permit to have a day care and it happens to boarder a mink farm
or whatever. The purpose is to provide notice to people.

NOTICE OF PUBLIC HEARING
ON PROPOSED LOCAL LAW NO. 1 OF THE YEAR 1992
LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the Town
of Dryden will hold a public hearing at the Town Hall, 65 East Main
Street, Dryden, New York, on the 14th day of July, 1992, at 7:30
o'clock P.M. prevailing time, to hear all interested parties and
citizens for or against the proposed Local Law known as The Right
to Farm Law. The proposed Local Law would require that notice be
given to permitees of the Town of Dryden when the activity subject
to such permit borders an existing farm. Such notice may be
required on building, special, zoning and site plan permits as well
as on subdivision plats.

CITIZEN PRIVILEGE OF THE FLOOR
Jack Ford, Oak Brook Rd - were very upset with the way that the
town highway blacktopped their road. He shy 1wed the board members
pictures he had taken. He was concerned because the road has been
raised so that he was a w fo it drop into his driveway and now
their mailbox is way below their car doom. This is riot right and
should be taken care of. He has a road right of way there and he
can not use it because of the S fr. grit drop arid this blacktop will
have to come up. This right of way is in his deed. If he has to
go to court to get this corrected he will.
Helen Ford - she called the highway department trJ complain about
the way they were blacktopping around the mailbox. Right now
there is foot build up near the mailbox and anyone going near the
mailbox r_an drive off the rigad when there was sn ow on the ground
because yc.lu would not be able to see the drop off. When she
complained about this she was told that there was not any snow
now. There was some discussion and Hwy Supt Gilbert will work
0 U the problems that they are concerned ab� ut.
Erica Evans - wanted to know the status of the Turkey Hill Rd.
water and sewer.
At t y Perkins - received a call from Senat • •r Seward' s office t hat
• they have been promised by counsel in the Comptrollers Office
that this will be resolved within the next 2 weeks. There was
riicire information that was mailed c lut to them that was requested.
The receipt of this information that was just mailed out
indicates that they are getting ready to send it ors t• � the Fiscal
Affairs Office. They needed this to determine whether or riot by
incurring this the town would be over their debt limit.
Ted Wixom, Mays it of the Village --if Lansing and Andy Sciarabba,
organizer for proposed recreat i r.in and cultural center.
Ted Wixom - previously supplied board members a report to
r insider recreation and cultural center in the Village of
Lansing. He went aver the report with the board members. The
Village cif Lansing would like to broaden the base for a .joint
venture to � i nc 1 ude the Town of Dryden, Town cif Ithaca, Town of
Lansing, Village of Lansing, and Village of Cayuga Heights.
They are here to ask the bi.-jard to review the document and to
consider participation. They would like construction to start
next spring so it will be ready by the fall. They would like to
r•'equest are amount of $15,000.00 maximuril from each municipality
for operations gl.tarantee biz ending � ever a 10 year period.
Clm Corrigan - wanted to know why the Village of Lansing went to
the concept of jr. lint ownership of 5 municipalities rather than
Lansing owning it and charging out whatever fees necessary to the
other municipalities rather than this complicated way.

Andy Sc i arabba - .j i nt ownership was not originally considered.
It was brought up in some discussions that they had with the
mayors and supervisors. The Village of Lansing has no problem
with bending this and being the owner. They are looking for an
insUrance policy of the other 4 or 5 municipalities for a short
fall cash flow, should there be any. They want to have one fee
Structure for all j -.1f the people who use the facility,
Clm Corrigan - felt that the board wiDuld have to � c• insider what
kind Of usage this facility would get fri:tm the citizens of our

Clm Baker - a lot of people drive to Cortland to use their
facility for hockey and ice skating,
Ted Wixom - the library is also considering _in building a branch
library in this same parcel of land.

Dryden. This matter was heard before Judge Ref ihan Jr. on June
19th. On June 30th he issued the decision of dismissing the
pet it it .in of Mr. Shank and Mr. Rizzo. That decision has been
reduced to an order which was served on Mr. Shank and Mr. Rizzo,

SECTION 1. Legislative Intent and Purpose
a. The Town Board of the Town of Dryden finds that farming
I
s an essential activity within the Town of Dryden.
b. Farming, as defined herein, reinforces the special
quality of life enjoyed by residents of the Town, provides the
visual benefit of open space and generates economic benefits and
social well -being within the community. Therefore, the Town of
Dryden emphasizes to newcomers and non - farmers that this Town
encourages agriculture and requests newcomers and non - farmers to be
understanding of the nature of day to day operations.
c. It is the general purpose and intent of this Local Law to
maintain and preserve the rural tradition and character of the Town
of Dryden, to permit the continuation of agricultural practices, to
protect the existence and operation of farms, and to encourage the
initiation and expansion of farms and agricultural businesses.
d. For the purpose of reducing future conflicts between
farmers and non - farmers, it is important that notice to be given to
future neighbors about the nature of agricultural practices.
SECTION 2. Definitions
a. "Farm" - includes livestock, dairy, poultry, furbearing
animal, aquaculture, fruit, vegetable and field crop farms,
plantations, orchards, nurseries, greenhouses, or other similar
operations used primarily for the raising of agricultural or
• horticultural commodities.

b. "Agricultural Practices" - includes all activities
conducted on a farm, necessary to the operation of a farm.
SECTION 3. The Right to Undertake Agriculture Practices
Farmers, as well as those employed, retained, or otherwise
authorized to act on behalf of farmers, may lawfully engage in
farming practices within the Town of Dryden at any and all such
times and all such locations as are reasonably necessary to conduct
the business of farming. For any activity or operation, in
determining the reasonableness of the time, place and methodology
of such operation, due weight and consideration shall be given to
both traditional customs and procedures in the farming industry as
well as to advances resulting from increased knowledge and improved
technologies.
SECTION 4. Notice to Prospective Neighbors
The following notice shall be included in building permits,
special permits, permits issued in Site Plan Review and in any
other situation where a permit is required to be issued by the Town
of Dryden and on plats of subdivisions submitted for approval
pursuant to Town Law Section 276 and the Land. Subdivision Rules and
Regulation of the Town of Dryden, New York.
"This property may border a farm, as defined in Town of
Dryden Local Law No. 1 of the year 1992, a Local Law
known as The Right to Farm Law. Residents should be
aware that farmers have the right to undertake good or
• acceptable farm practices which may generate dust, odor,

smoke, noise, and vibration."
SEVERABILITY CLAUSE
If any part of this Local Law for any reason is held to
be unconstitutional or invalid, such decision shall not affect the
remainder of this Local Law.
b. Nothing contained herein shall be construed as being
inconsistent with any other local law, ordinance, rule or
regulation of the Town of Dryden, the intention of this local law
being to supplement and complement other local laws, ordinances,
rules or regulations.

SECTION 6. EFFECTIVE DATE.
This Local Law shall be effective immediately upon filing, as
provided by the Municipal Home Rule Law.

• TERMINATION OF IRREVOCABLE LETTER
OF CREDIT FOR SPARROW CREST LANE
WHEREAS, the Town of Dryden has heretofore by Resolution No.
217 of 1991 accepted an offer of the dedication of Sparrow Crest
Lane as a Town Road, and

WHEREAS, said acceptance contemplated certain work to be done
by the developer which work was secured by an Irrevocable Letter of
Credit (No. 011792) dated January 17, 1992 and issued by the
Tompkins County Trust Company to the Town of Dryden, and
WHEREAS, the

2. That the Highway Superintendent shall take such steps as

a Town Highway with the express understanding that the construction
of the original improvements are warranted to the Town by the
developer for a period of one year from the date hereof.

Atty Perkins - Town of Dryden vs Irene Dennis - reported he has
sent papers on to supreme court. The defendant defaulted in
appearing cir answering and he has asked the court for .judgement
issuing an irIji_irict ion requiring the removal of the offending
motor veh i c 1 es. He has not received a report back yet.
Atty Perkins - Town of Dryden vs Carlos Stetson - reported he has
sent the paperwork on to supreme court and asking for a mandatory
injunction to cause the removal of the barn and .junk on his
property.
Atty Perkins - Town Cif Dryden vs Ronald Gresch 1 er - reported ed t hat
this case concerned a multiple dwelling on Ringwood Rd. This had
a number of problems regarding the health, safety and welfare.
The property was jr, foreclosure so he waited to see what was
going to happen. The second mortgagee Alternative Federal Credit
Union bid the property at the foreclosure sale. When he found out
the closing was complete he wri -.1te them a letter notifying them of
the problems that existed with the property. They have been very
cooperative and are keeping in touch with Henry arid the property
is now vacant.
Atty Perkins - reported that Sparrow Crest Rd. has now been
completed to Town of Dryden speci f icat io ns. The town has a letter
from the highway superintendent and a final map from the
® engineers for the developer. The Town Clerk is now free to
release the letter of credit for $169000m00

RESTRICTION OF VEHICLES!R MOTOR VEHICLES
Clm Baker offered the following resolution and asked for its
adoptions
RESOLVED, that SUpv Schug schedule a public hearing for proposed
Local Law #c_ - 1992 for the restriction of vehicles and motor
vehicles on August 11th at 7c30PM

Supv Schug - Village of Dryden moratorium sewer plant which would
serve the Cortland Rd water district. There are problems and they
feel that they have to increase the size of the plant. At which
point the town will become involved in assisting the village.
Cortland Road water district and existing Village -.if Dryden
contracts will be honored until they have expired. If the
Cortland Rd water district is in place at the end of the
contracts with the village they will then be subject like any
other user in the town. The town
