MARCH 14, 1995
Deputy Supv. C. Hatfield called the meeting to order at 7 :30PM
Members and guests participated in a moment of silence followed by
the Pledge of Allegiance.
Roll call was by Town Clerk Lloyd.
Present: Deputy Supv. C. Hatfield, Clm T. Hatfield, Clm Baker,
Clm Roberts, Atty Perkins and Z. 0. Slater
Absent: Supv. Schug
Deputy Supv. C. Hatfield appointed Clm T. Hatfield to audit the
highway fund bills.
Approval of the minutes:
Motion was made by Clm Roberts and seconded by Clm T. Hatfield
that the minutes of the town board meeting 12- 28 -94, 1 -4 -95,
Organizational meeting 1 -4 -95 and town board meeting 1 -10 -95 be
approved. Carried
COUNTY BRIEFING
Co. Rep. Evans - introduced Ken Thompson from the Solid Waste
Division.
Ken Thompson
spoke and at this
point the
tape
recorder
malfunctioned
so all issues and
comments
were
lost.
They will be at the April board meeting concerning this matter.
Co. Rep. Evans - as the board recalls at the October meeting there
was some discussion about what Ken did or did not do concerning
the leachate problem at the Caswell Road site. From November until
January there have been some serious problems. He has a letter
from Ken Thompson's counterpart sent to the contractor raising
those issues in trying to get them corrected. As you know the
county is going to be looking at a number of options to hopefully
and permanently correct the problems. He had proposed to the solid
waste committee that if they can not correct the problems this
year they should put an alarm on those tanks with a remote
telephone line so when the tanks get three quarters full the
county will know about it and respond to see that someone does
something about it. This would be about a $50,000.00 investment,
but if we can't solve the problem any other way at least they will
know what is happening and they are not knowing at the present
time. He has made the proposal and he will be pushing that it be
corrected completely this summer, but if not there will be an
attempt. This problem has not been solved and there are times when
it can not be trucked away as fast as it comes out of the pipe.
They need a permanent solution. He feels a man made wetland is the
• proper approach.

•The lagoon approach may not work because the leachate maybe
diluted enough that it will not properly format enough in a
lagoon. The county has done a lot of work at Landstrom whether man
made or wetland to be proven enough to be effective. He feels this
would be a good solution since there is already a wetland there.
Co. Rep. Evans - reported on cat licensing - this is still in his
committee. At the next committee meeting he thinks the SPCA will
be requesting that this be dropped. It is clear that there is not
enough support on the county board to pass it. He feels if it is a
public health issue that is one thing, but the general opinion is
the county has already taken steps to deal with rabies in cats.
The records show that in over 2 years there have been 4 rabid cats
and no human bites from those cats in that time. It seems like an
over kill certainly to say it is a public health issue. If it is
only to raise money for the SPCA he thinks there are more
efficient ways to raise money other than this because of the cost
of enforcement is going to be excessive for the gains. If cats are
really an issue or a problem, and there are 33,000 of them, there
could be a sharing basis for the towns and county. The county puts
about $17,000.00 towards cat control and the SPCA feels they need
$36,000.00. If any given town feels it is a problem they may
contribute to the SPCA. He does not think support exists on the
county board and he does not think the licensing of cats will come
to a vote.
• Clm Roberts - wanted to know if it would get out of his committee.
Co. Rep. Evans - that would not happen. If the SPCA wants it to
come out of his committee he did not have a problem with bringing
it out of this committee so the board could vote on it. If you are
going to lose it does not make any sense.
Co. Rep. Evans - in his committee they are trying to access the
affects of the proposed state budget on county government. If the
state chooses to only lower the budget, but does not remove the
regulations that are being enforced to the counties they are going
to be in trouble. If the state chooses to do something, he feels
mental health is appropriate. If they were to give the county a
block grant to deal with mental health issues less 20 per cent as
they have been in the past and remove the regulations the county
could to a far better job than what is being done now. For
example, the mental health department spends $80,000.00 a year
just to audit the books at the requirement of the state of New 1
York. That $80,000.00 could go a long way or the county could live
without it if they didn't have to audit their books. There are
examples of that throughout county government wherever the state
XS involved. In the area of welfare, the last estimate he heard
would be if all the welfare reforms or changes go through as
proposed would be a savings in county government of well over one
million dollars. He would like to point out on the other hand if
•they are going to implement the reforms and changes as proposed he
thinks they are going to have to come up with something as
cooperative extension, because for people to survive in a
different environment they are going to need education and
direction other than the last 40 years.

Lane - reported the new recycling center is open. You can
downtown site or the one on Peruville Road. He was not

Co. Rep. Lane - there has been a committee formed which is a

subcommittee of the solid waste committee to look at the fairness
district on
issues of the solid waste fee. Not whether or not there should
be
a solid waste fee, but how much we have to raise. They have
had a
lot of feedback from people who are not happy about the use
of
square footage for apartments and commercial property. They
want
to take a look at some of those factors knowing that if you
lower
the cost for one group, you still have to raise the same amount
of
money you are going to have to raise the cost for some other
that anyone
group. There are some seasonal properties that are not lived
in
year around and maybe hit too heavy with the solid waste fee.
The
committee is just starting and hopes to have a report by the
next
couple of months with possible changes. If the board had any
suggestions he would like to hear about them either by phone
or by
letter since he is chairing the committee.

office hours within his
district on

Village Hall
on April 8th from

will be
advertised so
that anyone

discuss county
issues and
bring things
to his attention

available.
Co. Rep. Totman - did not have anything to report, but would
answer any questions if the board had any.
Atty Perkins - wanted to know where he stood on cat licensing.
Co. Rep. Totman - Charlie Evans asked him that yesterday and he
did not give him a direct answer. When he said 4 or 5 members
would vote on it, he was one of those 4 or 5. He probably has the
same view that Co. Rep. Evans does. He did not think the SPCA
would force it to come out of the committee, because it will not
have a chance to come out of the board for a full vote. He
believes they have a problem and something has to be done. He did
not think the general public is willing to accept cat licensing at
this point. The SPCA seems to be getting a lot more cat calls and
spending a lot more time on the road with cat problems. It has
gone up a lot more than it has in the past and the SPCA is having
to dip into their funds that has been willed or donated to them
for other various reasons. The SPCA felt those funds should be
left there for maintenance and other reasons. He felt they should
take their time to see what other counties and municipalities are
doing to handle it. There are 4 municipalities in New York State
that are licensing cats, which is within the last year. Cortland
County SPCA has
gone
to
auctions to help in raising money, but
Tompkins County
has
done
nothing.

QUESTIONS AND /OR COMMENTS
Dave Totman - it will be used furniture sales. He is not going to
make any change to the building or the property. Restroom and
water facilities that he is using are already there. There is
plenty of room for parking and he is not changing the parking,
existing driveway access. Gene Rotunda is still the owner of the
property.
Clm Roberts - wanted to know the hours of operation.
Dave Totman - there is someone there from 8:OOAM to 3:OOPM working
on upholstery and he would be there in the evenings from 6:OOPM to
10:OOPM for 4 days a week.
Clm Roberts - wanted to know the number of customers he would
have.

•Stacy Wright - she plans on operating 4 days a week Monday,
Thursday, Friday and Saturday. It would be a 1 chair salon and she
would be the only one working there. She works with only non toxic
materials.

Stacy Wright - she is looking at about 15 customers per day.

be released until now. The significance of this project, is

Stacy Wright - she has a lease of a dumpster in Collegetown that
she would be using until that runs out. She recycles everything
and does composting.
Clm Roberts - if you have a dumpster or garbage cans the board
would like to make sure that the area is enclosed so that it is
not visible from the street.
Stacy Wright - she had no problem with that.

RESOLUTION #106 GRANT SPECIAL PERMIT
SAVAGE CREEK HAIR SALON - Stacy Wright
Clm Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board grant a special permit to Stacy
Wright - Savage Creek Hair Salon with the following conditions:
1 - business hours 8:OOAM to 8:OOPM, no Sunday hours, 2 - this
permit is non transferable, 3 - "Boiler Plate Conditions" adopted
7- 10 -90.

ATTORNEY
Atty Perkins - Howser VS Lok and Lim - the reason this is on the
agenda is because the town was named as a party to the defendant
because of certain approvals that were added in the subdivision.
The status of the foreclosure action is that it is on hold.
However, it has been resolved that the area which was set aside
Eor recreation or park area will continue to be used for that
purpose. So no action is necessary at the present time.

• Atty Perkins - Peregrine Hollow filed with the Town Clerk
petitions to extend the Snyder Hill water district and to
establish a Snyder Hill sewer district. The petition was made by
Peregrine Partners as part of the approval of the subdivision
application for the Peregrine Hollow subdivision. The sewer
district would be an entirely new district. The entire new
district and all of the improvements would be constructed at the
developers expense as a condition of subdivision approval and in
turn would be dedicated to the town after they have been inspected
and accepted as far as construction. Wastewater flows would go
through Town of Ithaca lines. The developer will have to construct
some lines in the Town of Ithaca to the Ithaca Area Wastewater
Treatment Plant. The entire expense will be borne by the
developer. The extension to the water district, is one part of the
subdivision is not in the existing Snyder Hill water district. The
petition is to add this small piece to the water district. All
water improvements within the subdivision are to be made at the
expense of the developer. He has reviewed the petitions and they
were revised at his insistence a couple of times. They are
sufficient now and are ready for the board to hold a public
hearing. If the board holds a public hearing on March 28th there
is sufficient time to publish and post the notice. The board needs
to pass a resolution to schedule the time and date.
Atty Perkins - Cortland Paving - the board members have a special
•package from Z.O. Slater regarding Mr. Ottenshot. Their goal all
along is to get him to comply with the town zoning ordinance which
would require him to get a special permit to operate a storage
area. Mr. Ottenshot finally submitted an application which Henry
deemed to be incomplete. Henry requested additional documentation
which has not been furnished.

Atty Perkins - it is at a point now where litigation is not
necessary.
Atty Perkins - in connection with the purchase by Francis
Paolangeli and others of the former Besemer property along Hall
Road survey. It showed a portion of the pavement of Hall Road
encroaching onto the property and as part of the transfer from H.
D. Besemer Inc. to Mr. Paolangeli a small triangle strip was
proposed to be conveyed to the town since it already had town
improvements on it. A survey was prepared and reviewed by Dave
Putnam and Don Gilbert. It proposes to give the town adequate
property for town highway purposes. The town needs to pass a
resolution agreeing to accept it and maintain it as part of Hall
Road.
•Atty Perkins - RMS Gravel Inc. - has requested from Don Gilbert
permission to install a large culvert under Mott Road. The purpose

Df the culvert would be to run a conveyer to convey gravel,
aggregate and material from one side of the road to the other
where they are mining it. There would be some expense and time on
behalf of the town. One to accept the engineering of it, the
I
nstallation and approval. The legal ramifications of how it is to
be accomplished, liability questions etc. Before anyone proceeded
they wanted the town board aware of their request. The town board
has to approve the engineering and legalities on the express
condition that all expenses in connection with this would be paid
by RMS.

Atty
Perkins -
the engineer and attorneys would be working for the
towns
interest
and not RMS and would be paid
by RMS. The town will
need
something
in writing acknowledging their
understanding of
this.
There are
some concerns that need to be
addressed.
Z.O. Slater - RMS is going to need a special permit for a mining
permit so everything can be tied together.
Atty Perkins - RMS is a preexisting non conforming use.
Dave Putnam - thought they applied last year for a special permit
to include another small portion on the north side of the road.
They had to revise their mining permit since it did not show the
whole area they had planned to mine and thought they had to get a
special permit from the town when they did that.
Atty Perkins - thought this was just a non conforming use. This is �
something that needs to be looked at.
Z.O. Slater - when they cross the road they go from RB1 to RC
where mining is allowed by special permit. They are crossing
zoning boundaries.
Atty Perkins - did not think that is what is determined. What is
determined is whether or not they own that property which they are
going to expand in something which is owned by the applicant or
part of the original parcel in that section of the zoning
ordinance. He did not think it had anything to do with district
boundaries. It is the use not the boundaries that is an issue.

Z.O. Slater - RMS would not come into a zone that mining is
permitted by a special permit.
Atty Perkins - you have to determine whether or not this is a new

parcel that was acquired after the effective date of the zoning
ordinance or whether it is part of the original parcel.

The mobile home sales were very active. Ten New Homes were
established and another 1A existing homes were replaced with new
homes. Double -wide Homes are by far the most often installed
home. Of the 24 mobile homes installed this past year, 1.7 were
double wide homes.
Of the single —wide variety, we saw the first of the new era 16
foot wide homes. I expect to see several of these in 1995. The
mobile sales people have informed •_Is that by investment per
sgUare foot, the 16' wide home is current best investment.
The one negative aspect of new construction, is the fact that
commercial building continues to drop off. With the exception of
61; 19929 you have to go back to 198/+ to find less dollars invested
in this area of new construction. There is nothing on the
horizon to indicate any immediate change in this trend.

The balance of our time was used to complete the yearly required
fire safety inspections of the more than 200 public and
multi.— family residence structures.
As usual, there were numerous Zoning Violations and complaint to

RESOLUTION DATED MARCH 28, 1995
A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION TO AND
APPROVING THE ESTABLISHMENT OF THE SNYDER HILL SEWER DISTRICT
OF THE TOWN OF DRYDEN, TOMPKINS COUNTY, NEW YORK, PURSUANT TO
ARTICLE 12 OF THE TOWN LAW.
WHEREAS, a map, plan and report have been prepared in such
manner and in such detail as has heretofore been determined by the
Town Board of the Town of Dryden, Tompkins County, New York,
relating to the establishment of the Snyder Hill Sewer District;
and
WHEREAS, said map, plan and report were prepared by a
competent engineer, duly licensed by the State of New York, and
have been filed in the office of the Town Clerk of said Town, where
the same are available during regular office hours for examination
by any persons interested in the subject matter thereof; and
WHEREAS, said sewer district shall be bounded and described as
hereinafter set forth; and
WHEREAS, the improvement proposed for said sewer district
consists of the installation of 3160 feet of 8" PVC sewer main, 500
feet of sewer lateral, manholes, meter pit and flow meter and
necessary appurtenances thereto, as more fully described in the
aforesaid map, plan and report; and
WHEREAS, the total estimated cost thereof is to be paid by the
developer of the subdivision known as Peregrine Hollow and
dedicated to the proposed sewer district at no cost to said
district as a condition of final subdivision approval of Peregrine
Hollow; and
WHEREAS, compliance with the provisions of the State
Environmental Quality Review Act have been performed and the

establishment of the Snyder Hill Sewer District of the Town of
Dryden and the improvements proposed therefor have been determined
to be an unlisted action, as to which a negative declaration has
been made determining that said establishment and the improvements
proposed therefor would not result in any significant environmental
effects; and
WHEREAS, an order was duly adopted by said Town Board on March
14, 1995 reciting a description of the boundaries of said proposed
sewer district, the improvements proposed, the fact that said map,
plan and report, were on file in the Town Clerk's Office for public
inspection and specifying the 28th day of March, 1995 at 7:15
o'clock p.m., prevailing time, at the Town Hall, 65 East Main
Street, Dryden, New York, in said Town, as the time when and the
place where said Town Board would meet for the purpose of holding
• a public hearing to consider the establishment of said sewer
district and said map, plan and report, filed in relation thereto
and to hear all persons interested in the subject thereof
concerning the same; and
WHEREAS, notice of the aforesaid public hearing was duly
published and posted in the manner and within the time prescribed
by Section 193 of the Town Law, and proof of publication and
posting has been duly presented to said Town Board; and
WHEREAS, said public hearing was duly held at the time and
place in said order, as aforesaid, at which all persons desiring to
be head were duly heard; and
WHEREAS, said Town Board has duly considered said map, plan
. and report, and the evidence given at said public hearing, NOW,
THEREFORE, BE IT

Section 1. Upon the evidence given at the aforesaid public
hearing, it is hereby found and determined as follows:
a) The petition is signed and acknowledged as required by
law and is otherwise sufficient;
b) All the property and property owners within the proposed
sewer district are benefitted thereby;
c) All the property and property owners benefitted are
included within the limits of the proposed sewer
district; and
d) The establishment of said sewer district is in the public
interest.
Section 2. The establishment of the Snyder Hill Sewer
District of the Town of Dryden, Tompkins County, New York, to be
bounded and described as hereafter set forth, and the improvement
therefor consisting of the installation of 3160 feet of 8" PVC
sewer main, 500 feet of sewer lateral, manholes, meter pit and flow
meter and necessary appurtenances thereto, as more fully described
in the aforesaid map, plan and report, the total estimated cost
thereof to be paid by said developer, and dedicated to the proposed
sewer district at no cost to said district is hereby approved and
the Town throught its contracts and agreements shall supply
wastewater transportation and treatment to said sewer district.
Section 3. Said sewer district shall be bounded and described

Atty Perkins - he received a request from an individual who wanted
to obtain a fireworks permit in connection with a swap meet held
by the Finger Lakes Chapter of ABATE which is a motorcycle group
against helmets. They wanted to hold this at or near the NYS
Armory in connection with the swap meet. A copy of the permit was
sent to the individual who was going to conduct the fireworks
together with the insurance requirements. He balked at providing
the insurance claiming he couldn't obtain adequate insurance. The
limits of the policy were established by the town some time ago.
The fact that he can't find a market for it are not grounds for
the town to expose the taxpayers in any unnecessary liability.

Z.O. Slater - was describing the fire that was at the outhouse in
the park. It turned out the lower blower fan burned up. It failed
to shut off and burned itself up. You couldn't have a fire start
in the wet area, but that was where the majority of the fire was
concentrated. There was damage up in the top where the circulation
and ventilation fan was. It stands to reason the ventilation fan
was on fire first and the debris from the fire fell down into the
wet area which was underneath if you follow the DRIFT.

water district consists of the installation of 2200 feet of 12 inch
ductile iron pipe, 2345 feet of 8 inch ductile iron pipe, 8
hydrants and valves, gate valves, corporation stops, fitting,
valves and necessary appurtenances thereto, as more fully described

WHEREAS, the total estimated cost thereof is to be paid by the
developer of the subdivision known as Peregrine Hollow and
dedicated to the water district at no cost to said district as a
condition of final subdivision approval of Peregrine Hollow; and
WHEREAS, compliance with the provisions of the State
Environmental Quality Review Act have been performed and the
extension of the Snyder Hill Water District of the Town of Dryden
and the improvements proposed therefor have been determined to be
an unlisted action, as to which a negative declaration has been
made determining that said extension and the improvements proposed
therefor would not result in any significant environmental effects;

extension of the water district are benefitted thereby;
C) All the property and property owners benefitted are
included within the limits of the proposed water district
extension; and
d) The extension of said water district is in the public
interest.
Section 2. The extension of the Snyder Hill Water District of
the Town of Dryden, Tompkins County; New York, to be bounded and
described as hereafter set forth, and the improvement therefor
