ZONING ORDINANCE AMENDMENT
TOWN OF DRYDEN
PLEASE TAKE NOTICE that the Town Board of the Town of Dryden
will hold a public hearing on proposed amendments to the Town of
Dryden Zoning Ordinance. The proposed amendments are as follows:

Section 1502 of Article XV of the Zoning Ordinance is hereby
amended by adding thereto a new subsection 13 to read as follows:
1113. For a tourist home, rooming house, boarding house
and bed and breakfast establishment: One sign
advertising the home, house or establishment, not
exceeding six square feet with indirect lighting
only. Any such sign is subject to approval of the
Town Board at the time of the special permit
hearing required for such home, house or
establishment."
Appendix A (Definitions) of the Zoning Ordinance is hereby amended
by adding thereto a new definition to read as follows:
"Bed and Breakfast establishment. A dwelling or other
residential structure which is owner occupied and in
which the renting of rooms for lodging and the serving of
breakfast to casual and transient persons is allowed by
special permit. No such dwelling or other residential
structure shall be permitted for the lodging of more than
9 such persons at any one time."
A public hearing on the proposed amendments will be held at
7:45 P.M., prevailing time at the Town Hall, 65 East Main Street,
Dryden, New York on June 13, 1995, at which time interested parties
will be heard.

ON PROPOSED LOCAL LAW NO. 2 OF THE YEAR 1995
LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the Town
of Dryden will hold a public hearing at the Town Hall, 65 East Main
Street, Dryden, New York, on June 13, 1995, at 7:30 o'clock P.M.,
prevailing time, to hear all interested persons for or against a
proposed local law repealing Local Law No. 1 of the year 1977 and
substituting in its place a local law providing for written
notification of defects and obstructions on town highway and
sidewalks in the Town of Dryden. The complete text of the proposed
local law is available from the Town Clerk 65 East Main St. Dryden,
New York 13053.

QUESTIONS AND /OR COMMENTS
James Hilker - is in the process of purchasing the property at
1968 Dryden Road (Homes of Integrity-mobile home sales). The only
difference is I will not be selling mobile homes. It will be
strictly modular homes, additions and remodeling. You will not
see mobile homes displayed on the site at all. Occasionally there
will be a modular home displayed. They will not be changing
anything else that has been going on there. They will use the
same office trailer and same storage building. The marquee will
remain the same and will have my sign there. My option with Mr.
Shippey is that I will have first option on purchasing the entire
property, which will probably take place next year. I am leasing
the land at the present time.
• Supv Schug - are there any changes you need to make to the old
agreement or revised.
Clm Roberts - questioned the farmers market that was going to be
held there.
James Hilker - it would be with myself and Mr. Shippey since I
have the first lease on the entire property and I will be acting
as property manager.
Supv Schug - the word mobile homes will be deleted from the
original permit.
Clm Roberts - wanted to know if there would be any changes made
in the lighting.
James Hilker - the only thing I would utilize would be the
lighting that is there now.
Clm Roberts - wanted to know the hours he planned on being open.
James Hilker - right now I would like 9:00AM to 4:OOPM Monday
through Saturday and maybe extend the hours in the summer if
business warrants it.
• - Clm Roberts - questioned being open on Sunday.
James Hilker - only if he had an open house for a modular home.

up by Collins Garbage Service.
Clm Roberts - questioned the old movie screen that is on the
property. j
James Hilker - it is very well built, the frame work is
galvanized steel. All of the panels are 1 inch marine plywood
encased with galvanized steel. It would be quite a job to
dismantle it.

COUNTY BRIEFING
Co. Rep. Lane - reported the county is discussing revisions in
the budget process. They are trying to see what programs, what
units of governments are doing to provide certain services and
how much tax it is costing.
Co. Rep. Evans - the budget will have a 3 or 3 1/2 percent salary
increase. Anything over 0 percent will come in as a special
request: The advantage to this is the board will be able to
scrutinize the requests better.

is Supv Schug - is the county really taking a look at the State's
mandates. Are we going beyond what the State mandates. To get
money out of the State are we spending more. In any department,
say the Health Dept. because they get so much state aid are we
running up what they are doing in the cost and operating
department just to get the state aid.
Co. Rep. Lane - there is a mandates review task force. They did
some work last year and the county did not receive a very good
report. They did more classification of different kinds of
mandates. Any time the county is told to spend money at their
level it is a mandate. Some mandates involve local funds that are
leveraged. Grant money and other mandates are pure local money
that has to be spent. The classification of those is still going
on.
Co. Rep: Evans - it is clear in the State
budget there are
additional mandates. A good example is
the
finger printing
which
will be required by the Dept. of Social
Services.
There are
no
funds to do that which comes under the
administrative
part
of the
budget. The administrative part of the
DSS
budget is capped
so
the cost of the program will come from
the
tax payers. The
work
fare will be another mandate. If jobs aren't
available the
county
will have to provide them.
• Co. Rep. Lane - reported the 911 emergency number will not be
completed until the end of the year, it was supposed to be
completed by July 1st. The review that is required for the
addresses, telephone numbers, and location of the boundaries by
telephone numbers between different agencies that have the
accommodation to respond is taking longer to be fed into the
system for NYNEX than had been anticipated. Cortland County hired
consultants that do that and it cost them $325,000.00. Tompkins
County elected not to do that. The committee has gone ahead and
authorized the dispatchers position to be funded in July. The
dispatchers positions will enable some of the people who are
familiar with the locations and addresses to work on the lists so
they will be done a lot quicker.
Co. Rep. Evans - gave board members literature regarding burn
barrels. This issue has come up in EMC and did not know how the
board members felt about burn barrels. EMC is making a major
effort to have them banned. He agrees burn barrels are a problem.
On the other hand in very isolated areas if you burn what you are
supposed too he did not see any problem with that.

Co. Rep. Evans - another issue the board should be concerned with
is the wastewater treatment plant. It turns out with the gauge
they use to measure the affluent coming off the trucks was never
sealed by weights and measures. It is illegal to charge from a
gauge that was never sealed and I am not sure what'the outcome of
this is going to be. I think the county will attempt to
renegotiate the contract with the city on this. The contract
gives all of the authority to the city and all of the
responsibility to the county. I think anything that would force
the city to renegotiate that would be worth doing. It is
important to note the city could decide if the county will not
accept their illegal bills to shut it down. It is not the
county's problem, the city runs it.
Supv Schug - wanted to know if the county was ready to pass
another local law without letting the towns know about yet?
Co. Rep. Evans - the county has no desire as far as I know and
certainly the Health and Environmental Quality Committee has no
desire to pass a county law eliminating burn barrels. It is in
the State Assembly right now. Whatever state group is pushing it
is going to take the brochure I gave the board members and change
the names in Tompkins County to New York State and use it in
trying to gain support at the state level.
Supv Schug - wanted to know where they get their funds from?
Co. Rep. Evans - a lot of their funds are donations. They are
partly funded the county, but not entirely. The county supplies
them a staff member. The brochure is strictly educational and it
has some legitimate points, but there has been no push to do it
locally. The health department would be the ones to enforce this
if it ever becomes a law.
Erica Evans - would like the county representatives to urge the
county highway department to check with contractors who are
putting in water and sewer and other things about what they are

is costing money and then the county highway department comes
along and scraps up all of the seed and topsoil and trucks it
off. This was done on Turkey Hill Road.
Co. Rep. Evans - wanted to know if she knew what they were doing.
Erica Evans - they are putting in gravel shoulders with old oil.
They just scraped up all of the beautiful topsoil and grass that
was growing beautifully that the company had done such a good
job.
Co. Rep. Evans and Co. Rep. Lane will look into this.

1. No civil action shall be maintained against the town or
town superintendent of highway for damages or injuries to person or
property sustained by reason of any street, highway, bridge or
culvert being defective, out of repair, unsafe, dangerous or
obstructed unless written notice of such defective, unsafe,
dangerous or obstructed condition of such street, highway, bridge
or culvert was actually given to the town clerk or town
superintendent of highways, and there was a failure or neglect
within a reasonable time after the giving of such notice to repair
or remove the defect, danger or obstruction complained of; but no
such action shall be maintained for damages or injuries to person
or property sustained solely in consequence of the existence of
snow or ice upon any street, highway, bridge or culvert, unless j
written notice thereof, specifying the particular place, was
actually given to the town clerk or town superintendent of highways
and there was a failure or neglect to cause such snow or ice to be
removed, or to make the place otherwise reasonably safe within a
reasonable time after the receipt of such notice.
2. No civil action shall be maintained against the town or j
town superintendent of highways for damages or injuries to person
or property sustained by reason of any defect in a town sidewalk or
in consequence of the existence of snow or ice upon any of its
sidewalks, unless such sidewalks have been constructed or are
maintained by the town or the superintendent of highways of the
town pursuant to statute, nor shall any action be maintained for
damages or injuries to person or property sustained by reason of
such defect or in consequence of such existence of snow or ice
unless written notice thereof, specifying the particular place, was
actually given to the town clerk or to the town superintendent of
highways, and there was a failure or neglect to cause such defect
to be remedied, such snow or ice to be removed, or to make the
place otherwise reasonably safe within a reasonable time after the
receipt of such notice.
3. The town superintendent of highway shall transmit in
writing to the town clerk within five (5) days after the receipt
thereof all written notices received by him pursuant to this local
law and subdivisions (1) and (2) of section 65 -a of the Town Law.
The town clerk shall cause all written notices received by her
pursuant to this local law and subdivisions (1) and (2) of section
65 -a of the Town Law, to be presented to the town board within five
(5) days of the receipt thereof or at the next succeeding town
board meeting whichever shall be sooner.
4. (a) This local law shall supercede in its application to
the Town of Dryden subdivisions (1), (2) and (3) of section 65 -a of
the Town Law.
(b) This local law repeals Local Law No. 1 of the year 1977.
5. This local law shall take effect immediately upon its

the provisions of the Municipal Home Rule Law.

Appendix A (Definitions) of the Zoning Ordinance was amended by
adding thereto a new definition to read as follows:
"Bed and Breakfast establishment. A dwelling or other
residential structure which is owner occupied and in which
the renting of rooms for lodging and the serving of breakfast
to casual and transient persons is allowed by special
permit. No such dwelling or other residential structure
shall be permitted for the lodging of more than 9 such
persons at any one time."
This amendment shall take effect after publication and as
provided by law.

Shirley Cowles - there is a deposit and if their place is not
cleaned up she uses the deposit for that. Right now I am renting
3 acres to cover the parking and set up space. The spaces are 10
by 12 feet which would include a walk way. I have received about
40 calls from different vendors.
Clm Roberts - wanted to know what the traffic pattern would be
and if there would be signs to tell them where to go and how to
get out.
Shirley Cowles - there will be a parking attendant there to
direct traffic.
Clm Roberts - was concerned about coming in and exiting from the
highway.
James Hilker - this has been discussed and they are not sure as
to how it will be handled since they are not sure how many people
will be there.
Clm Roberts - was concerned with Route 13 since it is so busy.
There should be some kind of a plan. There should be signs
indicating one side of the sign for traffic coming in and the
other side of the sign for traffic going out.

$.20 per sq. ft.
FOR PERMANENT VENDORS: (those who vend every weekend June thru October).
• two (2) days per weekend committal fee -- $20.00 per day.
• one (1) day per weekend committal fee -- $25.00 per day.
(committal time is four (4) weeks at a time). Those who plan to vend with us on a
permanent basis must fill out an application only once. If you miss a month you are
required to fill out another application. You may pay per weekend or per month which
ever you prefer but you will be required to pay one weekend/month in advance. (You will
always be one weekend/month ahead). Those who will vend with us all season
twice (2) a weekend will receive their choice of vending space and may keep that space all
season. This is on a first come first serve basis. If you miss a weekend your space may be
given to someone else.
FOR OCCASIONAL VENDORS: (those who are not willing to commit to any amount
of time).
• Fee -- $30.00 per day. You will be required to fill out an application each day /weekend
you come to vend.
• ALL fees must be paid in advance.
TO ALL VENDORS: You will be required to set up BEFORE 9:00 a.m. and will not be
able to break down until AFTER 6:00 p.m. This is for safety reason. If there is inclement
weather, you may set up in the mornings until noon then decide if you would like to stay
or break down. If you decide to break down, noon will be the deadline for that (this must
be for inclement weather conditions only). This will be the only day you will be able to
break down in the middle of the day. No refunds or exchanges for inclement weather
days.
SALES TAX #'s: A sales tax number (Certificate of Authority) is necessary for you to
sell TAXABLE items. This must be posted in your booth and a copy of it in your file. If
you do not have a number call; 1- 800 - CALLTAX and the state will send you an
application.
FOOD VENDORS: You must contact the NYS Health Department for all food
preparation. A Department of Health Certificate is needed in your booth before opening.
For marketing prepackaged foods you must contact the Dept. of Ag. and Markets.
Copies of certificates are needed for your file.
•
VENDOR DEPOSIT: A deposit of twenty dollars ($20.00) will need to be paid before
you set up each day. This money is to cover what we call "clean-up ". If you leave your
space clean of garbage and other debris you will receive your twenty dollars ($20.00) back
at the end of the each day. If you do not leave your space clean you will not receive your
twenty dollars ($20.00) back.
VENDOR INSURANCE: You are not required by law to have insurance. We will not
require you to have insurance as of yet. This is subject to change at anytime during the
season. You will receive an ample amount of time to obtain insurance.
EXTRAS.
♦ You may have a sign by YOUR booth only and INSIDE your space.
♦ No music.
♦ No alcoholic beverages allowed on premises.
♦ You supply your own tents, tables, etc ... as you need. All tent lines and poles must stay

pedestrians since the driving area runs between the parking area
and display area.
Shirley Cowles - there will be a parking attendant there to make

Clm T. Hatfield offered the following resolution and asked for
its adoption:
RESOLVED, that this Town Board grant a special permit to Shirley
Cowles to have a farmer's market at 1968 Dryden Road with the
following conditions: 1 - hours 9:OOAM to 6 :OOPM Saturday and
Sunday, 2 - this special permit is issued to Shirley Cowles only;
3 - entrance on the east and exist on the west; 4 - current rules
and regulations as supplied by Shirley Cowles be adhered too and
enforced by Shirley; 5 - sales and parking as according to the
map presented at hearing; 6 - "Boiler Plate Conditions" where
applicable.

CITIZEN PRIVILEGE OF THE FLOOR
Steve Kirsch - Dryden Youth Commission - reported 2 months ago
they had made recommendations on full funding for the 1995
budget. This put them in a position to make a grant application
through the municipal jobs funding which is a $10,000.00 funding
source set up by the Tompkins County Youth Board. They submitted
an application for the $10,000.00. There were 1305 requests and
they had requested $1,410.00 which has been granted. The purpose
of the funding was to find matching funds through local
businesses. The idea is to get about $2,800.00 in funds for this
summer and find 5 additional youths throughout the county and
businesses who might be willing to take them on as kind of a
learning apprentice role for this summer. The youth conservation
corp hiring went very well this year.
Ralph Varn - is interested in getting a map for his subdivision
filed in the court house. They have talked about bonding for the
road last week and was a surprise to me. We have never done it
that way in the past. Basically, I don't think the Town of Dryden
has ever done it that way in the past. I would like to address
that first to see if there is any way to get Barbara Caldwell to
sign the map. John Anderson has signed from the health department
and they fulfilled all of the additional requirements of the
planning board. I would like to get that map signed since it is
an intricate part of getting the subdivision under way with the
way they have set up the financing for the road, sewer and water.
They need the map filed in the court house in order to secure
peoples investments and also to get the money to do the roads.
That money is being held in escrow do to the roads, sewer and
water. In the past the way we have done it is Henry has given us
2 building permits on the property, not really for the
subdivision since they have enough road frontage to get 2 legal
permits. They have started one house and they are about to start
another house on a particular lot. If they need a third permit at
that time they would need to file a letter of credit or a bond of
some kind. I have sent a copy of the one I have used with the
Trust Company to Atty Perkins. An irrevocable letter of

credit to get the boards approval for that form of security and
also Atty Perkins approval which is required under the
regulations. Normally in the past whenever we have needed a
certificate of occupancy if portions of the road were not done at
that time you could get a letter of credit for whatever was not
completed on the road.
Supv Schug - you have complied with everything that the planning
board has requested.
Ralph Varn - yes, and I have a letter from Henry which talks
about that. Larry Fabroni has addressed the concerns that Henry
had and I have a letter that says it is basically okay and he
wants to run it by Dave Putnam. As far as I know Dave Putnam has
no problems with the conditional approvals. I think we have
addressed all of the things we had. Of course the water and sewer
district have been established and the health department approval
of those as well as the overall plat. I have those with me if the
board would like to see them.
Atty Perkins - wanted to know if Dave Putnam had a chance to
review Larry Fabroni's letter of June 11th on the estimates of
the road.
Dave Putnam - not completely, there are a couple of items he has
a question on. Everything has been addressed except he has a
couple of totals he has to question Larry about.
Ralph Varn - they will be addressed at the planning board meeting
which they have scheduled a public hearing to reduce the size of
the first phase and talk about the amount of letter of credit
that would be needed.
Atty Perkins - wanted to know if Hwy Supt Gilbert has seen the
estimates yet.
Hwy Supt Gilbert - I have not seen them yet because I have just
received them.
Clm Baker - wanted to know how many lots would be in the first
phase.
Ralph Varn - the first phase as approved by the planning board is
44 lots and that is the map he would like to file in the court
house. I am asking permission from the highway superintendent and
from the planning board to reduce the initial start up to 16 or
17 lots. They are putting in 1400 feet of road to satisfy that
and all of the drainage requirements that are required under the
44 lot final approval they have received from the planning board.
Atty Perkins - wanted to know how he intended to handle Section
• 5A of the subdivision ordinance. It is required upon completion
of the requirements of Sections 3 and 4. We are really talking
about 4. Security for the road and a notation of that effect upon
the subdivision plat which should be deemed to have final
approval and shall be properly signed by the appropriate officer
of the planning board.

Atty Perkins - you want to file a plat for 44 lots, but you only
• want to secure the construction of the facilities for 17.
Ralph Varn - basically, that is the way it has always been done
in the past in the town, at least to his knowledge. If it is
contrary I would like to know what they are. We have approval for
the full subdivision. Certainly we are not going to do any roads
or build any houses down there. We are not asking for any permits
in that section and we can put that stipulation in there. We are
not going to use any of those lots to finance the project. We
will finance the project out of the first 17 lots. We might come
back later with a request to do the rest in a similar fashion. We
have to bring the sewer line all the way up and the sewer will
service some of those remaining 31 lots, but the water won't
because it comes from Snyder Hill. Over the winter they plan to
start clearing the roads so they know what the road cuts are.
These 16 lots have all been cleared to Route 79 for the sewer and
have done all of the engineer staking and staking for the center
of the road and are interested in moving forward. I am
uncomfortable in not having a signed map.
Atty Perkins - you haven't complied with the ordinance yet.
Ralph Varn - in my mind I have compiled with the ordinance. It
was never a stipulation of the planning boards contingency
conditional requirements and its never been the way its been done
• in the past and I have done a subdivision before in the town.
Atty Perkins - condition of approval. Acceptance of the proposed
road by the Town of Dryden. Has the town accepted the proposed
road.
Ralph Varn - no
Atty Perkins - so how could you tell us you have completed all of
the conditions.
Ralph Varn - I am saying that is not the way it has been done in
the past.

Atty Perkins - one of the conditions of the planning board letter
is acceptance by the Town of Dryden of its portion of the water
system in the proposed extension of the Snyder Hill water
district. There is a similar condition with respect to acceptance
by the Town of Dryden of its portion of the sewer system in the
proposed district. Are you planning on bonding the cost of the
roads or completing them?
Ralph Varn - basically again it is the same kind of situation. If
at the time we need a certificate of occupancy for the houses we
are building there our intent is that the water and sewer will be
in. If it is not then we will bond whatever is not completed.
Obviously, it needs to be done in order to give water and sewer
service otherwise we would have to make some other arrangements
or we don't get the certificate of occupancy. Any sewer and water
lines that were not completed certainly if he was asking for a
certificate before everything was completed would be a part of
that.

Atty Perkins - by the town ordinance all improvements shall be
installed by the subdivider at his expense and no reimbursement
from the town and shall be installed to the satisfaction of the
town highway superintendent and town board. There are two
alternatives where you can proceed. One is where you can put all
of the road improvements in and file the subdivision map or you
can bond a corporate letter of credit covering the cost of these
improvements. What Mr. Varn is suggesting is he doesn't want to
bond the entire project only a portion of it, only the short part
of the road. The function of the town board is to protect the tax
payers from this type of purchasing that is involved. Ralph has 2
building permits on the theory that he could have gotten 2
building permits anyway. If he has to drill a well and put in his
own private septic system with the understanding he will not get
any more building permits until the plat is filed and he has
successfully bonded the cost of the improvements. The boards
decision is the amount of security for that and if you want the
water and sewer portion bonded also.
Supv Schug - he is asking for phase Ia and Ib is the balance of
phase I.

Drug -Free Workplace Plan
June 13, 1995
The unlawful manufacture, distribution, dispensing, possession
or use of a controlled substance at any site for the
performance of work (herein "the workplace ") done in connection
with employment for the Town of Dryden is prohibited.
2. CONDITIONS OF EMPLOYMENT.
(a) As a condition of employment, employees are required to
abide by the conditions contained in this policy.
(b) Each employee is required to notify, in writing their
department head or the Town Supervisor of any conviction
of a criminal drug statute which conviction involved the
workplace within five (5) days after such conviction.
39 TOWN RESPONSIBILITIES.
(a) If a federal grant is involved in the work performed, the
appropriate federal grant agency will be notified of such
conviction within ten (10) days after the.Town receives.

(b) Within thirty (30) days after receiving such notice of
such workplace conviction, the department head or Town
Supervisor will do the following with respect to the
employee who was convicted, including but not limited to:
(i) Take appropriate personnel action against the
employee, up to and including termination,
consistent with requirements of Rehabilitation Act
of 1973, as amended; or
Require the employee to participate satisfactorily
in a drug abuse assistance or rehabilitation
program approved for such purposes by a federal,
State, or local health, law enforcement, or other
appropriate agency.
(c) The Town will establish and foster a drug -free workplace
by:
(i) Publishing a statement notifying employees that the
unlawful manufacture, distribution, dispensing,
possession, or use of a controlled-.substance is-
prohibited in the workplace and specifying the
actions that will be taken against employees for

violation of such prohibition;
(ii) Establishing an ongoing drug -free awareness program
to inform employees about:
(1) The dangers of drug abuse in the workplace;
(2) The Town's policy of maintaining a drug -free
workplace;
(3) Any available drug counseling, rehabilitation,
and employee assistance programs; and
(4) The penalties that may be imposed upon
employees for drug abuse violations occurring
in the workplace.
(iii) Making it a requirement that each employee
engaged in the performance any work in
connection with a federal grant be given a
copy of the statement required by sub-
paragraph (1),
(iv) Notifying the employee in the statement required by
sub - paragraph (i) that, as a condition of
employment under the grant, the employee will:
(1) Abide by the terms of the statement; and
(2) Notify the employee's department head or the
Town Supervisor in writing of his or her
conviction for a violation of. -_a criminal.drug
statute occurring in the workplace no later
than five (5) calendar days after such

4. APPLICATION.
This policy is applicable to all workplaces associated with

TOMPKINS COUNTY HOMEOWNERSHIP PROGRAM
INFORMATION SHEET FOR PARTICIPANTS AND USERS
MAKING HOME OWNERSHIP AFFORDABLE!
Tompkins County has received a grant from the U.S. Department of Housing and Urban
Development (HUD) to assist eligible low and moderate income families become first -time
homeowners. To participate, households must live or work in Tompkins County, and all homes
purchased must be located in Tompkins County outside the City of Ithaca.
TERMS OF ASSISTANCE: The Homeownership Program will provide basic assistance
of 20% of the purchase price plus up to $3,500 in closing costs to eligible
participants, with maximum assistance of $25,000.
Participants in the Homeownership Program must provide a minimum of $1,500 or 2% of the
purchase price (whichever is greater) of their own funds for the home purchase. All homes
purchased must be on a permanent foundation and cost no more than $95,000.
All participants must be able to obtain a mortgage for the remainder of the purchase price
from a private financial institution. There are several mortgage lenders which have set aside
mortgage funds and created enhanced terms for Program participants, but households may also use
a lender of their choice.
HOMES TO BE PURCHASED: All homes must be in move -in condition at time of
• sale; no "handyman specials" may be purchased with Program funds. All homes purchased must
be in Tompkins County outside the City of Ithaca, and may include double -wide mobile homes on
a permanent foundation, condominium, cooperative and townhouse properties as well as single -
family homes. All homes purchased through the Homeownership Program will be inspected by
the County before purchase at no charge to the participant.
FINANCING: Program assistance will pay for 20% of the cost of the house plus up to $3,500
for applicable closing costs. Program assistance will be in the form of deferred payment loans
for the first five years, with future repayments of Program funds based on a 15 -year repayment
cycle at 3% interest. Program funds will be granted in the form of a second mortgage between the
participants and Tompkins County. Participants will be required to pay their mortgage, taxes,
insurance and other expenses based on their financial institution's policies.
COUNSELING: There is a requirement that participants receive counseling and
education about home ownership before purchasing a home through this Program. All required
counseling and education sessions are free to Program participants.
REAL ESTATE AGENTS: All real estate agents are able to participate in the Homeownership
Program and are chosen by participants with terms being the same as normal home purchases.

a resolution authorizing the town supervisor to sign the deed and

The Planning Board did not meet. The ZBA did meet concluding
its review of the two Finger Lakes Stone Company requests to
expand their Quarry Road stone quarry onto an adjacent parcel
of land that they, the stone quarry, are proposing to
purchase. This hearing process began August of 1994. Before
conclusion, DEC, independent engineers, geologist, well
digger, County Planning, T. G. Miller Engineers became
involved and the Ellis Hollow Neighborhood were involved.

Z.O. Slater - reported on Cortland Paving - I spoke with Mr.
Ottenshot's attorney, Attorney Shaw today and was told Mr.
Ottenshot had not been in contact with him since he was pursuing
a bankruptcy procedure with another attorney. However, he still
represents Mr. Martin Ottenshot and his interests, but not
Cortland Pavings interest. Atty Shaw suggested the reason we
® haven't had any application from Mr. Ottenshot is because the
property could be listed as an asset in the bankruptcy. I told
Atty Shaw those were 2 different corporations we are talking
about. Atty Shaw agreed with me, so he said he would get in touch
with Mr. Ottenshot to find out what the hold up has been. As of
yet I have not heard from Atty Shaw or Mr. Ottenshot.
Z.O. Slater - there have been 3 new dumpings there in the month
of May. 2 were Crispell Brothers and I can't remember the third
one. I have someone watching to see what is going on and they are
willing to testify if need be. The driveway goes to Cornell
fields and a house.

WHEREAS: the 4 -H Program of Tompkins County Cooperative Extension
serves the youth of Tompkins County without regard to race,
creed, color, or religion by encouraging participation in
leadership development and educational programs and
WHEREAS: the Tompkins County 4 -H Youth Fair held at 4 -H Acres is
the culmination of the year's activity program, or programs that
are held throughout the community, and is organized and conducted
by and for the members of 4 -H and youth who participate in youth
organizations throughout the county and
WHEREAS: the Tompkins County 4 -H Acres Youth Fair provides an
opportunity for 4 -H Youth and those involved in county youth
groups, to share with their parents, family, friends, and the
public the results of the year -long learning and growing process,

for - profit organizations to use the name of "Town of Dryden" when
providing services. This is effective immediately for all
programs not in service at this time. Current for - profit
programs will be terminated as soon as their present sessions are
completed or no later than July 31, 1995. A copy of this
resolution is to be mailed to the Town of Dryden Recreation
Commission and the Dryden Youth Commission as well as to current

then, and wanted to know why more people couldn't bid.
Hwy Supt Gilbert - because the State will not allow it. They set
up different areas. This Nova Chip is not on a State contract but
State regulations as to what company could bid on it. Suit Kote
could not bid on it. Penn Can has this area.
Clm C. Hatfield - so they can charge anything they want then. If
we want to buy it we have to buy it through them. This does not
seen right.
Atty Perkins - wanted to know how that could be.
Clm C. Hatfield - check into it Mahlon, it doesn't sound right. A
bid is more than one, I would think.
Supv Schug - wanted to know if Don could wait another month for
this approval.
Hwy Supt Gilbert - technically he would have to wait another
month, but has used the material already.
Clm C. Hatfield - is not saying it shouldn't be okay. What I am
saying is we should have more than one bid.

Supv Schug - if Atty Perkins looks into this and finds out that
after looking at the bids and everything that the State DOT said

DISCUSSION
Sewer connections charges will be worked on after the Turkey Hill
people have had an opportunity to connect.
Benefit levy - water company asked to have it left in place. It
doesn't come off until next year when the water company is paid
for. Cayuga Heights and Town of Ithaca have said no way.
Clean up along the side of the town hall - shrubbery will be
removed.
Fire works permit has been received from Robert Fletcher.
NYSE &G poles - on hold
Supv Schug - Court Officer for Monday evening - the court has
requested to have someone under contract for 2 hours on a Monday j
night while court is in session. (2 hours) for $15.00 per hour.
If the town did that it would cost the town $1,560.00 for a year
for 2 hours. Judge Lloyd saw no need for it during the daytime
since there are enough people around and enough officers
available. The board decided to take no action at this time.
