Members and guests participated in the Pledge of Allegiance

S upv Schug read the notice that was published in the newspaper
to consider a certain plan and estimate of cost in relation the
the proposed increase and improvement of the facilities of
D ryden Sewer Dist # 2 and Monkey Run Sewer Dist ( copy of public
h earing in minute book )
Q UESTIONS AND / OR COMMENTS
Harold Case , 953 Dryden Rd - wanted to know if this was going to
be a complete new pump station ?
Clm Garlock - the pumping station that is there now is able to
h andle the sewage that we have at the present time . There have
been serious problems with the pumps . At one tithe one puriip got
® badly damaged and it had to be rebuilt . This started us to
investigate the whole system . It turns out that the City of
Ithaca takes care of the maintenance on that work . The pumps in
the Varna area is no where near the kind of pump that they have
downtown . It was pointed out that if the town expanded that we
w ould have to have a submersible pump and not the dry bay pumps
w e now have . We have had several break downs of the current pump
and it is obvious that something has to be done . The town has
h ad Hunt Engineers look into the situation and they recommend
that the current pumping station be replaced with pumps that are
adequate . There will be a generator in case there is lose of
power .
H arold Case - there was a portable generator purchased when that
station was built .
D on Gilbert - the Town stores the generator and they start it up
several times a year to make sure it is ready in case it needs
to be used .
S upv Schug - the problem is that when the power goes _off the
station is taking so much sewage that by the time the portable
generator was in place it would be to late . A neighbor usually
gets the sewage in his backyard , and house plus flowing into
Fall Creek . The Health Dept has put the Town on notice that this
h as to be corrected .
Harold Case -- the enerat or was kept i n Varna for

NOTICE IS HEREBY GIVEN that the Town Board of the Town of
Dryden , Tompkins County , New York , will meet
at the Town Hall , 65 East Main Street , in Dryden , New York ,
in said Town , on the 14th day of November , 1989 , at 7 : 30
o ' clock P . . M . , Prevailing Time , for the purpose of conducting a
public hearing upon a certain plan and esitmate of cost in
relation to the proposed increase and improvement of the
facilities of Dryden Sewer District No . 2 and Monkey Run Sewer
District within the Town • of Dryden , Tompkins County , New York ,
consisting of the construction of a new pump station to be
located at the northwest corner of the intersection of Forest
Home Drive and Dryden Road ( Route 366 ) , to replace the existing
pump station known as the Varna Wastewater Pump Station , at a
maximum estimated cost of $ 185 , 000 .
Debt service and operation and maintenance costs of such

t construction of a new pump station shall be annually apportioned
among Dryden Sewer District No . 2 and Monkey Run Sewer District
by the Town Board ; and
At said public hearing said Town Board will hear all persons
interested in the subject matter thereof .

A RESOLUTION AUTHORIZING THE ISSUANCE OF $ 185 , 000 SERIAL
BONDS OF THE TOWN OF DYRDEN , TOMPKINS COUNTY , NEW YORK , TO
® PAY THE COST OF THE CONSTRUCTION OF A NEW PUMP STATION TO
REPLACE THE EXISTING PUMP STATION FOR DRYDEN SEWER DISTRICT
NO . 2 AND MONKEY RUN SEWER DISTRICT WITHIN THE TOWN OF
DRYDEN , TOMPKINS COUNTY , NEW YORK .
WHEREAS , pursuant to proceedings heretofore duly had and
taken in accordance with the provisions of Section 202-b of the
Town Law , and more particularly an order dated November 14 ,
1989 , the Town Board of the Town of Dryden , Tompkins County ,
New York , has determined it to be in the public interest to
increase and improve the facilities of Dryden Sewer District
No . 2 and Monkey Run Sewer District of said Town at a maximum
estimated cost of $ 185 , 000 ; and
WHEREAS , all conditions precedent to the financing of the
capital project hereinafter described , including compliance
with the provisions of the State Environmental Quality Review
Act , have been performed , it having been determined that such
capital project is an Unlisted Action pursuant to the
regulations of the New York State Environmental Quality Review
Act , which the Town Board has determined will not have a
significant effect on the environment ; and `
WHEREAS , it is now desired to provide for the funding for
such capital project ; NOW , THEREFORE , BE IT
RESOLVED , by the Town Board of the Town of . Dryden , Tompkins
County , New York , as follows : .
Section 1 . For the specific object or purpose of paying the
cost of the increase and improvement of the facilities of

D ryden Sewer District No . 2 and Monkey Run Sewer District of
t he Town of Dryden , Tompkins County , New York , consisting of
t he construction of a new pump station to be located at the
n orthwest corner of the intersection of Forest Home Drive and
Dyrden Road ( Route 366 ) , to replace the existing pump station
known as the Varna Wastewater Pump Station , including land or
rights - in- land , and original furnishings , equipment , ' machinery
and apparatus necessary in connection therewith , there . are
hereby authorized to be issued $ 185 , 000 serial bonds of said
Town pursuant to the provisions of the Local Finance Law . '

Section 2 . It is hereby determined that the maximum
e stimated cost of such specific object or purpose is $ 185 , 000
and that the plan for the financing thereof shall consist of
t he issuance of the $ 185 , 000 serial bonds of said Town
authorized to be issued pursuant to this bond resolution .
Further details pertaining to said bonds will be prescribed in
a further resolution or resolutions of this Town Board ; and - .
Section 3 . It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose
is forty years , pursuant to subdivision 4 of paragraph a of
Section 11 . 00 of the Local Finance Law . It is hereby further
d etermined that the maximum maturity of the serial bonds herein
authorized will exceed five years . •

Section 4 . Subject to the provisions of the Local Finance
Law , the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized , including renewals of such
notes , is hereby delegated to the Supervisor , the chief fiscal
officer . Such notes shall be of such terms , form and contents ,
and shall be sold in such manner , as may be prescribed by said
Supervisor , consistent with the provisions of the Local Finance
Law . .
Section 5 . The faith and credit of said Town of Dryden ,
Tompkins County , New York , are hereby irrevocably pledged to
the payment of the principal of and interest on such
obligations as the same respectively become due and payable .
An annual appropriation shall be made in each year sufficient
to pay the principal of and interest on such obligations
becoming due and payable in such year .
Section 6 . The validity of such bonds and bond anticipation
notes may be contested only if :
1 ) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money , or
2 ) The provisions of law which should be complied with at the
date of publication of this resolution are not
substantially complied with ,

and is fine . There was nothing wrong with the design but the
d istrict has been enlarged so that if the pumps are not past
their capacity they are at their capacity so there has to be
some kind of enlargement , the new pumps will take care of the
immediate 'f= uture .
C1w Walbridge - the concern about rebuilding the pump station is
that it will be able to handle the Donkey Run Sewer Dist , the
proposed Turkey H i l l Sewer Dist and any other future sewer
districts .

S upv Schug - had copies made f : r^ Eloard member' s of letter from
G eorge Sch lecht stating that the sewer situation is under
control with the exception of testing the system next spring -
G eorge recommends that the Town Board approve the installation
of the sewer lines with the condition that the Town receive a
. rl letter of certification from the contractor that the sewer lines
t ' were installed according to recognized standards .

K arl Westerling - the contractor has already signed the
statement for the as built plants that he has submitted to the
Town .
S upv Schug n° George has also recommended that any further
permits for the mobile home par^ k extension now proposed be
conditioned , Mr Westerling agreeing , that over the next year
further observations at the manhole indicated will be allowed so •
that infiltration can be more accurately be determined . Further
if the amount of infiltration proves to be unacceptable that Mr
Westerling will repair as necessary . Upon completion of the new
e xtensions an up to date as built plan will be done for the •
e ntire park .
Atty Perkins - Mr Westerlinq did provide the equivalent in
n umber one in Seorge4 s letter last June . The quest ion of the
testing and the inspections, is what is holding up application .
Item # 2 addresses that concern over the period of the next year .
S upv Schug - the other matter was that Mr Westerling was going
to amend his request to the addition to the trailer park . He was
not going to ask for the camping site .

K arl Wester^ l ing - has agreed to it orally , but he hasn ' t done
' anything else because he doesn ' t know what to do .
S upv Schuq - he was under the impression that all Mr Westerling
had to do was purchase a $ 500 . 00 meter or $ 1 , 000 . 00 meter to put
o n the line and turn on the village water , but this is not the
case _ The line that goes to that area is 1 1 / 4 inch galvanized
step / which is not acceptable to serve the trailer park with
✓ illage water . The only way he could get water would be to put
in a whole new main frcrn the Town line up to the trailer park .
He has been operating and does have water .
Clm Evans - he does not have a problem with what is there now ,
but would have difficulty with the expansion since the ordinance
states that a mobile home park has to be on public water and
seurer^ . The only way would be to apply to the ZBDP stating ing that
it would be an economic hardship . The • Town Board could not
e pprove it without changing the ordinance .
S upv Schug if the mCn granted this variance , then when and if
w ater became available Mr Westerlirig would have to hook on the
system .
K arl Westerltng - will apply to MOP since he does have adequate
water supply .

DISCUSSION OF DRYDEN LAKE PROJECT
Bob Di_ net , Finger Lakes Park Commissioner - in 1986 the
E nvironmental Duality Bond Act passed a 1 . 45 billion dollar bond
act that was aimed at the r^ emediaticn of toxic waste sites
throughout the State of New York . Included in that , money was
set aside for DEC and NYS Parks and Recreation to operate grant
programs . DEC has used their money for acquisition of
e nvironmentally sensitive properties . The Office of Parks and
Recreation chose to operate 3 grant programs . There is urban
cultural parks program , historic preservat ion program and a
parks program . What we are talking about is the parks program
w hich provides up to 50 per cent matching reimbursable grants to
municipalities for the acquisition of land for the development
o f land into recreational facilities . They have obligated this
money over a S year period _ The first year is $ 10 millions
second year SC mi x l ion and they are now in the process of
spending and additional $ 20 million this year . There are several
projects that are eligible under; the program . It has to be an
o utdoor / indoor recreational pr 'i .ject that takes place on property
that a municipality has either outright or ownership interest
in _ They used a priority rating system for all of the
applications that they received . In 1987 the Town of Dryden and
✓ illage of Dryden Made an application to the Office cif Parks and
Recreation for grant money . The application included the
development of a hiking / biking trail linking the village to
Dryden Lake along the abandoned railroad r - a - w . Certain

recreational development on land that sre controlled under DEC .
They process the application through their regional office and
than it goes to Albany for approval . The .ray the grant program
w orks is that they send the municipality an offer for a grant
w ith their terns and conditions . The Town of Dryden agreed to
the terms and conditions and signed the grant application . So
far they have done the archeological study on the situ and have
u ndergone the environmental review process . The one condition
that has to be agreed upon is reaching concurrence on terms by
w hich the Town will occupy the property which is under the
control l oaf DEC . All they sate is that the lease agreement has
to be at least 2 . years . The reason for the 23 years is that
this is a bond act and this is the length of time that the bonds
are for . This is where DEC is now with the Teen of Dryden in
mutually agreeing on how they can successfully bring the site
u nder a lease agreement with the Town so that they can execute a
contract for construction . DEC does not have far to go to make
this project a reality .
B rad Griffin , with DEC '. the program that Bob explained is an
O ffice of Parks program that would make funds available to the
Town of Dryden to implement a town park in cooperation with the
✓ illage of Dryden . In order for a ' place where those funds might
be utilized for a park or a park facility in Dryden would be
through your local government . You would either own land where
the park land could be implemented or to purchase land or to
explore with the State of New York the possibility of a
concurrent use permit which would allow the town use for park
purposes on the multiply use area of Dryden Lake state land . The
D ryden Lake was purchased as the result of a bond act by the
S tate in 1962 as a multipurpose area . They have maintained a
fishing access site and restructured the dam . They do feel that
u se for a town park is possible . The permit has been sent to
Albany for review and approval .
B ob Bonet - the Town of Dryden would be granted tenure of the
property for the length of the lease of E .3 years . Also the
activities that would be undertaken would be allowed under the
agreement .
B rad Griffin - the things that wcn 'uld guide them in looking at a
concurrent use permit would be tcl assure use to which the
applicant would meet statue the State purchased originally . It
also would have to be consistent with the other type uses or
other considerations environmentally or in terms of the habitant
o r other public uses that is posted on that site . There would
also have to he the legal consideration of whether or not the
authority was truly the agency to allow or forbid that use . Also
the consideration of that particular use would hove an effect on
the underlying land resources and property . In this particular
case there are certain things that must occur 1 - the use by the .

el uses in order to make the new park use possible . Those uses for
hurting or fishing exist on the site must continue and they want
those to continue in a way that will be compatible for park. use .
They also expect the hikers and genera public use fishing
access would be able to continue . He would not discourage any
d irect cont act to the commissioner that the application and
draft permit is in Albany and would like to move ahead .
f tty Perkins - - wanted to know the status of the second
application .
Flob GOne 'L- - he has processed the application and has sent it to
Albany for their review . All of the applications submitted will
be reviewed the first week in December . Based upon the ratings
they will make their recommendations to the commissioner for the
projects that should be selected for funding . They will then g -
the the Legislature for announcement by the Governor . They
shooid know by the end of this year . The Office of Parks and
Recreations will draft a contract with the Town of Dryden which
w ill outline the project t and special conditions .

Cc Rep Tiilapaugh -- reported on the garbage disposal fee - It was
planned to be implemented on 1 - 1 - 90 but they need time to work
o n the technical details so they have postponed the date to
3 -- 1 - 90 . They are extending the time l 'i' nger to the city and
✓ illages . They plan on using a type of tag system .
-- -- reported that in 1946 the County implemented a policy to
replace , repair and build bridges throughout the county on town
and village roads . The city representatives are upset with the
county because they are not getting the benefit from the county
paring for the repair and replacing of bridges since they are
county taxpayers also . This critter was brought up at their
budget meeting and is being considered that the towns should pay
more than what they are paying now . He wants to find out what
the city receives from the state and federal funds to help them
✓ eplace and repair the city bridges . Sometime in the future the
town might have to help the county with funds to work on the
bridges . At the present time the town is responsible for the
approaches to maintain the deck .

Town pursuant to the provisions of the Local Finance Law .
Section 2 . It is hereby determined that the maximum
e stimated cost of such specific object or purpose is $ 185 , 000
and that the plan for the financing thereof shall consist of
t he issuance of the $ 185 , 000 serial bonds of said Town
authorized to be issued pursuant to this band resolution .
Further details pertaining to said bonds will be prescribed in
a further resolution or resolutions of this Town Board ; and
Section 3 . It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose
is forty years , pursuant to subdivision 4 of paragraph a of
S ection 11 . 00 of the Local Finance Law . It is hereby further
determined that the maximum maturity of the serial bonds herein
authorized will exceed five years .

Section 4 . Subject to the provisions of the Local Finance
L aw , the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized , including renewals of such
notes , is hereby delegated to the Supervisor , the chief fiscal
officer , Such notes shall be of such terms , form and contents ,
and shall be sold in such manner , as may be prescribed by said
Supervisor . consistent with the provisions of the Local Finance
Law .
Section 5 . The faith and credit of said Town of Dryden .
Tompkins County , New York , are hereby irrevocably pledged to
the payment of the principal of and interest on such
obligations as the same respectively become due and payable .
An annual appropriation shall be made in each year sufficient
t o pay the principal of and interest on such obligations
becoming due and payable in such year .
Section 6 . The validity of such bonds and bond anticipation
notes may be contested only if :
1 ) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money , or
2 ) The provisions of law which should be complied with at the
date of publication of this resolution are not
substantially complied with ,

and an action , suit or proceeding contesting such validity is
commenced within twenty days after the date of such
publication , or
3 ) Such obligations are authorized in violation of the
provisions of the Constitution .
Section 7 . This resolution . which takes effect immediately ,
shall be published in full in the Ithaca Journal
the official newspaper , together with a notice of the Town
Clerk in substantially the form provided in Section B1 . 00 of
the Local Finance Law .

Councilman Hatfield offered the following
resolution and asked tor its adoption :
WHEREAS , Pinckney Road is a Town Road maintained by the
Town of Dryden , and
WHEREAS , the existing steel bridge with wood deck over
Fall Creek , near the intersection of Pinckney Road and Lower
Creek Road , is unsafe and has been closed to public
travel , and
WHEREAS , pursuant to Highway Law section 231 ( 10 ) the
Tompkins County Board of Supervisors by Resolution No . 43
( 1946 ) took over all bridges having a span of twenty - five
feet or over which are on town highways for the purpose of
maintaining and preserving them except for the floor or
wearing surface of such bridges , and
WHEREAS , by such action of the County of Tompkins the
Town has remained responsible for the approaches and floor
or wearing surface of such bridges , and
WHEREAS , the New York State Department of
Transportation has submitted to the Town a proposed
Agreement by which the Town is to maintain 0 . 125 miles of
secondary highway ( known as Pinckney Road ) from centerline
S ta . 3 + 00 to centerline Sta . 8 + 1 and centerline t

t o centerline Sta . 10 + 73 and to be designated as New York
P roject No . 3750 . 81 , and said proposed Agreement also
provides for the Town to request the Department of

t hat if such project is approved and constructed by the
D epartment and the Administrator of the United States
Federal Highway Administration , the Town will thereafter at
its own cost and expense maintain or cause to be maintained
t he approaches and floor or wearing surface of the replaced
bridge and pursuant to the aforesaid Resolution No . 43
( 1946 ) and the proposed Agreement herein referred to in a
manner satisfactory to the Department of Transportation and
the Administrator of the United States Federal Highway
Administration , or their authorized representatives , and
make appropriate provision each year for such Town required
maintenance ( to the extent that the same is not so made by
t he County of Tompkins ) ;
THEREFORE , BE IT RESOLVED , that the Town of Dryden
shall maintain the approaches and floor or wearing surface
of the bridge on such highway and guarantee the maintenance
of the same when constructed and will pay the cost of such
maintenance and will maintain the project in a manner
satisfactory to the New York State Department of
Transportation or its authorized representatives pursuant to

BE IT FURTHER RESOLVED , that the New York State
Department of Transportation submit such project to the

for construction with funds ' apportioned to the State for
construction of Highways and related projects under the
provisions of Federal Highway Acts , and
BE IT FURTHER .RESOLVED , that this Town Board act
through its Supervisor and the Town Clerk who are hereby
authorized to act for this Town Board to make and enter into
an agreement with the State Department of Transportation , in
manner and form and substance as herein stated and in
accordance with the form of Agreement herein mentioned and
attached hereto and as having been submitted to this Town
Board for action , and that this Town Board furnish six

Ambulance report
W est Lake Rd bridge update - the Town has completed what they
had to do to get everything ready for the bridge . We are now
waiting for the County to get the barricades up which should be
® by end of November or first of December .
The state should be letting bids out on the Pinckney Rd bridge
in the spring of 1990

RESOLVED , that this Town Board establish a reserve fund with a
separate bank account to be known as the Town of Dryden General
A Reserve Fund . Budgetary appropriations and surplus revenues
may be deposited as funds allow . Any expenditures from this
reserve fund are subject to a permissive referendum .
