HomeMy WebLinkAbout1989-03-29 TOWN BOARD MEETING MARCH 29 , 1989 Supv Schug - called the meeting to ,order at 12 noon Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : • Present ; Supv Schur , Clm Evans , Clm Hatfield , Clrn Garlock , Clw Walbridge and Atty Perkins George Schlecht - gave the Board members and went over the table and contents regarding the Yellow Barn development water study . The present condition is marginally adequate for what currently e xists . The conclusion that he reached is that the Town cannot look at the existing water company as the basis upon which a new d istrict would be built . The second area they looked at for the d istrict in terms of water was breaking it up in several areas . One is the immediate service area and then future development . The third area looked at within the new district was how is a water source developed . The three alternatives 1 - would be to ✓ ehabilitate and drill new wells in the immediate area of the service area . 2 - the development of a well field ; 3 - the extension o f Bolton Point water, from the Monkey Run Water Dist . In the study there certain alternatives and certain projections for growth and the what the first year cost would be to the user within the service area . They looked at what the annual cost would be if full development happened within that service area . The operation and maintenance cost assumes that the district would contract with Bolton Point to take care of maintenance and the charge for water . B efore the report is finalized he would like to have the Board ' s input . J im Greshen from Hunt Engineers -- reported on Turkey Hill Water and S ewer Dist . Board members have the report prepared by Hunt E ngineers which has the back ground of some of the existing conditions and talks about specifically the water and sewer systems and the different alignments and facilities that are present . The large district in the report is being looked as two different size d istricts . There is also the cost with the 0 & M costs and other fees that might be considered . You should keep in mind in the draft ✓ eport that the costs are currently prepared on a unit user or e quivalent dwelling basis . The costs in the report indicate some of the unit costs . The system is designed with the ability to handle more development on Rt 13 , the MA Zone and Hanshaw Rd area , Lower Creek Rd area and Yellow Barn Rd . I1 i1 3 - 17 - 89 page 2 Atty Perkins - no matter which way the Town goes , whether the Town o ffers Wilcox Press the opportunity to dedicate it to the Town and Sthen pay straight rate , or whether he installs it and the Town agrees to a buy back and then Wilcox Press would pay 1 . 5 rate , since he is an out of district user the contract must contain a provision into the effect that 1 - if the lines or ability to f urnish water or sewer services have reached their capacity , they must be disconnected , or the alternative he pays the cost of acquiring the additional capacity . ( This would be the cost for processing the sewage . ) -- - if the Town uses 1 . 5 rate formula you would compute for each u ser what their charge would be and then break it down to a formula to apply to the contract . You have to figure out what you have to ✓ aise , make your assessments , units and front footage . You would compute this for your out of district user and multiply that times 1 . 59 then you would figure out what you would be raising from the o ut of district user and then subtract that amount from the amount that has to be raised in the district and refigure everyone in the d istrict . You can also do the same thing with straight rate . Atty Perkins - will draft a contract for the Board members to consider . For out of district users ; 1 there will be a connection . premium paid at the time o f connection which will be based on a formula the amount of debt service already retired by the district ; 2 - the original improvements of the certified costs will or maybe bought back by the Town in the event that they are to be part of a Ilk new district to be formed by the Town with a 10 year straight line amortization ; that the user will pay a standard rate ; 4 - the out o f district user will have to purchase any excess capacity for w ater and sewer . S upv Schug -- reported that the Busy Bee has a situation where they want to dump treated water into the Village of Dryden sewer plant . The Village of Dryden will take it and the Town has to agree that they will do it . Clw Walbridge - since Steve Landau is out of the country at the present t irne the Environmental Management Council suggests that the Town of Dryden appoint another person to take his place . She has a name of Jim Willard who would like to serve on that committee . Adjourned : 1 „ 00PM 4.4( Susanne LLoyd Town Clerk NOTICE OF PUBLIC HEARING ZONING AND MOBILE HOME ORDINANCE AMENDMENTS ® TOWN OF DRYDEN PLEASE TAKE NOTICE that the Town Board of the Town of D ryden will hold a public hearing on proposed amendments to the Town • of Dryden Zoning Ordinance . The proposed amendments are as follows : 1 . The Town of Dryden Mobile Home Ordinance is amended as follows : ARTICLE I . GENERAL is hereby amended by ✓ enumbering Section 102 ( J ) as Section 102 ( J ) ( a ) Mobile Home - and by adding thereto a new paragraph ( b ) Non -Conforming Mobile Homes - to read as follows : ( b ) Non - Conforming Mobile Homes . A structure which would be a mobile home as herein defined except that it lacks the certification required by the United States D epartment of Housing and Urban Development and /or it does n ot comply with the National Manufactured Home Construction and Safety Standards shall referred to as a " non - conforming mobile home " . ARTICLE II : INSPECTION AND ENFORCEMENT is hereby amended by adding a new subsection ( c ) to Section 201 to ✓ ead as follows : ( c ) Non - conforming mobile homes are not permitted in any zone in the Town of Dryden . 2 . The Town of Dryden Zoning Ordinance is amended as follows : ARTICLE III . DEFINITIONS is hereby amended by numbering the first two paragraphs as Section 300 and Section 301 and by adding thereto new Sections 302 and 303 as follows : Section 302 . Sections 102 ( J ) ( a ) and 102 ( J ) ( b ) ( Definitions : Mobile Home and Non - Conforming Mobile Home ) of the Town of Dryden Mobile Home Ordinance shall apply to this O rdinance . ARTICLE X . MOBILE HOMES is hereby amended by adding a new Section 1003 to read as follows : Section 1003 . Non - Conforming mobile homes are not permitted in any zone in the Town of Dryden except as an established non - conforming use . A non - conforming mobile home may not be used to replace another non - conforming mobile home . This amendment shall take effect after publication and as provided by law . The public hearing on the proposed amendment will be held at 7 : 45 p . m . prevailing time at the Dryden Town Hall , 65 East Main Street , Dryden , New York , on March 14 , 1989 , at which time interested parties will be heard . The proposed amendments are as follows : Section 401 of the Town of Dryden Zoning Ordinance as last amended is hereby amended as follows : " Section 401 . All land in the Town of Dryden shall fall within one of the established zones as shown on a map entitled " Town of Dryden Zoning Map " orginally prepared by E gner and Niederkorn Assoc . , Inc . and last revised 2 / 10 / 88 " . ( The area to be effected by such change is more • particularly described as follows : ALL THAT TRACT OR PARCEL OF LAND situate in the Town of D ryden , County of Tompkins and State of New York bounded and d escribed as follows : B EGINNING at a point in the centerline of Hall Woods Road at t he intersection of said centerline with the centerline of Hall Road ; proceeding thence and along the centerline of H all Woods Road in a generally southwesterly direction and continuing from said centerline on the same course to a point in the centerline of New York State Route 13 ; proceeding thence generally northwesterly along said centerline to its intersection with the centerline of Lower Creek Road ; proceeding thence generally easterly and along the centerline of Lower Creek Road to its intersection with t he centerline of Pinckney Road ; proceeding thence generally southerly and along the centerline of Pinckney Road to a point in said centerline which is opposite the centerline of H all Woods Road extended in a generally northeasterly direction to a point of intersection of said extended centerline with the centerline of Pinckney Road . ) These amendments shall take effect after publication and as provided by law .
