QUESTIONS - AND / OR - COMMENTS John ' Caren - present owner of 1620 Hanshaw Rd - ' the sale of the house is contingent upoh" being able; to ' get approval for a jewerry shop in the house . Micky Roof, - designes . and ' manufactures herN own product , which are of high qual :.tye At.. 'the present time she , is renting a shop in Newfield and see needs jra .plice where people can see what her product looks like and to see her presentation , . ; She.lwould Like to buy the house and turn part . of it into a retail store and live in the other portion . She does not intend to change the house in anyway except to restore it because she feels that it is historically a beautiful house . As far as running a business and traffic patterns , the traffic is not a busy- one and will not change the property at all . C1m Evans -. . wanted to know- bow- many retail customers on the average per day ? Micky 'Roof - th`e average would be about 5 clients . Supy Cotterill - wanted to know if there would be other employees ? Micky Roof - right now she has a master goldsmith . and a bookkeeper . . S-upv Cotterill - wanted to know- if this would be strictly within the house or in any of the other buildings ? Micky Roof - this will not involve any of the other buildings . Catherine Brown - she has since looked more clearly at the Zoning Ordinance and a home occupation is allowed in the Zoning Ordinance by a special permit , Retail business establishments which are clearly of a neighborhood or a local service nature , such. as' but not limited to grocery stores , drug stores , etc , Those are allowed by permit and there is a real question whether a jewerry store is a local service in that area at all . In any case we have almost all of the residents in that area including two people who are building houses there who have signed the petition against it . She would like to have the petition go on the record . June 7 , 1986 We the undersigned , as resident , homeowners in the 8 - Square School area in the WAfir end of the Town of Dryden ( the area south and west *A en�l L of Rt . 13 and of Fall Creek ) are opposed to any further erosion of this residential neighborhood by the conversion of rural residen - tial properties for commercial use . In particular , we are opposed to the granting of a Special. Permit , as , sought by Mickey Roof at the Public Hearing on June 10 , 1986 before the Dryden Town Board , which would allow the conversion of the house and farm property offered for sale by John Caren , at 1620 Hanshaw Rd . , to a coriimercial use as a retail jewelry store . This has been and should "continue to be a prime residential area for families who prefer a rural residential agricultural environment from the city or suburbs . Particularly those who work at Cornell , which is just 4 miles or 10 minutes from the campus . It seems to them , more than a pity almost a . crime , if this beautiful rural area enhanced by- the fields and woods owned by Cornell along Hanshaw Rd , Sapsuckerwoods Rd and bower Creek Rd and by the extensive natural areas along Fall Creek is to be eroded away by short sighted odd hoke commerical development . Within the past year , they have had the MA Zone . Now they find an attempt being made to convert one of the most attractive and valuable residential properties in their neighborhood , a fine old farmhouse and its acreage , at 1620 Hanshaw Rd into a commercial establishment . A retail jewelry store which is completely out of keeping with the rural residential and agricultural character of the surrounding area and of their neighborhood . They can understand that the Caren ' s , now that ,- they no longer want to live there , would like to sell their property for as high. a price as they can get . They also understand that the sale of this property to Micky Roof for more than the Caren ' s perhaps have been offered to date by people interested in just living there rather than doing business there is contingent upon her getting a special permit for her jewerly store . They do not think that the Carenis sale or Micky--Roof ' s purchase or business plans should be at the expense of the people who live in that neighborhood and want to see its residential character maintained . As the petition that we have presented to the Town Board makes very clear they are absolutely opposed to any further nibbling away of the residential property in that RC Zone area by a new business which could be located instead in an area better suited to commercial enterprises . It could be put in the new MA Zone . Before the three other properties along Hanshaw Rd , which do not seem to fit into the residential character of the neighborhood are sited as precedent . She referred of course to the building at 1650 Hanshaw Rd now occupied by Cayuga Press , to the SPCA at 1640. Hanshaw Rd and to Ludgate Produce at 1652 Hanshaw Rd . It is important to -make clear that the first two were there prior to any zoning . The Cayuga Press- building and the SPCA are thus grandfathered in under the current ordinance . Ludgate ! s which started as a very small roadside stand , still has no room or permanent store building , , can perhaps still claim that allowed use despite the volume of business and the traffic generated . It should also be noted that the owner of Cayuga Press and his wife are building a new house adjacent to their existing commercial building and thuse demonstrating their interest in confidence in the residential character of the neighborhood . They request that the Dryden Town Board deny the special permit that would allow the residential farm property at 1620 Hanshaw Rd to be converted to a commercial use , This statement if from Mr & Mrs Stuart Brown . This is nothing personal to the Carne ' s or Micky Roof , but once that place is converted to a commerical use , then it is gone as a residence and it becomes a precedent for the future . John Caren - he understood and appreciated Mrs Brown ' s comments . One of the attractive things . about the offer Micky Roof made , and her business is right now in a wonderful colonial house where she '. is .renting the space . The attractiveness of the offer is many fold . One of the great things , if she buys the property is that she will maintain the character of the house . She plans no renovations at all . In terms of traffic , the traffic on the road will not increase any -more than the current traffic now. They now board horses for students at Cornell , who come and go on a regular basis . They bought the house because they loved it and they have had many offers on it . Suggestions were made to buy the house and build apartments on the rest of the land . They decided that they did not want that kind of an offer . This offer is attractive because it preserves the value of the house and offers a chance to Micky to do her private business in a small way , Micky Roof - had photos to show the improvements that she has made in the house that she is only renting . The photos will show the beginning and the end of what they Have done to a historical house in Newfield and that the community there is proud of , She intends to do the same thing with this old farmhouse . Catherine Brown - has visited her place in Newfield , but this still is a commercial use in a residential neighborhood . Heather Kailburn - wanted to know if she was going to make it attractive like a home or an attractive business? Micky 'Roof - it will be an attractive home , and the business will be very discreetly done Heather Kailburn - wanted to know if she was going to have a sign and how, large would it lie ? Dicky Roof - it would be whatever the ordinance is , .- but it will be done very attractively and tasetefully the way the house is done . Heather Kailburn - asked the Board if she does have a nice little business that does not offend the neighborhood , which she is presenting it as that way , and a � this is fine with her personally . If she moves and sells her property , now that the precedent has been made as a business home , could someone else move in and very easily make it look like a big business which would abuse the neighborhood ? Atty Perkins - it has been the policy of the Town Board not to have the special permit transferable . Min Creasy - sometimes they have heard the comment , what do you care because you have the SPCA and Ludgate Produce already . This bothers her because every additional commercial enterprise will strenghthen that argument . They are worried that this kind of a sentiment eventually would grow rather than dim :insh . Mr Levin , 1608 Hanshaw Rd - is in conflict about this , the principal of another business in that area is distasteful to him . However , all he has heard about the use of the house and the way the house will be kept seems attractive to him . He was concerned about the transferable use of the permit that it will not be violated and should be made very clear . Clm Evans- - if he votes for the special permit it would only be that it is not transferable . Since he has been on the Board all permits issued have been -made nontransferable . Mr Levin - should the owner rent or lease the property to another business , is this controlled in the permit ? Atty Perkins - this would also be the same . The special permit is personal to the individual and not to the property . Margaret Joyce , 505 Lower Creek Rd - has lived there since 1969 , and bought the property because it was a nice residential area . Now they find that they are being encroached upon more and more with all sorts of commercial businesses . As- far as she is concerned the neighborhood is becoming spoiled and she objects to the jewerly store being opened on Hanshaw Rd . She felt that it is time to give more consideration to the people who have bought homes in that area and have lived there for years and intend to go on living there . Ann Caren - owner of the property in question . She realizes that it is a residential area , However. , the SPCA is next door which .is a big deterrent with the sale of the house . Judi'th. Healy , 1690 Hanshaw Rd - if the business is allowed and does grow what would happen ? Micky Roof - what she does is . unusual and does not demand a lot of space or employees . She is a designer and makes her own product amd does not desire to have anything that large . Catherine Brown - under allowed uses in the Zoning Ordinance it states # 9 home occupation is allowed without any permit , this is an allowed use in that area . Allowed uses by a special permit , retail business establishments which are clearly of a neigbborhood or local service nature , this is not . If she just -made the jewerly ,that would be different , but the retail sales aspect is what t'nev worry - a7bou°t : 7;aser 1 Irew"er sstartea-1n t'he old house across from NYSE& G and then they outgrew the house and built a retail store right next door . This is the kind of thing that they do not want to see happen_ in their neighborhood . Yf by any chance that she should move , then someone corning in there could cite this as a precedent , get another permit and make something totally different that would be even more objectional . Micky Roof. - in the house there are two rooms ( livingroom and den ) that would be used as the display area , with glass display cases . The cabinets are all customed made and handcrafted . Clm Schlecht - wanted to know how many parking places would be made avail- able ? Micky Roof - there is a total of 15 acres , you can park two cars in the driveway and in the back of the barn you can park 6 or 7 cars . Clm Schlecht - the employees would be able to park in back of the barn and this would not be seen from the road . Clm Evans - wanted to know how many customers would be there at the same time ? Micky Roof - could not answer that , since she is not familiar with this area , but where she is now it would be 3 different groups of people in at the same time . On Sat . she is busy and she may have as many as 25 to 30 people at one time , so she would have to make a provision for that . Clm Evans - how many cars could you put in the current gravel area ? John Caren - there is room for at least 4 or 5 cars . Heather Kailburn - wanted to know if she was going to advertise in the yellow pages and if so maybe it could be by appointment only . Micky Roof - no , she wouldn ' t do that . Min Creasy - has come out of that driveway several times and feels that it is not a pleasurable driveway to . exit and wanted to know if she was going to make any major renovations to the entryway of the house in order to accomodate the customers going in and out ? Micky Roof - there would be 25 to 30 people , but that does not mean that there would be that many cars at one time . ' She does not want to change the property now because she likes the way it looks now . There maybe some trimming of trees to make it more visable . The only thing that she has considered is making the driveway a turnaround situation . There is a section in the back where she would have room . Min Creasy - wanted to know if she had intended to widen the driveway to two-way traffic ; Micky Roof - she would be willing to do that if it would % help her to buy the property. Catherine Brown - that is a very dangerous driveway . Closed public hearing . PUBLIC HEARING # 2 SPECIAL PERMIT - Ted Marchell Minutes of the public hearing ' Supv Cotterill read the notice that was published in the newspaper to consider the application of Ted Marchell , 959 Dryden Rd to build eleven 4 - unit apartment buildings at Mt Pleasant Rd in Varna parcel �f 55 - 5 - 19 . 2 q�UESTIOKS AND OR / COMMENTS Peter Trowbridge and Cathy Wilson from Trowbridge & Trowbridge went over the plans for the project . The project development consists of 44 rental housing units on 12 . 3 acres . Access would be from Mt . Pleasant Rd down the old railroad bed which would become the entrance road . They are asking for a negative declaration to the Environmental Assessment Fora and a special permit . The land is currently multifamily housing which is allowable under the current CA Zone . Mr . Marchell could by right develop multifamily housing on a 2 acre parcel . The reason they are here is because it is a 12 . 3 acre parcel . It is zoned for multifamily . The plan is a low density plan and could be serviced by Bolton Point Water and Sewer Diet . This would be phased in over a three year period , starting in the spring of 1987 . Mt . Harold Case , 953 Dryden Rd -- felt that there was no need for a housing project of this size and is not needed . He was also concerned ab6ut the water coming off the hill . The intersection of tit . pjLo.asant Rd o �4nd Rt 366 is one of the most dangerous innt�e" raeycty�ior�a and this will add to kfi. 4a problem . ua ?. George Guest representing the Varna Fire Dept wanted to know if Bolton Point had been contacted to see what the wager flow pressure would be there ? Peter Trowbridge - they have spoken with Bolton Point to make sure this project would be given the capacity that they would need and it has been verified that there would be enough water pressure . George Guest - also suggested that an access be made to the pond . Clm Schlecht - questioned about the entrance road that it may be eventually be turned over to the town . Peter Trowbridge - we are allowing for a r - o - w so that within the r - o - w an acceptable road could be put in and that Ted Marchell has no intention of dedicating any of the road to the town at this time . Atty Perkins - there should be consideration if this road is ever to be dedicated to the Town . Clm Evans - was very concerned about the entrance coming onto Mt . Pleasant Rd . The visibility at the location is very poor and there is a lot of traffic there right now . If there are another 40 to 60 cars this will be a very serious problem at the intersection of Mt . Pleasant Rd . and Rt 366 , and the proposed entrance onto Mt . Pleasant Rd , also Turkey Hill & Mt . Pleasant Rd , and Turkey Hill Rd and Rt 366 . Peter Trowbridge - you should think about the number of cars per hour that might be coming or going in that project and not within a short period of time Clm Garlock - wanted to know how it was going to be phased in and the Town keeping control over it ? Peter Trowbridge - it would be done in four phases and would be starting at the back of the property . Closed public hearing . TOWN BOARD MEETING . Stewart Absent - Clm Webb Supv Cotterill appointed Clm Garlock to audit the general and special fund bills Members and guests participated in the Pledge of Allegiance Approval of the minutes : Motion was made by Clm Evans and 2nd by Clm Garlock that the minutes of the Special Meeting held May Gth , Public Hearing and Town Board Meeting held May 13 and the Special Meeting held May 27th be approved as submitted . COUNTY BRIEFING Co . Rep . Tillapaugh - reported that the Environmental Management Council along with the County Board plan to have a series of educational meetings throughout the county regarding solid waste inensgeaient . Topics of discussion will be solid waste management , OP- ibihS of cost for the future and a site for a landfill in Tompkins � Dunty DEC will have a representative to talk about a new landfill . TIZEN PRIVILEGE 0i THE FLOOR Bill Bailey from Bailey Insurance gave the Town Board members a copy of a of different carriers regarding liability insurance and the Town Board decided to go with Aetna Insurance . pn Schroder and Amy Truman were present from the Youth Employment to Program wiith Mmsdtills that the Te' wzi Board might have , ThIA Ig Ag$ of Dryden , aa� Dan Collins , President of Tompkins County Area Development Corp . The corporation was founded about 20 years ago and operates out of the City of Ithaca . They are interested in the economic condition of the County and how they can advance that economic condition . They have had a fund raising drive for a 3 year budget . They have helped Cornell Univ . establish the incubator space on Warren Rd , Rothchilds Dept . Store to obtain an IDA renewal bond , they helped to fund the Tompkins County IDA , assisted NCR in their engineering and administration addition to their facility . They also helped Morse Chain with the 85 acres for their plant on Warren Rd . They helped Borg Warner with their IDA funding for that project . Secured StateDormority authority bond issue to bring Boyce Thompson Institute of Ithaca . They also have helped Ithaca Gun Co . , Koherly Machine , Hilker Cons . , University Sand and Gravel , Hi - Speed Checkwriter , and Ithaca Intersystems to get financing so that they would be able to stay in the area . Without their existence outside developers have no one to work with in the area . They wanted to make the Town Board aware of their services that are available . Michael Stamp - they try to help maintain the existing businesses that are here and to create an environment where a small business can prosper , which are their main goals . ATTORNEY RE SOLUT ION NO , 106A 1986 Councilman Evans offered the following resolution and asked for its adoption : The Town of Dryden Zoning Ordinance is amended as follows 1 . Subdivision ( 4 ) of Section 703 of said ordinance is hereby amended to read as follows : 4 . All lots shall be kept free of vehicles which are unregistered , or abandoned or inoperable , and shall be kept free of trash , rubbish or junk . For the purposes of this subdivision one . ( 1 ) vehicle which is unregistered but operable shall be permitted . An inspection certificate less than one ( 1 ) year old by an inspector licensed by the New York State Department of Motor Vehicles shall be prima facie proof of the vehicle being operable . For vehicles which do not have such an inspection certificate the owner may certify , under the penalty of perjury , that such vehicle is operable . An owners certification shall not be entitled to prima facie status as to the vehicle being operable . 2 . Subdivision ( 4 ) of Section 754 of said ordinance is hereby amended to read as follows : 4 . All lots shall be kept free of vehicles which are unregistered , or abandoned or inoperable , and shall be kept free of trash , rubbish or junk . For the purposes of this subdivision one ( 1 ) vehicle which is unregistered but operable shall be permitted . An inspection certificate less than one ( 1 ) year old by - an inspector licensed by the New York State Department of Motor Vehicles shall be prima facie proof of the vehicle being operable . For vehicles which do not have such an inspection certificate the owner may certify , under the penalty of perjury , that such vehicle is operable . An owners certification shall not be entitled to prima facie status as to the vehicle being operable . 7 . Subdivision ( 4 ) of Section 1206 of said ordinance is hereby amended to read as follows 4 . All lots shall be kept free of vehicles which are unregistered , or abandoned or inoperable , and shall be kept free of trash , rubbish or junk . For the purposes of this subdivision one ( 1 ) vehicle which is unregistered but operable shall be permitted . An inspection certificate less than one ( 1 ) year old by an inspector licensed by the New York State Department of Motor Vehicles shall be prima facie proof of the vehicle being operable . For vehicles which do not have such an inspection certificate the owner may certify , under the penalty of perjury , that such vehicle is operable . This is primarily a residential area , always has been and the fact that the SPCA was there before the zoning is irrelevant . This is an introduction to another business into a residential area and they are strongly protesting if this is allowed , the retail business part of it . If she ,lust said a home occupation , that she makes jewelry , nobody would have ever raised a question . This is an introduction of a commercial retail business into a residential area and this violates the zoning . There was considerable discussion and concerns about traffic , clustering of housing under a unified ownership , so there are unanswered questions such as who would be responsible for maintenance if the developer decides to leave the project - snow removal garbage , *etc . There should be the long environmental assessment form filed out , have a traffic study done at the intersections of Rt 366 , Mt . Pleasant Rd . and Turkey Hill Rd .
