TOWN BOARD MEETING
SEPTEMBER 6 , 1990

Supv Schug - called the meeting to order at 7 : 30PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk :
P resent : Supv Schug , Clm Roberts , Clm Walbridge , Clm
H atfield , Clm Corrigan , Atty Perkins and Z . 0 . Slater
APPROVAL_ OF THE MINUTES
Motion was made by Clm Roberts and seconded by Clm Corrigan that
the minutes of the July 24 , 1990 be approved as submitted .
Motion was made by Clm Roberts and seconded by Clm Hatfield that
the minutes of the August 14 , 1990 be approved as submitted .
CITIZEN PRIVILEGE OF THE FLOOR
B ill Bailey from Bailey Insurance - gave written report to board
members and went over some of the different plans for the town .
H e would 1 ike to try and get an umbrella quotation of 2 or
million dollars on top of the 1 million that the town now has .
This has been unavailable to municipalities until the last
several months . When he gets the information he would like to
® present the town a quote .
S upv Schug -- would like Bill to get a quote regarding the
underground tanks as soon as possible .
COUNTY BRIEFING
Co . Rep Watros - the county is working on their budget and they
figure on a 10 percent increase in the levy
Co . Rep Evans - reported on DR7 that a member of the Army Corp of
E ngineers is going to rule that they had jurisdiction over the
wet lands on DR7 . He feels that the county should start looking at
other sites and will do what he can to get that moving . The
County voted on giving the option of splitting the tax bill in
partial payments which he did not support because he felt that it
was a trap .
S upv Schug - he received a letter near the end of August from
K athy West stating that a resolution has to be adopted by the
t own board no later than October 1 , 1990 . He asked Atty Perkins
to write and ask for an extension of time since the board has not
h ad time to really study the resolution .
Co . Rep Watros - did not see any problem with that . The whole
board did not totally support it but now Mr . Shurtleff has swayed
the majority of the board in his favor . His concern and several

41, ether board members felt that they were getting into the business
of managing other peoples money .
— Mr . Waltman wants to get out of the political controversy with
the soil testing at the DR7 site . Co . Rep Watros feels that now
they are going to have difficulty with getting a panel of experts
that wi 11 be satisfactory to both points of view .
Co . Rep Evans - he feels there is support on the board to make
sure that it w i l l be a reasonable review . The county board also
✓ oted to raise the cost of the trash tags to LSO a tag .
Clrn Walbridge - wanted to knew if they have extended the time for
L ar, dstrom to stay open .
Co . Rep Evans - the county is saying 3 years , but could be up to
5 or 6 years .
CITIZEN PRIVILEGE OF THE FLOOR
Bob Watros - representing Centel Telephone Co . -° in talking with
their engineering dept . and they are going to look at a proposal
that would involve underground service near the West Dryden
Community Center . There does seem to be a series of buried
culverts adjacent to the old church property which their cable
might be in the way if the culverts have to be replaced . They are
® taking a second look at will get back to Supv Schug .
ATTORNEY
Atty Perkins - Z . 0 . Slater would like him to prosecute George
S tetscor, in the Town of Dryden Justice Court on the unlawful
trailers on Bone Plain Rd .
RESOLUTION # 225 STETSON PROPERTY
ZONING ORDINANCE VIOLATIONSM
Clrn Walbridge offered the following resolution and asked for its
adoption :
RESOLVED , that this Town Board authorize Atty Perkins to take all
n ecessary procedures in representing the Town of Dryden in
J ust ice Court against George Stetson for zoning violations .
2nd C1m Hatfield Roll call vote - all voting Yes
S upv Schug - scheduled meeting on Sept 20th at 7 : 00PM for Mark
S tevens application . He asked Z . O . Slater to have a notice put in
the paper and to notify all of the neighbors and residents that
w ere here at the time of the hearing .
Town Engineer -° w i l l meet with T G Miller tomorrow so then we
will be able to have a report regarding Wilcox drainage under new
411 Hall Rd and drainage on site to Hall Woods Rd .

Town Engineer Schlecht - recommended that at the present time the
town not take any action for the culvert under Hall Woods Rd
since there is no eminent danger to the road or property at the
present t irne .
J im Willard - thought there is concern there after the rain
storms they have had the water level came almost all the way
across the road . There was a provision that during construction
they were supposed to control the run off and one of the aspects
was to reduce the pipe size .
S upv Schug - said that he would follow up on that .
ZONING OFFICER - report given to board members .
Z . O . Slater -- reported that at the t irne of the staking for the
plantings of the buffer zone at the Wilcox site Kathy Wolf would
like a representative from the neighborhood near Wilcox Press , a
town board member or someone from the zoning office to be
present . It was decided that Jim Willard , and Z . O . Slater would
be present at the time of staking for the trees and elm Walbridge
if needed and was available .
Z . O . Slater - the English zoning violation is in the court
process at the present time . Unsafe structure for Varn is no
action will be taken until Oct . 1st . If no action is taken by Oct
1st Hwy Supt Gilbert will get bids for removal and dispose of the
® unsafe structure on the Varn property with expenses added to his
tax bill .
Z . O . Slater - regarding Al Pizza Jack Baker will be making a
f ormal application since there was a misunderstanding about the
drive up window and the way it was presented at the public
h earing .
S upv Schug -- NYSE & G is changing their driveway and since there
was no building Henry did not ask for site plan approval and
should have since there would be drainage involved . Henry is in
the process of asking NYSE & G as to how they are handling the
d ownstream drainage . A question was also raised about what will
happen when they flush the water tank behind NYSE & G . He thought
that the drainage problem should be addressed .
Atty Perkins -- wanted to know if NYSE & G received site plan
approval when they made their addition and the revised parking
lot was not part of that application .
Z . U . Slater -- at that time they indicated there was no change in
capacity of workers and they did not proposed to do anything with
the parking lot . NYSE & G did contact him to see if they needed to
d o anything when they changed their parking lot . They did not say
they were changing the size so he did not feel that it would be
covered under the site plan review .

It was a pleasure talking to you the other night at the Town
board meeting .
At the conclusion of the meeting X understood that you were
planning on sending me prints of the site plan details . As yet I
h ave not received them .
Perhaps you have already delivered the plans to the Town
O ffice although I ' ve checked with Henry Slater and he does not
believe so . If not , would you please let me know when we may be
receiving the necessary details .
Also , have you had any luck in talking to New York State
Electric and Gas to clarify why they feel the need for installing
primary service at this location ?

RESOLUTION # 2 2. 6 RESCIND RESOLUTION! fi t EEC,
Cirn Hatfield offered the following resolution and asked for its
adoption :
RESOLVED , that this Town Board rescind Resolution 0206 accepting
the trailer bid .
2nd Clm Walbridge Roll call vote a all voting Yes
S upv Schuq - there was a request from Hwy Supt to install a
computerized time clock for the highway department not to exceed
$ 1 , 500 . 00 . It would give a computer print out of time and total
hours worked .
Clm Carrigan -- questioned what it had for hard copies for his
record and would like to look into this time clock a little more
before she makes a decision .
HIGHWAY INVENTORY - copy in minute bock.
Hwy Supt Gilbert - questioned leave of absence for active duty
f or people in the reserves . The town policy is active reserve
d uty the town will reimburse the town employee for the difference
between wages the employee earns while on active reserve duty and
their normal wages . It does not state any length of time and he
was concerned about that if they were called to active duty .
Clm Corrigan - she would check but after a certain length of time
you become subject to a state military law .
H wy Supt Gilbert -- he received two bids on a loader which has to
be acted can within 30 days . They were opened on Aug 13th
Clm Walbridge - wanted to know if it could be acted upon to
accept the bid subject to Atty Perkins approval ?
Motion was made by Clm Walbridge that this Town Board accept the
low bid for a John Deere loader .
Harold Shoemaker from Syracuse Supply said that they submitted
the lowest bid that met specifications . Their delivery date was
set up on a 10 day delivery and based on the award and acceptance
of the machine that is when the clock would start running on the
lease agreement . If he delivered his machine the same day they
d elivered their machine his machine and interest rate is less , so
h is would be the lowest bid as far as payments , trade difference
and total cost .
Clm Roberts - wanted to knew if he was tel about a 1989 or
1990 machine .

S ection 1 . Pursuant to the provisions of section eight hundred
six of the General Municipal Law , the Town Board of the Town of
D ryden recognizes that there are rules of ethical conduct for
public officers and employees which must be observed if a high
degree of moral conduct is to be obtained and if public
confidence is to be maintained in local government . It is the
purpose of this resolution to establish a code of ethics for the
o fficers and employees of the Town of Dryden . These rules shall
serve as a guide for official conduct of the officers and
employees of the Town of Dryden . The rules of ethical conduct of
this code ee adopted , shall not conflict with , but shall be in
addition to any prohibition of article eighteen of the General
Municipal Law or any other general or special law relating to
ethical conduct and interest in contracts of municipal officers
and employees .
S ection 2 . Definition . ( a ) " Municipal Officer or Employee " means
are officer or employee at the Town of Dryden , whether paid or
o npaid , including members of any administrative board ,
commission or outer agency thereof . On person shell be deemed to
be a municipal officer or employee solely by reason of being a
volunteer fireman or civil defense volunteer , except a chief
engineer or assistant chief engineer .
( h ) ^ Interest " means a pecuniary or material benefit accruing to
a municipal officer or employee unless the context otherwise
requires .
S ection 3 . Standards of Conduct . Every officer or employee of
the Town of Dryden shell be subject to and abide by the
following standards of conduct .:
( e ) Gifts . They shall not directly or indirectly , solicit
any gift : nor accept any gift having a value of seventy - five
d ollars or more , whether in the form of money , services , loan ,
t ravel , entertainment , hospitality , thing or promise , or any
o ther form , under circumstances in which it could reasonably be
inferred that the gilt was intended to influence them , or could
reasonably he expected to influence them , in the performance of
t heir official duties or was intended as a reward for any
o fficial action on their part .
( b ) Confidential Information . They shall not disclose
confidential informations acquired by them in the course of their
o fficial duties or use such information to further their
personal interest ,
( e ) Representation before one ' s own ace00r . They shall not
receive , or enter into any agreement , express or implied , for
compensation far services to be rendered in relation to any
matter before any municipal agency over which they have
jurisdiction or to which they have the power to appoint any
member , officer or employee ,

( ci ) Representation before any agency for a contingent , fee .
46 They shall not receive . or enter into any agreement , express or
implied for compensation for services to be rendered in relation
t o any matter before any agency of the Town , whereby their
compensation is to be dependent or contingent upon any action by

paragraph shall not prohibit the fixing at any time of fees
based upon the reasonable value of the services rendered .
le ) Disclosure of interest in legislation . To the extent
t hat they know thereof , a member of the Torn Board and any
o fficer or employee of the Town of Dryden , whether paid or
u npaid , who participates in the discussion or gives official
o pinion to the Town Board on any legislation before the Town .
B oard shall publicly disclose on the official record the nature
and extent of any direct or indirect financial or other private
interest they may have in such legislation .
( f ) Investments in conflict with official duties . They shall
n ot invest nor hold any investment directly or indirectly in any
f inancial business , commercial or other private transaction ,
which creates a conflict with their official duties .
( g ) Private Employment _ They shall not engage in , solicit ,
n egotiate for or promise to accept private employment or render
services for private interests when such employment or service
creates a conflict with or impairs the proper discharge of their
o fficial duties .
( h ) Future employment . They shall not , after the termination
of service or employment with such municipality , appear before
any board or agency of the Town of Dryden in relation to any
case , proceeding or application in which they personally
participated during the period of their service of employment or
w hich was under their active Consideration .
S ection 4 , Nothing herein shall be deemed to bar or prevent the
t imely filing by a present or former municipal officer or
e mployee of any claim , account , demand or suit against the Town
of Dryden , or any agency hereto on behalf of themselves or any
member of their family arising out of any personal injury or
property damage or for any laaiui benefit authorized or
permitted by law .
Section 5 . Distribution of Code of Ethics . The Town Supervisor
o f the Town of Dryden shall cause a copy of this Code of Ethics
t o he distributed to every officer and employee of the Town of
D ryden within 10 daps after the effective date of this
✓ esolution . Each officer and employee elected or appointed
thereafter shall be furnished a copy before entering upon the
duties of their office or employment .
S ection E . Penalties . In addition to any penalty - contained in
any other provision of law , any person who shall knowingly and
intentionally violate any of the provisions of this code may be
li suspended or removed from office or employment , as the case may
be , in the manner provided by law .
Section 7 . Effective Date . This resolution shall take effect
immediately ,

Marvin English 1900 Hanshaw Road Violations , trash and
u nlicensed motor vehicles . The daughter of Mr . English ,
w hom was going to take charge of the violations , but did
n ot , therefore , we have turned this case over to the
D ryden Town Court for further action .
Also , I would 5a0 no reason to assume that . the P_ court
w ill have riy better luck with this than I have ,
therefore , I would assume that Attorney Perkins , should
proceed with his suggested path of pursuit .
Unsafe structures :
As of this date , no further action has been taken by
Ralph Varn to remove his barns on the M i d l i ne Road . I
believe , that the Town should consider removal of this
structure .
As of this date , the Mix Barn is totally down and is in
the process of being removed from the site to an

tentative budget will probably raise the sewer rates by about 4
percent .
