COUNTY BRIEFING
Co Rep. Evans - reported ed on cat licensing - this w i l l come out
of his committee either this month ! rm next month. He has told the
SPCA this is an issue that the public will have to decide as to
whether they want it or not. The SPCA did put out a survey, the
results of which they claim GO percent in favor and 40 percent
against.
•Clm T. Hatfield - said he received one of the SPCA
questionnaires. It was poorly worded and was designed to receive
one response only. He chastised them for the way they approached
this.
Co Rep. Evans - has not seer- the quest i _innaire and will check on
this. There are two � issues and one is the health issue concerning
rabies control in cats. The other issue is pure and simple the
SPCA wants to raise money because they claim the county is not
giving them the money they claim they need. The county is not
giving them the money because the county gave them $22,000.00 and
they asked for an additional $*125100.00. The county has currently
agreed to give them $6,800.00. The way it was calculated was
looking at their 1991 budget before the county started cutting
the budget and extrapi_ilate that at 3 percent a year to this
Current year. He could see that argument for them, but not
$25,000.00 with no logical
justification,
Co. Rep. Evans - reported the Public Works Dept. has asked for an
increase of $9601000.00. Out of that .t they received $185,()00,00.
There are 6 or 7 closed bridges in Tompkins County and they might
be able to replace one, but n• � more. The roads are continuing to
deteriorate in Tompkins County and have been paving about 70
percent of what they should to keep the roads up to standards. If
you don't fix the roads when they start to deteriorate it will be
a lot more when you have to start from scratch. This is a serious
• issue for the towns and one they will have to work. on.

$48100o.00. The youth bureau budget has gene over funds, but felt
they would be able to make up the difference. He appreciated the
beards resolution regarding the youth bureau. The youth b� ward has
talked of continuing ni .-j more than 3 years and it is expected the
youth beard will find ether solutir-ins thri.-jugh fees, etc so as not
to require this money after 3 years so you will probably see the
courity share reduced.
Co. Rep. Lane - wanted ti .-i clarify the $1851000.00 for the public
works department. $1309000-00 of that is committed to the towns for
extra snow plowing they did last winter that the county is
obligated to pay.
Clint Cotteri l l - has attended s• True i.-if the cat meetings and he was
surprised to � learn that only 54 percent r. 1f the dogs are licensed in
the county. The towns are having problems with getting people t• � do
the dog enumeration which tells him there will be less than 54
percent of the dogs licensed, how does the SPCA think they are
going to get all of the cats licensed even if they try.
Co. Rep. Evans - he understands the SPICA wants to do the
enumeration and he feels they will be willing to contract with the
towns to do dog enumeration and cats at the same time.
Co Rep. Lane - he wondered about C 1 m T. Hatfield's comment
regarding the cat Survey and wondered if Supv Schug had received a
copy of the questionnaire. At the municipal officer's association
meeting he raised that question when the SPCA presented the survey
and asked if they could have copies of the questions and the
information piece that was mailed out by the SPICA. He was concerned
about the way the questions were worded.

In the matter of the increase of
maximum amount to be expended annually ORDER CALLING
for the supplying of lighting for the PUBLIC HEARING
Leisure Lane and Meadow Drive Lighting
District

WHEREAS, the Leisure Lane and Meadow Drive Lighting District
was approved July 10, 1984 and the maximum amount proposed to be
expended annually for the performance or supplying of services for
such district was $750, and
WHEREAS, due to increases in the filed tariffs charged by the
New York State Electric and Gas Corporation for the performance and
supplying of lighting services including the furnishing of poles
and lights and the supplying of electricity the annual maximum
amount proposed to be expended is now $1,800, and
WHEREAS, it is now proposed to furnish two (2) additional
poles and lights and the electricity to illuminate such lights to
be installed in such district at an additional annual cost of
approximately $450, and
WHEREAS, Town Law §202 -d(2) provides the procedure for the
Town Board to authorize an increase in the maximum annual amount to
be expended for the performance and supply of lighting services
after a public hearing, NOW THEREFORE, IT IS HEREBY
ORDERED by the Town Board of the Town of Dryden, Tompkins
County, New York as follows.

Tompkins County, New York shall be held at the Town Hall, 65 East
Main Street, Dryden, New York in said Town on November 2, 1994 at
7:00 o'clock p.m., prevailing time, for the purpose of holding a
public hearing to consider approving an increase of the maximum
amount to be expended annually in the Leisure Lane and Meadow Drive
Lighting District in said Town, said annual amount not to exceed
$2,300, and to hear all persons interested in the subject matter
thereof concerning the same, and for such other action on the part
of the Town Board as may be required by law or shall be proper in
the premises.
2. The Town Clerk is hereby authorized and directed to cause
a copy of this order to be published once in The Ithaca Journal,
the official newspaper of said Town, the first publication thereof
to be not less than ten days before the day set herein for the
hearing as aforesaid.
3. This order shall take effect immediately.
The question of the adoption of the foregoing order was duly

Atty Perkins - Leisure /Meadow lighting district - was farmed in
1984 was proposed t• � expend an annual amoUnt not to exceed $750.00.
When the contract ran out with NYSE &G and there was an increase in
the annual cost for furnishing the lights and supplying the
electricity there should have been a public hearing conducted in
order to authorize the increase in the annual amount to be
expended. This gives the residents the opportunity to decide
whether or not they are getting enough benefit for the proposed
increase in cost. There has been a request from the Leisure Lane
residents to have 2 additional lights within the lighting district.
This is permissible since we are not spending any town finds for
capital repair. The town will have to hold a public hearing
authorizing ing the increase in the annual amount proposed t� � be
expended. Since n o information can be found regarding the Etna
lighting district and Varna lighting district similar public
hearings have not been held as the annual cast as charged by NYSE &G
have increased.

county owned solid waste disposal landfill site. The town may want
to comment on the ci aunty's neglect to live up to its obligations
under the existing permits. Between January 10th and May 8th 1994
the holding tanks at the site were overflowing at least 35 percent
of the time. This allowed leachate to escape and overflow on the
ground. The leachate that is pumped out of the tank is taken the
the Ithaca Area Wastewater Treatment Facility. The board might want
to comment on the future as to the way the county handles this
responsibility.

Atty Perkins - said it had been reported and the response was they
would look into it. The first was denial by Ken Thompson and then
when he was confronted with documentary evidence he charged his
story. It comes dawn to the question of economics for the county.
It is cheaper to let it overflew than to have it trucked the way
they are supposed to.

is the first time he has heard about it. He dues know there is a
contaminated well out there at one home. There are test wells
between Caswell landfill and the horse that show mane of those
chemicals. The county is supplying water to the ho rile until they can
find out where the contamination is coming from. There is no real
evidence at this time.

Atty Perkins - the first result was that Ken Thompson told the

The year went by, the improvements movements were not done and the letter of
credit expired. Now, it turns out there are certain necessary
i mpri.- ivement s that were originally t r. t be done which are not done. On
behalf of the town highway superintendent he wrote to Mr. Sutton on
September 26th advising him he had until October 21st tr. i complete
the necessary improvements and have them inspected by the highway
superintendent. In absence of his doing so the town may elect to
take necessary steps to conclude the read and take necessary action
to collect the cost associated therewith.

A RESOLUTION DELEGATING TO THE SUPERVISOR OF THE TOWN OF
DRYDEN, TOMPKINS COUNTY, NEW YORK, POWER AND AUTHORITY TO
DETERMINE WHETHER BONDS OF SAID TOWN AUTHORIZED BY BOND
RESOLUTION DATED APRIL 13, 1994, SHALL BE PAYABLE IN A
SUBSTANTIALLY LEVEL OR DECLINING ANNUAL DEBT SERVICE
MANNER.
WHEREAS, the Local Finance Law of the State provides that a
town board may delegate to a supervisor, as chief-fiscal officer,
certain powers of said finance board with respect to the issuance
of obligations of said town; and
WHEREAS, the Town Board of the Town of Dryden, Tompkins County,
New York (the "Town "), has previously delegated to the Supervisor
of said Town those powers with respect to the issuance of
• obligations for the increase and improvement of the facilities of
Turkey Hill Sewer District in the Town of Dryden, Tompkins County,
New York, consisting of the construction of a sanitary sewer system
including approximately 15,515 linear feet of eight -inch gravity
sewer main, a pump station and forcemains, 49 manholes, purchase of

equipment, machinery and apparatus and incidental improvements and
expenses in connection therewith, authorized by bond resolution
dated and duly adopted April 13, 1993, which could then be so
delegated pursuant to the provisions of the Local Finance Law; and
WHEREAS, on June 20, 1994, the Governor of the State signed
into law Chapter 201 of the Laws of 1994 which, among other things,

such bonds and bond anticipation notes be amortized in accordance
with the so- called fifty per cent rule; and
WHEREAS, said Chapter authorizes the finance board of a town,
the town board, to delegate such determination, together with
certain other determinations therein provided, to the supervisor of
a town, as chief fiscal officer; and
WHEREAS, it is now desired to delegate to the Supervisor of the
Town of Dryden, as chief fiscal officer of the Town, such powers,
NOW, THEREFORE,
. BE IT RESOLVED, by the Town Board of the Town of Dryden,
Tompkins County, New York, as follows:
Section 1. Pursuant to the provisions of paragraph a of
Section 56.00 of the Local Finance Law, the power to determine
whether to issue bonds and bond anticipation notes having
substantially level or declining annual debt service, as provided
in paragraph d of Section 21.00 of the Local Finance Law, td be
issued pursuant to bond resolution dated and duly adopted April 13,
1993 for the increase and improvement of the facilities of Turkey
Hill Sewer District in the Town of Dryden, Tompkins County, New
York, consisting of the construction of a sanitary sewer system
including approximately 15,515 linear feet of eight -inch gravity
sewer main, a pump station and forcemains, 49 manholes, purchase of

FoLIr of these were of no serious natui °e, resulting in a
minor inconvenience to the Occupants and fire
personnel. The other, two caused major damage. One a
two family home fire on Genung Road, left two families
homeless. New curtains installed in a bedroom during
the summer, when heat isn't necessary, caught fire when
the curtains which hung down onto an electric baseboard
heating unit all day long. The heat was set at 90
degrees and after several hours of this condition, the
fire resulted.
A second fire, a house was str,,Ack by lighting caused
minor structural damage, but destroyed the home
electrical system, also resulted in the family having to
leave the home pending repair.

phase (1) only, 48 lots of `2.5 total. With 12. contingencies,
after six years and six months from the time of the initial

RESOLUTION #C2 04 HIRE ATTORNEY F OR ZONING BOARD OFFAPPEALS
Supv Schug offered the followinn resolution and asked for its
adoptions
RESOLVED, that this Town Board appropriate money to hire Randy
Marcus from the law firm � �f Barney, Grossman, Roth & Dubow to guide
the Zoning Board of Appeals in their projects.

Atty Perkins - in July of 1993 the town obtained a permanent
mandatory injunction against Alton Stetson for him continuing to
occupy as a residence a rabbit hutch ors the property +tf the
northeast corner of Bone Plain Road and Wood R+.-iad. The zoning
officer has received a number of complaints fri. -im neighbors and
relatives that Alton having been released from .jail has now taken
up residence again in the rabbit hutch, which is a real hazard. He
would like authority from the Town Board upon receipt of
appropriate proof that Alton Stetson is Occupying the rabbit hutch
in violation of the mandatory prior .judgement of the court that the
town will be able to proceed in a ciz intempt proceeding to hold him
in contempt of courts
