Atty Perkins - reported that District Court Judge McAvoy has
granted the Town of Dryden motion to dismiss the case brought
against the Town by Philip and Melvin Simon , MVE Homes Inc . and
N ew York Manufactured Housing Association Inc to declare the Town
o f Dryden Zoning Ordinance unconstitutional .
Atty Perkins - the Town Board previously accepted Walden Lane .
There was a letter of credit set in the amount of $ 33 , 000 . 00 to
e nsure the completion of the road to town specifications . Hwy
S upt Gilbert has made a recommendation that this amount be
✓ educed to an amount not less than $ 13 , 000 . 00 . He indicates that
the present condition is that the base , ditches and culverts and
6 inch crusher run has been installed . Work that still has to be
d one to meet town specifications is that it has to be rolled and
a double stone and oil treatment needs to be applied . There are
still some technical requirements that the developers have to
complete in order to turn the property over to the Town . The
d eveloper is asking that the letter of credit be reduced .
G eorge Schlecht - the reason for the reduction of the letter of
credit is NYSE & G has not completed installing utilities which is
being held up because of the telephone strike . If they finish the

road now and the utilities are not installed it will require a
® road cut when the strike is over so that the utilities can be
installed which would not be advisable . There was some
d iscussion .
