Minutes of the Town Board meeting held July 9th
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Evans , Clm Webb , Clm Schlecht
Atty Perkins , and Z , O . Stewart
Absent : Clm Garlock
PUBLIC HEARING
SPECIAL PERMIT
July 9th , 1985 Charles E . Maynard
Minutes of the public hearing held July 9th 7 : 35PM
Supv Cotterill read the notice that was published in the newspaper to consider the
application of Charles E Maynard for a special permit to have a storage and carpeting
sales building at North . Rd approximately 750 feet past Mott Rd .
QUESTIONS AND/OR COMMENTS'
Ed Maynard - it will be a pole barn type structure , 24 by 40 feet , one story with half
of bath for lavatory and sink .
Supv Cotterill - wanted to know if it was going to be used for retail sales ?
Ed - it will be used as storage for carpeting that has been bought and some available
for sale . He will have some samples for people to look at .
Supv Cotterill - wanted to know how much land he has purchased ?
Ed - one acre , contingent upon the approval of the board to have this business there .
Ron Palmer - wanted to know how much frontage there would be ?
Ed . - approximately 150 feet .
Ron Palmer - wanted to know the purpose of chosing this location ?
Ed - it is close to the Village of Dryden so that heIwould be able to serve the
village easily .
Ron Palmer - wanted to know if this would be considered a commercial business and
wondered what this property was zoned as ?
Supv Cotterill - it is zoned RC , which is not strictly a commercial zone , and allows
certain types of applications for certain allowed uses .
Ed - there would be a hedgerow on the far side of the property and would be 150 feet
of road frontage . Mr Butler has mentioned the fact that you were interested in expanding
your trailer park and that you have a r-o-w going to your property .
Ron Palmer - has been negotiating with Mr Butler for the last several months to purchase
some of his property .
Ed - Mr Butler was only selling him one acre and not the entire parcel .
Ron Palmer - if he was going to expand his park in that direction he is conerned about
what is going to be there in a residential area .
Ed - what the plans are is to put up a wood type building or some other kind of siding
so that it will look attractive and there will be a lawn , shrubbery and will be nice
appearing .
Supv Cotterill - wanted to know if he had contacted the Health Department ?
Ed - yes , he had talked with them in regard to what had to be done , assuming that IH ::HN
the special permit was granted . � ,i , �
Ron Palmer - wanted to go on record as being opposed to this application . If the
permit was granted he wanted to know if there would be any restrictions put on the
special permit as to what he can do with the building?
Supv Cotterill - this Board has to make that decision as to whether or not it will be
granted and whether or not they want to put any restrictions on it . Mr Butler owns the
rest of the road frontage and also some property across the road and he might like to
propose more commercial business . This is what the Board would like to hear the
residents concern , as to whether or not you feel this is a bad place to put a business or not .
Ron Palmer - if he wants to expand his mobile home park , which is residential type business ,
he does not want to have commercial property near it . He felt that there was a lot of
property on the main street for a commercial type business .

TOWN BOARD MEETING
APPROVAL OF THE MINUTES : Motion was made by Clm Evans and seconded by Clm Webb that
the minutes of the three public hearings and special meeting held June- 10th and
' public hearing and Town Board meeting held June 11th be approved as submitted .
Supv Cotterill appointed Clm Webb to audit the general fund bills and special district
bills , and Clm Evans to audit the capital fund bills .
CITIZEN PRIVILEGE OF THE FLOOR
Charles Rumsey , 535 Beam Hill Rd - wanted the Town Boards approval or help to get a
garage changed over to a garage with as apartment on the upper level . He originally
built the garage with a variance approximately 50 feet from the road . He has gone
back to the ZBOA and they refused him permission to put the apartment in the- garage .
He stated that he was° fi'nanci'ally unable to build a house at the present time , but
would be able to convert the garage to a garage with an apartment . He does own
• 3 1 /2 acres. ZBOA felt that he had enough : : land in back of the garage to build a
house . He said that was true , but he did not have $ 30 , 000 . 00 to build a house , but
does have $ 5 , 000 . 00 to convert the garage . He would like the Boards help to get
this variance approved through the ZBOA .
Supv Cotteruil -, the Town Board has no jurisdiction over the action the ZBOA makes .
Charles Rumsey - has spoken with ZBOA Chairman , Mr Keech and was told that if he
would come to the Town Board , and explain his case , than the ZBOA would look At
the zoning ' variance again and maybe revise their decision .
Bob Keech , Chairman of ZBOA = he tried to explain to Mr Rumsey the reason for their
decision . ZBOA could see no way to grant the variance . Initally , he had started to
build the garage without a permit and then_ came to the ZBOA for the variance because
it was to close to the road . ZBOA did grant the;2variance , and Mr Rumsey feels that
the Board is treating 'him unjustly because he had started his garage without the
permit , which is not true . Bob said that he was not at the meeting , but he has read
the minutes and was sure that none of the Board members felt that way . They felt
that they should not grant this new request and set a precedent In granting variances
for people to build to close to the road other than what is required in the zoning .
• . Atty 'Perkins is the only reason he got the variance for being to close to the
• road because it was already under construction ?
Bob . Keech. - could not answer that because he was not at the meeting , - but did read the
minutes . From what he read in the minutes there are trees, ' etc that pretty well hide
the _garage and is on Beam Hill Rd which is pretty remote . There was one member that
almost did not vote for the variance and later changed his mind , so he did get the
variance . Bob thought he did have the footings poured for the garage before he
applied for the variance . c
Atty • Perkins - wanted to know if there was otherwise room on the . lot ?
Bob - yes, he has 3 acres.
Atty Perkins - this Board has no jurisdiction , it is strictly with ZBOA and what was
decided. at the hearing . - - , . . .
Charles Rumsey - found it hard to believe a variance was granted at one hearing and
two - , months later the second variance was denied . .
Atty Perkins - . it is a different purpose .
Mrs Barnes - wanted - to -know- the status with regard to Snyder Hill Water Dist ?
Atty Perkins -• the Board is waiting to hear_ from the bonding attorneys for the
resolution and determination .
Clm Evans = Mr Kraft of 10 Snyder Hill Court has requested to be included in the
proposed water district . - .
Atty Perkins Mr Kraft would end up bearing the costs for another district . He would
not be included in the district that has already been formed .
There was some discussion and the decision was made to go ahead with the already
• formed district instead of "holding up the timetable .
Clm Evans - will talk with Mr Kraft and let him know What has happened , but would
like to go on record that 'll there is anyway that is reasonable for Mr Kraft to be
included in the district he would like to see it done , without holding up the
present construction .
Atty Perkins - will contact the bonding attorneys .

COUNTY 'BRlEFTNG
Supv Cotterill - wanted to know if there was any truth to the rumor that the County
' is trying- to - start another landfill - in the Town of Dryden ?
Co Rep , Tillapaugh - there are studies being made to locate a site in Tompkins County .
To his knowledge both Mr Watros and himself have gone on record ' to the County Planning
Dept- &'- Public Works Committee as being opposed to having another landfill in the
Town of Dryden . a _ -• - ' -
Supv Cotterill - he would like his feelings relayed to the County Planning Dept
as being opposed . _ _ . _ _
- - Co Rep Tillapaugh- - what has been discussed to cut down on the - expense is to
support " a transport - station-to be hauled to another location ; • There was a . . - •
n resolution- passed by the County that when the Caswell Rd would be closed that
' another' landfill would not be located in the Town- of Dryden . • •

COUNCILMAN PRIVILEGE OF THE FLOOR _ . - . . -•

. Clrn Evans Souther Cayuga Lake Intermunicipal Water Commission has a proposal
requesting that at some point- the Town should consider some changes in their •
by- laws which will allow people in the water district to read . their own water
meters three out of four times a year , and then have the water district read the
' meter only once a year . This proposal will cut down on the costs They are looking
at ' ways of redistributing the cost of their rates so that they can charge their
capital costs to fixed- income in an attempt- to put the cost where it belongs in
the water rate . . - •• .
- RESOLUTION #140 - APPROVE . BY-LAW CHANGES OF SOUTHERN CAYUGA
• - - - ' LAKE INTERMUNICIPAL WATER COMMISSION 'a
' Clm Evans offered the following resolution and asked for its adoption: .
RESOLVED , that this Dryden Town Board- approves the by-law changes of the Southern
Cayuga Lake Lntermuni•cipal Water Commission which will allow. themto- implement
policies for residents of homes to read their own meters .
2nd Clm 'Webb ' . - Roll call vote - all voting -YES
• ZONING OFFICER
24 building permits for the month of June 9 one-family dwellings ; 6 additions ;
3 mobile homes , 2 garages ; 1 four unit building; 2 storage buildings; and one
foundation for the Baptist Chruch . ZBOA had 4 hearings . 1 - Charles . Rumsey ,
Beam Hill Rd . - a variance was granted for a .garage that . was already started •in •
•- April , set back 40 feet .instead of the 70 feet that -is required . Mr Rumsey
ill '
asked for another, ' variance to make an apartment in his garage to live in while : .
be built his house and then be able to rent out the garage later on. This •
variance was denied ; 2- Mercy Krebs requested a variance to place a mobile home
on Short Rd which is not a public road and the variance was denied . 3- Gene Rotunda
requested a variance to build a house on Yellow Barn Rd with less than the required
road frontage and wanted to reserve 60 feet for road to . land that would be• in
back of the lot.,_ • and _did not want it landlocked . This variance was granted .
4- James- Pyle requested a variance ^to place a mobile home without sufficient
road frontage on Midline Rd land later build a house . Will have a 25 ft r- o- w
to his lot although there is other land this is the only - place - available and -
suitable . This was granted . - - - -
There was some discussion regarding zoning and to have - signs posted: on • .state roads
coming . into the _ Town so that the the public is aware that Zoning is enforced in
the Town of Dryden . Supv Cotterill said that the Town will look into' the situation
and see what can be done . . . • . • .
ATTORNEY
Atty Perkins - gave Town Board members copies of the proposed resolution for
water and sewer studies near Varna ; Rt 366 , and: Rt 13 . The purpose and intent
is to include within the - study area all of the area that is within that
district but outside of . the existing . water or sewer . districts and included

in the study is any tax map parcel which • abuts any of the . roads . mentioned
in this description or any part of the tax map parcel . . There was some
discussion regarding the description and C1m Schlecht recommended that the
old • -A Zone be included in the water and sewer study .

PURSUANT TO TOWN LAW SECTION 209 - b
FOR A WATER STUDY FOR CERTAIN
AREAS OF THE TOWN OF DRYDEN

Councilman Schlecht offered the following resolution
and asked for its adoption :
WHEREAS , certain areas in the western part of the Town
of Dryden near the airport and along the Route 13 corridor
have been re - zoned for certain commercial and light
industrial ' uses , and -
WHEREAS , the location of those uses in this area is
largely dependent upon an availability of a public water
supply , and
WHEREAS , the Town is a part owner and has an interest
in the Bolton Point Water Project and Treatment and
Distribution Facility , and
WHEREAS , there are certain areas currently served by
private water supplies in the western area of the Town of
Dryden and along New York State Route ' 366 and in the area
west of . Varna and existing water districts , which areas are
within the area hereinafter described and which have
experienced acute shortages of water and/ or poor quality or
contamination of private water supplies , and
WHEREAS , it is in the best interests of the residents ,
businesses and the owners of the vacant developable lands in
the area hereinafter described to have a good , clean ,
reliable , safe and sufficient supply of public water ,
NOW , THEREFORE , BE IT RESOLVED BY THE TOWN BOARD OF THE
TOWN OF DRYDEN AS FOLLOWS :
1 . This resolution is made pursuant to Town Law
Section 209 - b .
2 . The Town Board hereby appropriates the sum of
$ 1 , 700 . 00 to pay for the cost of preparing a general map ,
plan , and report for providing the original facilities ,
improvements , or services for public water supply within the
area hereinafter described .
. i 3 . Such maps , plans and reports shall conform with
the requirements of Town Law Section 209 - c .
4 . Such maps , plans and reports shall be prepared by
Hunt Engineers P . C . of Painted Post , New York .
5 . The area to be encompassed by such map , plan and
report shall be as follows :
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of
Dryden , County of Tompkins , and State of New York. bounded
and described as follows :

thereby threatening contamination of private water supplies ,

businesses and the owners of the vacant developable lands in
the area hereinafter described to have a public sanitary
sewer system ,
NOW , THEREFORE , BE IT RESOLVED BY THE TOWN BOARD OF THE .

Supv Cotterill - reported that the Village of Dryden is. in the second phase of their
flood control program and are ready to require the easements from the property owners .
Reported that he had sent out letters to the Planning Board and ZBOA regarding
policies of permits on non-public roads and would like to hear any comments or
suggestions from the boards .
Barbara Caldwell - they have not met since they have received the letter , but felt
that the Planning Board would agree with the Town Board .
Bob Keech - appreciated the (letter , but suggested ' that it states a large tract of
land and felt that the word large could be deleted .

The following resolution was passed by the Planning Board
Motion was made by B . Lavine and seconded by J . Hunt that the Planning Board
was in support of the letter to the Town Board from Alton Reed on June 7th to
Bill MQbbs, County Highway Dept . They are in support of the two major points
in the letter in that the speed limit on the section noted should be lowered
to 45 mph as proposed and that the bank along the road should be tapered off
to eliminate the snow- problem as described in the letter . Carried
Supv CotterIli - attended the meeting on the proposed change of Rt 96 and gave
the board members copies of the proposed changes .
