QUESTIONS AND /OR COMMENTS
Jeff Frederickson - Would like to move their construction
business to Cortland Road. They plan on using the barn that is
there to store their warehouse material and any equipment they
have. They plan on having their office in the house and would
like to rent out the second floor to an engineering firm or some
other type of compatible business. The dUmpster will be out back
so that it is not in view t• � the public and covered. All of their
trucks will be taken home at night when the workers leave. There
will also be no rather cars there at night. The reason they would
like to move their business to this location is that they do 65'*
percent of the business near Ithaca.

Joe Hilderbrandt - when Mark Stevens first started this
development, it was discussed that the read in the r -w would be
turned over to the tciwn. He wanted to know if that had been done
yet. It was also discussed at that time it would be built to town
specifications and at the end would be a turn around which also
would be paved. The turn around is not paved and has piles of
dirt in it.

driveway. The gentleman is correct, the turn around is about one

because he is getting water in his basement now and never did

the role it has been playing in holding water, providing a
barrier and preserving the ecology of this ridge in keeping the

has cut dawn all of the trees. He is concerned about the

of the building. They have no plans at the present time to fuel
their vehicles there.
Adam Reganbcogan - originally when he purchased his property,
there was a plan, and may not have been approved of by the town,
but the builder was committed to a plan of developing houses in
that area. Mark built this structure which he had a lot of
negative feelings abut because it seemed to him that would
attract ether people later who might consider to be buyers in
that development. It seems like the use in that area was getting
very mixed. Mark has a habit of building things and then having
them grandfathered in by the fact they are there. Even though he
doesn't get permission initially he is able after- some time
lapses to pretty much do i what he wants. Further mare, there
doesn't seem to be a plan now with all of the different things
that are going on there and all of the existing problems. It was
originally for 11 lots for houses and this proposal dries not seem
in concept in a housing development.

came and asked about his housing project it was hard to accept
the beautiful hill he had destroyed. He has destroyed that hill
and she questions the integrity of that man and the entire
project. She can never image about doing any type of business
without researching every aspect of it entirely. He was supposed
to build lovely $100, C)Oo - $250,000 00 h• Ames and lovely roads, but
has he edone this no. He puts up this huge structure to use for
something. That structure should have never been there, so
whatever permit goes with that structure, she doesn't care about
because that structure should have never been there. That was a
beautiful hill and has been destroyed. His integrity should be
questioned.

Joe Hilderbrandt - he was here at the ether hearings for Mark.
Basically, he came in and bulldozed out the reads, bulldozed out
all of the lets and then came in and asked for a permit for a
subdivision. Accordinn to the Health Dept. he had destroyed some
of the lots to the point where they had to be combined in order

with the land and then came and applied for the permits later. He
thinks he should not be Given any permits for any of them until
he proves that he can treat that land with respect.

Attv Perkins - all of your comments are well taken and he agrees
with a loot � �f them. However. you misunderstand the function of
this board. Your comments should all be addressed t� � the planning
beard now that Mark has none to them and really needs permits
now. Now you can make him correct some of these problems, because
the planning beard has extensive powers to condition approvals on
him in replantinn trees, takinn corrective measures with respect
to drainage etc. What we are talking about toninht is a building
that is already in place with a permit. Mark is now asking for a
special permit which is for an allowed use with a special permit.
If you have any comments relevant to his use of the land and his
special permit that is where you should be directinn them. What
he has done in the past is horrible. he agrees.

Adam Reganbogan - at one time there were drainage cavities where
the water would go through along the hill and be distributed
evenly to flow down the hill. Now the drainage cavities have not
been taken care of and the water goes wherever it can.
Adam Reganbogan - he understands this property does have a
structure on it. A structure can be used by special permit. It is
at the discretion � �f this particular body t� � make a determination
whether a special permit be granted or not. He thinks there needs
to be made a determination as to whether this special permit is
in keeping with the spirit and the planning that needs to take
place relative to this Turkey Hill area. If this board grants the
special permit, basically yoi..t are making a very firm decision in
a way. You are saying that this particular company now has a
stake in this particular project in becoming a commercial land
project as opposed to becoming a community of homes. You would be

Supv Schug - received a letter from Ken Tillapaugh against this

steep hill, the artiount of vehicles using the storage garage and
road. Questioned if there would be bathroom facilities and shower
facilities there for employees. Also, is there an approved septic

Based upon comments at the public hearing, the applicant being
present and the owner not being present the concerned neighbors
having been heard and the owner Mark Stevens having recently
applied to the Town of Dryden Planning Board for residential
subdivision approval for adjoining lands
BE IT RESOLVED, that 1 - the requirements of Section 1303
Subdivision (a) and 1303 Subdivision 1 of the Town Zoning
Ordinance have been met by the applicant, 2 - the Downer Mark
Stevens represented to ether purchasers and neighbors the use of
property adjoining the site to be for upscaled residential uses.
A use for commercial purposes would conflict with adjacent uses
and proposed uses as represented by Mark. Stevens. Mark Stevens
also represented to the Town of Dryden at the time of application
for a building permit for a storage structure in question and the
subject of this permit was for private storage, 3 - that the
