Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk=
Present= Supv Schug, Clm Roberts, Clm Hatfield, Clm Corrigan,
Atty Perkins and Z.O. Slater
Absent= Clm Baker
Supv Schug appointed Clm Corrigan to audit the highway fund bills
since Clm Baker was absent.
APPROVAL OF MINUTES=
Motion was made by Clm Corrigan and 2nd by Clm Roberts that the
minutes of town board meeting held 7-13-93a 8 -5 -93 and Site Plan
Review 8 -5 -95 be approved. Carried
COUNTY BRIEFING
Co. Rep. Watros - the county is in the process of scheduling a
meeting for all of the local municipalities to discuss the merits
of establishing a county wide cable commission. As of Sept. 1st,
1993 Federal legislation took effect with respect to regulating
the cable. This will give local governments the option to develop
certain rules and regulations that pertains to the TV industry,
They are looking at the possibility of having a county commission
to have some means of a uniform system. Local 1 representation from
the municipalities will provide information to grant a franchise.
The cost allocations at this time would be for a consultant,
there wouldn't be any staff.
Co. Rep. Watros - the county is starting to work can the budget
and he did riot expect to see any hidden allocations.
Co. Rep. Evans - the county is going to start to negotiate with
their- 4 unions this month. In the case of the sheriff's
departments contract, if a sheriff is asked to go ran overtime and
is sitting in his car, he is also eligible for call in time, even
if he didn't go home. He feels these are going to have to be
negotiated and changed if they are going to control the sheriff's
department. Another area the county is going to have to be
concerned about is Biggs building A for people who have claimed
they have been made ill by the building. To completely renovate
this building he has heard $6.7 million. The county has currently
renovated part of the building.

for a telecommunication services franchise for said Town;
NOW THEREFORE, on motion duly made and carried, it is
RESOLVED, that said Board will hold a meeting a public hearing at
nrvden in said Town, on the 26th day of October
19 93 at 7:30 O'clock in the evening ,

® The better he can be prepared both as a candidate and hopefully
as candidate elect knowing where you are coming from, the better
he can represent you and the people in the 14th district. His
roots are in local goverriment and is interested in the same
things the board is from the level of police protection ion we have
in the sheriff's department, taxes, and the solid waste issue.

Deborah Bench, representing GTE of New York. - the public
service commission is requesting copies of all of their
franchises. The one for the Town of Dryden can not be found and
GTE can riot find copies � �r the original documents. GTE is now
asking that a resolution be adopted to hold a public hearing so
that a franchise can be issued. They will need their approval
before November 1st,

The following resolution was made at that time.
RESOLUTION #161 ISSUE FIREWORKS FERM I T
Clm Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board authorize Supervisor Schug to sign
the fireworks display permit with TC3. The fireworks will be held
on September 11, 1993.

RESOLUTION NO. 162
DESIGNATING THE TOWN SUPERVISOR OR DEPUTY SUPERVISOR AS THE OFFICER
TO REVIEW AND ISSUE PERMITS FOR PUBLIC DISPLAY OF FIREWORKS
PURSUANT TO PENAL LAW §405.00
Councilperson Hatfield offered the following
resolution and asked for its adoption:
WHEREAS, New York Penal Law §405.00(1) gives authority to the
Town Board to designate an officer of the Town as the person
responsible for reviewing and issuing permits for public display of
fireworks pursuant to such section,
NOW, THEREFORE, be it resolved as follows:
1. The Town Supervisor, or the Deputy Supervisor in the
absence of the Town Supervisor, is hereby designated as the officer
of the Town responsible for reviewing applications for permits for
public display of fireworks pursuant to Section 405.00 of the Penal
Law.
2. Such officer shall review the application for a permit
and when satisfied that the permit complies with the requirements
of Penal Law Section 405.00(2) and 405.00(3) and when the insurance
certificate as hereinafter required has been filed with the Town
Supervisor may i

3. No such permit shall be issued unless the applicant has
filed with the Town Supervisor a Certificate of Public Liability
Insurance indicating that the Town is the Certificate Holder
thereof and that there is in existence minimum limits of at least
$110001000/$2,000,000 aggregate.

Atty Perkins - the beard members had received a copy of a
proposed local law regarding ZBOA training and continuing
inuing
education.
Atty Perkins - under the amendments to Town Law effective July 1,
1992 the town board is specifically empowered to adopt a local
law which sets forth a training and continuing inuing education
requirements for members of the ZBOA and to set attendance
requirements. The concept of the amendment to Town Law was there
was no mechanism to ensure the members to take advantage of
programs and training that were made available. This was designed
to encourage members to discharge their function in a qualified
manner according to law. Atty Perkins felt this is well needed
and urged the board to consider this proposed local 1 aw which was
requested by Chairperson Anne Everett.
Clm Roberts - would like to review this proposed local law before
it went to � publ is hearing. The other board members had no

OPERATION AND MAINTENANCE AGREEMENT
• FOR FLASHING BEACONS
This agreement is made this 16th day of September

between the TOWN OF DRYDEN, a municipal corporation, 65 East Main
Street, Dryden, New York 13053 (hereinafter referred to as "the
Town ") and GEORGE JUNIOR REPUBLIC ASSOCIATION, INC. NEW YORK, Route
38, Freeville, NY 13068 (hereinafter referred to as "the school ".
WHEREAS, the Town obtained a Highway Work Permit from the State
of New York Department of Transportation for the installation of
flashing beacons on school signs on Route 38 near the George Junior
Republic, and
WHEREAS, Installation of the same pursuant to the terms of said
Highway Work Permit will be completed by the school, and
WHEREAS, the School has agreed to be responsible for the
operation and maintenance of said flashing beacons and school signs
which are to be installed as more particularly set forth in the
Highway Work Permit which is attached hereto and incorporated
herein by reference as Exhibit 1, and
WHEREAS, as a condition of the installation and continued
Permit for the flashing beacons and school signs, the State of New
York Department of Transportation has required that the Town
furnish an undertaking to the State of New York Department of
Transportation, such undertaking to be in the form annexed hereto
as Exhibit 2, and

WHEREAS, the school has agreed to defend, indemnify and hold
harmless the Town from any future expense, cause of action or
damages associated with such installation or the operation and
maintenance of the same,
NOW, THEREFORE, the parties hereto agree hereby as follows:
10 The School agrees to operate and maintain all the work
which was installed pursuant to the Highway Work Permit,
2. Such operation and maintenance shall be in strict and
full compliance with all provisions of the Highway Work Permit

and the rules and
Transportation.
3. The School

suit, judgment or attorney's fees incurred by the Town in
connection with the Undertaking given by the Town, it being the

Permit.
4. The School agrees to furnish to the Town a Certificate
of Insurance evidencing insurance coverage in at least the
amounts of $110001000/$2,000,000 in connection with this
agreement and the agreement by the School to defend, indemnify

and hold harmless the Town. The School agrees to name the Town
as an additional insured on such insurance.
5. This agreement shall be construed and interpreted
40 according to the laws of the State of New York.

6. This agreement may not be modified or cancelled except
•by another agreement in writing si

7. This agreement shall bind the parties hereto, their
respective officials, successors and assigns.
