FEBRUARY 13 , 1990
PUBLIC HEARING
LOCAL LAW # 1 - 1990
D eputy Supv Hatfield called the meeting to order at 7 : 30PM
Atty Perkins read the notice that was published in the
n ewspaper concerning Local Law # 1 - 1990 ( copy in minute book )

Members and Quests participated in the Pledge of Allegiance
Roll call was by the Town Clerk :
Present : Deputy Super Hatfield , Clay Roberts , Clm Walbridge ,
Clm Corrigan , Atty Perkin !( and Z . D . Slater
Absent : Supv Schug
Approval of the minutess
Motion was made by Clrn Walbridge and seconded by Clm Corrigan
that the minutes of the Town Board meetings held Dec 21st , Dec
28th , and Site Plan Review hearings held Dec a'' ist and Dec 28 be
approved as submitted . Roll call vote -- Clm Walbridge , Clm
Corr i. gars and Deputy Supv Hatfield YES - Clm Robert s -
abstained
. Motion was made by Clm Roberts and seconded by Clm Corrigan that
the minutes of the Town Bard meetings held Jan 2nd , Jan 9th and
S ite Plan Review hearing held Jan 9th be approved as submitted .

D eputy Supv Hatfield appointed Clm Walbridge to audit the
general fund and special district bills
COUNTY FRIEFING
Co Rep Wat ros - there was approval of distribution of $ 1700 . 00
o f dog funds which will come to the Town of Dryden . Also there
w ill be a revaluation program where they will place current
market va1 ues on properties this year . It will impact on the
evaluation of everyone ' s property in Tompkins County . There
w ill be an established procedure which will involve grievance
d ay to allow per p l e to come forth . The Town Boards will be
instrumental in hearing those concerns and making any
adjustments or corrections to the initial process . He will have
more information by the next board meeting . The current assessed
✓ alue is about + 0 per cent of the current market value .
Co Rep Evans -- recommended that when the new tax amount is sent
out that they include the amount of what the new tax computation
w ould be based upon the current years rate so that you would get
a chance to see what the change really was . Also there is a
proposed county law public hearing on Feb 26th which will make
it illegal to dump refuse and trash anywhere in the

N OTICE OF PUBLIC HEARING ON PROPOSED LOCAL LAW NO . 1 OF THE
YEAR 1990 WHICH AMENDS TOWN OF DRYDEN LOCAL LAW NO . 2 OF THE
YEAR 1989 ( A Local Law Establishing the Sewer Rent Law for
D ryden Sewer District # 2 )
LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the
Town of Dryden will hold a public hearing at the Town Hall ,
65 East Main Street , Dryden , New York , on the 13th day of
February , 1990 , at 7 : 30 o ' clock p . m . prevailing time , to
hear all interested parties and citizens for or against the
proposed amendment to such Local Law . The proposed amend -
ment amends Paragraph 5 b ) of such law to read as follows :
5 . b ) Based upon the water usage , the calculation of
the sewer rent shall be made by multiplying the number of
gallons consumed in the billing period by $ . 16 per 100
g allons . The product shall be the base sewer rent for the
billing period .

County . The fines for the first time will be from $ S0 . 0O to
$ 250 . 00 . It will allow that if you find trash dumped on your
property and report it and as long as you assist in finding out
who dumped it there you will not be liable to take it away . The
County is hiring a new deputy sheriff to enforce this law. and
there will be a clerk to answer the phone for complaints .
fltty Perkins - wrote a response to the County attorneys request
stating his concerns about the local law . Much were procedural
and questions of constitutionality . The question is why 1s it a
less of are offense to thlrmp unlawfully in the landfill than
outside the landfill . ft seems to him that whoever the host
community is has a real concern to make sure the people don ' t
d ump illegally in the landfill . You have only made that a
Co Rep Evans - his understanding was that nobody was to dump in
the landfill .
Fatty Perkins - there will be C 3' D material .
Co Rep Evans - so far there is , but he will do the best he can
to have that resolved and this has yet to come out from the
public works committee .
Atty Perkins - but you have provided that this is a separate
offense and his question is why is it in lesser offense . It shall
be unlawful fur any person to dispose of solid waste on the
premises of any solid waste facility operated by the County of
Tompkins in violation of any rules , regulations promulgated by
the Tompkins County Solid Waste manager or designee . He would
presume that would mean at the central processing facility or at
the landfill proper .
h e Rep Evans - one would presume that you were allowed to
dispose of it when you take it to the central processing .
Atty Perkins - it is only e violation for someone unlawfully to
d ispose of something at the central processing facility , whereby
if they leave it at the roadside it is misdemeanor . He wants to
know what the rational for the distinction is . What if it is
radioactive material , or hazardous material that its not suitable
for disposal at the landfill .
h e Rep Evans - will he everything he can to get this cleared up .

h er Tillepaugh - If someone finds illegally dumped garbage on
their property and they report it and you can ' t find out who

disposing of that garbage '?

RESOLUTION NO . 87 ( 1990 )
® Councilperson Roberts offered the following
resolution and asked for its adoption :
WHEREAS , Tompkins County selected what is known as DR - 7 as a
preferred landfill site in December 1987 as the site for a new
Tompkins County Landfill , and
W HEREAS , diverse problems with respect to the site including
t he presence of protectible freshwater wetlands under the
jurisdiction of both the Army Corps of Engineers and the Town of
Dryden have been identified on the site including in areas which
constitute some of the proposed active cells , and
W HEREAS , the County has not been able to pursue diligently
its application for a Permit to construct and operate a landfill
o n the DR - 7 site due to technical problems associated with the
hydrogeology , soil conditions and freshwater wetlands present on
the site , and
WHEREAS , there are more suitable sites available within the
County and outside the Town of Dryden , and
WHEREAS , the Town of Dryden has previously been host to a
County run landfill which landfill is near the DR - 7 site , and
® WHEREAS , continued delay by the County in constructing a new
landfill will prove even more costly to all of the taxpayers of
the County especially if the County is unable to obtain the
necessary Permit to operate and construct a new landfill on the
DR - 7 site , and
WHEREAS , there comes a time in all processees when a serious
e valuation of reasonable alternatives becomes necessary due to
continuing problems with design , location , constructability and
e conomic feasability as well as the ability to have a site and
design approved by the New York Department of Environmental
Conservation ,
NOW , THEREFORE , BE IT RESOLVED by the Town Board of the Town
of Dryden as follows :
1 . That the Town Board hereby respectfully requests that
t he Tompkins County Board of Representatives begin immediately
t he search for a more suitable and appropriate site for the
County ' s landfill .
2 . That such search be limited to areas outside the Town of
D ryden and areas which will not present the inherent problems
associated with the DR - 7 site such as a high watertable ,
including standing water and the presence of freshwater wetlands .
® 3 . Town of Dryden Representatives Watros and Evans be
✓ equested to present such a resolution to the Tompkins County
Board of Representatives for its consideration without further
delay .

Co Rep Evans -.. his understanding is if you are willing to assist
in finding out who did it that you will not be responsible for
the disposal of that trash .
Ken Tillaptugh - if someone drops garbage off on his land he
does not feel responsible for finding out who did it and taking
care of the garbage .
Atty Perkins - the proposed local law states that it is a
d efense to the prosecution of this section that the owner has
provided written notice to the Tompkins County Solid Waste
manager that solid waste has been unlawfully been deposited on
its property . It does not seem to require anyone assisting in
finding out who did it . The question still remains about
removal .
Bu = n Lavine was present and reported that he will be the liaison
between the Dryden Town Board and the Tompkins County Planning
P oard and will help out in anyway that he can .

Attar Perkins T would like the Town Board to consider closing the
hearing on proposed Local Law P1 - 199O and taking act ion .
Deputy Supv Hatfield - closed the public hearing on proposed
L ocal Law # 1 - 1990 .

asking the County to begin without further delay to look for
another landfill site .

Rtty Perkins - Board members have a copy of proposed resolutions
which would approve respectively the Turkey Hill Water" and Sewer
D istricts . The copies have the legal description attached to
t hem which has been a part of the study from the beginning .
P lease notice that on page 2 in the middle of the paragraph that
it reflects that the Dryden Town Board held the public hearing
at the 'Varna Community Center as opposed to the Dryden Town
H all . The Town Board has appropriated a sure of money to study,

• the creation of the water and sewer, district d You received last
fall the engineering report , and you scheduled and held a public
hearing . Now you need to approve the resolution establishing the
formation of the water and sewer districts . Each resolution
would be subject to a permissive referendum . After the
resolution is adopted the people within the district have the
right to petition the Town Board to hold a public vote on the
establishment of the Turkey H i l l Water and / or Turkey Hill Sewer
Dist . The petition pest be legally sufficient , it must be in
proper form and must be filed within 30 days of the Town Board
action . Within 44 days of the filing of the petition , if it is
legally sufficient and has the required number of signatures you
must hold a special election on the question of shall the Turkey
H ill District be established pursuant to the resolution of the
Town Board made an Feb 13th . At that election it takes a
majority of those voting to approve that . if it in approved at
the election then an application if that with the State
Comptroller for permission to establish the districts . If the
S tate Comptroller grants the permission they adopt an order and
send it back to the Town . The Town would then adopt a final
order establishing the districts . If the resolution is not
approved at the special election you may then go back and make
changes in the plan , district boundaries or in the improvements
an you may Na nothing .

Clm Corrigan - is concerned that the procedure is clearly and
completely understood by the people in the proposed district an
they can do what they need to do either for or against .
Rtty Perkins - by law the Town Clerk is required to have a
supply of petitions available . The farms have been prepared in
anticipation of your actions of some time . They do not yet have
the data of the resolution but the Town Clerk will have the
supply of forma on Feb 14th .

o pinions in writing from citizens against and predated before
the passing of the resolution . These are no good , is that

RESOLUTION DATED FEBRUARY 13 , 1990 .
A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATIoN
TO AND APPROVING THE ESTABLISHMENT OF THE TURKEY HILL
WATER DISTRICT OF THE TOWN OF D RYD EN , TOMP I N S COUNTY ,
NEW YORK , PURSUANT TO ARTICLE 12 -A OF THE TOWN LAW .
WHEREAS , a map , plan and report have been prepared in such
manner and in such detail as has heretofore been determined by
t he Town Board of the Town of Dryden , Tompkins County , New
York , relating to the establishment the Turkey Hill Water
D istrict ; and
WHEREAS , said map , plan and report were prepared by a
competent engineer , duly licensed by the State of New York , and
h ave been filed in the office of the Town Clerk of said Town ,
where the same are available during regular office hours for
examination by any persons. interested in the subject matter
t hereof ; and
WHEREAS . said Water District shall be bounded and described
as hereinafter set forth ; and
WHEREAS , the improvement proposed for said Water District
consists of the purchase and installation of approximately
10 , 700 linear feet of 12 - inch water main , 1 , 700 linear feet of
8 - inch water main , 1 , 950 linear feet of 6 - inch water main ,
3 , 000 linear feet of service tubing , and a 100 , 000 gallon water
storage tank , together with hydrants , gate valves and other
necessary appurtenances required in connection therewith , as
more fully described in the aforesaid map , plan and report ; and
WHEREAS , the maximum amount proposed to be expended for
said improvement is $ 990 , 000 ; and

WI REAS , the proposed method of financing the cost of said
410 improvement is by the issuance of serial bonds of the said Town
having a maximum maturity of not exceeding forty years . and the
cost of said improvement shall be assessed , levied and
collected from the several lots and parcels of land within such
I. ' Water District in just proportion to the amount of benefit
which said water improvement shall confer upon said lots or
parcels ; and
WHEREAS , an order was duly adopted by said Town Board 'on
January 9 , 1990 , reciting a description of the boundaries of
said proposed Water District , the improvements proposed , the
maximum amount proposed to be expended for said improvements ,
the fact that said map , plan and report were on file in the
Town Clerk ' s office for public inspection and specifying the
410 24th day of January , 1990 , at 7 : 30 o ' clock P . M . , Prevailing
Time r at the Varna Community Center in said Town , as
t he time when and the place where said Town Board would meet
for the purpose of holding a public hearing to consider the
e stablishment of said Water District and said map , plan and
✓ eport filed in relation thereto and to hear all persons
interested in the subject thereof concerning the same ;

Section 1 . Upon the evidence given at the aforesaid public

A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION
TO AND APPROVING THE ESTABLISHMENT OF THE TURKEY HILL
SEWER DISTRICT OF THE TOWN OF DRYDEN , TOMPKINS COUNTY ,
NEW YORK , PURSUANT TO ARTICLE 12 - A OF THE TOWN LAW .
WHEREAS , a map , plan and report have been prepared in such
manner and in such detail as has heretofore been determined by
the Town Board of the To of Dryden , Tompkins County , New
York , relating to the establishment the Turkey Hill Sewer
District ; and
WHEREAS , said map , plan and report were prepared by a
competent engineer , duly licensed by the State of New York , and
have been filed in the office of the Town Clerk of said Town ,
where the same are available during regular office hours for
® examination by any persons interested in the subject matter
thereof ; and
WHEREAS , said Sewer District shall be bounded and described
as hereinafter set forth ; and
WHEREAS , the improvement proposed for said Sewer District
consists of the purchase of additional treatment plant capacity
at the City of Ithaca wastewater treatment plant and the
purchase and installation of approximately 16 ; 400 linear feet
of 8 - inch diameter gravity sewer collection main together with
necessary related appurtenances , and one pump station with
force main , as more fully described in the aforesaid map , plan
and report ; and
WHEREAS , the maximum amount proposed to be expended for
® said improvement is $ 990 , 000 ; and

WHEREAS , the proposed method of financing the cost of said
411 improvement is by the issuance of serial bonds of the said Town
having a maximum maturity of not exceeding forty years , and the
cost of said improvement shall be assessed , levied and

which said sewer improvement shall confer upon said lots or
parcels ; and
WHEREAS , an order was duly adopted by said Town Board $n
January 9 , 1990 , reciting a description of the boundaries of
said proposed Sewer District , the improvements proposed , the
maximum amount proposed to be expended for said improvements ,
the fact that said map , plan and report were on file in the
Town Clerk ' s office for public inspection and specifying the
24th day of January , 1990 , at 7 : 30 o ' clnr, k P . M . , Prevailing
Time , at the Varna Community Center in said Town , as
the time when and the place where said Town Board would meet
• for the purpose of holding a public hearing to consider the
establish .nent of said Sewer District and said map , plan and

Ptty Perkins - distributed to the Board members a memorandum on
the engineering proposal as proposed by the Village with respect
to the village wastewater treatment plant .
Ptty Perkins - reported on the status of litigation that was
referred to the Town Attorney for prosecution . The people of the
State of New York on Thomas hoohat was resolved by a plea of
guilty and was fined a maximum fine by the town ,justice and was

further sentenced to remove the offending vehicles within 30
days . One charge against him was dismissed . He has two other
matters that involve litigation for executive session .

There were 2 Cases involving charge or construction
& conservation violations sent to the .Local court .

410 The Zoning Office has also started serving notices to a new section of
the Town concerning unregistered motor vehicles . As i. s normally the
case , there are many such violations ; and the owners claim to be
u naware of the Town Ordinance prohibiting such vehicles . We do find ,
that for the most part , the owners are compling with our orders to
✓ emove or comply by the other approved means .
We also have begun the normal public inspections that we do at this
time of year . For those of you whom are not f. arilisr with the State
o f N . Y . Requirements , we must make a fire safety inspection of all
structures open to the public within the Town each year. . We try to
do these inspections during late Winter and early Spring when this
o ffice is the least busy .

0 Deputy Supv Hatfield - has received a letter from Town Engineer
G eorge Schlecht that he has gone over the yarn Brothers project .
Atty Perkins - did receive a phone call from yarn Brothers
attorney . They were under the impression that nothing was going
to happen tonight since the Supervisor was not here and they
wanted to know what the status was . He did advise them that Town
Engineer Schlecht had been reviewing the plans that have been
submitted as a subdivision plat , and there were specific
comments on that . Also , he was reviewing the engineering report
o f the preliminary plans that had been submitted in connection
w ith the proposed Snyder Hill sewer district and there were also
comments in that respect also . He also advised him that the Mown
B oard did not have before them at the present time any petition
for the establishment of the sewer district . He has correspond
w ith Vann Brothers engineers and advised him as to what the
✓ equirements were and referred him to specific sections of the
Iae . They thought they have done that already . They are on
n otice as far as the Town is concerned there is no petition
pending . Also Town Engineer; Schlecht was continuing his review
o f the engineering report .

The Town Board of the Town of Dryden , by a resolution adopted
January 9 , 1990 , 19 , and the County Superintendent of Highways of the County
of , hereby request the Department of Transportation , pursuant
to Section 1622 . 2 of the Vehicle and . Traffic Law , to establish an area speed
restriction within the Southworth Road area , the boundaries
of which are described as follows :
on Southworth • Road beginning of the Pleasant View Trailer Park
and continuing over the bridge to the foot of the hill and to
the end of Lilac Lane .

Upon receipt of notice that the regulation herein requested has been
established , the Town of prydpu will provide , install and
maintain signs in accordance with the Vehicle and Traffic Law and conforming
to the Manual of Uniform Traffic Control Devices of the Department of Transportation .

OilDeputy Supv Hatfield - received a request and a petition from
the residents that live on Scuthworth Rd and Pleasantview
Trailer Park for the speed limit be reduced . Also school bus
stops signs and playground signs at the playground area to be
posted . ( copy of petition in minute book )
Deputy Supv Hatfield - felt that Hwy Supv Gilbert could post the
school bus stop sign and playground area sign , and the Town
would accept the petition for the request for a lower speed
limit and refer it to County Highway for their review .
