TO THE ESTABLISHMENT OF ' A PROPOSED WATER DISTRICT , TO •
BE KNOWN AS SNYDER HILL WATER DISTRICT , IN THE TOWN OF
DRYDEN , TCMPKINS COUNTY , NEW YORK , PURSUANT TO ARTICLE •
12 - A OF THE TOWN LAW .
WHEREAS , the Town Board of the Town of Dryden , Tompkins County ,
ilea() York , has heretofore duly caused a general map , plan and report

o� New York , which have been filed in the office of the Town Clerk

WHEREAS , an order was duly adopted by said Town Board on May 1 ,
1g85 , reciting a description of the boundaries of said proposed
Dater district , the improvement propose ' therefor , the maximum
amount proposed to, be expended for said improvement , the proposed
method of financing to be employed , the fact that said map , plan and
Qeport were on file in the Town Clerk ' s office for public
1P( spection , and specifying May 14 , 1985 , at 8 : 00 o ' clock P . M . ,
1Qevailing Time , at the Town Hall , 65 Main Street , in Dryden , New •
{ york , in said Town , as the time when and the place where said Town
6o - rd would meet for the purpose of holding a public hearing to hear
a. u. i persons interested in the subject thereof concerning the same ;
WHEREAS , such order was duly published and posted in the manner 11 '
Aqd within the time prescribed by Section 209 - 1 of the Town Law and
-Ascot of such publication and posting has been duly presented to

WHEREAS , said public hearing was duly held at the time and place
set forth in said order , as aforesaid , at which time all persons
desiring to be 4heard were duly heard ; and
WHEREAS , at a meeting of said Town Board hell May 14 , 1985
following the aforesaid public hearing said Town Board determined to
call a public hearing on the proposed deletion of Town of Dryden Tax
Na ; Parcels Nos . 69 - 2 - 3 . 2 , 69 - 2 - 3 . 4 , 71 - 1 ° 1 . 2 , 71 - 1 - 5 , 71 - 1 ° 6 and
71 - 1 - 7 from said proposed District ;
WHEREAS , it was subsequently resolved by said Town Board , in
Resolution No . 117 of 1985 , that the action of said Town Board on
May 14 , 1985 following the aforesaid hearing should be declared a
nullity and4that a public hearing would be held June 10 , 1985 to
consider the deletion of Town of Dryden Tax Map. Parcels Nos . 71 - 1 - 2 ,

71 - 1 - 5 , ,71 - 1 - 6 and 71 - 1 - 7 from said proposed District ;
WHEREAS , notice of such June 10 , 1985 public hearing was duly
posted and published in the manner and within the time prescribed by
Section 209 - d of the Town Law and proof cf such publication and
posting has been duly presented to said Town Board ; and
WHEREAS , said June 10 , 1985 public hearing was duly held at the
time and place set forth in said order , as aforesaid , . at which time
all persons desiring to be heard were duly heard ; and
WHEREAS , at said June 10 , 1985 pt blic hearing certain residents
of said proposed _ District expressed concern over the possibility
that lands of such residents would be assessed at some time in the
future for the capital costs of extending water lines to certain
parcels within said proposed District not presently proposed to be
served by the original improvement planned for said proposed

4HEREAS , said unserved parcels would be benefited by said
original improvement planned for said proposed District because the
construction of said original improvement would reduce the cost of
serving said unserved parcels in the future ;
WHEREAS , it is probable that future water lines solely to serve
said unserved parcels would be " laterals " within the meaning of
Section 199 of the Town Law , although the determination of whether
o r not such future water lines would so constitute " laterals " must
be made by said Town Board at the time such future water lines are
planned and proposed rather than at this time ;
WHEREAS , under existing provisions of the Town Law , the capital
costs of any such future lateral water lines solely to serve said
unserved areas would be borne by local assessment upon said unserved
several lots and parcels of lands which the Town Board shall
determine and specify to be especially benefitted , so much upon and
from each as sh :► 11 be in just proportion to the amount of benefit
w hich such water lines shall confer upon the properties determined
to be ber . = ited by such water lines ;
dHEREAS , said Town Board has duly considered said map , plan and
✓ eport and the evidence given at said June 10 , 1985 public hearing ;
NOW , THEREFORE , BE IT
RESOLVED , by the Town Board of the Town of Dryden , Tompkins
County , New York , as follows :

A RESOLUTION APPROVING THE ESTABLISHMENT OF SNYDER HILL
dATER DISTRICT IN THE TOdN OF DRYDEN , TOMPKINS COUNTY , NEU
YORK , AND APPROVING THE CONSTRUCTION OF IMPROVEMENTS
PROPOSED THEREFOR .
dHEREAS , the Town Board of the Town of Dryden , Tompkins County ,
New York , has made the determinations decribed in subdivision 1
Section 209 - e of the Town Law with respect to the proposed Snyder
Hill Water District ; and
WHEREAS , it is now desired to adopt a further resolution
pursuant to subdivision 3 of Section 209 - e of the Town Law approving
the establishment of said Snyder 9111 Water ` District ani the
construction of the improvements proposed ; . NOW , THEREFORE , BE IT
RESOLVED , by the Town Board of the Town of Dryden , Tompkins
County , New York , as follows :
ansti n_Aa The establishment of Snyder Hill Water District to be
bounded . and described as hereafter set forth , and the construction
o f improvements therein consisting of the purchase and installation
o f approximately 2 , 000 lineal feet of eight inch water main ,
including valves and hydrants , together with incidental improvements
✓ equired therefor , to serve said District , is hereby authorized and
approved . The maximum - amount to be expended for said improvement
snail aot exceed $ 116 , 975 . The cost of said improvement shall be
financed by the issuance of serial bonds of said Town maturing in
annual installments over a period not exceeding forty years ,

Minutes of the board meeting held August 13th
Supv Cotterill called the meeting to order at 7 : 30PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Garlock , Clm Schlecht ,
Atty Perkins and Z . O . Stewart
Absent : Clm Webb and Clm Evans
APPROVAL OF THE MINUTES : Motion was made by Clm Sch ^echt and seconded by
Clm Garlock that the minutes of the public hearing and town board meeting •
held on July 9th be approved as submitted .
Supv Cotterill appointed Clm Garlock and Clm Schlecht to audit the highway fund bills .
PUBLIC HEARING #1
August 13 , 1985 Crawford Adams Li gravel bank
Special Permit
Supv Cotterill read the notice that was published in the newspaper to consider
the application of Crawford Adams fora special permit to open a gravel bank at
384 Etna Road .
QUESTIONS' AND/OR 'COMMENTS
Mr Adams would only like to level the property so that he can put it back to
agriculture, - All they want to do is get the knoll out of the field so that
they can work the fields for agricultural purposes only .
Supv Cotterill •- wanted to know if he had read the rules and regulations of the
town ordinance ' tegarding gravel banks ?
Mr Adams - said that he had butjthey only want to remove about 9000 yards of gravel . •

Richard Root , Representative for Cornell University , is responsible for research
• that is going on in the land that is west of this proposed gravel bank . They have
a question that is mainly the extent of this gravel bank . It does not look like
there will ' be any impact, providing that the operation remains small .
Clm Schlecht - wanted to know if there would be a crusher and washer located there ?
M,r Adams - no , there will only be a loader . •
Clm Garlock wanted to know if he had a time frame for the gravel bank ? •
Mr Adams -• no , it is hard to put a time frame , unless you wanted to have someone
come in and remove it all at once , and he was 'not crazy about that . He would
rather have one or two trucks a day for maybe 2 or 3 years depending on how much
they want . As it was depleated they would fit the land and seed it and turn it
back to an agricultural entity .

Supv Cotterill read the notice that was published in the newspaper ix .
to consider the application of Tony Serviente for a special permit to have a
stained glass workshop and sales • of glass supplies within his home at 63 Neimi Rd .
QUESTIONS AND/OR COMMENTS
Mr Serviente - works in stained glass and would like to convert his garage into
a studio for himself and have a place to sell supplies . If a dozen people come
in , in one week that Would be a lot . He felt that there would be no impact on
the neighbors . It would : :only - be himself and his wife that would be working there .

Mrsafi .tsti'fel- /Niimi Rd has lived there for 6 years and has gone through times when
she has come home from work that she could' not get into here driveway because of
cars parked along the edge of the road and blocking her driveway . She has also
been late getting to work because she cannot get out of her driveway . She lives
across the road from Mr Lengemann who sells christmas trees and realizes that it

is seasonable ; but it is very annoying . Her concern is what is going to be done
about parking when this business opens ? '
Mr Serviente - there will be no parking outside of his property and , will be confined
to his driveway . He cannot conceive of ever having that many people at one time .
He only - expects one or two people a day , because it really is not a popular craft .
His hours would only be from. 10 : 00AM to 3 : 00PM during the day so' that would
eliminate the Morning and evening working traffic . During the peak time during
Christmas he wbuld ' only estimate 3, or 4 cars a ' day . .
Atty Perkins.. - wanted to know the size of his garage ? .

• Mr Serviente - the floor space is 16 x 19 feet .
Atty Perkins — wanted to know the square footage of the driv°eway. and the parking
area available now? ._ .
' Mr - Serviente - what is gravel now is - 30 X 15 feet and can be established' to
twice that size . They have a lot of - room to expand if they have to ;

" RESOLUTION #156 GRANT SPECIAL PERMIT CRAWFORD ADAMS
Clm Schlecht offered the .following resolution and asked fat its adoption :
RESOLVED , that this Town- Board grant ' the special permit to Crawford ' Adams to have
- a gravel bank subject to the following : 1 - that there will be no washing _ of gravel
on the site or crushing of gravel . on the site ; 2- that only approximately .9 , 000
yards of material and no more than 12 , 500 . cubic .yards be removed from the SIte ; .
3- . that the area will be seeded when the gravel has . been removed so that it is
restored back . to agricultural ; 4that .. this permit is subject to, obtaining all other
required permits of any . other . authority having jurisdiction with this operation ;
- . -. 5- that this - permit is not . tranferable by. sale ° or lease ;. and . 6 - that Bond beset
at . $1 , 000 : 00 for restoration . . . - - . .

a stained glass workshop - and sales of _ glass - supplies ' within . his home at 63 Niemi Rd .
with the stipulation that the parking ordinance be complied with . . .

SPECIAL ' PERMIT - . DRYDEN HOUSING GROUP
Minutes ° of Public hearing # 3 8 : 00PM •
Supv Cotterill read_ the notice that was published in the newspaper to consider
the application . of. Dryden Housing Group to build two . three story multi -family
dwellings C total. 48 units ) to be . located off Livermore Road . .
QUESTIONS- AND/OR COMMENTS
Tim Buhl , John Jackson and Brian Grinter are partners and are involved in this
project that ° came in response to a request put Out by the TC . 3 Foundation . TC 3
realizes - the need for this kind of development for. housing to strengthen the
college itself . °
Mr Bahar _ gave an . opening statement- as time . has - gone . on the . ti.mes and needs have
• changed a great deal . . A. lot of community colleges . in ° New York State have developed
housing facilities for their students . Agricultural and . Technical Colleges have
gotten involved in the arts and sciences which are liberal arts . Other community
colleges have begun to develop programs similar to the TC 3 - program . There are •
32 community . colleges in . New York State and 6 Agricultural . and Technical . Colleges .
Asa result ° of . these activities certain changes • ha, `ve begun to . occur . The . students
today are very mobile and go wherever • .they. wish to go . These kind of occurences
are forcing TC 3 to look into housing for students . Their research and their work
at the . collegeindicates that ' many of the students from Tompkins and Cortland County
who would want to go to TC 3 would rather . goto a _ coliege which has housing facilities .
TC 3 Is losing a substantial number . of ' Cortland Co students to colleges that have
housing facilities, also potential students from Tompkins and Tioga County .
TC 3 used to be one of the major attractions because of its programs . Now some
of these programs have been duplicated in Other places in New York and they have
added student - housing .

Every student that leaves Tompkins and Cortland Co . , by law , goes to another
community " college in the State of New York the taxpayer Must . pay .for his or het
education in that county . This is one source of income loss that we have to pay
. another county „ We have no. control . over the _ money going_ to that . college.. It
figures out to be about $ 5 , 000 . 00 per student . . .
- When TC- 3 cannot attractfa student froth other counties , hot because of their
programs not being good , but because of their competition . Same 'programs
duplicated, ' but because bf student housing : This is an important issue , ' that
this negative drainage has begun to hurt TC 3 , because they do hot have the ' . -
competition . They are no longer a small local place where they just cater to
the local community students . They have international students coming to the
college . TC 3 was considered as being a- national training benter for • students
coming from Nigeria . . . They - were contractors for : a 2 year . program in hotel and .
- restaurant bustness"management and technology . They did have . 40 students
coming from Nigeria but lost the contract for one reason and that was because
of housing : `. TC 3 is in the process of developing a - program for Caribbean students
In the undevelbped areas : . This program within the next 3 or - 4 years will bring
about 100 students here . Once you build anything on the .public campus , if the_
law . would allow it , it would be a public institution' and tax free . They strongly
felt that whatever housing facilities that were developed for the students should
and must be taxed so that it would be an : asset to the community . For that reason
they have acquired the Foundation land near the college to create a buffer zone and
to have: control over i✓hat happens on that land . This- is the background and why" they
have brought into focus ' the building they are proposing .
Tim Buhl _ - . shoived several drawings of, the ' proposed site plan . They looked at several
different sites around TC 3 . They wanted to _ tie the project into . the campus building
itselfand _ min_imize the impact on .. the Lee . Rd residents . They ; will not . have _ any
access_ to Lee. Rd , but would have the access . from , Livermore Rd . They tried to keep
the . building. as far away . from . the Lee Rd residents and as high as . they can get it
and still maintain water pressure . _ There will be two main buildings and will be
built on one and half acres on the 6 acre parcel . This project will house approximately
10.0 students and will be _ three stories high and four units per wing . _ There will be
a full time , on site manager at all times and would not be a student .

John Jacksonowns' and rents property -.in the City of Cortland to about 125 students .
He , knows the . concern , of noise , alcohol and traffic . _ They intend to run an
extremely tight operation . . There wi11 be no . use of alcohol in . the _ dorms and
they wi'll . control the noise . The parents and the students will have . to ` sign
° contracts of all . of these things spelled 'out _ There will be someone in each _ dorm
for supervision : . . _ .
The Boardroom was filled to capacity with residents from Lee Road and since no one
gave their names the following comments and remarks were made .
-- wanted to know bow far it was from the property line on Lee Rd ?
Tim Buhl - it is about 75 feet from the back lot line .
-- even though. the access road is from Livermore Rd fine , but you did not allow
for the foot travel that will be going across the private property to get to Lee Rd
to go to downtown . There will be no way that you are going to stop - that . The ' owners
there , have spent a . lot of . money to . build their _ homes . and felt that _ if TC 3 still
wanted to be _ a good . neighbor , that , ' it has been in , the past , felt that they should
spend the extra money for . the booster pump , and _ move , this project . further up _ the
hill and not effect Lee Rd at all . It looks like the only way for expansion is down
the hill . .
-- - . they. were _ concerned about property values .
Tim Buhl = ' felt that it would not effect the property values at all . This is' the .
reason that they are having . this hearing so that they ban get the peoples concern
and hear if there are any problems on this preliminary plan . They ^ wi11 be happy
to .; meet withTanyone who wants to establish a steering committee - so as to get
- any problems- straighten - out . . They have put forth a good effort to try and protect
the _ properties_ and property values . . There would be no problem regarding the
footpaths for the pedistri'an _ traffic . .
-- - wanted to know why they - were building apartments " instead of dorms ? '
° . Tim Buhl _ - they have to attract . students from an economic standpoint . . . They have
\ : investigated ' the . other community colleges ,:and how . their projects have developed
and . this: is what the kids are asking for today . . .
t --- wanted to .know' if there 'were any other land options beside this proposed site ?
° Tim Buhl - they have no other land option ,. infact they : do not own this property ,
they have what you cal ' a . preferred developer status . by the Foundation ._ .

-They have . no further plans than . what has _been proposed tonight . They think that this
will fullfill the needs of the college . He . felt that . it . will help in the tax base ,
lower the water and sewer costs . since they _ will . be users , and that it would not be
a detriment . to . the community and will help to , inake the college stronger . °
Tom Cory , 39 Lee Rd - felt that it concerns all of the people from Lee Rd for a
number of reasons 1 - the proximity to their property ; 2- you plan to triple the
population in - that area of single family houses; 3 - - this will have a dramatic effect
on life ' forTthe people in that area ' to develope a three story building 75 feet from
someones property . He felt that neither one of the developers would want to live
that close to a college . complex . The people - on Lee Rd have a ° reason to expect that
if there is going to be intense development on that property , that it be ., located
far enough away from their residence so that it is not . going to have an adverse
effect on their property value . .
- -- Also the _ question about police protection since it is located in the town and
not the village ; he felt that it will be Very difficult to control . It is of
extreme importance to them to have the buildings as _ far away from Lee . Rd residence
- as possible and that the property should be buffered .
John Chapman - Livermore Rd is virtually impassable in the : winter and was wondering
if that was taken into consideration With the study . .
Mr. Bahar . - that has been thought about and there would be an access to the
college parking lot .
--- there . was concern about the flooding . sitivation at the lower end of Lee Rd .
Tim Buhl - although there will bepaving . surfaces and changing runoff , they will also
be flattening the surfaces alit so that there will not even be a 6 percent slope ,
and having - roofs that will retain the water to run it off slowly . - The parking lot
can be done . the same way . - They feel that they might increase the runoff , but they
Can control it in - such a Manner that it will not come any faster than it does right now .
Mngelo _ 711aimo , ; 47 Lee. Rd - was concerned about the water pressure . With the current
. water ands ewer . facilities they now have has handled ' the increase but , right now
they do have water pressure problems . •
Mayor Lane , - from the figures given by the engineers . there will be ._ no adverse effect .
Supt/ Cotteri'l1 . - suggested that Mayor Lane form a committee from the Lee Rd area and
hold' meetirigs with - Mr Buhl since this is not going to ' be finalized tonight . He
felt that the Town Board was going to refer this proposal to the Town Planning Board
for their recommepdations , _ . since they have to approve the site and the road .
Mayor Lane - wanted to go on record that the Village of Dryden , since this proposal
was first brought to - them by the TC3 ,Foundation , - that 1 - they are concerned about
the impact On Lee Road , it is : a prime residential area within the Villages- since they
have a nuntber' of single family houses therey2 - they are very concerned about the
location. . of the building " bn the site ; , 3= • the impact and proposed buffering for noise ,
he - was wondering if the . proposed 75 feet buffering would be adequate ; 4 - runoff
control is absolutely essential . Egypt Creek now carries 105 percent - capacity and it
cannot handle . any more . runoff , . in rainstorms or flooding. from parking lots or roofs .
They really need to see some detail . of studies on what the . runoff is going to be
from there . He felt that there should • not ° be any , that it should all be on site
retained . 5- the Dryden Village Board does not want to see road access - onto Lee Rd
and do not want to see the land' in ' the Village owned by TC3 Foundation used as a
primary site . The rbad ' access now Is not Interconnecting with Lee Rd and they feel
that is good . 6- the water and sewer volumes are important to the Village , and they
• have had some preliminary figures . It will be important for the Village to know
the place where they are going to hook . in and also information on the easements .
There was some discussion and the residents met with Mr Buhl - for. further discussion
. in the courtroom . •

Supv Cotterill had a list from Robert . Everette . with 30 violations _ and wanted • them

every time that she has called in • the summer requesting some work - to • be done on
the road ; and every year • was told that it was on the schedule , so perhaps • i:t isn ' t
on this years schedule and slated for next year , but . this-. has been the ' case for
the last four years . " East Ma lbryviile Rd has been - iaorked - on ' continuely for • the
last year and there are not as many houses . -. Last year it was - resurfaced , the -
shoulders were built up and this ' summer there has been . work ' done oh it as well
as Gulf - Hill Rd .

User : Any individual , firm , partnership , corporation , municipal entity or
• district or other entit - hooked into the system .
RECITALS':
1 . The system is designed to automatically relay to the fire company , and
the central fire dispatch at the Tompkins County Emergency Control Center
at 310 West Green Street , Ithaca , New York , a signal when and where a fire
is- detected by the system .
2 . The system is not foolproof or failsafe but under proper maintenance and
conditions it is designed to function for its intended purpose .
• AGREEMENTS': .
1 . The Fire Company may charge a hook- up and installation charge of $ 300 . 00
per user , which shall be a one time charge and paid to the Fire Company
upon a satisfactory test of the system for each individual user .
2 . There will be no annual charge to any user for the system . . The Fire
Company may pass along to the users of the system an assessment when
and if maintenance of the system is required . The assessment shall be
shared equally by all users .
3 . The Fire Company shall not be held liable for any failure of the system
or failure to relay any automatic alarm to either the Fire Company or

4 . This agreement may be terminated by any user upon giving the Fire Company
