out sub shop. It would
be
on the same
order as
Tucker's
Take
Out
was.
Supv Schug - if the board grants the permit it will have to be
subject to health department rules and regulations. Henry said
the permit is at the health department, but has not heard back
from them yet.
Supv Schug - wanted to know the hours he would be open.
Tim

Clm C. Hatfield - wanted to know how many employees he would
have.
Tim Cornelius - just myself and maybe 2 others, whatever is
needed.
• Clm T. Hatfield - wanted to know if the people would be eating at
the site or is it strictly take out.
Tim Cornelius - it would be strictly take out. I would like to
put one booth in for a quick sandwich for a working man. It would
be no restaurant type whatsoever.
Clm Roberts - wanted to know how many customers he would have at
peak times.
Tim Cornelius - I have no idea.
Clm Roberts - asked Henry if the parking was sufficient.
Z.O. Slater - the parking plan is sufficient for all of the
businesses located there.
Clm Roberts - wanted to know if he was going to have a sign.
Tim Cornelius - did not know. It would not be any bigger than the
sign that is there now. It will have to be approved by Henry. I
have an existing sign that is 26 inches high and 6 foot long that
I would like to use if I can.

NY pursuant to 239 L &M General Municipal Law
Dear Commissioner Hanson:
Please find attached a copy of an application submitted by Susan
Cornelius, DBA, the Glass Slipper.
Ms. Cornelius is requesting a modification of her valid Special
Permit granted on April 25th, of this,year by the Dryden Town
Board.
At that time, the Special Permit authorized Ms. Cornelius to
construct a (4) unit store /office structure at 2215 Dryden Road,
Town of Dryden. At that time, the Special Permit also approved
(2) tenants, one was her own shop called the Glass Slipper and a
second for a hair- salon. Item # (6) required Ms. Cornelius to
seek further approval for all proposed tenants that would
generally fall within the established Special Permit provisions.
A copy of that April 25th Approval resolution is attached for
Your review.

Comments or concerns: At this time, I do not have any concerns. The (4 -10)
cars per hour will not have any real affect on existing traffic. So far

Permit Approval. Applicant is following requirement to obtain approval of

Due to the ongoing disregard of both the N.Y.S. Building & Fire
Prevention Code and the Dryden Town Zoning Ordinance, the Town of Dryden
will STRICTLY ENFORCE all REQUIREMENTS & REGULATIONS of both. The
following will be the general policy of the Town and this office:
1). No BUILDING PERMITS will be issued to any applicant until such time that
all other required permits, certificates and documents have been
submitted to this office and found to be acceptable and complete.

RESOLUTION #201 ACCEPT NEGATIVE DECLARATION

CITIZEN PRIVILEGE OF THE FLOOR
Robert Beck - regarding Malloryville Bog - would like to invite
all officials to visit the bog. I want to thank Atty Perkins for
all of the letters he has written to DEC on this issue. There
have been 3 applications for a gravel mine immediately adjacent
to and up slope from the wetlands at Malloryville. The first two
applications DEC issued positive declarations requiring a draft
environmental impact statement in each case. In both cases

the applicant chose to withdraw. Those occurred in 1987 and 1989.
• There now is a third application and Mr. Eddy chooses this time
to operate the gravel mine himself. In this case DEC issued a
negative declaration which was rescinded upon massive comments
from scientists at Cornell and Syracuse Universities, neighbors
and others from the town. DEC now is requiring them to have a
draft environmental impact statement. That draft environmental
impact statement was completed about a year ago and was reviewed
last summer. Again massive input was put into that and over the
fall and winter DEC reviewed our comments and further comments
from the applicants consultant. In April of 1995 DEC wrote a
letter to Alfred Eddy, the applicant, stating they could not j
issue a permit. This was the official denial of the permit.
Denial based upon our comments, specifically the comments from
the scientists concerning the hydrology and the effect of the
changes in the hydrology for the water source in the wetland
might impact the quality of the wetland. That lead to a meeting
in July 1995 which Supv Schug and Z.O. Slater attended and a lot
of issues were covered. The next step is for the applicant. The
permit has been denied, but the applicant has the opportunity to
pursue it through an adjudicatory hearing which is to be j
scheduled. This should be sometime in September or October. To my
knowledge it has not been scheduled yet. The adjudicatory hearing
would be the last step within the DEC for review of this case.
Beyond that if there was further contention it would go to the
courts outside of DEC. The adjudicatory hearing would involve an
® appointed administrative law judge, who is an employee of DEC.
That judge would then hold a formal hearing involving sworn
testimony and cross examination. You have to petition to be party
of that hearing in advance. The judge rules as to who gets to
have party status. This is a very important step and the judge
would write up his review and recommendations. This would then be
sent to the commissioner of DEC in Albany who makes the final
decision. This case has gotten a significant amount of state wide
attention. The reason is the wetland we are talking about is very
special and the best we have in this part of the state. There are j
ongoing studies with scientists, ecologists, botanists,
entomologists, hydrologist, geologists who are doing studies and
papers have been published on the formation of this wetland in
Malloryville. The wetlands are very complex and that is part of
the reason that it is so special. There are numerous different
kinds of wetlands and are all in close proximity to each other.
Several of those wetlands are very fragile. They are unusual and
very sensitive to the surroundings and exact conditions. That is
why we are so concerned because the water from the gravel mine
provides the water to the wetland. The applicants consultant says
at least part of the water bypasses the wetland. Professional
hydrologist and geohydrologist say that is not the case. There
are numerous springs along the west side of the wetland
immediately adjacent to the proposed gravel mine.

Robert Beck - it would be after the hearing is scheduled. I was
told we should have received those by now. All of the parties
should receive this information at which point the judge will
spell out the rules as to when we need to apply for petition
status. There is a new regional director for DEC who covers our 9
county territory from Lake Ontario to Pennsylvania. He asked to
be taken on a tour of the 2 most significant bio diversity sites
in central New York. One that was suggested was the Malloryville
Bog which he visited. He was very impressed with the wetland.
Ralph Mano, in regulatory services division, called me and was
very encouraging. Ralph told me that regulatory services division
of DEC would be a party to the hearing and present it case as to
why they can not issue a permit. They have been very careful so
it will not be overturned. An active participation by the Town of
Dryden is very important part in this case. This hearing is very
important. The nature conservancy has a very definite interest in
putting together a permanent nature preserve at the site. They
only go after the best, and this is one of the best. They have
offered Alfred Eddy money for the gravel mine property and so far
the answer is no from him. We are hoping in time he would like to
do business with the nature conservancy. This is the first step
and is critical because the long term protection of the wetland
depends on what happens to that 110 acre gravel mine property.

The conservancy would like to create a 300 acre permanent
wetland. My 38 acre property is already being used for scientific
research and is being used by school groups, individuals, and
environmental groups. The nature conservancy has regular tours j
® there. It is being used for educational, recreational, and
scientific purposes and that will continue. I view this as a
wonderful thing for the Town of Dryden. I am asking if it is
possible for the town to take a position to be an active
participant at the hearing and to state clearly what the towns
position is in terms of zoning, condition of the roads, concerns
for the neighborhood and concerns of the wetlands. The value to
the town of a preserve there that can be enjoyed by all of us. If
we don't continue to take a strong stand and do everything we can
we could very easily lose the case. The commissioner himself can
over rule the judge so we have to have a good case.

the 18th to run the utility lines out of the town right of way.
The water lines will be statred on Thursday Sept. 7th. I have
supplied Atty Perkins with all of the material that he has asked
for. I am interested in getting the people in the house. They are
the only customer they have now and are hoping we can get a
certificate of occupancy. We have a permit for that particular
lot. We expect to have the sewer and water line complete, the
base of the road down, NYSE &G hooked up to the house in order for
us to have the final inspections for the plumbing and electrical.
We are hoping to get the customer moved in after NYSE &G is hooked
up, if we can get a C.O. from the town for that one house. We are
hoping to complete everything that we need for the road, the
shoulders, seeding, walkway and everything that needs to be done
including the planting for the mitigating measures for some of
the neighbors. We are hoping to get everything done and not put
up any bond for anything since it is one and a half times what it
costs. It would be easier for us to complete the work if we can
get that one customer in. I would anticipate we would come in
November and have everything 100 percent done.

district by a local law or resolution. Before an ambulance
district can be formed we need to have some idea what the costs
will be on an annual basis and when it will start. The issue of
whether or not the town can actually employe these individuals
who are actually going to be emergency medical paramedics. I
still have not been able to resolve the definition as to whether
or not the town has the authority to employ them or whether they
will have to be employees of Dryden Ambulance. I think the
vehicle is the ambulance district and in order to take the
necessary steps we are going to need some costs as to what the
first year costs are going to be.

WHEREAS, the Town Board has received and considered a report
from Henry M. Slater, the Code Enforcement Officer, with respect to
a structure on the premises at 1062 Dryden Road (Town of Dryden Tax
Map Parcel #55- 1 -11), and
WHEREAS, Local Law No. 2 of the 1981 provides for a procedure
to compel the repair or removal of unsafe buildings and collapsed
structures, and
WHEREAS, prior attempts to encourage and require the removal
of said unsafe and collapsed structure at said address have been
unsuccessful;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD AS FOLLOWS:
16 The Town Board finds that the structure at 1062 Dryden
Road (Town of Dryden Tax Map Parcel #55 -1 -11) is unsafe and
dangerous due to its collapsed condition, and
2. Said structure shall be demolished and removed.
BE IT FURTHER RESOLVED AND IT IS ORDERED THAT: That a notice
pursuant to Section 6 of such local law shall be served upon
Clifford Heffron and Dorothy M. Heffron as provided in Section 7
thereof, said notice to be in substantially the following form:
1. The structure which is the subject of this notice is
located at 1062 Dryden Road in the Town of Dryden, County of
Tompkins, State of New York, Town of Dryden Tax Map Parcel #55 -1-
11.
2. The structure at said address is unsafe or dangerous in
that it has collapsed and is in danger of further collapse and is
unfit for any lawful purpose.
3. Said structure is to be demolished or removed in
accordance with all applicable provisions of such local law or
other local laws and ordinances of the Town of Dryden and the
County of Tompkins and the provisions of the New York State Uniform
Fire Prevention and Building Code.
4. Such demolition and removal of the structure shall
commence within 30 days after service of this notice upon Clifford
Heffron and Dorothy M. Heffron and shall be completed within 60
days thereafter unless for good cause shown such time shall be
extended.
5. The Town Board of the Town of Dryden will hold a hearing

in relation to such dangerous and unsafe structure on October 10,
1995 at the Town Hall, 65 East Main Street, Dryden, New York 13053
at 7:30 p.m. prevailing time to hear all persons including Clifford
Heffron and Dorothy M. Heffron regarding the order of the Town
Board requiring the demolition and removal of such structure.
69 In the event of the neglect or refusal of said Clifford
Heffron and Dorothy M. Heffron to comply with this order of the
Town Board to demolish and remove said structure, the Town Board is
authorized to provide for such demolition and removal and to assess
all expenses thereof against the land on which it is located and to
institute a special proceeding to collect the costs of demolition
including legal expenses.

moratorium on open burning since everything is so dry from lack

different person or vendor at whatever the price would be. The
alternative is some other procedure. Another alternative would be
they couldn't do the work until there is another board meeting
and we can propose a possible change. Does the board want to say,
you have to wait until the next board meeting if you have made
arrangements with the state bid and they can't come through, what
will we tell Don. He has to wait until the next board meeting
before we can give him approval to try a different person. ;
Supv Schug - there are two state bidders.

3rd.
Clm C. Hatfield - he did admit he wasn't following the procedure
like he should, but he was getting better at it. The company in
Georgia, he is all finished with them.
® Clm Roberts - other than Suite Kote there is another vendor that
is under state contract.
Supv Schug - Vestal is also under state contract. The point is
you don't have to pave a road tomorrow. You schedule it and you
schedule it ahead of time.

whether that person could come or not.
Clm Roberts - the board should give some written direction.
Clm Baker - he should follow the written direction he already
has, is to follow procedures. We shouldn't make the town board
members available by telephone pole to schedule an impromptu
meeting to approve the bills.
Clm Roberts - are we going to take some action or say what
already in place is good enough we don't have to say anything and
if it happens again we will go through the same process we just
went through or are we going to take some action.
40 Supv Schug - unless it is a real emergency refuse to pay the
bill. That is the only alternative we have. If you believe this
letter and you want to sign the bills and pay them, fine.

should pay them, but I don't agree with how it came about. Jim
should write him a letter.

Clm T. Hatfield offered the following resolution and asked for

There was one Fire Call during August. A single wide mobile
home within the Shady Grove Mobile Home Park at 27 Pinckney
Road, was destroyed by fire on Friday, August 25tH. The
debris from the fire has been removed and a new home will be
installed.
The ZBA met to consider the application of Cathleen Schickel
who was requesting a use variance to convert A former dairy
barn at 98 Schutt Road, a property within an RC Zoning
District, to a self storage facilitya
As the hearing progressed, it became obvious to the-
applicant, that the request was heading towards a denial,
which prompted the applicant to withdraw prior to a decision.

0 RESOLUTION NO. 208 (1995)
Councilman Tom Hatfield offered the following resolution
and asked for its adoption:
WHEREAS, Tompkins County, the City of Ithaca and the Towns and
Villages of Tompkins County are required under the Omnibus Employee
Testing Act of 1991 to implement drug and alcohol testing for their
commercial drivers license holders by January 1, 1996, and
WHEREAS, entering into an intermunicipal agreement pursuant to
General Municipal Law Article 5 -G with the County, City of Ithaca
and the Towns and Villages of Tompkins County is an efficient and
cost effective method for all parties to comply with this law,
NOW, THEREFORE, be it
RESOLVED, that Town of Dryden agrees to enter into an
intermunicipal agreement with Tompkins County, City of Ithaca and
the Towns and Villages of Tompkins County for the purposes of
implementing the required drug and alcohol testing and in the
furtherance thereof shall participate in the selection of a third
party (administrator) to manage such drug and alcohol testing
program, and be it

Supv Schug - Hall Road update - he took some of the stone back.
Schedule (3) people for winter night work from Nov 1st to April
30th from B:OOPM to 4:OOAM - discussion.
Supv Schug - this would be three of the regular men working a 40
hours week.
Clm C. Hatfield - questioned what they would be doing when they
weren't plowing.
Clm T. Hatfield - questioned if this was something that was
really needed.
Supv Schug - they are now on stand by call during the winter
months.
Clm C. Hatfield - they knew that when they were hired.
No action was taken until there was more information available.
CORRESPONDENCE
Dryden Lake police report for the month of July
DISCUSSION
Supv Schug - purchasing update - the computer has been installed,
but is not complete yet. The system should be working by the 1st
of October.
PAVE program - board members have copies of information. The Town
Board authorized Supv Schug to write a letter and refer them to
the youth commission.
There was discussion regarding the town putting in a sidewalk
from Empire Livestock to the Town of Dryden highway pavement and
stripping an area for sidewalk use to the town hall.

Clm T. Hatfield offered the following resolution and asked for
its adoption:
RESOLVED, that this Town Board appoint Tracy Kurtz of 10 Hanford
Drive to the Youth Commission replacing Ann Bianchi who is
resigning as of September 1995. Also thank Ann for her good
leadership and loyal service.

indebtedness for the purpose of providing a portion of the cost
of filing, constructing, enlarging and improving and /or extending
its water distribution facility to serve an area lawfully within
its jurisdiction to serve as prepared on USDA FMHA form #1942 -47.
The documents will be signed according to the bond resolution
previously adopted 4- 13 -93.
