and in such detail as has
heretofore been determined by the Town Board of

Dryden, Tompkins County, New York, relating to the establishment
of a proposed water district in said Town, such water district to
be known as Turkey Hill Water District of the Town of Dryden, and
WHEREAS, said map, plan and report were prepared by Hunt
Engineers and Architects of Corning, New York, duly licensed by
the State of New York, and have been filed in the office of the
Town Clerk of said Town, where the same are available during
regular office hours for examination by any persons interested in
the subject matter thereof, and
WHEREAS, the improvements proposed for said Water District
shall consist of the construction of a water distribution system
• including approximately 11,400 linear feet of eight -inch water
main, approximately 11250 linear feet of six -inch water main,
approximately 2,850 linear feet of service tubing, 19 hydrants,
16 gate valves and land and rights -in -land, original furnishings,
equipment, machinery and apparatus and incidental improvements
and expenses in connection therewith, and
WHEREAS, the estimated cost of said improvements is $606,475;
and

taxable real property in said Town shall be subject to the levy
of ad valorem taxes without limitation as to rate or amount
sufficient to pay the principal of and interest on said bonds as
the same become due; and
WHEREAS, compliance with the provisions of the State
Environmental Quality Review Act have been performed and the
establishment of the Turkey Hill Water District of the Town of
• Dryden and the improvements proposed therefor have been
determined to be an Unlisted Action, as to which a negative

declaration has been made determining that said establishment and
the improvements proposed therefor would not result in any
significant environmental effects; and
WHEREAS, it is now desired to call a public hearing upon the
question of the establishment of said Turkey-Hill Water District
of the Town of Dryden in the manner aforesaid$ and pursuant to
Section 209 -d of the Town Law, NOW, THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Dryden, Tompkins
County, New York, as follows:

Section 1. A meeting of the Town Board of the Town of
Dryden, Tompkins County, New York, shall be held at
the Town Hall, 65 E. Main Street in Dryden
New York, in said
Town, on the 8th day of September 1992, at 8:00 o'clock
P.M., Prevailing Time, for the purpose of holding a public
hearing to consider the establishment of the Turkey Hill Water
District of the Town of Dryden, the boundaries of such District
being as set forth in Appendix A attached hereto and made a
part hereof and to consider the map, plan and report including
estimate of cost filed in relation thereto, and to hear all
persons interested in the subject matter thereof concerning the
same, and for such other action on the part of said Town Board
as may be required by law or shall be proper in the premises.
Section 2. The Town Clerk is hereby authorized and
directed to cause a copy of this order to be published once in
the Ithaca Journal, the official newspaper of said Town, the
first publication thereof to be not less than ten nor more than
twenty days before the day set herein for the hearing as
aforesaid, and said Town Clerk shall also cause a copy thereof
to be posted on the sign -board of the Town maintained pursuant
to subdivision 6 of Section 30 of the Town Law not less than
ten nor more than• twenty days before the day set for the
hearing as aforesaid.
Section 3. This order shall take effect immediately.

including approximately 15,515 linear feet of eight -inch gravity

said Town having a maximum maturity of not exceeding forty years,

TOWN OF DRYDEN PROCUREMENT POLICY
WHEREAS, Section 104 -b of the General Municipal Law requires the
governing body of every municipality to adopt a procurement policy
for all goods and services which are not required by law to be
publicly bid, and
WHEREAS, comments have been solicited from all officers in the
TOWN of DRYDEN involved in the procurement process, now, therefore,
be it
RESOLVED, that the TOWN of DRYDEN does hereby adopt the
following procurement policy which is intended to apply to all goods
and services which are not required by law to be publicly bid.
PROCUREMENT POLICY FOR THE TOWN of DRYDEN
10 Every purchase to be made must be initially reviewed to
determine whether it is a purchase contract or a public works
contract. Once that determination is made, a good faith effort will
be made to determine whether it is known or can reasonably be
expected that the aggregate amount to be spent on the item of supply
or service is not subject to competitive bidding, taking into account
past purchases and the aggregate amount to be spent in a year. The
following items are not subject to competitive bidding pursuant to
Section 102 of the General Municipal Law: purchase contracts under
$10,000 and public works contracts under $20,000; emergency
purchases; certain municipal hospital purchases; goods purchased from
agencies for the blind or severely handicapped; goods purchased from
correctional institutions; purchases under State and county
contracts; and surplus and second -hand purchases from another
governmental entity.
The decision that a purchase is not subject to competitive
bidding will be documented in writing by the individual making the
purchase. This documentation may include written or verbal quotes
from vendors, a memo from the purchaser indicating how the decision
was arrived at, a copy of the contract indicating the source which
makes the item or service exempt, a memo from the purchaser detailing
the circumstances which led to an emergency purchase, or any other
written documentation that is appropriate.
2. All goods and services will be secured by use of written requests
for proposals, written quotations, verbal quotations, or any other
method that assures that goods will be purchased at the lowest price
and that favoritism will be avoided, except in the following
circumstances: purchase contracts over $10,000 and public works
contracts over $20,000; goods purchased from agencies for the blind
or correctional institutions pursuant to Section 175 -b of the State
Finance Law; goods purchased from correctional institutions pursuant
to Section 186 of the Correction Law, purchases under State contracts
pursuant to Section 104 of the General Municipal Law; purchases under
county contracts pursuant to Section 103(3) of the General Municipal
Law; or purchases pursuant to subdivision 6 of this policy.
3. The following method of purchase will be used when required by
this policy in order to achieve the highest savings.

A good faith effort shall be made to obtain the required number
of proposals or quotations. If the purchaser is unable to obtain the
required number of proposals or quotations, the purchaser will
document the attempt made at obtaining the proposals. In no event
shall the failure to obtain the proposals be a bar to the
procurement.
4. Documentation is required of each action taken in connection with
each procurement.
O 5. Documentation and an explanation is required whenever a contract
is awarded to other than the lowest responsible offerer. This
documentation will include an explanation of how the award will
achieve savings or how the offerer was not responsible. A
determination that the offerer is not responsible shall be made by
the purchaser and may not be challenged under any circumstances.
6. Pursuant to General Municipal Law Section 104- b(2)(f), the
procurement policy may contain circumstances when, or types of
procurements for which, in the sole discretion of the governing body,
the solicitation of alternative proposals or quotations will not be
in the best interests -of the TOWN of DRYDEN to solicit quotations or
document the basis for not accepting the lowest bid:
a. Professional services or services requiring special or
technical skill, training or expertise. The individual or
company must be chosen based on accountability,
reliability, responsibility, skill, education and training,
judgment, integrity, and moral worth. These qualifications
are not necessarily found in the individual or company that
offers the lowest price and the nature of these services
are such that they do not readily lend themselves to
competitive procurement procedures.
b. Repair of equipment and machinery, maintenance items i.e.:
toner, ribbons, oil filters, nuts & bolts etc. These can be
® specialized items . The purchaser will obtain at least two
verbal, written, faxed or catalog prices. It is up to the
purchaser which product to purchase.

In determining whether a service fits into this category the
TOWN BOARD shall take into consideration the following guidelines.
(a) whether the services are subject to State licensing or testing
requirements; (b) whether substantial formal education or training is
a necessary prerequisite to the performance of the services; and (c)
whether the services require a personal relationship between the
individual and municipal officials. Professional or technical
services shall include but not be limited to the following: services
of an attorney, services of a physician; technical services of an
engineer engaged to prepare plans, maps and estimates, securing
insurance coverage and /or services of an insurance broker, services
of a certified public accountant, investment management services;
printing services involving extensive writing, editing or art work;
management of municipally owned property; and computer software or
programming services for customized programs, or services involved in
substantial modification and customizing of pre - packaged software.
b. Emergency purchases pursuant to Section 103(4) of the
General Municipal Law. Due to the nature of this
exception, these goods or services must be purchased
immediately and a delay in order to seek alternate
proposals may threaten life, health, safety or welfare of
the residents. This section does not preclude alternate
proposals if time permits.
c. Purchases of surplus and second -hand goods from any source.
If alternate proposals are required, the TOWN OF DRYDEN is
allowed to purchase surplus and second -hand goods at
auctions or through specific advertised sources where the
best prices are usually obtained: Prior Town Board
approval is required for amounts over $999.00
d. Goods or services under $999.00 The time
