Supv Cotterill - read the notice that was published to consider the
application of Roger Hatfield to replace an existing double - wide
mobile home type office with a stick built office and storage
structure at 183 North Road .
Q UESTIONS AND / OR COMMENTS)
The application has been reviewed and found that the proposed
activity is a permitted use in the MA Zone , SEOR review has
indicated the potential for a modest impact for visual and drainage
consideration . Therefore , it is recommended that the Board approve
this project with specific conditions regarding drainage , signage ,
screening of storage areas and other aesthetic considerations ,
There also has been an amendment, to the parking lot , which is now
allowed .
Atty Perkins - wanted to know what was going to be checked on the
S ERR form ?
Z . O . Slater - it would be negative .
P ity Perkins a the project will not result in any large or
important impacts . Therefore , is one which . will not have a
significant impact on the environment , therefore a negative
declaration will be prepared . It is then the applicants intention
t o comply with all of the parking requirements .
Roger Hatfield - he has gone over the parking requirements with
Z . O . Slater .
Atty Perkins - wanted it made clear that he understood that if Mr .
H atfield wanted fewer parking spaces , the remedy would be to get a
variance . Put if the permit is issued on the basis of the
application and the amendment then that is what he has to go by .
Motion was made by elm Evans and seconded by Clm Hatfield that the
application of Roger Hatfield be approved since everything is in
order , and is with the recommendation from the Zoning Officer .

Supv Cotterill read the notice that was published in the newspaper
t o consider the Town of Dryden proposed Mobile Home Ordinance ,
Attar Perkins - there was a clarification made after the last public
h earing in Section 209 no that it will read ( existing Mobile Homes
and Mobile Home Lots - Mobile homes and mobile homes into lawfully
placed in the Town of Dryden on the affective data of this
O rdinance may be maintained in their existing placement unless
t hey ; ( 1 ) are moved , or ( ) are improved , or restored after damage ,
and the improvement or restoration affects 50 % or more of its total
f loor area ) .

At a regular meeting of the Town Board of the Town of

ARTICLE 1 General
SECTION 100 Title
This ordinance shall be cited as the Town of Dryden Mobile Home
Ordinance .
101 Purpose
It is the purpose of this ordinance to promote the health , safety
and general welfare of the inhabitants of the Town of Dryden ,
Tompkins County , New York by the regulation of site design for
mobile home lots , and the establishment of site installation and
® occupancy standards for all mobile homes located on mobile home lots
in the Town . This Ordinance does not apply to mobile homes in
mobile home parks or to mobile home parks .
102 Definitions
A . American Concrete Institute ( AC1 ) The organization which
publishes standards for concrete foundations and other concrete
structures . Such standards may be different from local building
code requirements , in which case , the more stringent requirements
will control .
B . ANSI - NFPA Standards - The standards and / or specification
promulgated by the National Fire Protection Assocation and Nationa :
Conference of States on Building Codes and Standards , Inc . , and
• published as ANSI A225 . 1 NFPA 501 A Manufactured Home Installations
1982 or it ' s most recent counterpart , however identified .
OC . Commercially Manufactured A Installed Designed and intended for
use with a mobile Lome and installed according to manufacturer ' s
instructions and complying with all appropriate codes , laws , rules ,
regulations , ordinances , and local laws .
D . Construction Permit - A permit issued by the Town authorizing the
construction of a Mobile He lot .
E . Enforcement Officer - The person or persons , by whatever title
designated by the Town Board , charged with the enforcement and
inspe = lions required under this ordinance .
F . Frc•nt Setback Line - A line marking the minimum distance from the
center of the read right -of -way . ( Also see Yards )
® G . House Roof Systems - designed and constructed of materials
permitted in the construction of single family dwellings by the New
York Ur. iform Fire Prevention and Building Code .
H . House Siding System - designed and constructed of materials
permitted in the construction of single family dwellinss by the
New York Uniform Fire Prevention and Building Code .

I . Installation Permit - A permit issued by the Town
Aauthorizing the installation of an individual mobile home .
J . Mobile Home - A structure , transportable in one or
more sections and while being transported is 8 body feet or
more in width or 40 body feet or more in length or , when •
installed on a lot , is at least 320 square feet , and which
is built on a permanent chassis and designed to be used as a
dwelling with or without a permanent foundation when
connected to the required utilities , and includes the
plumbing , heating , air conditioning and electrical systems
contained therein . The term shall include any structure
which meets the size requirements herein set forth , and for
which the manufacturer has filed the certification required
by the United States Department of Housing and Urban
D evelopment and which structure complies with the National
Manufactured Home Construction and Safety Standards . A
Mobile home is identified as such by the existence of the
seal required by the United States Department of Housing and
U rban Development . A modular home is manufactured and
certified according to the New York Uniform Fire Prevention
and Building Code , Article 2 . Unless the context requires
otherwise the term mobile home shall include a double wide
mobile home but the term double wide mobile home shall not
include a single wide mobile home . A double wide mobile
home includes at least two such sections transported
separately and designed and intended to be joined together
® as a single dwelling unit when placed on a site . A mobile
home should not be confused with a travel trailer which is
towed by a motor vehicle and which can be operated
independently of utility connections and is limited in width
while being transported to 8 body feet , in length to 32 body
feet and is designed to be used principally as a temporary
dwelling and does not require a HUD seal .

K . Mobile Rome Lot - A parcel of land ( outside a mobile home park)
for the placement of one mobile home for the exclusive use of the
owners . All placements and structures shall be subject to set back
requirements and lot area as specified in this ordinance , and in
the Town of Dryden Zoning Ordinance , whichever is more restrictive .
L . Mobile Home Stand - That part of a mobile home lot which has been
constructed for the placement of the mobile home and accessory
buildings or structures . A mobile home stand shall be constructed
and consist of either :
( 1 ) ten ( 10 " ) inches of compacted gravel ; or
( 2 ) a concrete slab at least six ( 6 " ) inches thick and reinforced
according to the standards of the American Concrete Institute ( ACI ) ;
or
( 3 ) six ( 6 " ) inches of compacted gravel with a reinforced concrete
runner on each side of the stand to provide support , such a runner
to be a minimum of 2 ' wide , 4 inches thick and the length to extend
to within 2 ' of each end of the home body ; or
( 4 ) masonary piers installed into the ground at least three feet
below grade ; or
( 5 ) a stand as defined in ANSI - NFPA standards of installation of
manufactured homes .
( 6 ) A mobile home stand shall not have an elevation exceeding 1 . 5
feet from the surrounding mean elevation and the site shall be
sloped to provide drainage away from the stand . All stands shall be
suitably graded to permit the rapid surface drainage of water .

M . Mobile Home Support System - Installation instructions provided
by the manufacturer of a mobile home , or if unavailable , designed by
a Registered Professional Engineer , Architect , or as set forth in
NFPA - ANSI Standards .
N . Occupancy Certificates - Written authorization from the
E nforcement Officer to occupy a mobile home
lot and the mobile home placed thereon .
O . Parking Space - An off street space available for parking of one
motor vehicle and which is an area at least nine ( 9 ) feet wide and
twenty ( 20 ) feet long , not including manuvering area and access
drives .
P . Permanent Residence - Residence for a period in excess
o f 60 days .
Q . Person - an individual , partnership , corporation or association .

R . Professionally Designed and Built
( 1 ) Designed and built according to plans prepared and sealed by a
licensed Professional Engineer or Architect ; or
( 2 ) Designed and built according to plans so that upon completion
the construction will be architecturally consistant with the design
o f other buildings on said lot and be asthetically pleasing .
S . Rear Setback Line - A line marking the minimum distance from the
✓ ear lot line ( Also see Yards ) .
T . Road - Road means road , street , avenue , right-of-way or ether
pur• iic line marking the exterior boundary of the public ownership or
✓ ight - of - way . ( Not to be confused with the traveled or maintained
portion of a road . )
U . Secondary Additions - Expanded rooms , enclosed patios , or

structural additions that are added to the mobile home on the mobile
home stand .
V . Side Setback Line - A line caking the minimum distance from the
side 1ot ' lines . ( Also see Yards )

w . Single Ownership - Refers to any individual , partnership or
corporation owning a parcel of land .
X . Skirting ( manufactured ) - A new durable vinyl or aluminum product
sold commercially and designed and intended as an enclosure for the
space between the mobile home and mobile home stand .
Y . Skirting Wall - Material of a weatherproof nature that is used to
enclose the space between the mobile home and the mobile home stand .
Skirting wall shall be masonry , or pressure treated lumber or other
material that would be permitted by the New York State Uniform Fire
Prevention and Building Code for enclosing a crawl space of a single
family home with no cellar . The skirting wall shall be installed
with its bottom edge below the frost line to eliminate any frost
heave .
Z . Storage - Refers to the placement of articles not in use .
AA . Storage Buildings
( 1 ) Portable - a structure with less than 150 square feet of floor
space , manufactured or sold in kit form , is easily movable on its
own support system not requiring a permanent foundation and not
requiring a bulding permit .
( 2 ) Permanent - a structure over 150 squre feet for which a building
• permit is required and which must comply with the New York Uniform
Fire Prevention and Building Code and the Town of Dryden Zoning
Ordinance .

BB . Temporary Residence - Residence for a period of less than 60
days .
CC . Yard - A yard is an open space other than a court on a lot ,
unoccupied and unobstructed from the ground upwards , except as
otherwise permitted ( See illustration for location of front , side
and rear yards . )

Article 2 Inspection and Enforcement
201 Prohibition
A . No person shall occupy or permit to be occupied any mobile home
on any mobile home lot without first complying with the provisions
o f this ordinance .
E . All mobile homes in the Town of Dryden shall comply with all
applicable laws , codes , rules and regulations , ordinances and local
laws .
202 This ordinance shall be enforced by the Enforcement Officer , who is
authorized and has the right in the performance of duties , to enter
any mobile home or mobile home lot to make such inspections as are
n ecessary to determine compliance with this ordinance or any other
applicable laws , codes , rules and regulations , Ordinances and local
laws . Such entrance and inspection shall be accomplished at
✓ easonable times , or at any tine in an emergency and whenever it is
n ecessary to protect the public interest . Owners , agents , operators
or occupants of a mobile home or mobile home lot shall be
✓ esponsible for providing access within their control for the
Enforcement Officer , in the furtherence of official
duties .

® 203 Duties of Enforcement Officer
It shall be the duty of the Enforcement Officer :
A . To maY.e initial inspections for Occupancy Certificates for
mobile homes placed on mobile home lots , and
B . to investigate all complaints made under this Ordinance , and
C . to enforce this ordinance by inspection for compliance , and in
the case of violations to prosecute the responsTle persons in a
court of competent jurisdiction , and to
D . request the Town Board to take appropriate legal action on all
violations of this ordinance , and to provide such applications and
forms as are necessary to implement the provisions of this
ordinance .

® 204 Violations
A . Upon determination by the Enforcement Officer that there has
been a violation of any provision of this ordinance , notice of such
violations may be given to the person responsible for obtaining or
maintaining the Construction / Installation Certificate for the mobile
hor.._ or mobile home lot in violation . Such notice shall be in
writing and shall state the nature of the violation and the remedial
actions necessary to correct it . The notice shall also specify the
dates by which remedial action must be taken to correct such

E . The Enforcement Officer may bring an appropriate legal proceeding
to punish the responsible person for such violation or in an
appropriate case , and with the prior approval of the Town Board , a
® proceeding to enjoin such violation .
C . Whenever the Enforcement Officer determines that an emergency
exi _ s which requires immediate action to protect the putlio health ,
safety or welfare , he may issue an order stating the existence of
such emergency and require that such action be taken as may be
deemed necessary to protect the public health , safety and welfare .

® 205 Violations and Penalties
A . A violation of this Ordinance is an offense punishable by a fine
not exceeding $ 100 . 00 , or by imprisonment for a period ncst exceeding
15 days or both . Each day ' s continued breach shall constitute a
separate , additional violation . In addition the Town Board shall
have such other remedies as are provided by law to enforce the
provisions of this Ordinance .
B . Occupancy / Installation Certificates may be invalidated for a
conviction of a violation of this Ordinance if the violation has not
been corrected .
206 Variances - When unnecessary hardships or practical difficulties make
strict compliance with any requirement of this ordinance unreasonable
® or impossible , an appeal may be taken to the Town of Dryden Board of
Appeals from those provisions of this Ordinance . The Zoning Board of
Appeals shall act in strict compliance with established case law , the
Town Law , and may vary or modify the provisions of this ordinance
only as minimally as may be necessary upon the required showings and
facts as presented .

® 207 EffEct of Partial Invalidity - Should any section or provision of
this Ordinance be declared invalid for any reason whatsoever , such
decision shall not affect the remaining portions of this Ordinance
which shall remain in full force and effect .
208 interpretation - The provisions of this Ordinance shall be held to
be minimum requirements . Whenever the requirements of this
Ordinance are at variance with the requirements of any other
lawfully adopted codes , rules , regulations , ordinances , or local
law , the more restrictive , or those imposing the higher standards ,
shall prevail .
209 Existing Mobile Homes and Mobile Hone Lots - Mobile homes and mobile
home lots lawfully placed in the Town of Dryden on the effective
date of this Ordinance may be maintained in their existing placement
unless they :
( 1 ) are moved , or
( 2 ) are improved , or restored after damage , and the
improvement or restoration affects 50 or more of its total floor
area .
210 Effective Date - This ordinance shall take effect and be in force
from and immediately after it ' s passage , publication of Notice of
Adoption and Posting as required by law .

ARTICLE 3 Mobile Home Lots
301 A . Mobile homes lots may be located in any zone permitted
in the Town of Dryden Zoning Ordinance as amended
from time to time .
302 Applications for Installation Permits and Occupancy Certificates
shall be filed with the Enforcement Officer . The application shall
be in writing , signed by the applicant , and shall include but not be
limited to the following :
A . Name and address of applicant
E . Address and location of the land or premises on which the mobile
home is or is proposed to be located . •
C . Sketch drawino to scale of the mobile home lot showing the
location or proposed location of the mobile home and any other
structures , buildings or improvements to be placed on the lot , with
® dimensions and information to demonstrate compliance with
the provisions of this ordinance .

D . Satisfactory evidence that the mobile hone lot will have an
® approved individual water supply and individual sewage disposal
system or is on municipal water and / or sewer .
E . The Application and accompanying information shall be filed in
d uplicate with the Enforcement Officer .
F . The application shall contain such other information as the
Enforcement Officer deems reasonably necessary . to insure
compliance with this Ordinance .
303 If a proposed mobile home lot will , when constructed in
accordance with plans submitted as part of the application , comply
with the provisions of this Ordinance , the Enforcement Officer shall
issue a Construction / Installation Permit . At such time as
construction is complete and a mobile home has been placed on said
® lot and if such construction and placement is in compliance with the
provisions of this ordinance the Enforcement Officer shall issue an
Occupancy Certificate . No mobile home or mobile home lot shall
be occupied until an Occupancy Certificate has been issued .

305 All mobile homes hereafter placed on any mobile home lot shall
conform to amd comply with all applicable mobile home construction
requirements in effect as of the date of manufacture of the mobile
home .

•306 Lot Size - All mobile home lots ( not in a mobile home park) shall be
at least one acre in size and have a minimum usable area such that a
circle with 150 ' diameter may be inscribed within the usable area .
307 Yards - Mobile homes and mobile home stands shall not be installed
closer than 70 feet from the centerline of any road , and no closer
than 25 feet from any rear property line and no closer than 15 feet
from any side lot line . Secondary additions , carports and
individual storage structures shall be subject to the same set back
requirements .
308 Each mobile home lot shall be provided with
a mobile home stand and mobile home support system constructed
according to the provisions of this ordinance . Mobile homes shall
be installed on the mobile home stand and mobile home support system
according to the provisions of this ' ordinance .

309 - - Single wide mobile homes shall be enclosed with manufactured
skirting or a skirting wall within 60 days of placement of the
mobile home on the mobile home lot . Doublewide mobile homes on
mobile home lots shall be enclosed with a skirting wall within 60
days of placement of the mobile home on the mobile home lot .
310 Portable storage buildings shall be a manufactured or kit type or be
professionally designed and built . Permanent storage buildings
require a building permit and must meet the set -back requirements
outlined in this Ordinance .
311 Carports or Awnings - Attached or free standing carports and awnings
must be commercially manufactured and installed or be professionally
designed and built .
• 312 Steps and Decks - Steps and decks must be either commercially
manufactured and installed or be professionally designed and built .
313 Solid Fuel Installations
All solid fuel installations must be approved by the agency having
jurisdiction therof and the owner of the mobile home shall apply for
and obtain all required approvals .

® 314 Secondary Additions to mobile homes must be either commercially
manufactured and installed as if professionally designed and built .
' For all secondary additions exterior design and construction shall
be compatible with the existing home exterior sheathing and roofing
treatment .
315 For each mobile home on a mobile home lot one ( 1 ) parking space
shall be provided . Such space and the required access driveway
shall be the same as required for a single family dwelling by the
Tow : i of Dryden Zoning Ordinance .
316 No outdoor storage of furniture , operable or inoperable machinery ,
appliances , unlicensed or inoperable vehicles or trailers or similar
items shall be permitted .
® All such items shall be stored in
approved storage buildings or inside enclosed carports .

. . ® 317 Each mobile home stand shall be connected to a septic system which
will be used exclusively for that mobile home located on said stand .
318 . Every mobile home lot and mobile home stand shall comply with the
Electrical Code of the Tam of Dryden (Local I ^. No . 3 oc the
year 1981 ) and all the
requirements of the public utility furnishing electricity to the
site . All fuel supply and storage systems shall be installed and
maintained in accordance with all applicable codes , laws , rules and
regulations ordinances and local laws governing such systems .

® 319 Mobile home stands with natural gas shall have an approved manual
shut off valve . The gas outlet shall be equipped with an approved
cap to prevent accidental discharge of gas when the outlet is not in
use . All natural gas supply systems shall be installed and
maintained in conformity with the public utility company standards .
320 A . Mobile homes provided with liquified petroleum gas systems shall
have approved safety devices to relieve excessive pressure and shall
discharge at a safe location .
B . Such systems shall have at least one accessible approved manual
shut off valve located outside of the mobile home .
C . All piping shall be well supported and protected against
mechanical injury .
® D . Storage tanks shall not be less than
100 lbs . and be located not less than five ( 5 ) ft . away from any
exit .

321 A . Mobile homes with fuel oil storage tanks shall have the tanks
securely supported and fastened in place .
B . Tanks shall be equipped with permanently installed and secured
piping .
C . Tanks shall be at least 275 gallons capacity .
D . Fuel oil storage tank installations shall be screened from public
view .

All mobile homes placed on mobile home lots after the enactment of
this ordinance , shall be a minimum of 672 square feet . ( i . e . 12
® body feet wide by 56 body feet long ) .
323 Responsibility of Mobile Home Lot Occupants
A . Occupants of mobile homes shall comply with the requirements of
this Ordinance and shall maintain the mobile home lot , facilities
and equipment in good repair and in a clean and sanitary condition .
B . Sufficient garbage containers with tight fitting covers shall be
utilized for the storage and disposal of garbage and rubbish .
Containers shall be screened from public view .

• RESOLUTION NO . 84 1988
Councilman Evans offered the following resolution
and asked for its adoption :
WHEREAS , a resolution calling a Public Hearing on
certain proposed amendments to the Town of Dryden Zoning
O rdinance was adopted by the Town Board on March 8 , 1988 ,
which resolution among other things called for a Public
H earing on March 29 , 1988 , and
WHEREAS , a Notice of Public Hearing was published and
posted according to law , and
WHEREAS , said Notice of Public Hearing described all of
the proposed amendments to the Zoning Ordinance including
t he complete text thereof , and
WHEREAS , said Public Hearing was held on March 29 , 1988
on the proposed amendments as published and posted and at
such Public Hearing comments were received from the public
concerning the removing from said proposed resolution of
P aragraphs numbered 21 and 22 which repealed the provisions
of the Zoning Ordinance having to do with the Planned Unit
D evelopment and established and ordained new such
provisions , and
WHEREAS , such Notice of Public Hearing was sufficient
t o notify the public of the proposed amendments to the
S Zoning Ordinance as hereinafter set forth ,

The Town of Dryden Zoning Ordinance is hereby amended
as follows :
1 . Subsections ( 1 ) , ( 2 ) , ( 3 ) , ( 4 ) and ( 7 ) of Section
701 are hereby repealed .
2 . A new Subsection ( 1 ) to Section 701 is hereby
e stablished and ordained as follows :
" Section 701 ( 1 ) . One - family and Two - family
dwellings . "
3 . A new Subsection ( 2 ) to Section 701 is hereby
e stablished and ordained as follows :
" Farming , farm buildings , gardening , nurseries ,
greenhouses and the raising of livestock and
poultry . "
4 « Subsections ( 5 ) , ( 6 ) , ( 8 ) and ( 9 ) of Section 701

" Article X : MOBILE HOMES
Section 1000 . The intent and purpose of this
article is to establish and identify specific areas where
mobile homes may be placed on individual lots and to
e stablish the conditions and criteria for the replacement of
e xisting mobile homes .
Section 1001 . No mobile homes used for a dwelling
may be placed , sited , parked , established or allowed to
✓ emain any place in the Town of Dryden unless it complies
w ith this Article and with the provisions of the Town of
Dryden Mobile Home Ordinance .
Section 1002 . 1 . Mobile homes shall be an
allowed use in the RC Zone . All new placements and all
✓ eplacements shall be installed with a house roof system and
house siding system as defined in the Town of Dryden Mobile
Home Ordinance .
2 . Double wide mobile homes shall be
an allowed use in the RB - 1 Zone .
3 . An existing mobile home in a RB
Zone may be replaced with only a double wide mobile home .
S uch replacement shall be installed with a house roof system
and house siding system as defined in the Town of Dryden
Mobile Home Ordinance .
4 . An existing mobile home in any
o ther zone may be replaced with a mobile home of the same
size or larger . Such replacement shall be installed with ' a
house roof system and house siding system as defined in the
Town of Dryden Mobile Home Ordinance .

21 . The first sentence of Section 401 is
hereby amended to read as follows :

MONKEY RUN SEWER DISTRICT
APRIL 12 , 1988
Supv Cotterill read the notice that was published in the newspaper
t o consider the modification of the plan of sewerage heretofore
adopted for the Monkey Fun Sewer Dist ( 4 ) in and for said Town , at
w hich time the Town Board will hear all persons interested in the
subject thereof concerning the same .
Q UESTIONS AND / OR COMMENTS
Atty Perkins - the public hearing is required because you are
modifying the plan that was previously approved in the initial
stages of the formation of the Monkey Run Sewer Dist . These changes
• were suggested by the engineers after they were on the site . This
d oes not change the total amount which the district was authorized
t o bond . It is only a technical correction to the map , plan and
✓ eport that was previously filed . This will cost the district leas
money because there will not be a pump station constructed .
Rupert Hall - wanted to know who was going to benefit by this
district ?
S upv Cotterill - at the present time this will only benefit the
commercial establishments .
Rupert Hall - wanted to know what had to be done to farm a water
. and sewer district ?
Atty Perkins it is not economically feasible in the first
instance to include all of the residential property along Rt 366 ,
w hich has been studied . You can ' t base initial capital construction
o n the water district and sewer district on single family
✓ esidents , This would never get by the State Comptroller . The Town
h oard made the decision that the best way to start sewage in this
e nd of the town would be to have the bulk users pay for the initial
capital construction of the transmission lined . Such time as those
are in place , other districts will be considered including the ones
you are talking about .

Co Rep Watros - reported on the landfill issue .
Clm Evans - wanted to know what he had voted on and what he was
told ? His understanding is that you were told this was just
ancillary testing to be done in preparation for preparing the D7
site , and wanted to know if this was correct ?
Co Rep Watros - yes that was correct
Clm Evans - DEC , based upon what Larry Chase has heard that this is
in fact THE site . That the site is unsatisfactory on Lucente land
and this is the site to be tested for the landfill itself . This is
n ot some ancillary testing , they are testing for the landfill site .
E ither you they told you the truth or they didn ' t . The map is here
t hat shows the new site that was shown to the Shank ' s , and you are
aware of the magnitude of testing they are talking about . He wanted
t o know how the County Board could make a decision without knowing
t he facts .
L arry Chase - made a phone call to Frank Trent of DEC in Kirkwood ,
N Y . He is the person to whom the two memos were addressed that he
h ad acquired from O ' Brien and Gere .
Co Rep Tillapaugh - wanted to know why he was directed to Mr Trent ?
. Larry Chase - Mr Trent ' s name was on the memos that he had
✓ eceived . The memos were from O ' Brien and Gere to DEC . They
d escribed O ' Brien an Gere proposed hydrologically tests at the DR7
site . He had asked Barbara Eckstrom for that material which she
checked with Frank Proto , and he said okay , as long as a
✓ epresentative from O ' Brien and Gere was present .
Co Rep Tillapaugh - to his knowledge Mr Trent has not been
involved . He is the person we have worked with on the Landstrom
site .
L arry Chase - one of the memos , has stated that future
correspondence should be sent to Charles Chernoff in Syracuse . On
the other hand these memos were sent to Mr Trent on Feb 12th and
March 7th and we received the map that Clm Evans is referring to on
March 25th . His difficulties to Mr Chernoff happened through Mr
Trent . His expression to him was , as he understands by the
e ngineers are planning on the more northerly location to the
landfill that they have seen all along . That because of problems
they have found while drilling and because of the trout in Mill
Creek they have moved their interests to the south . He also stated
• that you don ' t do a study this intensive , if you don ' t intend to
put it there . In Mr Trent ' s opinion , the extensive set of tests ,
borings and monitoring wells being proposed , half of which are on
the Shank property , half on the Lucente property represent the
tests for THE landfill . They are not ancillary tests , extra tests
t o get a little bit of extra information . This is the site as he
u nderstands it . Everyone he has shown the map to has the same
✓ eaction . Mr Chase said that he has some people in the area

To Whom it may concern ,
The following are my notes from some telephone conversations
that I had on 12 April 1988 . I made these calls in an
attempt to clarify the apparent differences Fn the two memos
from Obrien and Gere to the DEC . The first , dated 12 Febru -
ary 1988 , has 6 maps that show the active cell in the " old "
location from the phase II report , north of the south - most
east - west stream on the Lucente property . The second , dated
• 7 March 1988 , has only a single map ( labelled " figure 1 " ) ;
that map shows intensive testing on a " new " location south
o f that stream and crossing over into the Shank property . I
w anted to know if the county plans to move the landfill
active cell south as shown in the second map .
I asked Bill Mobbs if the new map suggests that the
active cell has been moved south to straddle the prop -
e rty line between Lucente and Shank . He said that the
e ngineers want to test several alternatives as a part
o f preparing the dEIS ; they are required to show that
411 they have considered alternative locations . He said
that I should not assume that the active cell has been
moved , but he did agree that the " thrust of interest "
is now to the south of the previous location .
I called Empire Soil Investigations in Groton to ask
about a neighbor ' s observation that several of Empire ' s
✓ ehicles have gotten stuck on the DR - 7 site and have
✓ equired a bulldozer to get them out of the mud . I was
told that Empire cannot comment about events on the
site and that I should contact the county officials for
further information . Bill Mobbs said that he had no
information on that subject and that I should talk to
Barbara Eckstrom ( who was not in the office today ) .
I ' ll ask her on Wednesday 13 April. 1988 .
I called Frank Trent at the DEC in Kirkwood and asked
about the new map . He said that the engineers had been
planning on developing the originally - indicated loca -
tion for the active cell but because of what they found
there and because of trout in several streams they have
decided to redirect their thrust further south . He
said that he understands that the new map shows the
area that the engineers want to use as the active cell .
I asked about the possibility that they are just gath -
ering data on " alternative locations " , to which he
responded that " you don ' t do a study like this if you
don ' t intend to put the active cell there " . I also

told Mr . Trent about the dug well in the northwest cor -
ener of the Shank property and about the observed water
level in that well being within 1 - 3 feet of the surface
at all times . I also mentioned the groundwater evident
in a new foundation excavation at the corner of Wood
Road and Etna Road . He seemed interested in that
information .
These conversations suggest that there is some confusion .
The DEC seems to feel that the active cell has been moved
south , whereas the county seems to feel that no decisions
have been made . I personally feel that the new map shows
very clearly that the active cell portion has been moved
south and is no longer entirely on the Lucente property but
now entends onto the Shank property .

believes however that they will also say that literally these maps
show that the landfill has been moved south to be about one - third
o n the Shank property and two - thirds on the Lucente property .
Clm Evans - felt that the County is testing their way across the
Town of Dryden until they come to a suitable site .
Larry Chase - has spoken with Bill Mobbs and was told that they
w ere just getting some extra data to show DEC that they have looked
at some alternative locations in the general area , but did agree
w ith him that their thrust of interest has moved south of the

previous location .
Co Rep Tillapaugh - the maps that the County had before , have
✓ arious alternatives and that is what they are checking as to where
t hey would locate the solid waste landfill . Before they did this
t esting they had to design a plan with DEC and have it okayed . He
w ants to look at these maps to see whether these areas they are
t esting on are near the Shanks property and if this was on the plan
that they submitted to DEC before they started working .
L arry Chase - the map that he has referred to in his document was
✓ eceived by Mr . Trent on March 25th and this was the map for the
t ests which show testing to be done on half of the Shank property
and half on the Lucente property .
Clm Evans - wanted to know if Barbara kctstrom admitted that the
t esting on the DR7 site was very shaky at the construction
committee meeting ?
to Rep Tillapaugh - no , not that he knew of .
to Rep Watros - he asked the question that it seemed to him thi'
move indicates that DR7 is shaky but he did not want to quote her ,
h e sensed concurrence that she might have said yes .
E llen Shank a they have never been contacted by the County in all
o f this time , and she has been to their board meetings . They only
mentioned that they were considering Mr Luoentes property .
h im Evans - the map has a dark line which he assumes would be the
maximum , and the Shank property even extends out of that . If this
is the correct map it will take even more property that is not
located in the specified DR7 site to build the landfill .
Clm Schlecht - essentially they have moved on to a new site , and
t hey are willing to to on by declaring eminent domain , but they
w ouldn ' t do that 1111. Dandy .
Clm Evans - they wouldn ' t use eminent domain anywhere else . The
✓ eason DR7 was selected with the criteria was that you could he
I 410 what you wanted and wanted to know if all of the rules have been
changed ? It looks like the testing is going to be done in West
Dryden until you can find a place , since you have already gone off
t he site . This should constitute a new site .
Atty Perkins - wanted to know how the test vehicles were getting on
the sites ?
Co Rep Watros - he thought they were using Wood Rd .
Atty Perkins - thought that the County should convey to Mr . Mobbs
and Mr . Proto and anyone operating a vehicle that Wood Rd is a Town
Rd and is posted with a S ton weight limit and has been posted for
sometime . He will ask Hwy Supt Gilbert to make sure they are still
posted as such . If there is a vehicle there that is in excess of S
t on someone will be issued a summons .
Clm Schlecht - the Town Board has asked the County each month as to
w hether or not the County has taken any other action as to look at
alternative sites . Have they begun to test other sites in the
County ?
Co Rep Watros - at their meeting yesterday there was a discussion
t o allocate funds to O ' Brien and Gere to look at 8 backup
additional sites , a more detailed look at 5 sites and then the
ultimate selection of 3 sites . This is moving forward and you will
see Board action at the next meeting for O ' Brien and Gere to start .
Atty Perkins has the 8 sites in the Phase 1 study .
Clm Evans - there is a rumor that Landstrom shows no water
pollution with the testing that DEC has done .
Co Rep Tillapaugh - DEC does claim that there is water pollution
t here .
Clm Evans - felt that the Town of Dryden is being had because the
County keeps changing the rules and being completely dishonest with
the Town of Dryden . They are not willing to follow their original
✓ ules that they set up . If the County is willing now to condemn the
Town of Dryden land , why haven ' t they been willing to condemn any
other land . He wants to know why they are only willing to condemn
o nly Town of Dryden land ?
Co Rep Watros - agreed with Clm Evans . He thought that with this
o ther backup site you might see some forced entry on these other 8
sites .
Clm Evans - you have to admit that the County has not made every
e ffort not to bother with forced entry on the other sites , and they
h ave not operated in good faith . Also the environmentalist for
O ' Brien and Gere said that this was the worst landfill site he had
e ver seen .
Co Rep Tillapaugh - would like to see a copy of his report .
L arry Chase - did have permission to go on the Shank property and
there is a dug well on the property and the water is 1 foot from
t he surface of the ground . This was mentioned to the Solid Waste
Committee yesterday that this is just as wet as the Lucente
property . Also CROWD is going to have a press conference on
Thursday morning .

Co Rep Tillapaugh - reported on Pinckney RD bridge . Plans for
401 construction is in late 1989 . There is a problem with the Dewitt
Historical Society in Ithaca and Dryden . They do not want the
bridge removed . They want it rehabilitated and left there for use .
It was built by the Groton Bridge Co . in the 1000 ' s , They are
t rying to get it established in the State registrar . Right now the
bridge plans are on hold until this is resolved . The bridge will
n ot hold the weight limit of fire trucks as it is at the moment .

RUN SEWER DISTRICT ( 4 ) IN SAID TOWN .
WHEREAS , pursuant to proceedings heretofore had and taken in
accordance with the provisions of Article 12 -A of the Town Law , the
Town Board of the Town of Dryden , Tompkins County , New York , has
heretofore established the Monkey Run Sewer Distict ( 4 ) in said Town
and has adopted a plan of sewerage therefor ; and
WHEREAS , a resolution was duly adopted by said Town Board on
March 29 , 1988 , specifying the 12th day of April , 1988 , at 7 : 30
o ' clock P . M . , Prevailing Time , at the Town Hall , 65 East Main
Street , in Dryden , New York , in said Town , as the time when and the
place where said Town Board would meet for the purpose of holding a
public hearing to hear all persons interested in the consideration
of a proposed modification of the plan of sewerage heretofore

APPURTENANCES AND LAND AND RIGHTS IN LAND IN AND FOR THE
MONKEY RUN SEWER DISTRICT ( 4 ) OF THE TOWN OF DRYDEN ,
TOMPKINS COUNTY , NEW YORK , AT A MAXIMUM ESTIMATED COST OF
$ 933 , 000 , AND AUTHORIZING THE ISSUANCE OF $ 933 , 000 SERIAL
B ONDS OF SAID TOWN TO PAY THE COST THEREOF .
WHEREAS , pursuant to proceedings heretofore had and
t aken in accordance with the provisions of Article 12 - A of
t he Town Law , and more particularly an order dated April 12 ,
1988 , the Town Board of the Town of Dryden , Tompkins County ,
N ew York , has established the Monkey Run Sewer District ( 4 )
of the Town of Dryden ;
WHEREAS , pursuant to proceedings heretofore had and
® taken , and more particularly a bond resolution dated July
14 , 19 87 , the Town Board of the Town of Dryden , Tompkins
County , New York authorized the purchase and installation of
approximately 13 , 000 linear feet of 8 inch sewer main ,
together with pump stations , gate valves , necessary
appurtenances and land and rights - in - land in and for the
Monkey Run Sewer District ( 4 ) of the Town of Dryden ,
Tompkins County , New York , at a maximum estimated cost of
$ 933 , 000 and further authorized the issuance of $ 933 , 000
serial bonds of such Town to pay the cost thereof ;
WHEREAS , pursuant to proceedings heretofore had and
t aken , and more particularly ( 1 ) a resolution dated March

said Town , and ( 2 ) a resolution , dated April 12 , 1988 ,
approving a proposed modification of the plan of sewerage
heretofore adopted by the Town Board of the Town of Dryden ,
Tompkins County , New York , for the Monkey Run Sewer District
( 4 ) in said Town , the Town Board of the Town of Dryden ,
Tompkins County , New York approved a proposed modification
of the plan of sewerage heretofore adopted by said Town
Board ;
WHEREAS , it is now desired to authorize the purchase
and installation of approximately 8 , 000 linear feet of 8
inch sewer main and approximately 6 , 450 linear feet of 10
inch sewer main , together with pump station , gate valves ,
necessary appurtenances and land and rights - in - land , for
said Monkey Run Sewer District ( 4 ) , as more fully set forth
in the order establishing said Monkey Run Sewer District ( 4 )
and the subsequent proceedings described herein , and to
provide for the financing thereof ; and
WHEREAS , all conditions precedent to the financing of
the capital project hereinafter described , including
compliance with the provisions of the State Environmental
Quality Review Act , have been performed ; NOW , THEREFORE , BE
IT
RESOLVED , by the Town Board of the Town of Dryden .
Tompkins County , New York as follows :
Section _ 1 . The bond resolution dated July 14 , 1987 ,
of the Town Board of the Town of Dryden , Tompkins County ,

appurtenances and land and rights - in - land for the Monkey Run
Sewer District ( 4 ) of the Town of Dryden , Tompkins County ,
New York , at a maximum estimated cost of $ 933 , 000 and
further authorizing the issuance of $ 933 , 000 serial bonds of
said Town to pay the cost thereof is hereby superceded ;
S ection 2 . The purchase and installation of
approximately 8 , 000 linear feet of 8 inch sewer main and
approximately 6 , 450 linear feet of 10 inch sewer main ,
together with pump station , gate valves , necessary
appurtenances and land and rights - in - land , for the Monkey
Run Sewer District ( 4 ) of the Town of Dryden , Tompkins
County , New York , as more fully described in the aforesaid
proceedings , at a maximum estimated cost of $ 933 , 000 is
hereby authorized .
S ection 3 . The plan for the financing of the
aforesaid specific object or purpose is by the issuance of
$ 933 , 000 serial bonds of said Town hereby authorized to be
issued pursuant to the provisions of the Local Finance Law .
Further details pertaining to said bonds will be prescribed
in a further resolution or resolutions of this Town Board .
S ection 4 . It is hereby determined that the period
of probable usefulness of the aforesaid specific object or

® purpose . is forty years , pursuant to subdivision 4 of
paragraph a of Section 11 . 00 of the Local Finance Law . It
is hereby further determined that the maximum maturity of
the serial bonds herein authorized will exceed five years .
Section 5 . Subject to the provisions of the Local
Finance Law , the power to authorize the issuance of and to
sell bond anticipation notes in anticipation of the issuance
and sale of the serial bonds herein authorized , including
✓ enewals of such notes , is hereby delegated to the
S upervisor , the chief fiscal officer . Such notes shall be
o f such terms , form and contents , and shall be sold in such
manner , as may be prescribed by said Supervisor , consistent
w ith the provisions of the Local Finance Law .
® Section 6 . The faith and credit of said Town of
D ryden , Tompkins County , New York , are hereby irrevocably
pledged to the payment of the principal of and interest on
such bonds as the same respectively become due and payable .
There shall be annually assessed upon and collected from the
several lots and parcels of land within said Monkey Run
S ewer District ( 4 ) deemed benefited by the improvement , so
much upon and from each as shall be in just proportion to
the amount of the benefit which the improvement shall confer
u pon the same , an amount sufficient to pay the principal and
interest on said bonds as the same become due , but if not

0 paid from such source , all the taxable real property in said
Town shall be subject to the levy of ad valorem taxes
without limitation as to rate or amount sufficient to pay
the principal of and interest on said bonds as the same
shall become due .
Section 7 _ The validity of such bonds and bond
anticipation notes may be contested only if :
1 ) Such obligations are authorized for an object or
purpose for which said Town is not authorized to
e xpend money , or
2 ) The provisions of law which should be complied
w ith at the date of publication of this resolution
are not substantially complied with , and an
® action , suit or proceeding contesting such
✓ alidity is commenced within twenty days after the
date of such publication , or
3 ) Such obligations are authorized in violation of
the provisions of the Constitution .
Section 8 . This resolution , which takes effect
immediately , shall be published in full in The Ithaca
Journal , the official newspaper , together with a notice of
the Town Clerk in substantially the form provided in Section
81 . 00 of the Local Finance Law .

Update :
During the month of March the last of the necessary arrangements were
completed to get . the , " Junk Car Removal " going . Thanks to the help
of Karl we were able to get some press coverage . As a result of that action
people have been calling here to get more detail of how to get their vehicles
removed . I ' ve attached a copy of the fine article that Karl wrote for your
review . Thank you Karl ! As a result , I ' rn covering the roads one afternoon a
week spoting non - compling vehicles . There are easily several hundred vehicles
that do not comply . I ' m guessing that by the end of the summer that I will
have covered all roads . This may or may not hold . I ' ll have to recover all
roads at least once just to verify removal after notices have been issued .

prior to the next Town Board meeting . Site Plan Review notices require a
10 day posting and the Ithaca Journal requires a min . of 3 days lead prior

DISCUSSION
There was discussion regarding the leak in the Town Hall roof , also
the roof on the highway building should be looked at . The building
committee will look into this and make a recommendation .
Letter from the State Cable Commission that the Town franchise with
American Community Cablevision expires in 1991 . This requires
action 3 years prior to the expiraticin date .
