Supv Schug - Atty Perkins has reviewed the agreement to make
sure it did not destroy the Town of Dryden vr.fl!!nteer youth group
and recreational projects.
Alice Green - works fi •r the Ithaca Youth Bureau - she has tried
to develop a system to do away with the triple fees for Dryden
residents. She feels this pilot partnership is a giziod way to test
out whether we can jointly cooperate in recreational services for
children beginning with children in the Ithaca school system, but
live in the Town of Dryden. They hope to work with the local
volunteer programs and offer programs in the different
municipalities as part of this two year partnership. She would
like the Town of Dryden t� � spend the same aril unt that has been
spent before to subsidize the triple fees for this partner
period. Town of Dryden residents regardless of the school
district will have a chance to participate in the recreation
programs at the base rate. This does depend on assistance from
the county board. The other part of the new partnership is that
each of the people who contribute will have representation � �n the
.joint commission to look at recreation resr. iurces.

RESOLUTION #177 JOINT_- REC'REAT I ON PARTNERSHIP
Clm T. Hatfield offered the following reso1ution and asked for
its adoptione
RESOLVED, that this Town Board supports the new joint Recreation,
Partnership two year
project. This resolution is contingent upon
the Tompkins County Board of Representatives approval of their
funding and the rate will stay the same.

Brian Earle - asked the boards ci.-int inued support on the West
Dryden Community Center project. He wondered if there was any way
the architects could eliminate the painting project completely
and only work can the roof and foundation.
Supv Schug, - that was recommended by the state. He questioned the
bricks of the foundation as being painted.
Brian Earle - thought they were painted with latex paint.
Supv Schug - w• indered if the town was in a pi.-isit ion to say it
would be safe enough ti -.1 wcnrk on the roof and foundation around
the lead paint. The preliminary bids the architect put out were
for a breakdown of all different categories.
Brian Earle - reported there are slats falling out of the steeple
and are worried since there are children on the play ground.
Supv Schug - wanted to know the boards opinic.in abr.iut repairing
the building and do the painting at a different time.
Clm T. Hatfield - thought the building shi.nuld be fixed and worry
about the painting later. There might be some funding at a later i
date that would become available.
Clm Roberts - one of the concerns about the paint was the
procedures might become a l is more difficult next year. The
procedures might be similar t asbest i- 1s removal and that is why '
we were 1 i_nok. i n g so closely at it.

Clm Baker - felt we were i-. 1n a sliding scale of funds. We are �
being encouraged in a lot of directions to save the building and
take whatever money we can lay our hands _in now to fix the roof
and foundation ion and we find next year it will be $55, oo i. C)Cr or I

these categories we could build a fabUl OUs new building On the
same site and not interfere with the community development and
probably enhance the area. He is concerned about this.

This agreement is made by and between the Village of

Village with the Village paying for the material; and

WHEREAS; the patties hereto desite to enter into aH agreement
setting forth their understandings With respect to Johnson street
in said Village;

AMENDMENT NO. 1
TO
AGREEMENT DATED AS OF THE 3RD DAY OF OCTOBER, 1994
THIS AGREEMENT is dated as of the 3rd day of October in the
year 1994 by and between Town of Dryden (hereinafter called OWNER)
and Bat -Con, Inc. (hereinafter called CONTRACTOR).

General Conditions
forming a part of
the
above
Agreement are amended to read as follows:
19. PAYMENT TO CONTRACTOR
1901 At least ten (10) days before each progress payment falls
due (but not more often than once a month) , the CONTRACTOR will
submit to the ENGINEER a partial payment estimate filled out and
signed by the CONTRACTOR covering the WORK performed during the
period covered by the partial payment estimate and supported by
such data as the ENGINEER may reasonably require. If payment is
requested on the basis of materials and equipment not incorporated
in the WORK but delivered and suitably stored at or near the site,
the partial payment estimate shall also be accompanied by such
supporting data, satisfactory to the OWNER, as will establish the
OWNER' S title to the material and equipment and protect the OWNER'S
interest therein, including applicable insurance. The ENGINEER
will, within ten (10) days after receipt of each partial payment
estimate, either indicate in writing approval of payment, and
present the partial payment estimate to the OWNER, or return the
partial payment estimate to the CONTRACTOR indicating in writing
the reasons for refusing to approve payment. In the latter case,
the CONTRACTOR may make the necessary corrections and resubmit the
partial payment estimate. The OWNER will promptly pay after
presentation of an approved partial payment estimate the CONTRACTOR
a progress payment on the basis of the approved partial payment
estimate less the retainage. The retainage shall be an amount
equal to 5% of said estimate of the work completed. Upon
substantial completion of the work the CONTRACTOR shall submit to
the ENGINEER a partial payment estimate for the remaining amounts
due the CONTRACTOR. After approval of such estimate by the
ENGINEER, the OWNER shall approve such estimate and promptly pay
CONTRACTOR the remaining contract price less two (2) times the
value of any remaining items to be completed.

On behalf of the Dryden Youth Commission, I would like to submit the following
preliminary budget request for 1995. The Youth Commission is currently
reviewing the 1994 programs and will begin to review 1995 requests for youth
programs at our September 15th meeting.
One program we feel is necessary and beneficial to continue is the Family and
Children's Service contract that enables us to have a full time youth coordinator.
The total expense for 1995 will be $26,979 of which 50% would be reimbursed.
At our August meeting, the Commission unanimously voted to continue with
Family and Children's Service as our provider for 1995.
The budget figures for 1995 are as follows:
State and county funds available for 1995 include:

In addition, the Villages are eligible for:
$1,050 in DFY Youth Services - Village Dryden

If the Town wants to assure that the Youth Commission can take full advantage
of all available state and county funds, the Town would need to appropriate an
amount twice the total revenue or
$20,655 + $14,028 = $34,683 x 2 = $69,366
The Town would show offsetting revenue of $34,683 leaving a maximum net
expenditure of Town funds of $34,683. The actual amounts needed from the
Town may be somewhat less since the Villages usually do provide the local
match for some of their locally planned youth service programs; however, we do
not yet have firm figures from them. In 1994, the Villages provided a total match
of $5,788 which decreased the Town's obligation by that amount. If you have

WHEREAS, by Resolution 290 adopted December 11, 1990 the
Town of Dryden adopted a formula which would partially exempt
certain real property within the Town owned by persons
sixty -five (65) years of age or over, and
WHEREAS, certain amendments to the Real Property Tax Law
have provided for the option to the Town to increase the income
eligibility levels,
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD AS FOLLOWS:
1. Real property owned by one or more persons each of whom
is 65 years of age or over, or real property owned by a husband
and wife, one of whom is 65 years of age or over, shall be
exempt by taxation by the Town of Dryden to the extent set forth
in the following formula:

2. Any exemption provided in this resolution shall be
computed after all other partial exemptions allowed by law have
• been subtracted from the total amount assessed.
3. The real property tax exemption on real property owned by
a husband and wife, one of whom is 65 years of age or over, once
granted, shall not be rescinded solely because of the death of the
older spouse to long as the surviving spouse is at least 62 years
of age.
44 No exemption shall be grantedt
(a) If the income of the owner or the combined income of
the owners of the property for the income tax year immediately
preceding the date of making application for exemption exceeds the
• amounts set forth in the formula in this resolution. Income tax
year shall mean the twelve month period for which the owner or
owners filed a federal personal income tax "return, or if no such
return is filed, the calendar year. Where title is vested in
either the husband or the wife, their combined income may not
exceed such sum. Such income shall include social security and
retirement benefits, interest, dividends, total gdili from the sale

or exchange of a capital asset which may be bftAOt by a loss from
• the sale or exchange of a capital Asset in the §ata@ income tax
year, net rental income, salary or @arnings, ehd het income from
self - employment, but shall not include a return of capital, gifts
or inheritances. In computing net rental income And net income
from self - employment no depreciation shall be allowed for the
exhaustion, wear and tear of real or personal property held for the
production of income;
(b) Unless the title of the property shall have been
vested in the owner or one of the owners of the property for at
least twenty -four (24) consecutive months prior to the date of
making application for exemption, provided, however, that in the
event of the death of either a husband or wife in whose name title
• of the property shall have been vested at the time of death and
then becomes vested solely in the survivor by virtue of devise by
or descent from the deceased husband or wife, the time of ownership
of the property by the deceased husband or wife shall be deemed
also a time of ownership by the survivor and such ownership shall
be deemed continuous for the purposes of computing such period of
twenty -four (24) consecutive months. In the event of a transfer by
either a husband or wife to the other spouse of All or part of the
title to the property, the time of ownership of the property by the-
transferor spouse shall be deemed also a time of ownership by the
transferee spouse and such ownership shall be deemed continuous for
the purposes of computing such period of twenty -four (24)
consecutive months. Where property of the owner or owners has been

subject to taxation and the remaining portion only shall be
entitled to the exemption provided by this section;
(d) Unless the real,property is the legal residence of
and is occupied in whole or in part by the owner or by all of the
owners of the property, provided that an owner who is absent while
receiving health- related care as an inpatient of a residential
health care facility, as defined in section 2801 of the Public
Health Law, shall be deemed to remain a legal resident and an
occupant of the property while so confined and income accruing to
that person shall be income only to the extent that it exceeds the
amount paid by such owner, spouse, or co -owner for care in the
facility; and provided further, that during such confinement such
property is not occupied by other than the spouse or co -owner of
such owner.
50 The Town shall notify or cause to be notified, each
person owning residential real property in the Town of the
provisions of this resolution. This may be met by a notice or
legend set on or with each tax bill to such persons teading "You

68 Application for such exemption must be made by the owner,
or all of the owners of the property, on forms prescribed by the
State Board of Equalization and Assessment and shall furnish the
information and be executed in the manner required or prescribed in
such forms, and shall be filed in such assessor's office on or
• before the taxable status date.
79 At least sixty (60) days prior to the taxable status
date, there shall be mailed to each person who was granted an aged
exemption on the latest complete3 assessment roll an application
.form and a notice that such application must be filed on or before
the taxable status date and be approved in order for the exemption
to be granted. Within three (3) days of the completion and filing
of the tentative assessment roll, notice by mail shall %be given to
any applicant who has included with his application at least one
self - addressed, pre -paid envelope, of the approval or denial of the
application; provided, however, that upon the receipt and filing of
the application there shall be sent by mail notification of receipt

of the same to any applicant %ho has included two (2) of such
envelopes with the application. Where an applicant is entitled to
a notice of denial such notice shall be on a form prescribed by the
State Board of Equalization and Assessment and shall state thin
reasons for such denial and shall further state that the applicant
may have such determination reviewed in the manner provided by law.
Failure to mail any such application form or notices or the failure
of such person to receive any of the same shall not prevent the
levy, collection and enforcement of the payment of the taxes on
property owned by such person.
80 Any conviction of having made any willful false statement
in the application for such exemption, shall be punishable as set
0 forth in Real Property Tax Law Section 467(7).
90 This resolution shall supersede and replace Resolution
No. 101 (1990) adopted February 26, 1990.
