Evans - if he didn't he apologized, but it went through very quickly. More importantly they were told that our state assemblyman would not approve the sales tax unless the city agreed to it. The Town of Ithaca was also � involved in that. Supv Schug - the Town of Ithaca doesn't share in that. Co. Rep. Evans - he knows they didn't, but they finally agreed. Initially they wanted to and were insisting on it. They finally agreed and he doesn't know what compromises are between the city and town of Ithaca. It was a negotiated agreement between the county and the city for the $825,000.00. Originally the agreement the city was asking for was rejected by the county. When it came to a vote he had assumed that it would fail. The Groton representative voted for it so it passed 8 to 7. His reasoning � was the county taxes would be higher if he didn't vote for it and secondly he didn't feel he wanted to give his town any money because they would squander it. Supv Schug - the Town of Dryden did not have a chance and he personally .ly w• old rather have his personal property tax go up then . to see all of the towns held up by the city. Co. Rep. Evans - would have preferred a 50/50 split with the towns and city. He was very surprised when the $825,000.00 deal � passed. CITIZEN PRIVILEGE OF THE FLOOR Toni Miller - He is representing the Grange as a member t• � the Tompkins County Soil & Water Conservation District. They Put in for extra money last year for a technician and was turned down. The last technician they had was in 1968. At that time there were 3 SCS employees in the county, right now they are back to � one. This is a county wide position �n to serve the county. The technician is employed by the district and not the county. (copy in minute book.) . They are looking for the towns support. They are going to the BNA committee tomorrow and hopefully it will be passed on to the full board. C1m Corrigan - wanted to know where the money comes from to pay the technician? Toni Miller - most of the money will carne from the county. This is the initial start up which will help them. They have asked for $319000,0o this year. It will allow them to have a half time secretary and a full time technician with benefits. They want • someone with experience so there w i l l not be any problems. There is a good chance they will get $229000.00 from Congressman Walsh. Cortland County gave up their $12,0 00.oO to Tompkins County if this program goes through because their program is going fine. PRESENT: Supery Counci Counci Counci Counci ABSENT: None isor - lperson 1person 1person 1person of the Town Board of the Town of Dryden, held at the Town Hall on the 9th day of M., there were James Schug Charles Hatfield John Baker Ronald Roberts Elizabeth Corrigan The following determination and resolution were respectively made and adopted by the Town Board of the Town of Dryden, to wit: DETERMINATION WHEREAS, the Town Board caused notice of public hearing to be published in The Ithaca Journal, the official newspaper of the Town of Dryden on October 16, 1993, to consider the advisability of adopting a resolution, in accordance with the provisions of Section 209 -b of the General Municipal Law, authorizing the SLATERVILLE VOLUNTEER FIRE COMPANY, INC., to furnish general ambulance service for all of the residents of the Town of Dryden, and WHEREAS, a public hearing pursuant to such notice was held on • October 26, 1993, and which said notice of hearing described: (1) the general ambulance service which is proposed to be furnished; (2) the area to be served; (3) the names of the fire company affected; (4) the time and place within the Town where such hearing will be held; and (5) that all persons residing within the area to be served or persons, firms and corporations owning real property within the area to be served, or persons, firms and corporations whose business interests or employment would either be benefitted or adversely affected, whether or not a resident or owner of real property within the area to be served shall have the right to be heard in person or by representative at the public hearing,.and at which public hearing it was pointed out that the Town of Dryden was served by several other Fire Companies which did not provide general ambulance service to the area proposed to be served by the Slaterville Volunteer Fire Company, Inc. and the understanding between the Town and the Slaterville Volunteer Fire Company, Inc., was that the fire protection contract is to be entered into principally for the furnishing of general ambulance service in the area to be served by Slaterville Volunteer Fire Company, Inc. in, the Town of Dryden, and • WHEREAS, the matter was fully Town Board and all persons present given an opportunity to be heard statements considered by the Town considered and discussed by the at the time of such hearing were with respect thereto and their Board, and CI • • WHEREAS, the Town Bo, authorize the furnishing ambulance service and to SLATERVILLE VOLUNTEER FIRE FOUR THOUSAND DOLLARS ($4, or before February 1, 1994 and deems it it of such f ire enter into an COMPANY, INC., 000.00) for one and the public interest to protection and general agreement therefor with for the consideration of (1) year, to be paid on WHEREAS, the consent of SLATERVILLE VOLUNTEER FIRE COMPANY, INC. to furnish general ambulance service has been obtained, and NOW, AFTER HEARING AND CONSIDERING THE STATEMENTS MADE AT THE PUBLIC HEARING: on motion of Councilperson Roberts, seconded by Councilperson Corrigan, it is RESOLVED, that the Town Board hereby finds, in accordance with the provisions of Section 209 -b of the General Municipal Law, that it is in the public interest to authorize the furnishing of such fire protection and general ambulance service for the said residents of the Town of Dryden, and it is further RESOLVED, that service shall be fur shall be prescribed and approved by the further such fire protection and general ambulance 'nished subject to the rules and regulations as by SLATERVILLE VOLUNTEER FIRE COMPANY, INC., Town Board of the Town of Dryden, and it is RESOLVED, that within ten (10) days after the date of the adoption of this resolution the Town Clerk shall cause a certified copy thereof and the determination on which it is based to be filed in the Office of the Clerk of the County of Tompkins together with the consent of SLATERVILLE VOLUNTEER FIRE COMPANY, INC., and it is further RESOLVED, that the Town Supervisor be, authorized to execute an agreement between the SLATERVILLE VOLUNTEER FIRE COMPANY, INC., ambulance service for the consideration of the of FOUR THOUSAND DOLLARS ($4,000.00). and he is hereby TOWN OF DRYDEN and for such general payment by the Town The vote on the adoption of the foregoing resolution was as follows: Supervisor- James Schug Aye Councilperson - Charles Hatfield Aye Councilperson - John Baker Aye Councilperson - Ronald Roberts Aye Councilperson - Elizabeth Corrigan Aye The resolution was thereupon declared duly adopted. w STATE OF NEW YORK • COUNTY OF TOMPKINS TOWN OF DRYDEN ) SS: 0 40 I, Susanne Lloyd, duly elected Town Clerk of the Town of Dryden, DO HEREBY CERTIFY, that I have compared the preceding resolution with the original thereof filed in my office in the Town Hall, Town of Dryden, Tompkins County, New York, adopted the 9th day of November, 1993, and that the same is a true and correct copy of the whole thereof. Under the codification of the case law it was felt that the use variance was almost impossible to obtain because the applicant had to show he could derive virtually no economic benefit at all from the property. He had t• � have clear and convincing economic proof. This legislative change has changed the requirement of all economic use. Now the applicant can not realize a reasonable return provided the lack of return is substantially demonstrated rated by confidential evidence. It has eased the standard by which the Zoning Beard of Appeals must Judge applications for use variances. Supv Schug - there J. Eckert in Albany who had requested a change in the fire hydrant agreement. He notified them that the provi-sion they wanted to delete could riot be changed. It was a reasonable provision that was designed to protect the provider of the hydrants. He has drafted a minor revision to the contract ract which w i l l not sUbseq cent 1 y chance anything, but will satisfy A. J. Eckert concerns.
