HomeMy WebLinkAbout1981-06-03 Public Hearing June 3 , 1981 Proposed Sewer District - Cortland Road Minutes of the public hearing held on June 3rd 7 : 30 PM Supv Cotterill read the notice that was published in the newspaper concerning the proposed sewer district for Cortland Road . QUESTIONS AND / OR COMMENTS Mr Lee Mitchell , representative from Vrooman Engineers , handed out copies of the engineers report . The basic proposal is to run a sewer line north of the present line in the Village of Dryden . Within the district there is now the Dryden High School and TC 3 , extensions from the village system . These would be added in the overall district . The village sewer system has the capacity to pick up the additional • flow from this area . The actual area served would be the equivalent of about 100 units . The total flow from the area would be approximately 35 , 000 gallons a day . The present village treatment pland has the capacity for this , so there will be no overload problem . Mr Bill Petrillose wanted to know how the gallons per day were figured out ? Mr Mithcell said by counting houses and using average figures for similar occupants in places where they are metered . Mr Petrillose wanted to know how they were established for a mobile home park ? Mr Mithcell said that they could be on the order of a factor . In Portzline Trailer Park there are 70 trailers and they would be converted into 53 equivalent units . Mr Petrillose said that he was talking about gallons flow per day . In the engineers report it is listed as 17 , 500 gallons and wanted to kno where he came up with a figure of 330 gallons per unit ? ) . Mr Mithcell said that it was a general average nationwide . Mr Petrillose said that the national mobile home average is 150 gallons per day per unit . Mr Mithcell said that it is figured different ways , by unit and by population . Mr Petrillose said that you will not get 125 gallons through 1 / 4 inch line which he has and is legaL, He also questioned the gallons of flow per day on the laundromat . In the report he wouldn ' t be able to run the laundromat with that many number of gallons per week because his water softener would not work . . Mr Mitchell said that these figures are just preliminary estimates . The figure is that an average washer uses about 50 gallos of water . Mr Petrillose said that Speed Queens are a standard machine , with a 35 gallon capacity , so where does the 50 gallons come from? The Big Boy use only 40 gallons , so the figures are based about double of what he is presently using . Dr Robert Jacobson said that a single family rate is quoted in the report , and there are so few single families involved . It never approaches the question of how you translate the rate to the actual user of this system whether they be trailer parks , professional offices , apartment houses , food servide places , etc . and he felt that they should have answers at some point before they are asked to make a decision . How do you translate _ the reate that you are proposing which is a single family rate to what they are actually doing there ? Supv Cotterill said that it is listed in the equivalent single family unit column for different operations . . Mr Petrillose said if the usage isn ' t there , why should he be based on 53 units ? • Supv Cotterill said that if the statistics prove that this is not a proper number , which is what we have to have so that we can convince the engineer that this is not a true amount . Mr Palmer wanted to know if Dryden High School and TC 3 were going to be included in this district ? • Supv Cotterill said that they are included , but they are not listed in the report , since they are already under contract with the village . If this is established they would give the town the money and in turn the town would pay the village and it will not vary either way it is paid . In the future if there were to be repairs made they would help to share those costs , but they are not going to benefit the district greatly or hurt the district . Their contract is based on a formula . Dr Jacobson wanted to know that since Dryden High School and TC 3 are not going to really affect the rate why is all of the acreage included in this proposed district ? Supv Cotterill said that there are some advantages , because if there was a house built near the school they would be able to hook into the sewer . Dr Jacobson said that he was talking about the outer boundaries of Dryden School and TC 3 particularly all the way to Livermore Road where there are not houses and is all college owned land . Supv Cotterill said that if there is development , there has to be sewer available . Mr Petrillose wanted to know how many units TC 3 and Dryden School are figured as family units ? Mr Mitchell said that they are paying more per unit . Mr Petrillose also wanted to know why they are paying for such a big water district ? All we •are going to do is pay for what , we are going to get and pay for improving their land because they will be in the sewer district . Supv Cotterill said that your cost will not go down with them in or out of the district , but it could help spread the cost because they will be helping to pay for the main line that you are going to use . 41) Mr Petrillose said that until they develop that land , the other people are helping to improve their land . Supv Cotterill said that even if they don 't use it they are going to help pay for it . Mr Petrillose wanted to know how? Supv Cotterill said that the Town Board could decide to figure it on assessed value and a unit charge . Mr Petrillose said until they develop . - the land it is just going to be made more valuable because they would be included in the district . He felt that all of the land should not be included in the district, just a strip up Route 13 . Mr Mitchell said the school equivalency is around 227 but , they are charged a flat rate for so much a year . TC 3 is 204 and they are also charged a flat rate and are paying about $ 12 , 000 per year now . Mayor Michael Lane said that there is a full time equivalency rate of number of students that is divided by a factor of 3 . 4 and the school is paying about $ 13 , 000 which included the elementary school in the village . Mr Mitchell said that when you finance a public district you have to make people in the district contribute to the cost of building the district and operating it . All property in the district is considered benefited . They would apply a benefit charge on the tax base and it can be done several ways . People who are getting - actual service out of the line will have to be assessed the users fee as well . They have figured as high as they could go . Dr Jacobson wanted to know if it would be possible to have some sort of an understanding Prior . to building the project that to the users the disparity between the fee charged for in village residents and out of village residents would remain not to exceed a certain percentage in difference . The rate right now is 12 for the out of village user . He felt that there are a lot of options here since the big users such as TC 3 and Dryden School are not on any rate that they can understand . They are on an individual contract and will probably continue to do so and the rest of us are stuck in the middle if the village , who already has had significant problems of processing their waste . We know that engineers as good as they are can ' t immediately predict what problems are going to arrise 5 years from now . We should assume that there are going to be tremendously increased costs to the overall project . How do they know how the costs are going to be distributedto users between village rate and out of village users ? Mayor Lane said that they haven ' t looked at the figures yet . He was sure that there would be an increment for the outside village user and was not sure what it would be , but within a reasonable range . Mr Mitchell said the rate in the report would include upgrading the village plant . Dr Jacobson wanted to know how that compared with in village users . Wouldn ' t it be reasonable for the district to say to the potential users that we have an understanding that the rate will not exceed 11/2 irrespective of what their rates will be ? It is reasonable if the village rates go up so will the outside rates go up so that we pay our fair share , but the disparity between the town structures should be understood if we get hooked on . Supv Cotterill agreed and felt that the village shouldn ' t get rich from the people outside . . The village should just have their costs covered and be protected and felt that they shouldn ' t furnish anything for the people outside , but it also should not be a profit making operation . We will be willing to pay our share but not 2 peoples share . He felt that we have a good realtionship with the village and does not foresee any problem . He felt that no one could sign a contract and give us a guarantee next year or 5 years from now , because the Village Board and Town Board changes and nobody can bind anyone else who would be elected to office 5 years from now . 97 Mr Petrillose said that a meeting he attended at the village there was a figure of $ 87 . 00 for the village and the town might have to pay around $ 99 . 00 . now he sees in this report that it will be either . $ 104 or $ 109 depending the financing . He wanted to know how much over the $ 87 . 00 would the village be paying ? Supv Cotterill said that there are 2 things to look at . The village has a set rate , surcharge wich is more than their base charge and there is no way of knowing these figures . Mr Petrillose wanted to know if the people outside would be paying $ 30 or $ 40 more than the village residents ? Supv Cotterill said that there will be a district charge added on to the contract . This cannot be guaranteed and is strictly an estimate . Mr Mitchell said that the $ 40 . 00 would be to pay off the bond issue . 1111 Mr Petrillose wanted to know if the $ 40 . 00 was going towards the pipe what was the $ 140 . 00 going towards ? Supv Cotterill said that is for the pipe and the village contract const which is the combined cost , that is based on regular financing and not FHA . Dv-Jacobson rsaid that he understands why the village is proceeding with this project and the town and other entities cooperated in this study and at this point where you are instituting a district . Is it the boards position that a primary motivation should be the desire of the people that they are going to be serviced . Supv Cotterill said that was part of it , and the Health Dept keeps telling the town that we have serious problems and have to give the people an alternative to see if they wanted a district and make it public . Supv Cotterill said that is why he is very upset that John Anderson is not here at these public hearings to tell the people what he has told the Town Board . The Health Dept is going to require you people to do something when you do have sewer problems , what kind of costs you are going to face on a private basis . He felt that it appears to the town that there maybe a possibility of receiving a Federal grant . The price is probably the best you will ever get , and the Board felt that the people should have an alternative . Mr Palmer wanted to know if this is passed and made a district when would it be in effect and operable ? Mr Mitchell said that any grant application to be accepted this year would have to be in by the middle of July of 1981 . If the grants are approved , which would be in early October 1981 and then would have to be put out for bid so the earliest possible date would be in the summer of 1982 . Mr Palmer was wondering , because right now he is having problems wih his sand filter and wanted to know if he should spend the money to have it fixed now , would he be exempt from the sewer district ? Supv Cotterill saidrthat he would not be exempt if he is within the sewer district . He thought that the Health Dept might allow him to do the minimum if they knew that there was going to be a district formed . Mayor Lane said that from the 1:ivillage standpoint they are very concerned about the capacity of their plant . There is an excess capacity there now , but is a planned excess capacity . He was looking at the boundaries and there are several areas that you could have potential housing units or multiple family units . He was wondering what the projection is in this district ? Mr Mitchell said that they had projected some growth of about 50 per cent which would make it an increase of 25 , 000 gallons . Supv Cotterill said that we have a zoning ordinance which the Town Board would make • the final decision and the village would have time to come to the public hearing to give their input to let us know if there would be an overload on the plant . There is some control over the development in that area . They would have to figure that someone will pay for increasing the size of the pant or it will not be allowed to be developed . The upgrading of the plant right now that is being proposed will increase the capacity to more than what this district is going to put in it . Mr Mitchell said it would be about the same . The usual service agreement that would be between the district and the village would include provisions for acceptance up to a maximum limit or if you would exceed that they increase the facilities each . year , which is a fairly common provision in the contract if you exceed 50 , 000 gallons a day . Dr Jacobson said that he would like to try and support it . You are saying that you have a centralized commercial problem and you want to try and serve it from a unified sewer approach . He is a fairly small user and would support it . We are including a lottof land and he does not understand the colleges intentions with regard to dormitory construction and until he has a better understanding of their participation in the cost of this project and their future benefits from the project he could not understand including the entire acreage in this project . I I Supv Cotterill said that they are not going to build anything unless they are approved for sewage . Th y have only approval now for the school and present buildings . If they have to pay the cost of doubling the plant that may change their mind . He said if the village decides that they can handle the college they may be exempt from zoning , but they are not exempt from the cost of processing sewer and the village would have that control . Dr Jacobson thought that they should do it as an individual entity and not a district that he has to ,participate in . Supv Cotterill Said that you would have more control if they were in the same district . Dr Jacobson saiid that they could sell that acreage that was announced that they are getting . It was a private foundation that gave it , ' and a foundation that took it and they can say that they need that land sold to increase their foundation earnings . • As far as he can see they pay for the line up there or not , he cannot see including all of the acrelage in the contract as they presently exist . Supv Cotterill Said that the only advantage is that . they will help pay the cost for the district whether they develop or not . Tf they do develop - it will have to be done to meet our approval . He wanted to know if they had any suggestions for setting up the district as the fait way to charge . It can be done on assessed value and a unit charge which they would contribute to the cost without putting anything into the system . There cannot be a solid figure until the federal grant has been approved , la bond issue drawn up , and put up for bid and a contract written with the village to process the sewage . There is no way of knowing a definite figure at this meeting '. ' I Dr Jacobson and Mr Petrillose were against such a big district with all of the acreage . Supv Cotterillisaid that this public hearing is to set up the boundaries of the district . If the boundaries are to be changed there will have to be another public hearing and there will not be enough time to set up a public hearing and yet get an application in for a Federal grant . Atty Perkins said that if the Town Board answers in the affirmative at its June 9th meeting can adopt a resolution establishing a district subject to a permissive ✓ eferendum . If the people in the district do not move it to a vote within 30 days the district will be formed . For a permissive referendum they have to sign and file a petition to put the district to a vote on their own . Each resident gets one vote and the owner in tile district . If there is no permissive referendum there has to be an application filed with Audit & Control . This does not mean any construction will take palce , it means that a district is formed . Federal funding still has to be sought , contracts have to be let and accepted before construction would begin . This district Cannot bond over what is listed in the plan and report without another public hearing There was some discussion about the boundaries . 1 Dr Jacobson said that he would like to go on record , a resident of this district and a businessman within this district and as it is presently submitted from a territory standpoint he is against the formation of the district . Also , he is against approving a districtwithout having a formula for- the application for the rate as part of the o riginal proposal . Supv Cotterill said that we will have to get more data before we can give anyone a guarantee of how it will be set up . There are several property owners that do not own enough property to install an up - to - date sewer system that will meet the state ✓ equirements . Mr Petrillose wanted to go on record with Dr Jacobson being against the district as it is submitted and would like to see another proposal other than the one presented tonight with some type of formula for the amount to be charged and a total assessment in the district that would be used . 1 . Mayor Lane said with regard to go on record as far , as the village goes they do not intend to take a position on the formation of the sewer district itself . They would be involved if they decided to take the affluent , but some of the things that they would be concerned about would be that their current ordinance would not allow them to accept the affluent so that is one thing that the present Village Board would have to change . He couldn ' t speak for , the board , but it would have to be looked at . The capacity of the plant is a concern to them , what ever size the town would like to make it is fine with them but the village would be looking for safeguardslin their contract and the larger incsize the more safeguards they would be interested in . He said that there would be an surcharge to outside users but could not give a definite figure at this point . There would not be any benefit , to the village to have its own sewer plant and operating its own village government unless they would be talking about annexation and he didn ' t think they are interested in that . If outside users are receiving the same services and not paying village t axes there isja question that we have to respond to our village residents . Supv Cotterill said that the engineer has indicated that this district is bound to lower your costs within the village because we would be helping to pay the cost for up dating your plant that would have to be done even if a district was not formed . You might be using more chemicals to process the extra flow but the man hours shouldn ' t 1 change and we would be paying part of his salary . He couldn ' t see any justification for charging 1 or 12 for outside users because we are already paying for the line and upgrading the plant and there is a benefit to the village .- residents because the cost would be spread out more and you are getting your plant paid for and if you have to upgrade it you will have more people to help . Your costs would be identical with or without this district . There is no way that the village would not benefit if we paid an equal amount . Supv Cotterill said that he would be able to get the figures . of assessed value in the proposed district . Dr Jacobson wanted to know if Supv Cotterill would go on record as a supervisor that if a situation were to develop where it was approved by the residents and- ”you went ahead and began to negotiate with the village and found that they insisted on 12 rate or anything substantially different from an equal rate application that you would be against it ? • Supv Cotterill said that first of all we have to get closer to that point before we get a bond issue to build a pipe . Dr Jacobson said that right now we are approving it on your say so that is why he asked the question . - Supv Cotterill said that first of all we have a figure here which we are talking about . If we go beyond that figure then we have to go back to another public hearing which means that is the end of it . Dr Jacobson said that the costs we.. are concerned with are the rate fee and that is not part of the resolution and that could change . He said the rate fees are meaningless because of the inadequacy of the information that they have . Supv Cotterill said that there is no rate cost regarding sewer . If the outside users were charged 50 percent more there is no way the town could stay within the projected costs so the village could even kill the district . QUESTIONS AND / OR COMMENTS Atty Perkins read a letter from Mr Frank Speno , Executive Director of George Junior Republic Assoc . Inc . stating that they hereby request the Dryden Town Board to pass a resolution toi create a sewer district for George Junior Republic so that they may qualify for participation in the Phase II program of the Dryden-Freeville Joint Waste Water Facility Plan . Closed public hearing 7 : 20 PM PUBLIC HEARING June 4 , 1981 Proposed Sewer District - Werninckville • Minutes of the public hearing held on June 4th at 7 : 30 PM Supv Cotterill read the notice that was published in the newspaper concerning the proposed sewer district for Werninckville . QUESTIONS AND / OR COMMENTS . Mr Mitchell said that it would be economical if the Werninckville Sewer District was built at the same time as Freeville Village . The Werninckville Dist . would be responsible for the piping in addition to what is required by the Village of Freeville . They would be responsible for their own debt service within their district . The treatment plant would also have to be larger so there would also be a charge for that . The annual charge to the district people would be made up of enough money to cover the bonds for their share of construction for the plant and operating costs . S Mayor Lane , who has served on the joint sewer commission for 2 years , wanted to urge the Town Board to consider the district favorably as part of the overall Freeville area development that they have been considering . Recently the Tompkins County Health Dept has gone on record as supporting the community-wide concept of sewer treatment in this area . If the district isn ' t formed and the grant applications aren ' t made rapidly the chances are that the Werninckville area receiving any Federal or State money which could; amount to 872% will probably be gone for many years . June 9th Supv Cotterill called the meeting to order at 8 : 00 PM IIMembers and guests participated in the Pledge of Allegiance _ Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Metzger , Clm Webb and Atty Perkins Absent : Clm Tarr , Clm Jordan and Z . O . Stewart Approval of the minutes : Motion was made by Clm Webb and seconded by Clm Metzger that the minutes of the Public Hearing , 2 Proposed Local Laws , Special Permit Hearing and Town Board meeting held on May 12th be approved as submitted . Motion was made by Clm Webb and seconded by Clm Metzger that after the correction was made of spelling help in the first paragraph and in the twelfth paragraph to read (is not the prosecutor ) . that the minutes be approved for the May 18th special meeting . COUNTY BRIEFING • Co Rep Watros reported that redistricting will have a significant impact on the town . Supv Cotterill said that he had copies for the board members . CITIZEN PRIVILEGE OF THE FLOOR Mr & Mrs Henry J Bennedy , 41 Old Dryden Rd , wanted the Town Board to give permission to Sammons Communication to hook them up to their cable system , since it is available and more convenient and is to far out for Ceracche TV to hook them up . Sammons is • willing , but it needs the Town of Dryden approval . Atty Perkins said that he will be meeting with Ceracche TV and will check into the matter since the Town of Dryden does not have a franchise with Sammons . PCOUNCILMAN PRIVILEGE OF THE FLOOR Clm Webb reported that the street light was out at the corner of Rt 13 and Gulf Hill Rd and asked Town Clerk Lloyd to call NYSE&G to report it . ATTORNEY . Atty Perkins felt that it was important for the board members notto be confused with the report and plan done by Vrooman Engineers , that.: the time table set forth in their proposed forms because it will not happen that quickly . If the Town Board adopts the resolutions tonight establishing the proposed sewer districts they are subject to a permissive referendum and the Town cannot transmit anything to the State Comptroller until July 10th . Atty Perkins said that he has spoken with a bonding attorney in New York and they are aware of the form of the resolution which he has prepared and it is satisfactory to them . Each resolution varys a little from the resolution as set forth in the engineers report . We are putting in the resolution that the maximum cost will not exceed what has been proposed and what is set forth in the plan . Also , • in each resolution the improvements will be financed over a period not exceeding 40 years and not 30 years which was set forth in their resolution . These proposed resolutions do not at this time determine which properties will be benefited the most ' or set anyirates ; It establishes . a district subject to a permissive referendum . It states that the Town may contract for the improvements and bond for improvements , not exceeding the amounts in each resolution . The bonds will be serial bonds made payable in any One installment . That the boundaries are the ' same asset forth :in our public notice . The procedure would . be that if . the Town Board so .desires to adopt each of these resolutions tonight the Town Clerk must publish and post within the next 10 days the copies of the ' resolution . • The 30 day period would :begin • on June 10 , : 1981 as day one!. At ' the end' of the 30 Area period the Town Clerk sends • to the Dept of Audit and Control the application for the creation of the districts , with . the certificate that no petition •was . filed for a permissive referendum and other documents that are required by law which are not subject to this resolution . Atty. Perkins felt that it was going toy be close to get this all done by July and wanted the board members to be aware oflthis . Atty Perkins said : that he Would let Vrooman Engineers know that assuming that no petition for a permissive referendum and an election is not necessary and assuming further that Audit and -Control authorizes this , than the . Town Would like• to proceed • and we will operate along those lines , but we do not have any authority to contract with Vrooman except for our letter of content and good faith of our intentions . • Supv Cotterillauthorized Atty Perkins to work with Vrooman Engineers when the approval has been made . Supv Cotterillifelt• that the Town has an obligation if we are going :' to. -consider a. ' district and request some kind of an agreement from the villages before the end of this month so that the people within the districts can have. sortie . information as to where welstand . . Clm Webb wanted to know what they would need for a ;petition ? . Atty Perkins said that it would be 5 per cent of the total number of voters in the proposed district . Dr Jacobson said that since the last public meeting was held with regardlto the establishment for a sewer district , has the Town Board received any additional , information either affirmative or negative from owners within the district ? Supv CotterillIsaid that he hasn ' t received anything . Dr Jacobson said that there are some things that have to be considered in making your decision . ' There should be some • sort of clear ' need for a : different type of sewer system . Supv Cotterill : said that the first requirement to get a grant is that the engineer has made this study . and has shown a proven need which he has . indicated. this need ._ • He felt. that John Anderson , from the Health Dept should have . been to . these public hearings because he gives the Town . Board .members the opinion that he is very • lenient on people only because there have been sewer districts pending and he .. • . did not . feel that he. should ask the people to . upgrade their sewer systems if a . sewer districtiwas going to be - formed . within a . shor.t period of, time . . v . Dr Jacobson said that in the engineers report there is not one documented case that listed specifically as immediately needing a sewer or not being solved some other way .. Supv Cotterillisaid that there is no problem that cannot be solved some other ' way . Dr Jacobson said what bothers him is where all of the people are :if - they want a sewer district established ? Supv Cotterill said that the only time people, come . to_ . a pub1ic . heari•ng is that if they are opposed to something . . . Atty Perkins. said . that it should be considered in . terms of benefit and not by need . This board only has to make a determination that the. property Will . be benefited and not that it needs to be established . Supv Cotterill ; said that he was convinced that right now we have an obligation to the property owners to make something available because - he is personally convinced that we are talking around $100 to $125 per unit if it is based on a unit chargé , that never again in the history of our lifetime will we be able to get a : public sewer in any area for under $ 200- 300 . In the other : areas that we are talking - about are $ 200- $ 300 . ' We have an obligation ' tb allow the people ' to have • it . If the .people say that they don ' t want it and the Health Dept wants to get tough on ' them they can ' t come back on the Town and say that ' we threw their opportunity away . If the people don ' t want the sewer district that is their right , but he iaouldn ' t1want someone to come back 51years later and say the town had an , opportunity for them to , get sewer at $100 and didn ' t give them a chance . ' Supv Cotterill ' appointed Clm Metzger and Clm Webb to audit both highway and general fund bills since Clio Tarr and Clm Jordan were absent ! .� r , Clm Webb Said: that was why he asked how hard it was to get a referendum , because ".if : theftowh does pass this resolution the people should have every right to vote , . on .it :; It _is very ,obvious that the trailer parks are going to carry it or defeat it . If there ;is this much opposition and the Town Board does pass the resolution , then he. felt . that the people should. .have, a referendum and make it clear to each individual . Dr Jacobson ' sai'd that the boards position was perfectly logical . CORRESPONDENCE Supv Cotterill reported that he had written a letter to Empire Livestock with regard to the land outback of the highway building since the town only owns about 30 feet from the back of the building to see if they would be willing to sell some land . Mr Tom Petersonthad a map drawn - up of about 2 acres . Supv Cotterill has since received a letter from the Board of Directors stating that they will sell the 2 acres with a suggested price of $10 , 000 . 00 , and require a restriction in the deed that the land will not be used for residential purposes in the event that it is resold by the town . There was some discussion and the Town Board decided to give them a counter offer of $ 5 , 000 . 00 . Supv Cotterill was wondering who does the redistricting for the town ? Mrs Caldwell said that she would check to see who will be doing it . There was discussion with regard to SPCA and no action was taken . Supv Cotterill 'read a letter from the SPCA stating that they would not do any dog enumeration for 1981 . The completion date for 1980 dog census will be completed within the next 2 weeks and a report should be sent to each township . Supv Cotterill said that he has not received anything at this time . The SPCA will give a termination date for services to those towns who do not give a written acceptance for a 1981 contract in its present form . This termination date will be in June 1981 . Supv Cotterill authorized Atty Perkins to write a letter with regard to the SPCA that the 1980 dog census is not completed yet and the Town would like the 1980 contract fulfilled before the Town will consider signing the 1981 contract . Supv Cotterill read a letter from the Etna Community Assoc . regarding the help and cooperation they had received from the Town of Dryden Highway Dept . There was a suggestion that 2 people from the Town Board , Village Board and the emergency service to look at the situation to see if it would be advisable to ask TC 3 and Dryden School for a contribution towards emergency service .
