TOWN BOARD MEETING
PUBLIC NEARING * 1 Karl Westerling
OCTOBER 10 , 1989
S upv Schug read the notice that was published in the newspaper to
consider the application of Karl Westerling owner of Little Creek
Mobile Home Park. at 152 North St to expand by 20 residential home
lots and 1 camper lot . ( copy of notice in minute book )
Q UESTIONS AND / OR COMMENTS
K arl Westerling -'- he is proposing to add 20 . mobile harries . The
park now has E dead end roads and he would like to connect them
along the cresk . Water and other services have been tied to those
areas as long as 20 years ago and some recently as 6 months ago .
The expansion of the park has been with the park ownership since
Mr Part line built it .
S upv Schug - the travel camper hook up is not an allowed use9 SO
that would have to be done through the ZBU11 . The mobile home park
is not using municipal water and the present mobile horde park has
not complied with the request from the Town Board going back to
last year to get approvals on the sewer system that is in place „
Karl Westerling - as far as the sewer issue , he was asked by Atty
Perkins to contact George Schlecht , which he did in June and has
lip had him dig the sewer system op 9 different times . He was out
there last Friday to do more testing . Every time George has asked
him to do more testing he has done it . But , testing a system that
is underground and invisible is very difficult to do because it
is a system ' designed not to hold water pressure . George is trying
to find the best way to day it . He is somewhat busy so every time
h e has been asked to do something he has done it . It has not been
✓ esolved to George ' s satisfaction and was told he would get back
to him sometime this week as far as what he wanted to dog next . He
w ent to the person the Town told him to go to and has done
e verything he has been requested to do and does not know what
more he can do with regard to the sewer .
Atty Perkins - the only thing that is left to do is bring the
installation of the sewer system into com p l iance is testing of
the system and a reasonable assurance that there is no
infiltration . He has met all of the other items . This has gone on
f or some time9 he has correspondence back in May to Karl , in
J une , July you are working on it . Letter to George Schlecht in
Aug requesting to get it finished . At some point this has to be
finished and has is be brought to a conclusion _ This has gone on -
for 6 months .
K arl Westerling called Atty Perkins office in Sept- before he
bought the (park to find out what had to be done . This is what
strrted it all and he understands this , but by the same token

when the engineer that he was requested to deal with tells him to
do something he does itr He has complied with all of Oeorgets
✓ equests because he knows he is busy . He rues not knows what more
h e can do _ He would like t get this resolved .

Supv Schug - wanted to know about the water . .
Karl Westerling - his reading of the ordinance says , that he
doesn ' t have to use water , hut served by water , 'There was some
discussion regarding the definition of the wording . He is served
by municipal water and is hooked to his system with the exception
o f a meter . If he installs a meter water will flow into his
tanks , so it is at his disposal in that sense it serves him . It
is of use to him if for some reason both his wells fail him , that
he can get a water supply from the village on an emergency basis
by getting a meter from them . He feels he meets the definition
that he is being served by village or municipal water .
P tty Perkins - the zoning ordinance states that mobile home parks
h ave to be served by both municipal water and sewer . This was the
intent of the Town Board that any expansion to a mobile home park
has to be public water and public sewer" .
Karl Westerling - he did not know what the intent was , but he has
information an the adequacy for his water supply . He has r
separate wells and E separate aquifers Each well alone is more
than sufficient to meet his demand for water and b pressure pumps
e ach of which alone are more than adequate to meet the supply for
the park , The health department will back that up . He also has
pressurized and non pressurized storage .
him Evans - he is the one that proposed the ordinance where both
w ater and sewer be available for mobile home parks . His intention
w as when you turned on the faucet it would be public water , and
w hen you flushed the toilet it would to in the public sewer
system . He has no problem that Mr Westerling has adequate water
for the current park , but has a problem with private water supply
for the expansion units for the mobile home park . He felt this
might set a precedent in other parks in the Town .
K arl Westerling a he didn ' t think that there were any other parks
in the Town that can say they are served by municipal water and
not use it .
tie Evans - there are part , in the Town that a mobile home park
could be created , which would he in the same situation that you
have now „
S upv Schug - the Board can turn this down as it stands or turn it
o ver to the Planning trerd . Mr Westerling would have to apply to
the tbbh for the camper lot and the water supply based on the
o rdinance . He wanted to knew if he would like to get the sewer
situation cleared up with George Schlecht and come hack to the
Board for further review .
If Atty Perkins the Town Board can turn down the application
ilkwithout prejudice and Mr Westerling can reapply when certain
items have been addressed , or you can adjourn the hearing if he
w ants to modify his application .

CITIZEN PRIVILEGE OF THE FLOOR
P am Stonebraker , Director of the SPCA - gave the Board members a
. copy of their proposal for a dog control contract . Their proposal
was for $ 11 , 500 . 00 and this is negotiable
Clm Evans - the Town does currently have a 2 year contract with
L orraine Bard . The contract he would like to propose is a base
amount with a S per cent increase for 3 years and at the end of
the first year the fourth yea r be negotiated .
Supv Schug - w '::".cld like Pam to address for hire the comments from
the other towns when the SPCA increased their rates .
H elen Lang , 1121 Dryden Rd . - she owns property adjacent to the
Mark Stevens project on Dryden Rd and is sure the Town is
familiar with the problems that have been raised in the past
about that which as effected the neighborhood with erosion ,, water
run off , excessive noise , change of drainage patterns on the
hillside and the clearing of the hill which continues to go on .
Her concern is the enforcement of the zoning laws in that area
and is very disturbed t h at Zoning Officer Mr Slater has worked
and Was paid by Mr Stevens or this particular project .

She finds it blatantly unethical that the zoning officer is paid
by the contractors and the builders that he is in charge of to
✓ egulate . She would like to hear the Town Board ' s response to
that She thought it should be a matter of public record if in
fact this is happening .
S ckpv Sch '.sg - the comment was brought up prior to this and an
investigation was made of this by the Town Uoard by asking Mr
S later to state what happened and what he did to and under what
conditions .
Z . O . Slater - landscape work had nothing to do with anything at
the time with Mr Stevens . There is nothing open that we were
supervising at the time . He simply was low bidder on the project
that he bid in his landscaping business which he has had since
prior to his taking over this toning position . The Town of Dryden
has a local law adopting his position and the function of his
position with everything he can and carrot to and everything he
w as involved in at that time fell within the guidelines of the
local law . There is nothing at the Steven ' s project at this time
that is a requirement or not an allowed condition of Dryden ' s
Town Zoning Ordinance , DEC , SEGA or anyone since we have kept
close tabs on any of the activities that have gone on there . He
has had wawa of these things confirmed by kitty Perkins and
previous Supv brttwri11 an he elide * t know what to tell Ms hangs
. i Sups Schug - it was brought up that the Town had allowed Henry to
d o thiw , but the Town did not allow him to do anything that
w asn ' t covered . He could not wank outside the zoning law . The
drainage he understands was recommended by NYSDOT and than it was
flooded over .
H elen Lang '-r she still is concerned abut the drainage problem
from Mark Stevens development and has pictures of the road being
flooded . She doesn ' t contest whether or not it is legal for Mr
S later to work for developers within the Town of Dryden , but she
d oes tell you as public officials that everyone hears of this ,
and everyone she has spoken with bar felt that it is unethical
for him to do that and it reflects very poorly on the Town of
D ryden .
D iane Willard , S Hall Woods Rd - she gave a copy of a model
zoning ordinance on soil erosion and wondered about the status of
it .
Clm from - bid read it over and felt that it should be
considered for the Town of Dryden when they amend the toning
o rb i, nante .
S wpv ,chug - it ie to bad when the original zoning ordinance was
w ritten that everything couldn ' t have been considered . We now
find cliches and problems within the zoning ordinance that we are
• vrrently working on a program to update and encompass some of
the problems that residents have concern about and bring those
things under control .

Councilman Evens offered the following
resolution and asked for its adoption ;
RESOLVED that the Town Board approves an increase in
the amount of $ 10 , 000 . 00 in the agreement with Lockwood ,
Kessler & Bartlett , Inc . the consulting engineers employed
to review the material associated with Tompkins County ' s
siting and application for a permit to construct and operate
a sanitary landfill at the DR - 7 site in the Town of Dryden ,
The amount of increase in said agreement is made on the
express understanding that the scope of the review by to
includes all documents submitted in association with
Tompkins County ' s application for a permit to construct and
operate a sanitary landfill at the DR - 7 site , and it is
FURTHER RESOLVED , that Jan S . huhliok , Esq . , special
counsel to the Town of Dryden in connection with this
landfill matter , be instructed to see that appropriate
written documentation of the amendment to the agreement with
Odd is made to reflect the increase in the amount hereby
authorized .

Councilman Evans offered the following
resolution and asked for its adoption :
WHEREAS , the Town Board heretofore ordered the
d emolition and removal of the building at 957 Midline Road
( Town of Dryden Tax Map # 59 - 1 - 36 , 1 ) reputedly owned by
P hilip Ensmenger and Patricia Ensmenger ; and
WHEREAS , said order was based on a report of the Town
B uilding Inspector dated May 3 , 1989 together with
accompanying photographs ; and
WHEREAS , the reputed owner was served with a Notice
pursuant to Local Law # 2 of the year 1989 that such
demolition and removal must be completed by August 19 , 1989 ;
and
WHEREAS , said Notice was filed in the Tompkins County
f
Clerk ' s Office on June 23 , 1989 ; and
WHEREAS , a hearing was held before the Town Board on
June 27 , 1989 on its order of the demolition and removal of
said structure ; and
WHEREAS , the reputed owner has refused to comply with
. the lawful order of the Town Board which ordered the
demolition and removal of said building ,
NOW , THEREFORE , BE IT RESOLVED BY THE TOWN BOARD AS
FOLLOWS
1 , That said building shall be demolished and removed
by October ii , 1989 _ at a maximum cost not to exceed
_ 710.00 and the site shall be restored to a safe and
sanitary condition .
, That pursuant to Section Z0 of Local Law # i of the
year 1989 all expenses incurred by the Town in connection
with the within proceedings shall be levied and collected
in the manner provided for the levying and collection of a
special ad valorem tax and the Town Clerk is hereby directed
to levy such expenses against the property as provided by
law ,

Atty Perkins - gave the Board members proposed policies for the
connection for out of district customers for district water; and
sewer lines . This would be reviewed on a case by case basis .
Atty Perkins - reported on 2 cases of litigation . Willard vs the
Town of Dryden and Wilcox Press . He sent copies of the decision
to Board members , 'Town Clerk and Zoning Officer . ,Judge Rose
dismissed the petition against the Town . Simon brothers and MVE
vs the Town of Dryden , this matter was heard in federal court in
August and there was a favorable decision from Judge McEvoy
dismissing that case . The time to appeal has expired and no
appeal has been fi. Ied . He does have one matter for executive
session involving litigation
Atty Perkins - there is .a proposal before the Board to increase
the contract or the agreement with Lockwood , Kessler & Bartlett
Inc who was retained by the Town of Dryden to review Tompkins
Countyts documentation and application for a permit to construct •
and operate a sanitary landfill at the DR - 7 site in the Town of
Dryden . They are requesting an increase of $ 10 , 000 . 00 because of
additional data which has been submitted to them that wasn ' t
available to them when they gave us their original quote . He has
talked with our special landfill counsel and his opinion is that
it is a reasonable request .

have been taken . The hearing was held and to his understandings
based on conservations with the building inspector the owner
intends to take no action and would like the Town to remove the
building and assess the cast of the removal to the owner . There

Dear Jim :
Please be advised that this office is in repeipt of an application from
Karl Westerling , owner of Little Creek Mobile Home Park 152 N . Street CYyden
New York , to expand Little Creek Park by 20 residential home lots and 1 lot
to be used as a travel camper hook - up lot . '
Since Mobile Rome Parks are an allowed use in the R . C . Zones , when Municipal
1 Water & Sewer Services are provided by Special Permit only , I ' ve verified that
the park has such services available . However , I to find that the water is not
being used at this time . Mr . Westerling assures me , the only thing preventing
the water service , is the installation of a meter or meters as necessary . I
believe that this may be an issue . Is it enough that the service Is available ,
or must it be in place 7 The Ordinance is unclear on this point .
By the provisions ; of the Mobile Home Park Ordinance , the applicant makes
application to the Town Board for a Special Permit . If the Board dhooses not
- to deny the permit on the spot , the Board would refere the application to the
Planning Board for a Ordinance Compliance review . This being the case , I ' ve
scheduled a hearing for 7 : 30 P . M . for the Tues . Oct . 10Ck , 1989 Town Board
Meeting .
Since this action falls within the 239 L S N State Guide Lines , I ' ll be sending .
a copy of this proposal to the Tompkins County Planning Department .
Please also be advised that I ' m in receipt of a Site Plan Review /Special Permit
Application a New Radio Station for W . HbClU . Radio on HanshawtRthad near the
new tweory . This material will be given out at the Board Meeting . f would
also request that , during the Board Meeting , you set a time when the Board
would be able to conduct a Site Plan Review / Special Permit Hearing for this
project . Please note that the Hearing can be no sooner than 2 weeks from the
day that you make the selection ,
p I would also inform you , that I ' m expecting a Site Plan Review Application
from HEP Materials to expand their Rt . 13 site to include the sales of Modular
Homes .

assessment form that has been prepared by Hunt Engineers . He has

S upv Schug -- J ' :' hn Anderson from the Health Dept has requested
that the Town do certain things to comply with the Varna pump
station . Hunt Engineers has agreed to do this work . One is
compliance with the engineering report plan construction . The
facilities are required to be under supervision of a person or
f irm qualified to practice professional engineering in the State
o f New York under the education law of the State of New York . The
construction of all facilities should commence as soon as
possible and be fully completed by Sept 1990 . He has asked Hunt
E ngineers to give the Town a proposal for doing the short
e nvironmental assessment form . An amount of $ 8 , 000 . 00 shall be •
added to the fee of the Varna pump station for the work that they
have done to satisfy Tompkins County Health Dept .

Budget hearing - Oct 26th following park review
Ralph Yarn , Va. rn Bros Construction - would like to submit to the
Town Board plans for a proposed sewer district in the Snyder Hill
area and the 47 foot access road . The have talked with Hwy Supt
G ilbert and he wrote a letter to Barbara Caldwell stating that he
approved of the road . This has been discussed at the Planning
B oard meeting and they also approved the road being a 47 foot
access . They also need Town Board approval . They plan to use the
full 47 feet and put in a storm sewer and curb walk rather than
h aving a ditch . There was some discussion .

Ralph Yarn - w '::' u1d like the Bard ' s approval for putting in a
town 47 foot access road _ They ars going to the Planning Board on

RESOLVED , that this Town Board accept in principle the 47 foot
access road into the site with the requirement that if land
becomes available , or is possible to be acquired to make a 60
foot wide road that Varn Brothers Construction would be required
to do that . Also stogy sewers will be installed . over the width of
the 47 foot road
