PUBLIC HEARING
NOVEMBER 5 , 1986
Minutes of the special meeting held Nov 5th
Supv Cotterill called the meeting to order at 7 : 00PM _
Members and guests participated in the Pledge of Allegiance .i
Roll call was by the Town Clerk - Present : Supv Cotterill , C1m, Evans , Clm Webb
Clm Schlecht and Clm Garlock
Absent : Atty Perkins
Supv Cotterill read the notice that was published in the newspaper to consider
a proposed amendment to the Town of Dryden Mobile Home Park Ordinance .
1 . Section 2 of the Town of Dryden Mobile Home Ordinance is hereby amended
to read as . follows : •
" Section 2 . Purpose
( 1 ) It is the purpose of this Ordinance to promote the health , safety ,
comfort , convenience and the general welfare of the community and to
protect and preserve the property of the Town of Dryden and it inhabitants
by regulating mobile homes and mobile home parks in the Town of Dryden , NY .
(2 ) J4obi1e homes shall only be allowed in mobile home parks which are
established pursuant to this Ordinance / Mobile home parks may only be
established in those areas of the Town of Dryden which are served by
municipal water and sewer services"
QUESTIONS AND / OR COMMENTS
Supt/ Cotterill - the zoning ordinance was passed in 1969 and since that time there
have been a few_ changes . There has- been a lot of requests by different groups in
different areas of the town to make amendments to the zoning ordinance in several
different areas , not specifically mobile homes' , but this is one that we have
had specific requests for . The Planning Board has been directed to study the mobile
home ordinance and the zoning ordinance and make recommendations for possible
updates, changes or. clarifications . There have been a ; few changes to the ordinance
but not very many, This proposed amendment will not effect any current , existing
mobile home in the town . These would be grandfathered in under State law . Also ,
where there is a. mobile home on a private lot it could be replaced with a newer
one within a certain length of time . This will effect any new proposal and will
also include. existing mobile home parks if they are not on water and sewer .
They would not be able to enlarge if they are not on water and sewer .
B . j0 flcCardle , McLean - the idea of putting a mobile home on a lot is because
of the financial situation where people can not afford to build a house or put
the time into building . They buy a lot for an investment and put a mobile home
there with hope's in the future they might be able to build a house , or that
might be all the person can afford to buy. If the Town puts• these stipulations
in you are forcing the person that can ' t afford a $ 60 , 000 or $ 70 , 000 house to
pay rent to other people and -make them the profit , when in fact they should have
some equity themselves . This is- probably the only level they can start at and
-maintain . If you look at the mobile homes they make today, there is nothing
wrong with them . Some houses look worse than these mobile homes . She wanted to
know why there was any question to mobile homes and who was making the question ,
people. in $ 80 , 000 houses or who . It does not seem fair to the people that cannot
afford anything else . It is not that they are trying to live cheap , but is within
their budget . This would be the senior citizens and the young people trying to
make a living . There has to be a line .
Supv Cotterill a lot of towns - around Dryden do have ordinances that have
restrictions or in some cases are not allowed .
B . J . McCardle - if you have restrictions to put in a foundation , you are not only
making a burden on the person that can ' t afford anything higher , but you are
putting in a permanent fixture- which makes. the tax rate go higher . The idea is
to keep the price down so you can afford something .
Roger Hatfield - Cheryl Lane - he owns a trailer park on Hanshaw Rd and has 44 acres .
They have had numerous requests to expand , so this would mean no expansion .
Supv Cotterill - unless there is public water and sewer .
Roger : Hatfield - is the Town going to be expanding water and sewer out in
their neighborhood .
Supv Cotterill - the Town is willing if he is willing to pay, but is not sure that
it would be feasible .
Shirley Spencer West Dryden Rd - they are in .the process of putting their mobile
home on their lot and wanted to know -how this was going to effect them .
Supv Cotterill a building permit that has been issued or - preexisting is not
effected .

Shirley Spencer - it was stated earlier due to health and• s.afety , she wanted to
know the meaning of that .
Supv Cotterill - felt . that health and safety would be the welfare of the whole

•B . J . McCardle -1 there are some houses that are so bad they shouldn ' t even be
• there and should be demolished as far as health and safety , so why pick on the

Supv Cotte•rilli -. this is true , there are probably some houses that are a problem .
, John Tottey , Beam Hill Rd - to put a trailer on a lot in the Town of Dryden and
apply for a building permit , you need Health Dept approval even . before . the permit
is issued, On the health and safety , if it _ is . all right for a house why isn ' t it
all right for a mobile home with . regard . to water . and sewer . You are just talking
about a -place . to live basically .. You still have to conform to the Board of Health

Dennis George , •jGeorge St . - wanted . to know what constituted a mobile - home , is it
a certain dimension or certain . size . Is it something with wheels on it , If you- - .
t ake the wheels off and put a founda `tion , unden it , then would it become a house .
What is the difference between a modular • house. , a mobile home or a . prefaB house ,
Supv Cotterilll - there is a definition in the present mobile home. ordinance which
states that a . H;yehicle either standing on wheels or with -wheels -removed -and : resting
on crib-b?.ng7 ties ? 1baocka Or a wall and used for year round human habitation . A
-mob ,ie home shall not be considered to be a - dwelling or . dwelling unit for the
purposes- of this - ordinance .
Phil Conger , , -Krk. Rd - he has property that he .- pays taxes on , andhe. ,chooses to
live. - in a -mobile home . When he is tired of a, mobilehome he wants to be able
to exchange it for another one , : just like he doe“ is- cars . ' He wants . . to continually
live . in a mobile home , not an expsensive house and does not want to be told that
he - can ' t livelin a -mobile home . , He does not want to move out to the middle _ of
nowhere whereihe would have to travel 50 -miles to work . ° He felt that he should
not be deniedih.is freedome . ' to .have : what he wants- to live in and where he wants
t o live . in it w?ient it . is Dryden ,. Ithaca . br anywhere . else . . He does not want
someone building a $ 100 , 000 house next to him and then having them wanting to
h ave _ the Board pass zoning so that he can ' t replace_ his mobile home , with. a newer
one . Every year they come out with new models and if he - wants to. buy a new; model
he wants to be able to do it and not be restricted to an old 14` fbot wide trailer .
Supv. Cotterill - existing - trailers will not be .effected by this .

Norman . VanTine , - :Wood Rd - at present he doe 's live in a mobile home park and he does
own a lot on Wood Rd with: a mobile home on it . Most of. Wood Rd does have mobile
homes and he agrees with.- restricting mobile homes in certain areas . He felt that
it is wrong when the whole Town is restricted to mobile homes on a lot . Most of
the people with. mobile homes on a lot are established and intend to stay there .
Roy Rizzo , owner of Country Manor Estates Trailer Park on Wood Rd . - he can
understand th'e Town , with . restricting mobile homes . in the village and restricting .
t hem to a certain area . He ' cannot understand why a mobile home park would be
✓ estricted to! a -municipal water and sewer , when they get. . constantly , checked by
the HealthDept . They have to meet all of the Health Dept standard's on sewage ... and
• water , The mobile home parks around here are better than most of the houses when
it comes to sewage and water . He felt that there. are no violations in the parks
because they me so restricted by. the Healt Dept . Re ' is opposed - to restr 'i'cting
the. -mobile home and felt that there should b.e . a designated area for them .
P am Kellogg , 901• Dryden Rd - she currently lives in a mobile home park : She is
not in favor ef these town proposals . for the following - reasons .
1- she is not aware of any health or safety reasons why a mobile home, is in
anyway anymore of a risk than a . home built site . You still have the . same water ,
sewer and electrical hook-ups . .
2- there is a very thin line between modular and double wide. homea .and modular
being acceptable .
3- site built homes tend to be unaffoyd-alire to many people .
• 4- the proposed ordinance restricts freedom of choice .

5- by forcing people into a no choice park situation it tends to ghettoize people .
P arks in theIpast have been built in swampy areas causing collective health and
safety problems more so than on individual lots , and the Health Dept is not strong
enough in getting some of this cleared up .

6- some site built homes are health and safety hazards which the Town does
not deal with properly , example 1900 Hanshaw Rd .
7 - with constantly rising land prices people tend to keep their homes . It is up
to the individual and the Town to promote good looking places . Possibly promoting
_ a tax break for those who do keep their homes in better shape . She has driven
around and there are just as many trailers as there are site built homes that
are kept up , be it on a foundation or not .
8- some landlords tend to be quite overbearing in regulating park residents who
own their own homes , that only rent their land. They are encumbered with rules
and regulations and also very controversial ones .
799 ' 9 - the way she ' understands it you are going to ' be discriminating against
the working class people who can ' t afford a $ 600 or $ 700 house payment .
Lynne George, George St - still cannot understand the health and safety . She has
lived the last 20_ years of her life lop a mobile home . There were no problems
because everything has to be inspected : by the Board of Health . Her parents never
had a leaky septic , once or twice they had frozen water , yet the neighbor also
had frozen water . Yet , when she moved into an apartment she was subjected for
months and -months of raw sewage backing up in her bathroom . She wanted it pointed
out the health and safety for an individual buying an acre or two of land to put
a trailer on . It has to be inspected by the Health Dept just like a home .
Supv Cotterill - thought there was not any difference between health and safety
regarding mobile homes or a site built home . He did not think that the words
health and safety has . anything different to do with mobile homes than they do
with residents or commercial businesses . These words are - throughout the zoning
ordinance itself , The zoning regulations are there to promote a better town ,
they are not aimed at mobile homes or mobile home parks . There has been a request
to rewrite the ordinance to make some specifications as to what should be required
to make them acceptable . The Planning Board has been working - on them . There
was a request for a mobile home park in the West Dryden area which was approved
because they min all of the present specifications yet the boardroom was filled
with people objecting to it because of the water and sewage problem which creates
a health hazard to the Town . '
Jan Rogowicz , Irish_ Settlement Rd - has lived in a mobile home since 1972 . People
are concerned that someone like youself is deciding what value they should have in
their housing . You are the people who are going to vote and decide just what type
of development can occur in the Town . There is a value judgement ' and what gives
the planners , because he has ' a maters degree in public planning to be the only
dreamer for this' society. The only person in the society who can establish values. .
These people have no gift from God to establish their values . He chooses to live
in a mobil home because he can afford to live in one . It is all he really needs
and does not think that there is anything . wrong with. that ' or anyone else wanting
to live in a mobile home . People should have the option to be able to have a
mobile home in this country on their own land and have the option at sometime if
they live in a park to move in the country . People need freedom _ and this is part
of what America is . He - did not think that these things should be denied .
Pat Hatfield , real estate broker in Dryden - she has a waiting list of people that
are waiting = for land to put their mobile homes on . ' Every listing that comes through
the multiple listing board from Cortland and Ithaca has a deed restriction against
mobile homes . She can ' t believe West Dryden Rd that is made up of almost all
mobile homes now , any land out there has a deed restriction against mobile homes .
She can see a restriction against the size of mobile homes and the number of families
that might be living in them , but cannot see saying no to these mobile home owners
that are looking for land . . -
Jim Shippy , owner of Homes of Integrity - ' he felt ' that the way ' the amendment is
drafted is highly : discriminatory and prejudicial . He thought that it was drafted
by people who don ' t live in manufactured homes themselves . He felt that you are
saying something about the kinds of people you don ' t want in Dryden and this is
what is bothering him . He has an invested interest:;.• _ and he likes Dryden and likes
the people in Dryden . He thinks that people that ' live in mobile homes are not any
better or any worse than people that live in $ 100 , 000 . He strongly ' suggests that
the Town develop an ad hoc committee made up of Jim Ray and perhaps some other
people who have knowledge of manufactured homes . Manufactured homes built now
are better built than some of the stick built houses you have right now . They have
2x6 sidewalls , 16 inch . on the center , r27 in the ceiling , r19 - in the sidewalls ,
and r22 in the floor . These homes sell anywhere from $ 25, 000 to $ 35 , 000 . So to
place these. homes in Dryden will increase your tax base . This amendment reads that
you are going to deny any mobile homes in the Town of Dryden . Yet , you do not make
municipal services available so that a halfway decent park could be developed ,
so that we could spend that kind of money to develope it in this community .
Therefore on the record , I think that what you have done is highly discriminatory
and prejudicial .

Supv CotterillH - the Town of Dryden has more trailers than any town in the county ,
so we certainly have not been discriminatory . Possibly the reason that we do is
because the other towns have restrictions on mobile homes .

Jim Shippy - why is a developer = who builds a $ 100 , 000 is : appointed to the planning
committee . Why don ' t you appoint someone to the planning . committee who lives in a
mobile home ? .

Supv Cotterill - there is a member on the Town Board that lives in a mobile home ,
so we are not • trying to be discriminatory .
Jim Shppy - !he did not mean the TownTBoard but the Planning Board .
Supt/ Cotterill - we are looking all . . the time for people to serve on the Planning
Board and Zoning Board of Appeals and other boards inythe Town . If there is
anyone that would like to contribute considerable time to the Town Board and
county meetings they would be more than willing to have their names who would
like to serve )
Lela Sutliff , .4Goodband Rd has lived in a trailer for 24 years . They have been
happy living in, a -mobile home and have had - 5 different ones .

Pam Kellogg - Ithe ' reason that she owns a mobile home is so that she can get
• it . paid off arid do other things and not having to pay all of this interest to banks .
In-the past you haven ' t even been able to deduct mobile homes unless they are on
a permanent foundation or on a separate parcel . The Town of Maine just lost a
case , where alperson owning a mobile home did challenge the Town with a similar
ordinance ,
Frank VanTine Wood Rd - lives in a trailer - park and he plans to . buy a piece of
land so that he can put a mobile home or . a double wide on it and he wants that
decision to be his . own , He wants a place with his own pride and does not want
a $ 100 , 000 home next door or behind him . He does not want all of his money going
into interest , -
Jim Ray , onwer of Hillside Acres in Varna _ he would like to know if anyone in the
room was in favor of the proposed ordinance . .
Gertrude Calvert , West Dryden Rd . - was in favor of the proposed ordinance . She was
opposed to the recently proposed mobile home park that was just passed on West
Dryden Rd adjacent to her property . Her feeling is that there are too many
parks already and it will lower the property value .

Jim Ray the?re are no national studies to confirm the idea that mobile homes . .
lower property value . Mobile homes - when . they are properly installed do not lower
property -value , . There is a chance that you have poor installation , but as a
general rule it is not fair - to make that statement . He would like to raise the
question - knowing that you can ' t get an answer but - the way you make water and
sewer. as part , of the proposed ordinance . Will you , if you are going to restrict
mobile . home , parks to one or two . districts be expanding water and sewer . As you
expand them will you be making them large enough. to . nake the provision for mobile
home parks .toibe built within those districts so . that as a district grows a . certain
percentage of; the people that want to live in that area can live in mobile homes
. as an alternative . A mobile home as defined by the . federal government now control
all of the construction In a mobile home made available . Is nodular home
' transported t'o the site on a chasis that stays with the - komq ° axels are sometimes
rezoved , . but most of . the new homes look exactly like a conventional - home once
they are intoned , There are people who are against the esthetics of mobile homes
inirnore restricted areas other than Dryden and have gone so far as to demand on
new installation house roofs , and siding and some towns have phased this in over
a number of years . As a mobile home dealer even though it costs them anywhere from
$ 1 , 300 to $ 2000 it does add to the durability of the product. This type of thing
along with. aIlfew other installation regulations as- to sturdier steps etc makes
a mobile home fit the category of conventional housing . This particular position
that _ he takes) has been taken by - the Federal Court in Louisiana . The Federal Court
has ruledthat the parish down there who . said that you could not have any mobile
homes anywhere . in the parish , that the ordinance was arbitrarily and unreasonable
and that the lordinance did not address . itself to the characteristics of the
manufactured ,ihome as it exists on the land as to the characteristics at the time
of deliverance . You can deal . with the differences here in0local regulations
without outlawing this particular housing . alternative . The ° Judge said that the
manufactured ! homes today can compare. favorable with site built houses in size ,
safety and attractiveness . With the assumption that all manufactured homes are
different from site built . homesCwith respect to the detriment ., resident and the
publicspacei.problem can to longer be accepted . The ordinance does not address
the statement made by IIr Shippy , - -who has been in the business longer than he has .
Many local jurisdictions have eeen enacting laws . requiring ° equality in treatment
in : the manufactured housing . These new laws , single family homes cannot be barred
from a single - family neighborhood simply because of the fact they are a mobile home .
It seems to him that the Town . Board should take the position that they are a
good housing lalternative to low and middle income people and affordable .

The problem is that they cannot provide this to many people because of many
local governments have made this kind of housing illegal . It is expensive ,
and he doubted very much if any person in this room had the resources to take
this case to Federal court . If the Town Board does enact such an ordinance , it
might not be challenged . It might take people like Jim Shippy and himself
pooling resources and park operators to help , since they are also in the sales
business He has seen and sold some of the junky situations that are in this
t own and other towns , but so have the builders in Cayuga Heights and everywhere
else . Every neighborhood has its sore subject . You can however , through
✓ egulation on the installation that you have before you ( Jim Ray gave a copy
o f his regulations in his mobile home park to the Board members and left copies
for the Planning Board ) set up some specifications such as skirting , siding ,
✓ oofing , steps , commercial manufactured dishes or professional design of
dishes . You could set a standard that would be acceptable and place the mobile
home on the same status of the conventional house . You already have your zoning
with setback requirements , additions , and garages so there is no difference for
a mobile home on a private lot . There should be no difference in the type of
control between the two kinds of houses . Mr Shippy has suggested an Ad Hoc
committee for further study and he feels that this is a . good idea , and felt
that some of the people in this room should be_part of that process . Either
✓ eviewing the committees proposed document or being on the committee itself .
He felt that the people in the Town , on the Town Board and Planning Board have
the ability to come forth with a comprehensive program to bring the respect for
mobile homes up where it should be and to possible punish those who are causing
the problems . The reason we are here tonight is because somebody did not clean
up their yard . The Town Board has the ability to govern some of those practices
and set some standards . In realtion as to where you start I don ' t think you
need a consultant , you simply could study a municipality within a 50 mile radius
from here or write to the State Planning Association . If you just take the park
rules of the various parks in the area and pick out the good and bad parts , you
will find a set of controls that are not going to very much differ than you
would probably put on yourself . Some of his rules follow word for word the present
Town Ordinance . He would be glad to provide some time on any type regulation like
this . He would like to see mobile homes still available on private lots . He does
agree that mobile homes should not just be anywhere . In relation to public water
and sewer , in the last 28 years he has seen a lot of people in various parts that
their equity has been hurt by the fact that certain parts of the town has been
closed or spaces have been closed down because the sewer systems have failed or
water systems have failed . In most cases where a park is allowed to be large
enough they were able to solve their problem and develop a new water and sewer
system . If the Town of Dryden should expand water and sewer they should be
treated as a multi family operation such as an apartment house . He has been looking
in the Town of Dryden for land for a new park and he has found very little land
that the Health Dept tells him he needs . The Health Dept requires space to replace
every system once , so that when a system fails he has enough space available for
another system to replace the failed one . He appreciated the opportunity to talk
t o the Board and he would be glad to come back and give some assistance . He does
have a set of park rules and most of the tennants are happy and like the standards
that he sets because they do have high standards . In exchange they do have a lot
o f friends in the Varna community because they feel that their property value is
not effected .
Ted Burke , 633 Caswell Rd - has bought a piece of property 3 years ago and the
value of the property was $ 1 , 300 . He now has a mobile home and a pole barn on
his property and is assessed at $ 18 , 000 . So he does not see where a mobile home
could devalue property .
Catherine Brown - she is one of the people who has circulated the petition on the
west end of the Town of Dryden which has asked to be rezoned from RC to RB1 . This
does not restrict mobile homes on individual lots . The petition was trying to stop
adding mobile home parks in unsuitable places . There was a public hearing for a
mobile home park in the West Dryden area and there was a large turnout of people
who said they know the land , know the soil conditions , and know the conditions
of the mobile home park which is already at the upper end of Hanshaw Rd . They
were complaining of water pollution , and other problems there . It was brought
up that they do not need any more mobile home parks in this end of the Town of
Dryden.. . If all mobile home parks were as strictly regulated as Mr Ray would
perhaps like to see than it might be different , but they never have been and for
the foreseeable future they were not going to be . They know that the Health Dept
is not as strict as it might be on the septic conditions . They are not against
people in mobile homes on individual lots , they do have nice homes and have pride
in ownership . What they are against is the devaluation of the whole of the Town
as compared to the rest of the county , because in Dryden anything goes . She thought
that this was just a hearing for a moratorium , that this is not going to be forever .

Supv Cotterill ! read the notice that was published in the newspaper to consider the
establishment of a proposed sewer district know as Monkey Run Sewer Dist (4 )
QUESTIONS AND / OR COMMENTS
Robert Kellogg ; 1226 Dryden Rd - his name was mentioned in the description as being
on the border of the proposed districts . Is it the Towns intent that any property
owners along Rt 366 would not be included .
Supv Cotterilli - There is no residential property included in this proposal .
Mr Kellogg - the way the boundary is drawn on the map it would take in the south
side of the old railroad r-o -w , A number of property owners along Rt 366 had an
opportunity toibuy to the center of the railroad r-o-wand that was purchased with
the understanding that if any utilies were to go in there , such as a sewer or water 1
line t e. Town would automatically have the easement to put the lines through . He
would/ heave the Board consider relocating the boundary line to the center of the
✓ ailroad r- o-w+ because if not that is going to include a small portion of all of the
property- owners along Rt 366 . If the boundary line can be relocated through the
centers that will show the boundary of the proposed district , If things go through
and they want to put the trunk lines in the r• - o -w-, then the ' Town can exercise their
easements and put the lines anywhere on the 66 foot r- o-w .
Supv Cotterilll - does not see this as a problem to move the ' boundary of the district
t o the center of the r- o-w .
Atty Perkins - I could not see a foreseeable problem
Catherine Brown , Lower Creek Rd - pointed out that there are several errors in the._
description and that the road names should be changed from Hanshaw Rd to Lower
Creek Rd . '
Roger Gromet , owner of Parkwood Village - there are 149 tennants . They would like
t o be given the opportunity to join the water and sewer district , in case something
happened to 'Fall Creek , which is their primary source for water supply , It would be
a great benefit to the Town and he would like to have them considered .
Supt/ Cotterill, - it has been looked at and studied . There were a number of reasons •
why it was not included in the original proposal . One reason was going to involve
illr
more time and expense . The Boards feeling was that if they started with this
present proposal , they would make the capacity to allow for growth so - - that other
districts coulld be formed . This would not only be the Hanshaw Rd area , but other
areas along Rt 366 where people have expressed an interest .
Roger Gromet -ifelt that there would be two immediate contributors on Hanshaw Rd
to the cost of the new district , in that there are significant commercial facilities
there . They do not need any water at this time , since their source at Fall Creek is
doing a good job , but Fall Creek is an open creek . They are also aware that NYSE &G
is in the proposed district and they may abandon their plant , tand they would have that
opportunity . They have examined all of these . They have some wells that they haven ' t
completely utilized and could always drill more wells . . They have not had a chance
t o study the engineering report and would like a copy of it . They would like to ask •
• that before the Board makes a final decision1they have a chance to study the report .
It maybe that after they study the report they: would not want to join , but they
do not have that attitude and feel that it is something for the future .
Supv Cotterill the Boards feeling is that there will be future expansion and growth .
Roger Gromet - would like to see some kind of commitment ; be it now or some years
down the road for their opportunity to hook-up if they ever have a tragedy at the
mobile home park .
John Majeroni , representing Cornell Univ - they were concerned with the proposal for
the 'main reason that about 700 acres that are involved , 600 acres of the land belongs
to Cornell Univ . Therefore , they are curious as to why you are calling it a commercial
district when such a small portion of it is . really commercial . They . do not think that
the proposal is in the public interest and cannot believe that all of the properties
benefited are included in the district . Specifically out of the Cornell 600 acres
about 400 of - that is the Monkey Run natural area . The remaining 200 acres is in
agronomy and plant breeding and is used for educational purposes . By making the
university essentially pay. to have this sewer and water line run'_ to NYSE & G and
commercial properties puts an unfair burden on those properties that are in our
educational usage . They also fea that it is just a short time before the houses
along there are included forseeing something of a seperate district being created
that would mean a lot lower rate while they tie in while Cornell is paying the
freight for the main transmission line . The only reason they are not included now
is because if they were included the cost would be to high to - them and that is why
they are excluded totally . The line drawn is very arbitrarily and goes out of its
way to avoid residents and goes out of its way to grab Cornell land . They have
nothing aggathat extending the sewer line , but when they have six sevenths of the
land and could end up paying six sevenths of the bill or some other major portion of
the bill that is what they are concerned about .
Robert Cooke , Director of Plantations - they as the sub unit of Cornell , have
responsibilities for this land and knowing how Cornell works there is no doubt
in his- mind that if there are costs they will be brought down to bear on the
plantations , They maintain much. of this land as conservation oriented and educational
purposes , They only receive about one fifth. of their income from the university and
raise the rest of it on. the generosity of alumni. If . there were a financial cost
associated with this land that would come to bear directly on therr . operations .
Their intent is to preserve the land preciscely for the purpose of conservation
and education , so they- are very concerned about the change which would lead to
the _ ,increase costs being born by the plantations ,
Dan Kailburn , 1731 Hanshaw Rd - as he understands it there is going to be a package
type sewer plant located within 300 yards of his property and he was . very much
against it .
Supv Cotterill - this is only an alternative and nothing has been discussed except
for transmission lines which. would not need a sewage plant , .
Mark Watson , Dryden Rd - Cornell UnivLmentioned that they were objecting to the
proposed district and he felt that it would be in their best interest to protect
the watershed , '. with. all of the commercial development along Rt 13 .
Jim Ray , owner Hillside Acres MHP - what is the impact on the existing water and
- sewer district where lines already have been constructed and would be partially
utilized by this proposal . Would there be credit for the use of those or rent
as income to the Varna Dist and secondary if they do have to be increased in size
would the Varna Dist have to help pay for that .
Jim Gresens - the cost figures that are presented have taken into account the
transmission fees that would be charged to the new district and paid to the existing
district for the use of their facilities . The flows that are anticipated at this
point in time all the existing facilities are adequate to transport the anticipated
flows .
Robert Relyea , 901 Dryden Rd - he would like to see some engineering plans and
would like to know what the cost is going to be to the Town if this is not going
to be a benefit district , If it is to be a benefit district then Cornell is correct ,
they are going to pay their fair share if their lands are included , If he: has taken
it off the maps correctly it would appear to him that there is total folie in including
the 600 acres of Cornell land in this district . __- The logical course , if you look
at the countour maps and want to tie into the Varna sewer - district you would come
down - the railroad track . If you take the present map and draw a " T " across the state
roadilRt 13 by NYSE& G and install a pumping station at that point or whatever is
necessary you should be able to gravity feed all the way down the ' railroad track .
• The railroad track is about 400 feet from the last manhole in the: Varna . district as it
standStrightnow ; .Hd is concerned since he is a resident in Varna , is that . so far
they- have never seen any reductions in either their water or sewer costs . They always
seem to be getting a little bit deeperr in . During the time that Gary Zee was Supv ,
• when the Varna dist was built , it - .was built to take care of Varna . The pumping
station would have to be enlarged , and he would have to disagree with the engineer

Years ago he paid for the engineering cost and they disputed anothercconsulting
engineers figures . The present district as it is being paid for by Mr Ray and
the park and other residents in Varna is adequate only to take care of that
particular commnunity . At the time Turkey Hill Rd , Mt Pleasant Rd and all of the
rest of the places did not want to be in the district . As a result of that they
held their costs down . Maybe some changes have been made in that last 10 or 15
years that he Is not aware of , but he does not think so . At the present time
the capacity of that district and the c• capacity of the pumping . station is only
adequate for what is in the district with its current expansion . Therefore , he is
✓ equesting that this Board make available its engineering study , and its corrected
maps if that should be the case , but more importantly he can ' t ' see taking all this
beautiful valid land that is agricultural land , plantation land that we all enjoy ,
and throwing it into a district where there is no :, long range plan let alone a

short term plan for the use of that land where it would be involved in creating
a sewer district . If you use the " T " approach he can give you the exact figures
on the cost of construction if you own theeland . If you use this approach you can
g et the same commercial properties and is not necessary to include Cornell land
and he sees no purpose behind • it .
Roger Gromet - would like to study the engineering report before the Board makes
their decision for a final determination
Supt/ Cotter llH the reports are available and have been for the last month in the
Town Halls There. was considerable discussion .
Roger Grometl - J they would like the opportunity as some future time to hook-up if
they need to , Tf they do , they have a parcel of land near Fall Creek where they
draw - water from and they would be pleased to contribute that to • the Town because
they, wouldn1t have any use for it . They are not asking to be included in the district
at this time , but they want to know in some form - of formal commitment : that when and
if they need it there . tennants will be protected .
Mr Rupert Hall1, Turkey Hill Rd - has heard the comments that NYSE &G is pushing for
this district and wanted to know if this was true . -

Supt/ CotterillI - does not feel that NYSE &G has pushed this . He has had contact with
them and askediwhat their interests were and they ' have indicated that .they definitely
do have an interest , because they foresee over the next several years- they maybe
in a position to spend considerable money to upgrade their sewer and water facilities
to meet specifications , They are looking at the future . They have been very
cooperative in working with the engineer .
Mr Hall - NYSE &G was also approached at the time the Varna wa:ter; _ and . sewer district .
were formed and at that time they said that they were interested , so it isn ' t
something they have been pushing . He was the one who was pushing to get the water
and sewer on Turkey Hill Rd and at that time they were interested and were told
that they could not be included , but it was adequate so that they could tap on at
a later date , Pe wanted it made clear that NYSE& G is not pushing for the district ,
Roger Gromet would like to have the opportunity to contact his surrounding
neighbors to see if. they would like to join the district and ask . . the Town Board
to reconsider the boundaries and give them a time frame and they will come back
for another hearing , .
Closed public hearings

There was considerable discussion regarding the proposed water and sewer district .
Atty Perkins I . when the Board is ready to take action you have to make certain
findings and pass a resolution establishing a district subject to a permissive
✓ eferendum . One of the findings that you have to make is that all of the land
benefited by the proposal is within the district .
J im Gresens - ' one condition that the Town Board should consider is the federal
g rant has a stipulation that no designated flood plains or wetlands will be
serviced by sewer . This should be considered to be included in the resolution .
Supv Cotterill authorized Attorney Perkins to draft a resolution for the proposed
Monkey Run Water and Sewer district . 1
COUNTY BRIEFING
Co Rep Watrosi - reported that the County is considering . the payment of taxes by
the installment plan . If the County passes this , than the Town would have to
go along withLthe installment . At this time he is not in favor of it and wanted
t he Boards input . There was some discussion and the Board needed more information .

APPROVAL OF THE MINUTES - Motion was made Clm Evans and seconded by Clm Webb
that the minutes of the Nov 5th special meeting be approved as submitted ,

Clm Evans wanted to know the status of the Snyder Hill Water Dist .
Atty Perkins - reported that it is expected to go to the State Comptroller either
Nov 20th or Nov 21st to be signed by the Deputy State Comptroller and will let
the Board knows as soon as he finds out .

ACCEPT OFFER OF DEDICATION OF CHELSEY CIRCLE & BEAR CIRCLE
WHEREAS , the Town of Dryden Planning Board has approved
the subdivision plat for " Willow Glen Development-" , and
WHEREAS , the roads to be designated as " Chelsey Circle "
and " Bear Circle " on said map . have been constructed
according to Town specifications and have been approved by
the Town Highway Superintendent , and
WHEREAS , the sufficiency of the title , and the
instruments conveying the same to the Town have been
examined by the Town Attorney and found to be in order , and
WHEREAS , the filing of the subdivision plat in the
Tompkins County Clerk ' s Office in the Tompkins County
Clerk ' s Office constitutes an offer to dedicate such
property shown as " Chelsey Circle " and " Bear Circle " to the
Town of Dryden upon the satisfactory completion of the
improvements ,
NOW , THEREFORE , BE IT RESOLVED , - by this Town Board that
the roads shown on said subdivision plat , filed in the
Tompkins County Clerk ' s Office , and more particularly
described in a deed to the Town of Dryden dated November 19 ,
1986 , and which is to be recorded _ in the Tompkins County
Clerk ' s Office, be , and hereby are , accepted as Town Roads ,
and the same are to be added to the official Town map and

Gordon Gabareel - working for the New York State Wildlife - wanted to report to
the Town Board that he is getting a lot of complaints from people that they are
not getting the service from the Dog Control .. .Officer and they expect him to do it .
He did not feel that the Dog Warden is representing the Town of Dryden in the best
interest . He gave the Town Board 2 letters of complaints and also she is setting
out traps that do not have her name and address on them , which is required by law .
Supv Cotterili, - she does have an answering service and he has not received any
complaints . As far as he knows anytime that she has gotten a call she has answered
it . He will also talk to her about setting out traps that are not identified .

of Dryden , to wit :
DETERMINATION
WHEREAS , The Town Board caused notice of public hearing
to be published in The Ithaca Journal , the official
newspaper of the Town of Dryden on October . 20 , 1986 , to
consider the advisability of adopting a resolution , in
accordance with the provisions of the General Municipal Law ,
authorizing the SLATERVILLE VOLUNTEER FIRE CO . , INC . , to
furnish fire protection and general ambulance service for
residents of the Town of Dryden , and
WHEREAS , a public hearing pursuant to such notice was
held on October 28 , 1986 , and at which public hearing it was
pointed out that the Town of Dryden was served by several
other Fire Companies which did not provide general ambulance
service to the area proposed to be served by the Slaterville
Volunteer Fire Co . , Inc . and the understanding between the

the fire protection contract is to be entered into

WHEREAS , the matter was fully considered and discussed
by the Town Board and all persons present at the time of

WHEREAS , the Town Board deems it in the public interest
