Roll call was by Town Clerk Lloyd: Present: Supv Schug, Clm Baker, Clm Hatfield, Clm Roberts, Atty Perkins T. Hatfield, Clm C. and Z.O. Slater Approval of Motion was made minutes from minutes: by board Clm Roberts and 2nd meeting Dec. 13th be by Clm C. Hatfield that the approved. Carried COUNTY BRIEFING Co. Rep. Evans - he is on a committee to look at technology for the county. One issue is networking the county offices and then hopefully the towns. They will also be looking at technology to improve organized development in the county. Co. Rep. Evans - a committee will be looking at arraigning prisoners, remotely with their permission, in not having to transport them. If this can be done there will be a considerable savings since this is one area where there is a lot of overtime in . the sheriff's office. Co. Rep. Evans - reported he had received a couple of phone calls in the proposed Turkey Hill water /sewer district that 10 hours was not enough time to make sure your vehicles were not in the way of the construction. He also received another phone call from someone in the proposed district who had just received their tax bill and it had more than doubled. Co. Rep. Totman - he enjoys receiving information from the town in letting him know what is going on. If there is any problem with the way he votes or the way he represents the town he would like to hear any criticisms if there are any so he can respond to them. CITIZENS PRIVILEGE OF THE FLOOR Karl Heck - reported they have been gathering information for the small cities grant and hope they will be getting some applications. They have changed one requirement where one public hearing was required and now there has to be two public hearings. One public hearing is that you are supposed to talk about the program and what the program can do and the second public hearing is more specific about the application. Supv Schug - scheduled a public hearing for 12 noon on January 26, 1995 and the second public hearing would be February 7, 1995. TB1 -10 -95 Page 2 • Clm T. Hatfield - regarding annual household income, is this all sources of income or household taxable income. Karl Heck - it would be all sources of income. They use the gross I ncome that is on the tax form. Clm T. Hatfield - if someone's income is 844,450.00 should we tell them not to bother to fill out the application. Karl Hecht - no, because it is geared for very low income and they might be eligible. Clm T. Hatfield - wanted to know how the program worked if you are a renter. Karl Hecht - the owner would have to follow certain guidelines and keep it for affordable housing for a certain number of years. They couldn't make the improvements and then double the rent. ATTORNEY Atty Perkins - still waiting for the State to sign off on the transfer of Abbott Rd. Atty Perkins - regarding the Cortland Paving (Rt 366 & Freese Rd). He feels this will be a successful resolution. The town has sought to enjoin the use of the property since the defendant has not applied for or obtained a special permit. They were able to convince the defendants attorney that all the town was looking for was compliance. Without prejudicing any of his rights is going to make an application for a special permit. This should be ready to be heard in March. Atty Perkins - regarding Mr. Stetson - he has perjured himself of his contempt. He has spoken with his attorney and was told he was not living in the rabbit hutch. He is living down the road. His case worker is trying to find him suitable housing. Atty Perkins - Howser vs Lok & Lim - no change Atty Perkins - Farm Fire tax relief - depending on how many parcels are in the McLean fire district the difference to a property with 8100,000.00 assessed value would be 80 cents. They used all the parcels in the town, total fire section expense. A closer number would be 60 cents per 8100,000.00 assessed value. The total tax impact would be to an owner of 8100,000.00 property would be 60 cents if he used agricultural assessments to determine the assessment for fire protection purposes. 0 a� 1 rN RESOLUTION NO. 76 RESOLUTION ADOPTING AGRICULTURAL ASSESSMENTS ON AGRICULTURAL LAND FOR PURPOSES OF CALCULATING BENEFIT ASSESSMENTS OR SPECIAL AD VALOREM LEVIES FOR THE TOWN OF DRYDEN FIRE PROTECTION DISTRICT WHEREAS, the Town of Dryden is committed to preserving agricultural lands for agricultural purposes and the State Legislature has by 1994 amendments to Section 305, Subdivision 6, and Section 306, Subdivision 5 of the New York Agriculture and Markets Law, authorized the governing bodies of local municipalities which levy taxes for fire protection district purposes to adopt a resolution permitting the use of agricultural assessments rather than full value assessments for the purposes of calculating such levy, and WHEREAS, the Town Board finds that such a use of agricultural assessments would be advantageous in helping the farming community maintain its lands as agricultural lands by reducing the cost of fire protection for those lands, NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Dryden as follows: Section 1. Use of agricultural assessment on lands within an agricultural. district. The assessment determined pursuant to subdivision 1 of Section 305 of the New York Agricultural and Markets Law shall be used for purposes of calculating the benefit assessments or special ad valorem levies for the Town of Dryden Fire Protection District on agricultural lands within an agricultural district. Section 2. Use of agricultural assessments on lands outside of an agricultural district. The assessment determined pursuant to subdivision 1 of Section 306 of the New York State Agricultural and Markets Law shall be used for purposes of calculating the benefit assessments or special ad valorem levies for the Town of Dryden Fire Protection District on agricultural lands outside an agricultural district. Section 3. Applicability. The foregoing assessment modification shall apply only to agricultural lands that have qualified for the agricultural assessment in accordance with the applicable procedures set forth in Subdivision 1 of Section 305 and Subdivision 1 of Section 306 of the Agricultural and Markets Law. Section 4. Effective Date. Hatfield offered the following resolution and asked for its adoption: RESOLVED, that this Town Board schedule a public hearing to amend the zoning ordinance for Elder Cottages on February 7 at 7:30PM. 2nd Clm T. Hatfield Roll call vote - all voting Yes • Bed and Breakfast - no action taken at this time. Atty Perkins will draw up the changes for the proposed zoning change for a bed and breakfast to be allowed in other zones. HIGHWAY SUPERINTENDENT Yellow Barn Rd - on hold Caswell Rd - on hold Hile School Rd - on hold CORRESPONDENCE Dryden Village Police report DISCUSSION 1996 Solid Waste annual fee collection - will be reviewed by Atty Perkins to see if it is legal. The Town Board decided to send out a questionnaire within a 2 mile radius of the West Dryden Community Center and put an ad in the The Shopper for input regarding the spending of money and making • the center usable. 01 TBl -10 -95 Page 4 • JUSTICE REPORT - $7,596.00 for the month of December FINANCIAL REPORT - available to board members RESOLUTION #78 APPOINT REPRESENTATIVE TO RECREATION PARTNERSHIP - Elizabeth Corrigan Clm C. Hatfield offered the following resolution and asked for its adoption: RESOLVED, that this Town Board appoint Elizabeth Corrigan as its representative to the new governing board of the Recreation Partnership, 2nd Clm T. Hatfield Roll call vote - all voting Yes RESOLUTION #79 DISBURSE INTEREST IN MCARTHUR FUND Clm Roberts offered the following resolution and asked for its adoption: RESOLVED, that this Town Board authorize the Supervisor to disburse the interest in the McArthur Fund to two schools in the Town of Dryden as follows: $81.77 to Dryden Central School and $5.22 to George Junior Republic for a total disbursement of 586.99. 2nd Clm C. Hatfield offered the following resolution adoption: RESOLVED, that this Town Board authorize the Sup his annual report to the State Comptroller and a Town Clerk by March 1, 1995 in lieu of an annual February 1, 1995 to the Town Board. 2nd Clm C.
