TOWN BOARD MEETING
OCTOBER 9 , 1990
Supv Schug called the meeting to order at 7 : 30PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk :
P resent : Supv Schuq , Cirn Roberts , Clm Walbridge , Clm
H atfield , Clm Corrigan , Atty Perkins and Z . O . Slater
Approval of the minutes : Motion was made by Clm Roberts and 2nd
by Clm Hatfield that the minutes of 8 - 28 - 90 ; 9 - 6 - 90 and 9 .- 27 - 90
be approved as submitted . Carried
CITIZEN PRIVILEGE OF THE FLOOR
S uzanne Stephen , Tompkins Co . Health Dept spoke on the concern of
✓ abid animals that are working their way from the Pennsylvania
southern outbreak and not the northern rabies that has been in
New York State . She wanted to know what the Town of Dryden will
d o to help prevent or protect its residents and if the town had a
leash law .
Town Clerk Lloyd -- it is a dog control law which the dog is
supposed to be under the owners control at all times .
Suzanne Stophen - if you don ' t have a leash law you aright want to
consider one . Chemung County has had 2 rabid raccoons and it
might take so:: rne time before it cones into Tompkins County so you
h ave some time to consider in removing your stray cats and dogs .
There is a need to o educate the public to get their cats and dogs
✓ accinated which there are clinics ava i l ab l e every year . The
✓ esponsibility for the Health Dept . is only if there has been a
bite from a wild and / or domestic animal that is acting peculiar .
She has literature on what to tell the public if they have any
q uestions . They do want to be notified if there has been a bite ,
scratch , exposure to a bizarre acting animal , body fluid , blood ,
saliva . Since there has not been any monetary value to raccoon
h ides in the last 3 or 4 years there has not been any control
o ver, the population except by road kill or disease so the raccoon
population is larder then they would normally have . The State DEC
n ow prohibits the relocation of raccoons because of the rabies
outbreak . In Tompkins County there are about 6 rabid bats a year
in the Fall Creek area . She left literature on reporting animal
bites and would like to establish some sort of a plan as to how
the town will deal with the telephone calls .
S tephanie Schaaf , 'Tompkins Co . SPCA -- they are contracted by the
county to provide animal control services . By the county contract
they have to investigate animal cruelty for all species . They
also have to provide sheltering facilities and animal control
® services for all cats , bats and livestock . There has been an
increase from the previous year of 16 % for cats , 80 % for bat

- Report any incident where a person is bitten by any warm blooded animal .

For reports of bites by bats or vicious and / or unprovoked bites by suspected rabid
animals , report such incidents 24 hours a day , seven days a week at the phone f. ,

For reports of bites by animals not suspected of having rabies after hours phone
calls are not necessary .• Phone calls to the Health Department during working
hours to report bite incidents would be appropriate for bites involving •
unvaccinated dogs and cats , biting faxes , raccoons and skunks .
Hailing a Health Department animal bite report would be appropriate for all other
bite incidents . .
Use the Tompkins County Animal Bite Report farm for obtaining information on an
incident and provide all the information asked in the first four sections when
is known .

Goal . •
Don ' t suggest to a complainant or anyone to shoot an animal in the head ( an
animal ' s brain is necessary for laboratory analysis ) .
Don ' t suggest to a Complainant that an animal is rabid . , . . tho_ Health Department
makes that Judgment .
Don ' t rely on the person bitten to file the report with the Health Department .
Don ' t forget that the information you provide enables the Health Department to
find and confine a biting animal .

SUBJECT: RABIES POLICY

' Due to the entry into New York State of the rabies virus in
✓ accoons , ' and the increased public awareness of the
n ortherly spreading epidemic , an increase in wildlife calls
t o the various ' police agencies will occur . Most ;
complainants will be concerned about a strange acting animal
they believe may be rabid . In most instances if the animal
is diseased , it will be distemper or mange . However , rabies
. has entered Southern New York and become a real threat .
To prepare for the eventual problems associated with the
d isease , DEC , Ag & Markets , and the Department of Health
h ave developed an Interagency _ Rabies _ _ Cont .ingency _Plan which
assigns specific tasks to each agency . A - copy is available
t o any department requesting one .
S ince several agencies have requested assistance or
® information with regard to our response policy on suspected
✓ abid animals , it is being disseminated to all of you .
Hopefully , it will save time for all of us and the public .
There are only two instances which require an ECO to respond
t o a suspected rabid animal call . They are :
1 ) When a human has been bitten or scratched by a raccoon
or other suspect wild animal .
2 ) When a domestic animal or pet has been bitten or
scratched by a raccoon or other suspect wild animal .

The DEC Wildlife Unit in Cortland , ( 607 ) 753 - 3095 , is the
primary responder to such calls . ECO ' s will respond if
available when the Wildlife Unit cannot be contacted .
P ublic requests for assistance regarding wild animals
e xhibiting unusual behavior where no human contact or
demestic animal has been bitten or scratched can be handled
by one of two ways . First - The complainant may contact a
Wildlife Nuisance Trapper for assistance ( see enclosed
listing ) . They should be aware these are private citizen -
n ot department employees - and they normally charge a fee .
S econd - Alternatively , they may choose to dispose of the ii
® Animal themselves . Where it is not prohibited by law they
can shoot it and bury it . CAUTION - Recommend that they not
h andle the carcass . Pick it up only with the shovel , or
wrap a newspaper or garbage bag over it . Then dig a hole
and bury it so that domestic animals cannot come in contact
with it .

2 . If an animal is found dead on your property and you have no
✓ eason to believe that a person or pet has been in contact with
its blood or body fluids ; recommended disposal is by burial
u nder 24 " of soil or by double plastic bag and regular trash
hauler.
3 . If an animal is found dead in the road , contact the municipality
responsible for maintaining that road , or dispose of as
previously mentioned .
4 . Managing biting animals suspected of having rabies : •
R . Biting animal - a cat or dog - suspected of having rabies : .+
1 Owner known , wants animal kept aline - confined for if
10 days , observe daily for sign of rabies .
2 . If the animal is still healthy after 10 days , there is no
n o rabies danger from that bite .
3 . If the animal dies or shows signs of rabies during the
10 day period , call the Health Department , which will
send the head to the Rabies Lab immediately for
e xamination .
B . Biting animal - stray dog or cat ( or if owner will allow
animal to be destroyed ) , or wildlife or exotic pet
The Health Department will send the head to the Rabies
Lab immediately for examination . If in the evening or
weekend , call the evening number to report the bite , and •
the head will be sent the next business day .
C . Unvaccinated animals , including livestock , in contact with
a rabid animal MUST BE destroyed unless quarantined for
a four month period . Vaccinated animals in contact with
a rabid animal MUST RECEIVE a rabies booster injection
within 5 days of exposure .
5 . Dogs and cats should be currently vaccinated for rabies at all
times . Dogs are required to be vaccinated . Barn cats should be
trapped and vaccinated or destroyed . Cat vaccination will
become man story, upon the first documented rabid animal ,
o ther than a bat , in the county .
6 . Managing bites from animals suspected of having rabies . If a
person is bitten by an animal , the wound should be washed with
soap and water and medical attention sought immediately . Rn
attempt should be made to capture the animal without
damaging the head , or getting further bites .
7 . For any further information , please call the Environmental
Health Division at 273 - 7275 .

RECREATIONAL OPPORTUNITIES FOR TOWN OF DRYDEN RESIDENTS
The Ellis Hollow Community Association , as well as other Town of
Dryden residents with children in the Ithaca City School District ,
feel that the recreational needs of our families are not being met .
W e believe that it is the responsibility of the Town of Dryden to
provide recreational opportunities for ALL its youth throughout the
Town ' s geographical borders - - even those youth who do not attend Dryden
schools .
W e feel that this is a fair request considering the proportion of Town
of Dryden taxes which are paid by residents living within the Ithaca
City School District .
W e see several solutions to this problem :
Solution 1 _ The Town should contract with the City of Ithaca for
Youth Bureau Recreational programs .
a . Because of the triple - rate fees charged
Dryden residents , many families cannot
afford to have their children participate
in Youth Bureau programs .
b . Participation in these programs and
interaction with other children from the Ithaca
School District is important to our young people .
It maintains the sense of community with Ithaca ,
where they will attend middle and high schools .
c . Many programs available at the Youth Bureau
are not available to us elsewhere .
d . Due to our rural location , few recreational
facilities are as convenient or accessible as they
may be for village or city residents .
e . Youth Bureau programs are popular and well - run .
This is evident from the number of Dryden residents
that continue to participate despite high fees .
f . Those who cannot pay the high fees lose their
only access to recreational programs .
g . If the Town made these programs financially
affordable to ALL YOUTH , it would be providing
guidance in their activities and a positive
b outlet for their creative and athletic energies .
SQ1utign2 _ We request that the budget for the Town of Dryden
include a line item for Recreation specifically earmarked for
residents who are part of the Ithaca City School District . These funds
could be pooled with similar funds from the Town of Caroline to
• support activities involving young people from both towns who attend
Ithaca City Schools ( i . e . Caroline Elementary , Dewitt Middle School ) .
aQlutjQa_31 We request representation from the Ellis Hollow
Community Association on the newly formed Dryden Youth Commission .
We feel that it is important for Town residents within the Ithaca City
S chool District to have a voice on this commission .

✓ esponsibility to provide any type of wildlife control services
to the citizens of Tompkins County . As part of their mission as a
h umane organization they at the time decided that they would
continue to take calls for distressed or injured wildlife animals
t hat were to young to take care of themselves . So far this year
they have handled 337 wildlife calls a 250 % increase . In the Town
o f Dryden they have handled 96 stray cats , 45 owner surrendered
cats , 4 livestock calls , 3 bats , 19 wildlife , other than bats 7
o f those were raccoons . She would 1 ike to see the county , before
an outbreak occurs put together some kind of rabies task force to
get planning and coordination of services between the Health
Dept . , SPCA and other dog control officers in the county as well
as other municipalities . They would like the town boards in the
municipalities put pressure on the county since they are the
centralized agency to start working on this so that they are not
overwhelmed 6 months down the road when the first positive comes
through . It will probably happen in the southern or western
municipalities and she does not look forward with having to deal
w ith this .
S upv Schug -- the town could pass a resolution to encourage the
county to consider a task force for rabies planning and
coordinations of services .
® Suzanne Stophen - her purpose for being here is to ask the town
to consider what they are going to do as part of a task force to
act in a unified manner in asking the county for support of that
o r delegating that to the Health Dept . When the board has decided
w hat they are going to do she would like to know .
Millie Reed •- gave the beard members a petition concerning Ithaca
Youth Bureau recreation programs and information of recreational
o pportunities for the Town of Dryden residents . ( copy in minute
book )
They are representing the Ellis Hollow Community Assoc . and they
f eel that their recreational needs are not being met . They are
asking that the Town of Dryden participate in the City of Ithaca
Youth Bureau program . If you live in certain towns that
participate in it you pay a certain fee and if you lave in the
Town of Dryden you pay triple the amount of the fee . The City of
Ithaca wants the Town of Dryden to pay $ 17 , 000 . 00 . She feels that
it will need a little more investigation and she will gladly do
anything she can so that they will be able to participate in the
city programs . Right now the city does not have any special
f ormula and they base it on every child in the town . She would
like the town to consider reimbursing the people who participate
in these programs so they do not have to pay the full triple
f ees .
S upv Schug - the town spends $ 12 , 000 . 00 ( $ 22 . 00 per child ) on
yc".tt h recreation and only reimbursed $ 4 , 000 . 00 . No one is
e xcluded from the youth program , but Ithaca is doing it
d ifferently . One solution may be that when they receive a bill

from the City of Ithaca for the child that participates , in a
pr- rgram to turn it in to the Town of Dryden for reinlhursement ,
but this will have to be looked into .

Clm Corrigan - there are a lot of people that are interested and
there should be some fair wiry of pro rating it .
S tpv Sehug - has asked several times over the years for a
breakdown as to what the Town of Dryden could do . The Town of
Ithaca does participate since they do not have a youth program of
their own - Last year they paid to the City of Ithaca $ 153 , 000 . 00
f or 400 youths $ 38E , 50 per child and this year the City of Ithaca
h as raised the amount to $ 160 , 000 with no more children which
w • IL1d bring it to S4CPCP . 00 per child . The county did help the Town
o f Dryden with their at risk children .
Millie Reed - would like to know a little more about the newly
formed Dryden Youth Commission as he the goals and purpose .
S upv Schog - they hope to have a meeting sometime in early
November . There was a steering committee who did some guideline
w ork . He did not think that the town board had the time or the
e xpertise to sole all of the youth prrdleme4 but it is are
interest to everybody .
Millie Reed -- thought the Dryden Youth Program was for the
children who attended Dryden sch '_' oia .
Trpv faded - the youth board tried in some of the sports to
encourage the Ellie Hollow Community group to have a team or two
o f soccer to practice right there at the community center ao that
they would not have to come all the way over to Dryden ,
Millie Reed -- they would like to keep it within their community
and the children school mates . If possible they would like their
share of money so that they could use it for their programs . They
have had a soccer program that has received a lot of
participation where they use the Caroline school .
Ann Jarrow -- there a lot of people in the summer who work and
they use this typo of recreation as a form of day care for the
children . There era a lot of programs that are rdrod but it is so
e xpensive that they can not participate . It is not just e matter
o f recreation and giving the child something to do after school .
d lot of people would like to use this program part of or all of
the sunnier .
Millie Reed - if they could get some money in combination with
Town of Carolina money they could have their program at Caroline
school which has been successful .

® Supv Schug - the town is already 100 percent over spent on
✓ ecreation for the town now . He didn ' t think with the state ,
f ederal or county budget there wi 11 be anymore youth money . The
t own board wi 11 try to get informat ion from the youth bureau to
see what funds are available . They are in hopes to get the Dryden
Youth Commission ready for spring programs and involve the entire
town .
J ack Ford - passed pictures around to the board members to look
at the back property that belongs to Charles Shew Furniture .
These are examples of what they have to live with . They have had
problems over the last several years with trash and garbage . He
h as a picture of a mattress that he has complained about that has
been there for over a week and all they did was move it from one
place to another . There is a pile of garbage that has been there
for months and just keeps growing . There were boxes there from
9 - 17 - 90 to 10 - 6 - 90 and then they were moved to another place . He
thought that it was a fire hazard because there are only 2
e ntrances a front and a back . He would like the town board to get
this place cleaned up . When Mark made his road the town made him
✓ aise it high and they have trouble getting into their driveway
and would like the Town of Dryden to fix it since they accepted
the road .
H elen Ford - their neighbor went off the road because it is so
® narrow and such a steep incline . It will be a hazard in the
w inter when it is covered by snow .
J ack Ford - wanted to know if the Town of Dryden allowed people
to park unlicensed vehicles on town property permanently . He has
a right - of - way but it belongs to the Towr, of Dryden .
Z . O . Slater, - did not consider the tractor trailer that is parked
there a vehicle .
J ack Ford - people that work in the stare are parked there in the
✓ oad r - o- w .
Helen Ford - some of the officials in the Town of Dryden have
✓ eceived her complaints starting in April regarding the horrible
mess that continues at Shew ' s . Shew ' s was obviously told that
something had to be dome because they did get a trash bin from
D oug ' s Trash Removal and for a very short while things were
picked up , not 100 percent but somewhat better than they had
been . However , it seems unless they are monitored on a continual
basis they become very slack and the unsightly mess becomes even
more so . If it were food it would be a real garbage dump with
✓ ats . What she wants to know is why Shew ' s can ' t keep its trash
confined and out of sight . The full length of the building from
the parking lot past the loading deck to the end of the building
411 has trash of some kind . The kitchen sink that was put out there
last June of 89 and was complained about has been

® relocated to between the wheels of a tractor trailer and
supposedly hidden from view , but you can see it . She wanted to
know what the point of all this mess is . Surely a small fraction
o f their profit can be used to take care of all this trash on a
biweekly basis so that it doesn ' t accumulate . They are the only
building in the area that flagrantly flaunts trash as if they
w ere flowers . She has been picking up their trash for years and
years and has finally given it up because they can afford to do
it themselves and they should . Why can ' t it be enforced because
it is a violation to have trash outside a building . It is
h orrible looking and she wants to know why it can ' t be stopped .
He has a responsibility to that area and he would not like that
trash in his own back yard and that is what it amounts to
Atty Perkins - there is a section in the town zoning ordinance
that states that all lots shall be kept free of vehicles which
are unregistered , or abandoned or inoperable , and shall be kept
free of trash , rubbish or junk .
H elen Ford ° she quoted that in her first letter to the town .
Atty Perkins - right now the maximum penalty for a violation in
the town is $> 100 . Oc0 and the board will be considering in the near
f uture to amend the zoning ordinance to provide for a maximum
f ine of $ 350 . 00 and up to 6 months in prison for the first
® violation . For the second violation the fine would not be less
than $ 350 . 00 nor more than $ 700 . 00 and up to 6 months in prison .
H elen Ford - wanted to knew if anybody in Dryden was going to
e nforce this against Dave Armstrong ?
S upv Schug - this is the first time he has heard about it at a
beard meeting .
H elen Ford - Henry has received a copy of the letter of her
complaint before .
Mark Stevens - when he owned the land and the town did not have
the right of way Dave kept the trailer up behind F & T
D istributors where they rented a spot . When he 1 ived at 9
O akbrook Dr . and owned the land Dave asked him if it would be all
✓ ight for him to move the trailer body up behind his store for
storage and he told Dave that if he had to use it he would have
t o keep it plowed out . Since the land has been deeded over it has
been sitting on town right of way property . It was moved up there
May 16th and he does use it for storage for his business .
S upv Schug - wanted to know if Henry has received other
complaints about the mess up there .

® L . O . Slater - no , other than the names that came on the one
petition that Mrs . Ford sent . No one else has ever mentioned it
He has reminded Dave from time to time that he has been getting
slack . He stopped today and one of his employees gave him a tour
and they have started to use the dumpster . They are baling their
cardboard and periodically taking it away . They have agreed that
they needed to be a little bit more timely in getting rid of the
cardboard . There is a man that comes and picks up the wood every
several weeks to use for firewood .
Helen Ford ° said that statement is wrong about the wood . The
trash bin is smaller than a store or apartment building would use
and they need a much larger one . She passes there twice a day and
sometimes more and it just stays there . What bothers her is not
in the dumpster , but what is lying can the ground outside the
place and blowing around .
Z . O . Slater -- they did commit to be more conscientious and keep
it under control .
S upv Schug - wanted Hwy Supt Gilbert to check the road r - o - w and
make sure that the trailer is not on town property .
Mark Stevens - there is not room for him to get the trailer bed
o n his property because it has to be 15 ft from the property line
® for storage .
Clrn Walbridge - wanted to know how many times Z . O . Slater has
been there since the letter he received in the spring ?
Z . O . Slater - this is the first time he has been out there , but
Clint has been out there twice and he has written to them as to
w hat was to be expected to be in compliance .
Clm Walbridge -- wanted to know if it was possible to get there
more often and make sure that if he needs a bigger dumpster make
sure the suggestion is made or fine him .
Z . G . Slater -- thought that he will either have to comply or a
✓ iolation letter will be sent and if need be turned over to the
court system . With the landfill situation you have to find a way
to dispose of the material and it has to be cut and baled to
certain specifications and delivered to the person who has agreed
to take it and does understand that this is a problem .
E rica Evans -• this is Going to be the law and we are all going to
h ave to do it whether we want to or not .

Helen Ford - he is not just a hoixeowneri he is making a profit
and certainly he can pay to have this cut , baled and removed . If
it were a home certainly Henry would be right out there slapping
then with a fine , but this is somebody who lives and is
a nociated with Dryden sQ people look the ether way and this is
✓ eally unfair .
[vlra Walbridge - is concerned that if he goes out and it looks as
though they are in compliance and the neighbors Come in with
pictures and complain she hopes that he will get out there to
keep checking .
Z . O . Slater - this is the first that he has heard from the Fords
since this spring so he thought everything had been taken care
of .
Helen Ford - there were abort 3 letters and she assumed Henry was
d oing his .job . She was waiting and really hoping that she would
n ot have to come and speak at a town meeting .
Clint C ';' t t er i l l - if you are going to treat everyone the same
✓ egarding violations and turn them over to court you will have to
triple the man power .
Supv Schug - the zoning officer has never been instructed to take
t hem to court , but that everyone is given a fair warning and an
opportunity to clean up the mess . After checking several times
and it is still not cleaned up then you will be forced to take
than to court . The neighbors are asking for a atop by and if you
f ind a mess , put than on notice .
t . p . Slater - Dave ham to come up with a better way to handle his
problem because he generates cardboard .
S upv Schug - that is his problem and your problem is to inform
h is that he had better fired a solution to this problem and keep
it cleaned up .
Tim Willard , Hall Moods Rd - gave the board a list of complaints
( copy in minute book ) . He would like to see something done
✓ egarding the drainage flaw before the spring run off comes . The
concern with the railroad has been destroyed ea that there is no
vegetation there and there is a 13 ft hole dug and debris is
blowing around and waanta to know who is responsible for the
restoration ?
S upv Schug -- anything that has been disturbed has to he put back
t o its original condition .
Jim Willard - it has been bulldorah and a number of shrub , are
gone . He went out them when dump trucks ware there and was told
that they didn ' t look closely enough at the plans to see where
the property line was . They gave hie the alternative that they

Dear Supervisor and Councilors ,
I have several comments, complaints, and questions to make on the Wilcox Press
project.
1 . ) We have complained before the town board several times about excessive water flows
• through the culvert under the railroad bed. In the site plan approval, the rate of flow was to
be restricted to the pre-construction rate during and after construction . Nothing has been
done to restrict flows , therefore they are in violation of their site plan approval .
2 . ) Our section of the railr4• . bed has been destroyed, who is responsible for restoration ?
3 .) There is a new structure in future wetland that, to the best of my knowledge, appears on
no previously approved site plan . What is it and should it be there ?
4.) Are they in compliance with the previously approved drainage plan ? I am not certain all
of the drain pipes present were there in previously approved drainage plans.
5 . ) Is the building height the approved level ? The only previous mention of height I've
managed to find is 33 ft.
6 .) October 4th and 5th are the most recent times debris from the site has blocked the road .
It would be nice if they could be more considerate of the residents who also require use of
the road.
7 . ) There are still occasional instances of violating the hours set down by the town board.
We would appreciate it if these questions could be investigated and answered . We
would especially appreciate it if the raih%d culvert could be taken care of as soon as
possible. This is an important safety issue for the residents and is also required by the site
plan approved by the town board.

Councilperson Walbridge offered the following resolution and
asked for its adoption :
RESOLVED , that the Town Board hold a Public Hearing on a proposed
amendment to the Town of Dryden Zoning Ordinance whereby Section
1804 of Article XVIII of the 'X' own of Dryden Zoning Ordinance would
be amended to read as follows :
Section 1804 . Enforcement and penalties . A violation of this
ordinance is hereby declared to be an offense , punishable by a fine
not exceeding three hundred fifty dollars or imprisonment for a
period not to exceed six months , or both for conviction of a first
offense ; for conviction of a second offense both of which were
committed within a period of five years , punishable by a fine not
less than three hundred fifty dollars nor more than seven hundred
dollars or imprisonment for a period not to exceed six months , or
both ; and , upon conviction for a third or subsequent offense all of
which were committed within a period of five years , punishable by
a fine not less than seven hundred dollars nor more than one
thousand dollars or imprisonment for a period not to exceed six
months , or both . Each week ' s continued violation shall constitute
a separate additional violation . In addition , the Town Board shall
have such other remedies as are provided by law to enforce the
provisions of this Ordinance .

Atty Perkins - at the request of the town board he has prepared a
proposed resolution which w i l l amend Section 1804 of the town
zoning ordinance . The present town ordinance does not comply with
the maximum penalty permitted under state law . The current fines
d o not offer sufficient deterrent . The current maximum fine is
$ 100 . 00 and each day shal 1 constitute a separate violation . The
proposed schedule of fine would be $ 350 . 00 or imprisonment not to
e xceed 6 months . A second offense within 5 years not less than
$ 330 . 00 nor exceed $ 700 . 00 or imprisonment not to exceed 6
months . He suggested that the town board schedule a public
h earing for the amendment to the ordinance because it adds

Atty Perkins - Cornell sewer line agreement ( bonding. authority )
W hen there is an agreement with Cornell and a set of plans
approved by Cornell you will have to adopt under the proceedings
of Town Law Section 202b which will put in place the bonding
authority for us to go ahead with that project . You should
consider if this should be a joint project with the Varna and
Monkey Run sewer district .
Atty Perkins -- Turkey Hill water and sewer district update . He
h as been working on it and gathering information for the
responses to their concerns and he would hope to have everything
in the next 30 days to mail to them and then we will have to wait
® for their response as to what we submitted .

Atty Perkins ". Al Electric , contract D which had to do with
certain improvements to Monkey Run water district included
providing telernetering to keep the tank filled automatically . It
h as finally been completed . There was a problem with the
t elemetering equipment and was taken out and repaired . It now has
been installed and has been working since June 8th . Our engineers
h ave signed off but there were a couple of technical corrections
to the closeout documents . They are recommending final payment at
such time the town has those corrected documents . Such as they
provide the corrected release of the waiver of lease and they
provide the maintenance bond in the amount of $ 30 , 000 . 00 which is
good until June 8 , 1991 .

George Schlecht -• permanent stakes would be iron bars and when
they did the survey originally it was contemplated that you would
be in the construction season so they ran control lines up the
center of the road and scat spikes . It has already gone through

of those points will not last . He can do it for what was in the

to rebuild the whole road than there might not be enought money

minute book ) . The engineers recommend that the bid be awarded to
F G Cortipagni and that the Supv be authorized to sign the notice
o f award and a transmittal letter to them with a notice to
proceed . The contract does provide that the waterline work will
be dome by Dec- 15 1990 which will allow sufficient pressure at
t he Wilcox site for the testing of their system together with
their on pump house . The actual tank will not be completed until
the spring of 1991 .

G eorge Schlecht - thought that it was the intention of Wilcox
P ress as part of their as built to show how it was changed on
their property . We changed our plans to conform with their design
as it is now on the new Hal 1 Rd .
ZONING OFFICER - report giver, to board members
7 . 0 . Slater -° Wilcox Press and Hi - Speed Checkweigher want to know
what provisions they will have to meet in order to take temporary
occupancy of certain sections of their buildings because the
transferral of their business is from one location to another and
w ill have to be staged . Hi - Speed Checkweigher is looking at the
e nd of this year and Wilcox Press is looking at about February .
S upv Schug Henry should put together a report where Wilcox
P ress would have 2 years to comply with the Army Corp permit so
that the board knows what you are giving there as a certificate of
temporary occupancy and this would have to be realistic with the
state criteria .
Z . Q . Slater - everything relative to fire safety and the general
d ay to day use of that occupancy has to be in 100 percent

compliance . The offices will be the last thing that they shut
d own .
Clm Walbridge - the board has to consider the drainage plan and
that they shouldn ' t be given a temporary certificate of occupancy
w ithout the drainage plan in and working . Also she wants to make
sure that a list of chemicals has been given to the Varna Fire
D ept .
Supv Schug -- Wilcox Press and Hi --- Speed Checkweigher should be
giving Henry a time table on each department . Some of the things
h ave been done , but you should consider drainage , fire , water ,
sewer parking lot , grading , paving o r a gravel road to
the
building they are going to use so that it is accessible by the
f ire department . Also will the sprinkler system be hooked up and
w orking before they put the bindery in .
Z . O . Slater -- those things have to be on line in the areas where
they are going to use them .
S upv Schug - you should use these items of concern and have them
addressed with what items you feel is required for the town so
t hat you can safely issue a temporary certificate of occupancy
for that portion of the building .
Z . 0 . Slater -- he will have something in draft form for the board
to look at on Oct 23rd or Nov 1st making sure you see what is
g oing to be done before any occupancy is permitted . He will ask
for a time table from Wilcox Press and Hi - Speed Checkweigher .

Marvin English 1900 Hanshaw Road Violations , trash and
® unlicensed motor vehicles . There has been one further
development with this case . The Dryden Town Court has
set an appearance date of 10 / 4 / 90 . We ' ll be able to
u pdate you at this case at the Town Board Meeting .
Unsafe structures :
I ' rn very happy to report that both of the yarn Barns on
Midline Road have been properly removed and the
✓ esulting cellar / pits have been acceptably filled in .
We also find , the Mix Barn is totally down and has been
properly removed from the site to an approved disposal
site . The resulting cellar / pit has been properly
filled in as well .
The Wilcox Buffer Planting have been Sited and
installed . On October 19th , the appointed group meet on
the old rail road for the staking . This went very well ,
in fact , it went so well that once the initial sitting
was completed ; there were some trees left over which
w ere placed to further improve the overall density . The
trees arrived the follow day and were immediately
planted . If you would like to review the installation ,
the best place to do so would be from the Hall Woods
® Road end . There is sufficient parking room near the
e ntrance and one needs to do is walk along the trail .
Normal footwear should be sufficient .
S tetson Case , George Stetson has once again been
✓ escheduled for a later date . As you may or may not
✓ ecall , an October End Trial had been set for his
u nauthorized placement of a home made double - wide mobile
h ome on Pone plain Rooad Freev i l l e , New York . However ,
d ue to technical error , that appearance will require
✓ escheduling . At this time , I ' ve not been informed as to
w hen that will be . I ' l l keep you posted .

P lease be advised that this office is in receipt and several
written complaints and videocassette which established that
you are using a portion _o f your personal property as a
private air field which is a violation of the Dryden Town
Zoning Ordinance Section 750 , allowed uses for R . 13 . °• 1 Zoning
Districts .
As you will recall , on February 7th , 1989 , you attended a
public hearing , which part cif , was a request from you for a
variance to establish a air field for private use by
yourself . As you will further recall , that request was
denied . Use of the field is a violation of section 1902 . 3 , a
decision of the Zoning Board of Appeals .
As you will also recall , on September 14th , 1989 , Town
Attorney Mahlon R . Perkins , sent to you , a letter outlining
the necessary steps required to establish a private air
. field . The direction was very clear . I have attached a copy
of that communication , as well as a copy of a communication
for the Commissioner of Transportatior, which directed you to
make a couple of site improvements to the purposed site
prior to their approval of your air field . Again , you ' ll
find that you are not in compliance with that direction .
L astly , I would inform you , that any further violation of
any of the above issues will result . in a court appearance
citation form this office and direct notification to the
Commissioner of Transportation of all violations regarding
the use of this unauthorized air field .

At the request of Supervisor Cotterill , I have reviewed the
L anding Area Proposal which has been received by the Town of
D ryden .
It appears that there are two procedural requirements which
now need to be addressed . The first is that you will
apparently have to obtain a variance of Section 751 of the
Town of Dryden Zoning Ordinance . The establishment of a
private landing area is not an allowed use in your zoning
district . You should contact the Code Enforcement Officer ,
® Henry Slater , for the procedures to be followed to obtain
the zoning variance .
Assuming that the variance is granted , the next step would
be for the Town of Dryden to request the New York State
Commissioner of Transportation to determine whether or not
the establishment of the airport complies with the
applicable standards . In connection with that determination
the Town will request that a hearing be conducted by the
Commissioner .
Prior to that hearing we will need a statement from you that
the airport will be privately owned and that all of the
owners of the land on which the airport will be situated
have consented to its establishment . -

• This determination does not mean Federal Aviation Administration
( FAA ) approval of the physical development involved in the
proposal , nor that the proposed action is environmentally
acceptable in accordance with applicable public laws . It is only
a determination with respect to the safe and efficient use of
airspace by aircraft . In making this determination , the FAA has
considered matters such as the effect the proposal would have on
existing or contemplated traffic patterns of neighboring
airports , the effects it would have on the existing airspace
• structures and projected programs of the FAA , and the effects
that existing or proposed man- made objects and natural objects
within the affected area ( insofar as they are included on your
� . 7480 - 1 or available on maps and drawings in this office ) would
have on the airport proposal . This determination , issued in
accordance with FAR Part 157 , does not relieve the proponent of
any compliance responsibilities relating to any law , ordinance ,
or regulation of any Federal , State or local governmental body .
Please complete and mail the enclosed FAA Form 5010 - 5 to the
office noted on the form ( with a copy to this office ) when
heliport operations begin : it advises us that the airport is
�4110 active and your airspace determination will become permanent .
FAILURE TO DO SO WILL' . CAUSE YOUR AIRSPACE DETERMINATION TO EXPIRE
a ON THE DATE INDICATED ABOVE . If the airport is not activated
prior to this date , you should request a time extension to allow
for completion . If you do not , we will assume that the proposal
has been abandoned and your airspace will be canceled .

their support .
G eorge Schlecht - regarding the Adult Care Facility he reminded
the architect that he has not seen any detailed map of the sewer
lines and he told them if they felt that they could build the
sewer lines without a review fine , but the town would not accept
t hem . He still has not seen then . He recommended that they not
✓ eceive a building permit until the sewer lines have been
reviewed by the town .
S upv Schug - wrote a letter to NYSDOT contractors working on Rt
13 and Rt 366 and Pinckney Road . They need a letter stating that
the town would stripe the roads . The road between NYSE &• G and
J im ' s Place has now been repaved and will be in good shape for
w hen it is turned over to the town .
