Minutes of the public hearing commencing at 7 : 30 PM
Supv Cotterill read the notice that was published in the newspaper concerning the
application for Gary Mullen , 470 Livermore Rd to extend his body shop at 290 Cortland Rd .
QUESTIONS AND/OR COMMENTS
Gary Mullen - it will be basically a paintroom , 20 ' by 32 ' on the back side of the
building , facing Livermore Rd . It is the same type of construction as the other building .
Clm Metzger wanted to know if there will be any bathrooms ?
Gary Mullen - no , it will be just one big room with no plumbing .

TOWN BOARD MEETING
May 11 , 1982
Minutes of the Town Board meeting held on May 11th .
Supv Cotterill called the meeting to order at 7 : 35PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Jordan , Clm Metzger ,
Clm Webb , Clm Evans , Z . O . Stewart and
Atty Perkins arrived at 8 : 00PM
Approval of the minutes : Motion was made by Clm Metzger and 2nd by Clm Jordan that
the minutes be approved after the correction of the word accused on page 27 under
questions and or comments and the word change from on to one under Tom Wood on page 27 .
COUNTY BRIEFING
Co Rep Watros reported that the county has received the copies of the resolutions that
the Town Board made at their last meeting held on April 13th . Co Rep Tillapaugh
is on the Planning and Public Works Committee and he hoped that he would see to the
terms that you have made to the committee . He will be sure that they are brought
up at any meeting that he attends with the whole board . The county is actively
pursuing a use for the old hospital .
COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Webb - since the public hearing last month with regard to mass meetings , he didn ' t
contact Jon because there was all opposition and no one was in favor . He was not sure
if it was the money factor or the size of people . Since no one is backing us we should
not pursue this any further , until someone from the town asks us to do something .
ATTORNEY .
Reported that awhile back there was a request from Ithaca Area Wastewater Treatment
Plant . The town has to adopt a local fresh water wetlands act ordinance .
Atty Perkins said that he had written to the New York State Dept of Environmental
Conservation asking if we had any wetlands in the Town of Dryden and they couldn ' t
tell him because they are still studying it . There is a provision in the law that
you may adopt a wetlands act saying that you will assume jurisdiction over wetlands
in your area when the map is filed . A local law has to be introduced and one has
been prepared . It will be consistent with the wetlands act that the Village of Dryden
and the Town of Ithaca have adopted .
Atty Perkins also reported that we have formally established the GJR Sewer Dist in
Dec 1981 and Werninckville in Jan of 1982 . The State Comptroller has approved the
establishment of the Cortland Rd Sewer Dist .
ORDER - ESTABLISHMENT OF THE CORTLAND ROAD
SEWER DISTRICT
Motion was made by Clm Metzger and Seconded by Clm Evans that the following order
be adopted .
WHEREAS , the Town of the Town of Dr_ yden , Tompkins 3579
County , New York , has caused a general map , plan and report to
be prepared and filed in the office of the Town Clerk of the
Town in relation to the proposed establishment of a sewer dis -
trict in the Town , to be known as the Cortland Road Sewer
District ; and
WHEREAS , an order was adopted by the Town Board on May 18 ,
1981 , reciting a description of the boundaries of the district ,
the proposed improvements , the maximum amount proposed to be ex -
pended for the - improvements to be provided in connection there -
", with , the fact that the map , plan and report had been presented
to and also were on file in the Town Clerk ' s Office , and specify -
ing June 3 , 1981 , at 7 : 30 p . m . in the Town Hall , 65 East Main
Street , Dryden , New York in the Town , as the time when and the
place where the Town Board would meet in a public hearing to hear
all persons interested in the creation of the district , and for
any other action on the part of the Town Board with relation to
the matter as might be required by law or proper in the circum -
stances ; and
WHEREAS , the order was published and posted in the manner
and within the time prescribed by Section 209 - d of the Town Law
and proof of the publication and posting has been presented to
the Town Board ; and
WHEREAS , the public hearing was held at the time and place
set forth in the order , and all persons desiring to be heard
were heard ; and
WHEREAS , following the public hearing and based upon the
evidence given thereat , the Town Board on June 9 , 1981 , adopted
a resolution subject to permissive referendum determining in the
affirmative all of the questions set forth in subdivision 1 of
Section 209 - e of the Town Law and approving the establishment of
• the district ; and
• WHEREAS , notice of the adoption of the resolution was pub - •
lished and posted in the manner provided by law , and proof of
the publication and posting presented to the Town Board ; and
WHEREAS , no petition was submitted to and filed with the
clerk protesting the adoption of the resolution and requesting
that it be submitted to the qualified electors of the Town re -

siding in the proposed Cortland Road Sewer District for their
approval or disapproval ; and

WHEREAS , the Town Clerk ' s Certificate as to No Filing of a
Petition for a permissive referendum. was duly filed in the Office
of the ; Tompkins County Clerk ; and
WHEREAS , the STATE COMPTROLLER has on April 30 , 1982 , ordered
that the application. for permission to establish said District
is granted and has permitted the establishment of said District
pursuant to the To Board ' s Resolution of August 17 , 1981 ;
' NOW , THEREFORE , IT IS
ORDERED , by the Town - Board of the Town of _Dryden , Tompkins i
County ; New York , as follows : . 410
1 ! The Cortland Road Sewer District of the Town of Dryden ,
Tompkins County , New York , is hereby established substantially in
accordance with the aforesaid map , plan and report , and the dis -
Itrict shall be bounded and described according to Schedule 3
Iattached hereto .

2i . The construction of the proposed improvements for the
distr. i 'ct , and also including land or rights in land , original
furnishings , equipment , machinery or apparatus incidental thereto ,

substantially as set forth on the map , plan and report is hereby
authorized at a maximum estimated cost of $ 250 , 000 . 00 . The
method' of financing is the issuance of serial bonds not to exceed.
the am I ount of Two Hundred Fifty Thousand ( $ 250 , 000 . 00 ) Dollars
payable with interest over a period of thirty years if conven -
tional financing is sought or forty years if Farmers Home Admin -
istration financing is available . The cost of construction of
said sewer system shall be assessed by the said Town Board in
proportion as nearly as may be to the benefit which each lot or
parceli will derive therefrom .
3 , The Town Cleric is hereby authorized and directed to cause
a certified copy of this order to be recorded and filed in
accordance with the provisions of subdivision l of Section 209 -g 410
of the ; Town Law .
4 ,. This order shall take effect immediately .

Reported that there will be a Tompkins County Municipal Officers Assoc . meeting on
May 26th at 7 : 00PM at the Lehigh Valley Restaurant .
ZONING OFFICER
7 building permits for the monthhof April . 3 additions ; 2 toolsheds and 2 one -family
dwellings . ZBOA held no hearings .
CORRESPONDENCE
Letter from the SPCA with regard to a meeting on May 20th at 7 : 00 PM at the Town
Hall in Ithaca .

DISCUSSION •
There was some discussion about fire safety standards and public assembly .
Jack Miller wanted a copy of our Local Law regarding our Fire Prevention Code .
There was some discussion about the turnaround on Redwood Lane . It was decided that
there will have to be a public hearing before it can be deeded back . to the property
owner . Supv Cotterill asked Hwy Supt Humphrey to get all of the paper work to
Atty Perkins so that there :can be a public hearing next month .
A hearing is scheduled with the Village of Dryden on June 14th at 7 : 30 PM regarding
the sewer study .
RESOLUTION # 69 APPROVE AMENDMENT TO STATE DIVISION
FOR YOUTH
Clm Webb offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board approve the amendmenttto the State Division for
Youth to increase Youth Service by $ 200 . 00 with the same restrictions as on
original , to . expire on December 31 , 1982 .

RESOLUTION # 70 APPROVAL OF THE NAME ITHACA AREA
WASTEWATER TREATMENT PLANT
Clm Metzger offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board authorize the approval of the name Ithaca Area
Wastewater Treatment Plant .

RESOLUTION # 71 WEEKLY WAGE OF ANY SERVICE EMPLOYEE
WHEN ON ACTIVE DUTY
Clm Jordan offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board authorize the Supv to make up the difference between
the normal weekly wage and what any service employee makes per week when on active
duty for the reserves .

Clm Metzger offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board authorize the Hwy Supt to sell the Galion 3 wheel
roller to the Town of Berkshire for $ 4 , 500 . 00

Schedule meeting at Varna Community Center on Mon May 17th concerning Water Dist #1
RESOLUTION # 76 GRANT SPECIAL PERMIT - Gary Mullen
Clm Webb offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board grant a special permit to Garu Mullen for his
request for an addition to his building with the following restrictions ;
17 this special permit is limited to Mr Mullens use only and may not be transferred
by sale or lease to any other party . 2- six day work week , Mon thru Sat . no working
hours on Sun . 3- there shall be no outside storage of any vehicles except those
waiting for parts14- there shall be no more than 3 cars outside marked for sale or
held for sale at any one time . 5- the Town Board may at such time if Mr Mullen fails
to comply with these provisions cancel the special permit .
