaning or at least to obtain a definite maximum estimate before engaging a septic tank
cleaner.
Normal use of household detergents and chemicals will not be harmful to your dis-
posal system. Avoid use of so- called septic tank cleaners or conditioners as they have
not been shown to be beneficial and they may result in actual harm to the system.
If repairs or replacement of the system become necessary, a new permit from this
Department will be required.

As per our discussion yesterday, I met with the Ithaca Gun
Controller regarding the possible lease of our building can the
North Road. They are most interested in the property, and, if all
goes well, a possible purchase in the future.
As you know, they are going through a reorganization process and
possible, eviction from their current location in King Ferry. They
have been approached by investors to relocate out ot* state, but
would prefer to stay in the; area due to the reputation of the "Ithaca
Gun ". Maybe we can help in keeping them here.
In their reorganization plan, they are selling all their mtunul'adur-
ing cqu1pineW as they found they can purchase: parts less than they
can make theta. Consequently most of' the activity on the; North
Road would be warehousing parts, repair work, and some
assembly work. They will have between 10 and 12 employees on
site. I think it will be a very low key operation, and certainly
creating much less traffic and noise than the Pepsi Operation.
.1 will keep you posted as to what develops, and would appreciate,
any direction we should take, il' any, as far as the Town is
concerned.

Please find enclosed copies of three Tompkins County planning
Department, NYS General Municipal Law, 239 LRAM responses for
projects to be reviewed on Tuesday, February 27th, 19960
7:00 Big Al's II Convenience Store, No further comment.
7:15 Benicor: County Planning recommends, further attention to the on
site parking facilities. With snow gone, I visited the site
finding that my original estimate of parking for 40 — 50 persons
is fairly accurate.
Their specific concern of vehicle turn around area, in my
opinion, in unfounded. I believe the concern stems from their
review of the September 1989 site drawing which illustrates a
proposed green area within the traffic circle at the Northeast
corner of the warehouse. This green area was not included in the
final site installation. In fact the entire area was developed as
a solid stoned surface suitable for parking and traffic flow.
Surface is consistently solid with no puddling of run off. The
site is well developed, nicely landscaped and well maintained.
This specific project should compliment the site. Further
projects can be addressed for specific need as each is proposed.
Also a memo from Benicor, established that Remax Associates will
attend hearing as agent for Benicor. I assume Joe Quigley is
agent, as Mr. Metzger is out of town the week of the hearing.
7:30 Roger Hatfield, Site Plan Review, County Planning Department has
no specific comment or recommendation. A question has come up
concerning use of the upstairs area. Suggest upstairs use be
clarified at the hearing.

Thank you for your efforts in getting us on the hearing schedule at the next Town Board
meeting on February 2 7th. Unfortunately I will be out of town that week, but I am asking
that a representative from ReMax Associates, our Realtor, be on hand should arty questions
arise. Hopefully I have answered any gray areas, but someone may come up with an
inquiry.
Your concern about parking should a larger tenant or buyer come on the horizon should not
be a problem. The turn around circle shown on the original site plan was made into one big
parking area during the time of construction. I would guess about 30 cars could be located
in this area if it were ever necessary. Also there is a lot of empty acreage around the north
and west side of the building that is available.
Thank you again, and will be anxious to hear the outcome when I return.

• The County Planning Department staff remains concerned with the width and location of
curb cuts on the site plan. These changes are a concern for the following reasons.
0
(1) wide curb cuts allow unstructured traffic patterns as people enter and exit the site.
(2) locating curb cuts this close to an intersection can cause delays for cars trying to
enter and exit the site (cars turning into the site can cause delays, as well as cars exiting the
site can be blocked in by vehicles waiting at the intersection). The previous drawings
located the curb cuts a sufficient distance from the intersection to avoid these problems.
In order to mitigate these concerns the Department suggests that each of the three curb cuts
be reduced in width by half, from 60 to 30 feet. The location of the access points, as
shown on the enclosed sketch, will not change significantly, butmill be located further
from the intersection than the access points currently proposed.
However, the proposal, as submitted, will have no significant deleterious impact on
intercommunity, County, or State interests. Therefore, you are free to act without
prejudice.

FEBRUARY 27, 1996
Deputy Supv C. Hatfield called the public hearing to order at
7:20PM
Deputy Supv C. Hatfield read the notice that was published in the
newspaper concerning the application of Benicor (copy in minute
book).
QUESTIONS AND /OR COMMENTS
Deputy Supv C. Hatfield - Benicor is proposing to have Ithaca Gun
there which would be just assembly and shipping, no manufacturing.
Benicor was granted a special permit on 11 -89 to construct a
warehouse facility in a RD zoning district. The facility was
constructed and occupied by the owner for the use of a soft drink
distribution center. After 3 years the operation ceased and was
later leased to Deanco Inc. There is a possibility of Benicor
obtaining a lease with Ithaca Gun Co. They are requesting
modification of this existing permit to include warehousing, light
manufacturing and assembly. The proposed lease employs 12 people
throughout the normal working day. They have sold their original
manufacturing equipment since they have found they could purchase
the components cheaper than manufacturing them. Consequently there
will be little manufacturing on site. Product activity will be
centered on the assembly of their only patented product along with
repairs and refurbishing work. The operation is small and will
have less impact of traffic, noise and delivery as compared to the
soft drink business. The company has had offers to move out of
State and we feel we should try and keep local companies local.

Dear Mr. Slater:
This letter acknowledges your referral of the proposal identified above for review and
comment by the Tompkins County Planning Department pursuant to §239 -1 and -m of the
New York State General Municipal Law.
The County Planning Department staff has the following concerns and questions regarding
the special permit review for 119 Mill Street:
1) We agree with all of Mr. Slater's concerns and questions regarding the disposal of parts,
storage of automobiles, and the noise level of activities on the site as discussed on page 2
of the Special Permit Review,
2) Regarding the disposal of paint and thinners, what "waste centers" will be used to
dispose of these wastes?
3) Just north of DR 39 is the border of the Mill Dam Marsh, Freeville. This marsh is a
Department of Environmental Conservation protected wetland (OR 19). While the 119
Mill Street site is not within the Unique Natural Area, it does drain into it.
However, the proposal, as submitted, will have no significant deleterious impact on
intercommunity, County, or State interests. Therefore, you are free to act without
prejudice.

business. I would hope to know within 3 years before I would have

Clifford Maxwell - I am a body shop man by trade and I hear this
noise all day so I would not like to come home at 5:00PM and hear
the same noise. Also, my wife is a nurse and works the night shift
so sleeps during the day. During the summer time would be very
hard since our bedroom faces this proposed business. If he has a
paint shop, he will have to do something with the chemicals. There
is a lot involved with a body shop. There will be paint fumes so
he will have to install a fan to suck out the fumes. He is already
working over there. I live next door to this and I do not need to
hear this on the weekend or late at night. It is a little too
close for a body shop.

I could do the work inside of the garage with the doors down to

8 :15PM and read the notice that was published in the newspaper
concerning the application of Pro Lawn & Landscaping. (copy in

QUESTIONS AND /OR COMMENTS
Nick Bellisaro - I have been in the land landscaping business for
7 years. We are primarily landscape maintenance year around with
commercial businesses. We have outgrown our present location and
would like to relocate to a place that would house our supplies
and equipment.
Clp Roberts - wanted to know the hours and days he would be there
at the site.
Nick Bellisaro - it depends on the time of year. In the summertime
it would be 7:00AM to 6:OOPM. In the wintertime it depends on the
snow, since I do snow plow work. It could be all hours of the day
or night.
Clp Roberts - wanted to know if the snowplow equipment would be
stored there.
Nick Bellisaro - yes, there would be snowplows, small tractors,
pick up trucks, dump trucks and a backhoe which would be stored
inside of the building.
Clp Roberts - wanted to know if there would be a salt pile there.
Nick Bellisaro - no salt pile will be stored on the premises, this
is stored at the site. We take care of the Pyramid Mall and
Triphammer Mall. Most of the heavy equipment is stored on site.

Adam Regenbogen - There have been some misrepresentations that Mr.
Stevens has made. This was supposed to be a residential lot
subdivision at some future time. It was not intended for
commercial purposes, at least that was the premiss. Some of these
• structures were apparently built without prior approval by the
board. There are 3 garages across the street from 24 Oak Brook
Drive. I am concerned because water and sewer is not established
completely. Whatever happens up the hill runs right down onto my
lot without any adequate way of causing that drainage to go around
the property. I have brought this up in previous meetings
regarding increased traffic of large vehicles going up and down
the hill. It is a very steep hill with a bus stop at the bottom of
the hill. There are children in the neighborhood and I think there
is danger there with mixing the usage. I know Mr. Stevens has been
trying to sell some homes up there. I question why he mixes the
type of uses. I think he would have been better off to go along
with his original plan of building houses. With the vote of the
water and sewer district going in there would give him an
opportunity to build smaller houses. I do not oppose that. Even
though that usage and most of the other usages he has been
proposing since then probably without deleterious effect on the
value of the existing properties in that area. I did not oppose
the applications for residential type properties, but I do feel
the type of special permit that is being considered here and the
establishment of a commercial usage in the higher parts of that
lot will in fact will cause some problems. They are spelled out in
the zoning regulations as to what the specific areas are namely
traffic, larger vehicles, the incline of the hill is not good for
large vehicles going up and down. It is a neighborhood where
• people live there and houses nearby and around without the well
and sewer hook up.

Adam Regenbogen - There are questions as what is going to insure
is them that the water and sewer in the area does not get impacted.
There have been problems before and a lot of dead trees now. The
sewer and drainage in the area have killed off some of the large
trees because of all of the water coming down off the hill. The
drainage is inadequate. I want to raise those concerns to the
board. I am not thrilled about a business going in there. If this
board says it can happen I suppose you have the final say, but I
do feel there has been a lot of mixing and matching and mixed
messages in terms of the planning.
Atty Perkins - Mark got approval in 1988 and has exhausted the
approval. The Planning Board said no more subdivision approval for
1 and 2 without public water and sewer. Now the question is
whether or not he can divide this property without complying with
subdivision rules.
Atty Wheeler - subdivision has not been sought for this because it
has been Mr. Stevens understanding that the sale having occurred
in 1989 this particular proposal would not fall within the
subdivision regulations, that is why we are here. Maybe Mr.
Stevens could address the well, drainage and grade of the hill.
Certainly the well and sewer would be a condition of the approval.
Mark Stevens - the grade of the hill, the road and turn around is
to town specifications. The town takes care of the road and there
• have not been any accidents there within the last 5 or 6 years.
Drainage is working proper. There was a slight problem during the
flood. Nancy Connely, next to the Antler's, a pine tree came down
on her property so a little water came over and she called me and
I went right down and fixed it. There is a little driveway work to
be done and I told her I would also fix that as soon as the
weather permits. I don't think Mr. Regenbogen's property has been
worked on at all for any drainage reasons above that. He mentioned
about the septic. There is nothing above him that has a septic.
The building does not have a septic or a bathroom. The house is
now on public sewer. I believe he is the only one who is not
hooked up to public water and sewer which is available. The
problem with his pine trees if there is a septic problem it is
probably from his house. The application I am going for is to use
the storage building for the same thing I do only maybe a little
cleaner operation. He has smaller equipment than I do where I have
bulldozers and excavators he has small backhoes, lawn tractors,
and pick up trucks. For the safety of the road I would rather see
a 1000 pound tractor come down rather than a 40 ton loader. I have
bought another place near Spencer and that is where I am doing
business. This is the reason Nick would like my storage building.
Clp Roberts - back in 1994 when Airport Limousine applied for a
permit, one of the findings at that time was any use of the
building or property as- reason for concern was inadequate drainage
plan and facilities. Has anything been done as far as the drainage
plan or an engineering study since that time (1994).

• Mark Stevens - the map you have was done when the road was put in
and the drainage has been working properly. The road has ditches
on each side which carries the water down. The highway department
has not had to do anything to the ditches since the road was put
in.
Adam Regenbogen - I hear what Mr. Stevens is saying, but I want to
indicate that the pine trees that are gone are on my property.
But, above my property there is a fallow area between the garages
on the hill and where my property starts where there are a lot of
trees falling down on Mr. Stevens lot. The drainage when he says
no work was done on my property, there had been a drainage system
above my house which gradually got filled up with mud from the
hill above it. I didn't clear that out, but what gradually
happened was the drainage that was built behind the house
cluttered whatever was built to help the water move to the sides
around the house. Whatever system is in place evidently hasn't
protected my house. I did get flooded during the recent flood, but
I also have gotten flooded several times before that. It is not
just the flood of unusual circumstance. The drainage coming down
the hill does come straight down. There is not an adequate system
to cause the water to come down from a higher elevation to a lower
elevation. This is a problem which not only affects me, but also
the neighbors across the street on Dryden Road. I do take some
exception to the explanations Mr. Stevens has made.
• Joe Hillebrant, 1171 Dryden Road - agreed with Adam Regenbogen, I
had a pine tree that came down in back of my property because of
all of the water coming down the hill. The ground is just totally
water logged. I am also concerned and want to know if there will
be herbicides and pesticides used. Will there be liquid fertilizer
and will these be stored there. I live at the bottom of the hill
and have a well and am concerned about it. Public water and sewer
is available but I can still use the well and use it for drinking
water. I am also concerned about big trucks going up and down the
hill.
Nick Bellisaro - we are not a certified pesticide applicator and I
do not plan on being one because of the liability involved. They
are all restricted if you are commercial.
Joe Hillebrant - I feel the drainage issue has never been
resolved. I have been to several of these meetings and this
question was always brought up. I do not feel it has been
adequately resolved. The way the lots have been cut into the side
of the hill and all of the trees that have been taken down. I just
do not feel this has been given adequate attention. I also feel
the increased traffic will be the same as when we were here for
the airport limousine service. That building was originally built
and I signed an agreement as probably most of the people around
there did that it was to be used by Cornell to store furniture etc
• and would be accessed once a month. I agreed to that because I
felt it was a limited use for that particular situation. I feel
this is a lot higher visibility and a lot higher traffic. I have
children and there is the school bus situation.

Joe Hillebrant - no, I live at 1171 Dryden Road right behind it.
Mark Stevens - so going down this road has nothing to do with your
traffic.
Joe Hillebrant - traffic still goes up and down Dryden Road.
Mark Stevens - the traffic would only create 3 or 4 more cars a
day.
Joe Hillebrant - I will still be there when those trucks are going
up that steep grade, in the winter at night at 1:OOAM when the
plows are going in and out.
Mark Stevens - that is a town road and was built to town
specifications.

Nick Bellisaro - I am not sure how it could do that since we would
be doing it indoors. If there is some spill there is adequate
things to do that.
Joe Hillebrant - you can guarantee that.
Nick Bellisaro - I could make that guarantee.

out of there the
more riskier it
is for

The way the driveway
was built you
can only see up
about 30
feet.
Anything that comes
down that hill
at 20 MPH is a
hazard and
when
it is icy and snow
banks you can't
see around the corner
so
it is
a potential for an
accident.
Mark Stevens - the use of the building would be the same as what I
am using it for now and this would be on a smaller scale with
smaller vehicles.
Nick Bellisaro - I run a clean operation, keep everything clean
and environmental friendly, you can't get much friendlier than a
landscaping business. The buffer zone where he mentioned trees are
falling down. There are dead trees there that I mentioned I would
clean out and I also plan on leaving that buffer zone.

Mark Stevens - poured concrete.
Nick Bellisaro - as far as oil changes is very minimal. Our
vehicles only get 5000 miles on them a year. We are looking at 50
gallons a year.

Clp Roberts - on the plans you mentioned there would be some mulch
piles and stone piles. Would that be open piles?
Mark Stevens - yes, there would be no packaged stone or mulch.
Deputy Supv C. Hatfield - on the lower side of the building you
mentioned you were going to clean that up and landscape it, is
that correct. There seems to be a lot of equipment and some kind
of drums there. This will all be removed?
Mark Stevens - correct, there is one big bulldozer left and a
excavator. There are some pipes on the upper lot. Everything will
is be cleaned up.
Clp Roberts - asked Mr. Hillebrant if any of his other neighbors
were having drainage problems.
Joe Hillebrant - they had water in their basements.
Clp Roberts - questioned if this existed before the site was
developed.
Joe Hillebrant - I am not sure since some of the property has
changed hands several times since then. You can go over there
tonight and see water running right outside of the hill.
Z.O. Slater - there is the possibility if you were to look at the
permit and the contingencies that would resolve the water issues
If they are going to continue to be a problem forever because
nothing ever happens with the property. If something happens to
the property maybe you stand the ability to get something done to
resolve these water issues as a contingency.

over 45 years and that water has always run there and no one is
going to stop it. It was running there when the woods were there
before Mark bought it and it will still run.

down. The watershed that was up there before he took out all of
the tap roots?
Jack Ford - yes it did. That water has been running for years.

is approved is going to make it worse. It seems to me if you have
someone in there with landscaping, we could get some shrubbery
planted and things done to dress it up. I see some acknowledgment
that this might be something that would happen and start to help
alleviate that. I suspect the hydrology of that area is such that
just addressed that of 45 years experience. Trees will help, but
you are not going to stop that kind of water flowing deep in the
ground. It sounds like this application would be going from bigger
vehicles to smaller vehicles for the same general use and they are
willing to do some landscaping and planting and address some of
these issues.
• Clp Roberts - there is only a short EAF SEAR form filled out for
the site and would like the long EAF form filled out considering
the history of the site.

Clp Roberts - my concern is not so much as being changed, but
there has been concerns with the site in the past. The long EAF
form would show what the town reviewed and would protect the town.
Mark Stevens - when I bought the property there was no ditch above
their property line. That was one of the town requirements that
the ditch be put in along the side of the road. This has helped
cut some
of the
water runoff.

ditch and I would own part. I will assure the neighbors it will be
a joint maintenance of the ditch.
Clp Roberts - the board could make this a condition that the new
owner would maintain his portion of the drainage ditch if there
was an approval.
Nancy Connelly - wanted to know about the ditch behind her house
and who would be responsible for that.
Mark Stevens - I own that and will keep it maintained.
Atty Perkins - you can have the applicant specifically address the
areas of concern.

Clp T. Hatfield - this would document some of the concerns that
• were addressed here tonight and will document the existing use vs
the proposed use. This will also address the drainage issues and
landscaping issue and develop it further inside the scope of the
long EAF.
Atty Perkins - what form of discussion would you like for the
drainage issue. Do you have any recommendations as to what form
the drainage for the whole site might take.
Dave Putnam - from what has been presented so far is an
I
mprovement over what is there. The town historically has asked
that no increase in runoff be generated by this. It is not going
to go up and very possible it is going to go down.
Atty Perkins - you have to look beyond this particular change in
use. You have to look at the whole site and the opportunity for
that review was never presented. He really needs to address all of
the land he owns and what has been done to it.
Clp Roberts - wanted to know if this would be a burdensome and a
costly thing to do.
Dave Putnam - you are not looking at a lot of drainage
calculations you are looking more at an area of land and this has
been done in the past what can we do it mitigate the problems it
• has caused rather than to define it by if a drop of rain falls on
top of the hill where is it going to go. You are looking at
existing conditions and actually a drainage ditch was put in in
1981 and you should make sure maintenance is continued on the
ditch.

RESOLUTION #102'00 GRANT SPECIAL PERMIT
Big Al's Convenient Store
Clp Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board grant a special permit to Michael
Herzing with the additional conditions: 1- Health Dept. approval
of the new plan, 2- all previous conditions granted on 12- 12 -95,
3- all entrances and exits be striped to indicate traffic lanes,
4- south property line will be fenced with at least 3 foot
stockade fencing and landscaped in addition to the west property
line, 5- hours are revised from 6:OOAM to 9:OOPM to 5:OOAM to
10:00PM seven days a week.
2nd Clp Grantham Roll call vote - all voting Yes
• Town Board went over request for Joe Yeager application for a
repair shop.
Clp Roberts - there were 2 concerns, the noise and the chemical.
Clp T. Hatfield - regarding the chemical, air and dust will be
covered by a permit from NYSDEC and those issues will be addressed
in that permit. We can make our permit approval subject to any
NYSDEC and State permits required. The noise issue is a little
harder to correct.
Board members went over EAF SEAR form.
Regarding the noise issue the board requested Mr. Yeager to
consult an engineer to figure out some way for noise reduction and
submit the report to the board. There could be a berm or some type
of fence to reflect the noise. The board scheduled Mr. Yeager to
come back to the board on 3 -26th at 7:15PM with the noise report.

Atty Perkins - town board went into a short executive session to
discuss a personnel matter and litigation matter. 9:40PM
Town Board reconvened at 10:OOPM and the following action was
taken.
RESOLUTION #102 MILEAGE ALLOWANCE
i
Clp Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board authorize the mileage allowance to
be paid Town Officials, including election inspectors, at a rate
of 30 cents per mile when using their own vehicles for official
town business other than town meetings. This will be effective
March 1, 1996.
2nd Clp Grantham Roll call vote - all voting Yes
Atty Perkins - with regards to claims by the NYSDEC the town
improperly disposed of construction and demolition material from
the Empire Livestock demolition. In an effort to avoid litigation
and further action on behalf of the department the town has an
offer from DEC to settle this matter agreeing to a consent order
that admits the town unlawfully disposed of construction and
demolition material on a site other than one that has been
authorized and from that site the town also transported the !,
construction and demolition material to a site owned by the town
on Johnson Road. The consent order provides for a civil penalty to
be paid by the town in an amount of $1,000.00. It is my
recommendation that given the potential exposure of the town, the
length of time to get an effective defense, and the amount of the
proposed consent order the town should consider a resolution
authorizing the deputy supervisor to sign the consent and consider
the penalty be paid.
RESOLUTION #103 AUTHORIZE DEPUTY SUPERVISOR
TO SIGN CONSENT ORDER FOR NYSDEC- Illegal Dumping
Clp T. Hatfield offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board authorize Deputy Supervisor C.
