QUESTIONS AND/OR COMMENTS
Mr Fabbroni presented the Town Board with maps of the proposed water and sewer dist .
Atty Perkins stated that the Town Board would have to answer in the affirmative
4 questions under Section 194 of Town Law . If you so choose , by resolution
approve the establishment of the district as the boundaries are finally determined
to be . A copy of the plans are to be sent to the Health Dept . The approval of
the State Comptroller .is not necessary since there will be not indebtedness by
the town . - .. . . .

PROPOSED LOCAL LAW # 2 - 1981 Electrical Code for
May 12 ,. 1981 the Town of Dryden

Supv Cotterill called the hearing to order at 7 : 30 PM
Supv Cotterill read the notice that was published in the newspaper concerning a
proposed Local Law adopting an Electrical Inspection Code for the Town of Dryden .
QUESTIONS AND/OR COMMENTS
Mr Russell Hendrick , Branch Manager ; Mr Mussi , Ass ' t Branch Manager and Mr Floyd
Ferris , Dist . Inspector were present to answer any questions .
Supv Cotterill was wondering if anyone putting an addition on their own house and
wanted to do the wiring himself would the Underwriters inspect the job or would a
licensed electrician have to do the work to get an inspection ?
Mr Hendrick said that anyone can do the wiring as long as it passes the code .
Mr Watros wanted to know if this code would be over and above the regulations that
are now applied to the Underwriters requirements ?
Supv Cotterill said that the town does not have any code right now . If there is
a new house or addition NYSE&G will not do a hook- up until an Underwriter does
the inspection , but a person can add 2 rooms on their house and the Underwriters
may never know it .
Mr Hendrick said that under Section 8 stating that this local law would not be
applicable in certain cases ; that it shall not apply to any construction unless
a building permit is required by the town . Whenever a building permit is required j .
an electrical inspection would be required .
Supv Cotterill said that any change of use or any addition that requires a building
permit would require an inspection . This electrical code will only apply to the
town and does not include of Village of Dryden and Freeville .
Mr Hendrick said that if the building inspector has a building in the town that he
would like a reinspection , under this local law they will do it free of charge to
the town . The building inspector will request it on a certain form that they
provide him and they in turn will furnish a copy of their finding .

PUBLIC HEARING # 4
Special Permit - Ithaca Intersystems
May 12 , 1981 1650 Hanshaw Rd . Ithaca , NY
Minutes of the public hearing held on the 12th of May
Supv Cotterill called the hearing to order at 7 : 45 PM
Supv Cotterill read the notice that was published in the newspaper for the application
to build an executive Administrative & Engineering facility at 1650 Hanshaw Rd .
QUESTIONS AND/OR COMMENTS
Supv Cotterill said that a special permit was issued to Ithaca Intersystems for this
same building on Nov 3rd 1980 . However , they decided that they would like a building
100 ft by 200 ft rather than the 60 ft by 150 ft that was originally applied for .
Mr Claude Mathews , Vice President for Ithaca Intersystems said that it will be the
same general structure as before , but just larger . Right now their personnel is in
4 different locations . This will provide space for them in one building . Right now
they have crone from 40 employees to 100 employees . Their expansion has grown a lot
faster than they had anticipated and they felt that they would need a larger building
than they had originally applied for . The new building would be used for office
and engineering .
Clm Webb wanted to know if they have upgraded the sewer study since they are doubling
the size of their building and employees ?
Mr Mathews said that there will be a seperate sewage facility for the new building .
They have had a.:-special - study done " in the current assembly 6rea and it was determined
that since it was a public facility at one time it was adequate for the building
that they now have . It will be a seperate system for the new building with the
Health Dept approval . .

Supv Cotterill called the meeting to order at 8 : 00 PM
Members and guests participated to the Pledge of Allegiance ' . . •
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Tarr , Clm Webb , Clm Jordan ,
Clm Metzger , Atty Perkins and Z . O . Stewart
Approval of the minutes : Motion was made by Clm Metzger and seconded by Clm Jordan
that the minutes of the Special Permit Hearing and Board Meeting held on April 14th
be approved as submitted .
COUNTY BRIEFING
Co Rep Tillapaugh reported on the proposed crosstown arterial highway .
Reported that the Open Container law has been discussed at the county committee meeting
and he voted in favor of it . Also reported on the construction of an elevator in the
Court House . .
Supv Cotterill wanted to know if the County had discussed the TC 3 foundation acquisition ?
Co Rep Tillapaugh said that the County would have some kind of decision , but he was not
on the committee .
Clm Webb reported that he and Supv Cotterill had attended a telephone meeting concerning
the residents in the -northern part of the town . The problem is they can not call the
county seat without . making a toll call . They are going to ask the County about getting
some type of facility so they can call the sheriff and other important phone calls
without making a toll call .
Co Rep Tillapaugh said that nothing has been received at the County level at this time
but is sure they will , and he will look into the matter .
CITIZEN PRIVILEGE OF THE FLOOR
Atty John Stevens , representing Clinton E Cotterill , presented the Town Board with a
map for a proposed town road . Atty Stevens stated that Mr Cotterill has requested that
the town dedicate this road , pursuant to Section 273 of Town Law . This proposed road
should be referred to the Town Planning Board for their comments . Mr Cotterill has
stated that he will put down a coat of oil or stone to the specifications of the
Hwy Supt for certification for this road . The utility lines have been buried beneath
the road . This does not need sub- division approval under Section 3 Sub-Division C of
the Town Sub- Division regulations as any lots made will be over 10 acres in size .
Atty Stevens requested a public hearing for this proposal on the dedication for this
road at the regular Town Board meeting in July . The Town Planning Board will receive
the proposal for their comments .
Atty Perkins said that the Town Board should refer this proposal to the Town Planning
Board and they have 30 days in which to comment . The June Town Board meeting is less
than 30 days so a public hearing could be scheduled at that time for the July Board
Meeting . The Town Board gave the proposed map to Mrs Barbara Caldwell , Planning
Board Chairman .
Mrs Caldwell reported that she had attended a draft meeting concerning the East Ithaca
Circulation Study . They are looking for approval of concept but not necessarily approval
of details nor committments from the different municipalities involved . She had a
draft copy and it ! was subject to changes . This is about a 7 year time table and
with limited access . The County Planning Dept said they would come to a board meeting
if requested to ; explain it in more detail .
Supv Cotterill felt that the Planning Board should look at it and then make any
comments to the Town Board .
ATTORNEY
Atty Perkins reported that the SPCA contract is tabled until a special meeting
to be held on May 18th .
Reported on George Rd that GJR does have the deed that he had sent and Mr Speno
will follow up on it . Atty Perkins suggested that the Town Board not take any
action at this time .
Reported that the town would be considering 3 proposed sewer districts . The town
will be receiving from Vrooman Engineers after the time for the permissive referendum
on the resolution is up . The procedure is for this Board to enter an order reciting
the 'proposed description for the district , that the map , and plans have been filed
with the Town Clerk , and set up a public hearing . Since we don ' t have the plans yet
and will not receive them until next week , after the 30 days are up , he suggested —
that the Town Board schedule a special meeting pending the receipt of the plans , and
enter that order and schedule a public hearing . This will have to be worked in with
the other 2 public hearings which will need to be held for the other 2 districts .
One of which proposed district encompasses all of the area near GJR . The other district
includes some area outside of the Village of Freeville in Werninckville . along Rt 366 .
If the Town Board chooses , pending the receipt of plans , maps and reports you may
enter an order into the minutes and schedule a public hearing for those 2 districts
or you can waitiuntil after you have had a chance to review those documents . The
hearings probably should be held on 2 different nights . The town cannot form a
district within ! the Village of Freeville or include any part without the villages ( `
consent . If the district is to include area within the Village . of Freeville , the
Village will have to adopt a resolution subject to a permissive referendum to be t `
included in the proposed district .
The Town Board decided to look at the plans and make their decision at the May 18th
special meetingjand schedule a public hearing at that time .
Atty Perkins reported on the status of the abandoned LVRR property . The Town has the
option to purchase all of the abandoned property r- o- w in the Town of Dryden . The
total purchase price is $ 2950 . 00 of which the town has paid 10 per cent . The town
would end up with easements or a right to install water , sewer or other utility lines
in that r- o- w . Between the Village of Dryden on the south and the center line on
West Lake Rd there are approximately 12 . 68 acres , no approach has been made to the
property owners ; along the r- o- w . This has been discussed before and felt that this
property would be the most developable for any public use . ._ There is no reason if the
town :. wishes to retain title to this property . Between the Village of Dryden north
to the Village of Freevillg there are approximately . 16 acres which borders mostly
GJR . This will probably be marketed to GJR . All of the property will be marketed .=
north of the Village of Freeville to the Groton Town Line . All of the property-
between East Ithaca and the Village of Freeville has been contracted to be sold . -
At the present time the Town of Dryden will end up with about 13 acres for a
temporary period of time . The town will be able to sell the rest of the property
and would have the easement within the r- o- w for the installation of water , sewer
and utility lines . Atty Perkins said that if the town is willing , arrangements
should be worked out so that a resolution can be adopted at the June meeting .
Clm Metzger wanted to know when the option time was over?
Atty Perkins said that the option time was 18 months which would be up October 24th
1981 . He felt that the time to act would be now . The town would be investing about
$ 3300 or $ 3400 of town funds , of which $ 2950 . 00 has already been paid . The Village
of Dryden has bought all of the property within the village limits and the Village
of Freeville has bought all of the property within their village limits . All the
town would end up owning would be the land south of the Village of Dryden to West
Lake Rd . Atty Perkins said that he would have a formal written proposal for the
June meeting .

Supv Cotterill reported that he had asked the Health Dept for a report of their survey
on the septic systems involving the Yellow Barn Rd area that they took several years
ago . The Health Dept felt that there are some bad situations in that area and the
people that live there do not think that there is . Supv Cotterill said that he did
receive the report of the bad systems of 2 years ago and none of these have been
upgraded . He thought that this report should be given to the Planning Board for them
to review and see what their recommendations are . Mrs Caldwell stated that this was
one of the areas of their concern and they only had a preliminary chart which showed
percentages of systems with problems in different areas . There was some suggestion
that part of this area could be done as a cluster system .
TOWN CLERK •
The Town Board delegated Town Clerk Lloyd as licensing officer for Games of Chance in
the Town of Dryden . Effective date of appointment is from May 12 , 1981 to Dec . 31 , 1981 .
Reported that the Tomp . Co Municipal meeting will be held May 21st at The Livery at 6 : 00PM .
Clm Jordan introduced a proposed Local Law providing for the repair or removal of unsafe
buildings and, coilapsed structures . .
Supv Cotterill scheduled a public hearing for June 9th at 7 ;,15 PM
ZONING OFFICER
Issued 9 building permits for the month of Arpil . 1 one- family ; 1 replacement for a
mobile home ; 4 storage buildings ; 2 additions to houses and Ithaca Intersystems special
permit .
CORRESPONDENCE
Letter from Ellis Hollow Community Assoc . regarding zoning in Ellis Hollow area .
The Town Board gave the letter to Mrs Caldwell , for the Planning Board consideration .
There was also a petition of 110 signatures against multiple housing in that area .
Received a letter from John Marcham of the Intergovernmental Relations Committee with
regard to the acquisition of the land for the foundation fund at TC3 . Supv Cotterill
said that the Village of Dryden has sent a letter stating that they are strongly
opposed to taking the land off the tax roll , since the college has stated that they
do not need the land for college use .
RESOLUTION # 70 TAKING PARCEL # 37- 1 - 10 OF TAX ROLL BY
TC 3 FOUNDATION,` '
Clm Webb offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board disapprove of TC 3 Foundation taking over parcel
# 37- 1 - 10 , thereby eliminating it from the tax roll .

Received report from Dryden Village Police Dept requesting the State to lower the
speed limit on Springhouse Rd .
RESOLUTION # 71 REDUCE SPEED LIMIT ON SPRINGHOUSE ROAD
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board request the State to lower the speed limit to 30 MPH
on Springhouse Road .

OLD BUSINESS
Mr C J Drost presented the Town Board with. a revised application to his original
building permit ., Atty. Perkins said that the revised application is significantly
modified to include 8 units instead of . the 9 original units . 4 - two . bedrooms and
4 - one bedroom -, with an increase in the sq footage of floor area . . Atty Perkins
opinion was that since the request has been so modified as to change its original
application that this board should require another public hearing . The sq footage
area has gone from 5700 sq ft to 6800 sq ft , and they are to be owner occupied

rather than a rental unit .
Mr Drost said that he called the attorney since the last hearing and he tried to
make some adjustments after he had feed back from the residents . He tried to
adjust the plans to make it more in line with what they would like . As. it was set
up as a single bedroom unit it would attract more single people and now it will . ° •
have 1 extra room in each unit and will attract families .
Supv Cotterill said that - the Town Board held a public hearing for a certain proposal
and that is what they . have to act on .
Mr Drost said that - he called the attorney about the new proposal and ' . the - feed back
• he received on the phone : was that. this wouldn ' t change anything :
Atty Perkins said that the application has been changed a lot from what was asked
about on the phone . You discussed about changing it from 9 to 8 units and said
nothing about changing it , from 1 bedroom units to 2 bedroom units ; and discussed
changing it ' to condominiums at . which time I told you another public hearing would
have to be held . It • was his opinion that the modifications of your application for
a special permit is an explicit withdrawal . of - the first application ; . therefore
a second application will have to have another public hearing . The purpose of . a
special permit is to :create an opportunity for the public to hear and -receive their
comments on the proposal . If you significantly change that proposal the public
has the right to be notified and come back to be heard .

Mrs Caldwell wanted to know if the town had ; any regulations oh condominiums ? '
Atty Perkins said that there were not any regulations unless it comes under our
planned unit development regulations . This is not a - condominium proposal as he
understands it as modified right now . The question was asked , if he changed it
from rental units to condominiumunits would a public hearing be required and he
advised Mr Drost that another public hearing would be required .
Supv Cotterill said that the town has received a petition from the Ellis Hollow
residents with 110 signatures opposing this 9 unit apartment house . . The Town Board
will have to disregard the original proposal and another public heating will have
to be held for the revised proposal . If Mr Drost would like to come back for another
public hearing properly scheduled and advertised the Town Board will gladly look at
whatever proposal he would like to make . This is not . legal for the Town Board . to
take action on since the application . has been revised . . .
Atty Perkins reported that the Town Board must determine by resolution : 1 -whether the
petition was signed and acknowledged and approved. as required by law and is otherwise
sufficient according to Town Law; 2- determine whether all of the property and the
property owners within the proposed district are benefited thereby ; 3 - determine
whether all the property and property owners benefited are included within the
proposed limits or extension ; 4- determine whether it is in the public interest
to grant in whole or in part the relief .' sought , which would be the creation of the
districts . If the Town Board answers • all of these • conditions iii the affirmative
the resolution approving the establishment of the district should set forth the
boundaries and the limits as finally determined .

. WATER AND SEWER DISTRICT
Clm Webb offered the following resolution and asked for its adoption . .
RESOLVED , that this Town Board determines with respect to the petition of Rocco P .
Lucente for the Oriole Drive Water and Sewer District that (a ) the petition is •
signed and acknowledged or approved as required by law and is otherwise sufficient ,
(b) all of the property and property owners within the proposed district or extension
are benefited thereby , (c ) all of the property and property owners benefited are
included within the limits of the proposed` district or extension , (d ) it is in the
public interest to grant the relief sought in the petition .
AND IT IS FURTHER RESOLVED , that the establishment or extension of the district that
the boundaries be , as set forth in Exhibit C in the petition as filed with the Town
Clerk . That those boundaries be set forth at length in the minutes of this board meeting .

and State of New York and being a part of Military Lot No . 51 in said town bounded
and described as follows :
Beginning at a point at the northwesterly corner of premises conveyed to
Rocco Lucente by deed of Donna K Stewart (executrix of Doris G Kanagas ) dated July 28 ,
1965 , recorded in the Tompkins County Clerk ' s Office July 28 , 1965 in Book 457 of Deeds
at Page 983 , also being at the northeasterly corner of premises conveyed to Rocco

RESOLUTION # 73 PROPOSED LOCAL LAW # 1 - 1981
PROVIDING FOR THE DEFENSE OF TOWN
OFFICERS AND EMPLOYEES
Clm Metzger offered the following resolution and asked for its adoption .
BE IT ENACTED by the Town Board of the Town of Dryden As follows :
SECTION 1 . As used in this local law , unless the context otherwise requires :
(a ) the term " employees " shall mean any person holding a position by election ,
appointment or employment in the service of the Town , but shall not include a
volunteer , any . person not compensated for his services or an independent contractor .
The term " employee " shall include a former employee , his estate or judicially
appointed personal representative . (b ) The term " Town " shall mean the Town of Dryden .
SECTION 2 . (a ) Upoii compliance by the employee with the provisions of section 3
•
of this local law , the Town shall provide for the defense of the employee in any
civil action or proceeding in any state or federal court arising out of any alleged
act or omission which occurred or is alleged in the complaint to have occurred while
the employee was acting or in good faith purporting to act within the scope of his
public employment or duties . Such defense shall not be provided where such civil
action or proceeding is brought by or on behalf of the Town ,
(b ) Subject to the conditions set forth in this local law , the employee shall be
represented by the Town Attorney or an attorney employed or retained by the Town
for the defense of the employee . The Town Board shall employ or retain an attorney
for the defense of the employee whenever ( 1 ) the Town does not have a Town Attorney ,
( 2 ) the Town Board determines based upon its investigation and review of the facts
and circumstances of the case that representation by the Town Attorney would be
inappropriate or ( 3 ) a court of competent jurisdiction determines that a conflict
of interest exists and that the employee cannot be represented by the Town Attorney .
Reasonable attorney ' s fees and litigation expenses shall be paid by the Town to
such attorney employed or retained , from time to time , during the pendency of the
civil action or proceeding subject to certification by the Town Supervisor that the
employee is entitled to representation under the terms and conditions of this local
law . Payment of such fees and expenses shall be made in the same manner as payment
of other claims and expenses of the Town . Any dispute with respect to representation
of multiple employees by the Town Attorney or by an attorney employed or retained for
such purposes or with respect to the amount of the fees or expenses shall he resolved
by the court .

(c ) Where the employee delivers process and a request for a defense to the :
Town Attorney or , the Town Supervisor as required by section 3 of this - local .
law , thes :Town • Attorney or the Supervisor , as the case may be , shall take the - .
necessary steps including the retention of an attorney under the terms and • . = .
conditions provided in paragraph (b ) of this section on behalf of the employee •
•
to avoid entry of a default - judgment , pending resolution of any question •
relating to the obligation of the Town to provide a defense . . .
SECTION 3 . The duties to defend provided in this local law shall be contingent .
upon (a ) • delivery to the Town Attorney or , if none , to the Town Supervisor of _.
the original or a copy of any summons , complaint , process , notice , demand or
pleading within five days after he is served with such document and (b ) the full _
cooperation of • the employee in the defense of such action or proceeding and
defense of any action or - proceeding against the Town based upon the same act
or omission , and in the prosecution of any appeal . Such delivery shall be deemed
a request by the employee that the Town provide for his defense pursuant to this
local law , unless the employee shall state in writing that a ;. defense is not.
requested .
SECTION 4 . The benefits Of this local law will inure only to employees as defined
herein and • shall not enlarge or diminish the rights of any other party nor shall
any provision of - this local law be construed to affect , alter or repeal any
provisions of the Workers' Compensation Law . .
SECTION 5 . The provisions of this local law shall not be construed to impair , .
alter , limit or modify the rights and obligations of any insurer under •any policy
of insurance . .. .
SECTION 6 . As otherwise specifically provided in this local law , the provisions
of this local law sha11 not be construed in any way to impair , alter , limit ,. modify ,
abrogate or restrict any° immunity available to or conferred upon any unit , entity ,
officer or employed by ; in accordance with , or by reason , any other provision of .
state or . federal statutory . or common. law . .
SECTION 7 . The provisions of this local law shall apply to all actions ' and
proceedings specified herein which have been commenced , instituted or brought
on or after the effective date of this local law . '
SECTION 8 . This local law shall take effect immediately upon adoption and the
compliance with the provisions of the Town Law and the Municipal Home Rule Law
as they pertain to the adoption of local laws . -

Sect.i 1, = - TITLE . This local . law shall be known as The Electrical Code
of the Town of Dryden . It

Section 2 - - STATEMENT OF . PURPOSE . Since there is danger to life and {
property inherent in the use of electrical energy , this local law is enacted
to : regulate the installation , alteration of wiring for electric light , heat or = - :
power and signal i systems operating on tufty 150J volts or more , in or on all` real ?
property within the Town of Dryden , exclusive of the Village } ' of Dryden . : - - - : .`r
Section 3 - - NATIONAL CODE ADOPTED . All electrical installations heretofore
mentioned shall be made in conformity with the requirements of the National Electrical • wI
Code except where the provisions of this local law or any other local ordinance or •building Code of the Town of Dryden shall differentl y prescribe , in which event i

compliance• with the provisions of such local law , Ordinance- or Building Code shall (
be recognized as proper compliance with this Ordinance . The requirements of the l
National Electrical Code shall be those known as National Fire Association Pamphlet r .# 70 , as approved and adopted by the American Standards Association . : ' ,
Section 4 -- ELECTRICAL INSPECTOR . The Chief Inspector , and each of the duly , i
appointed Inspectors of The New York Board of Fire Underwriters are hereby authorized
and deputized as agents Of the Town of Dryden to make inspections and reinspections J
of all electrical installations heretofore and hereafter described , and to approve , . .
or disapprove the same . In no event , however , will the cost or expense of such . { '
inspections and reinspections be a charge against the Town of Dryden . 7 '

" Section' ` 5" " °'DUTIES OF THE ELECTRICAL INSPECTORS . .._.. (a ) It shall be the duty
of the Inspector to report in writing to the Building Inspector or. Zoning Enforcement
Officer , whose duty it shall be to enforce all the provisions of this local law , all
violations of or deviations from or omissions of the electrical provisions of the
National Electrical Code , and of all local laws , local Ordinances , and Building
Codes as referred - to in this local law insofar as any of the same apply to electrical
wiring. : The Inspector shall make inspections and reinspections of electrical
installations in andcon properties in the Town of Dryden dporinthe written request
of an authorized; official of the Town of Dryden or as herein provided . The inspector
is authorized to make inspections and reinspections of electrical wiring installations ,
devices , appliances , and equipment , in , a.nd oh properties within the Town of Dryden
where he deems it necessary for the protection of life and property . In the event
of an emergency it is the duty of the Inspector to make electrical inspections upon the
oral .request of an official or officer of the Town of Dryden .

• (b) It shall be the duty of the Inspector to furnish written reports , to the
proper officials of the Town of Dryden and owners and%or lessees of property where
defective electrical installations and equipment are found upon inspection . He
shall authorize the issuing of a certificate of compliance when electrical install -
• ations and equipment are in conformity with this local law . He shall direct that
a copy of the certificate of compliance be sent to the Town of Dryden to the attention
of the Building Inspector or Zoning Enforcement Officer .
Section . 6 - VIOLATIONS OF THE LOCAL LAW. It shall be a violation of this
local law for any person , firm or corporation to install or . cause to be installed ,
or to alter electrical wiring for light , heat or . power in or ' on properties in the
Town of . Dryden until an application for inspection has been filed with The New •
York Board of Fire Underwriters . It shall be a violation of this local law for a
person , fi ±m or corporation to connect or cause to be connected electrical wiring ,
in or on .properties for light , heat or power , to any source of electrical energy
supply , prior to the issuance of a temporary certificate , or a certificate of
compliance , by The New York Board of Fire Underwriters .
Section 7 -- PENALTY FOR VIOLATIONS . Any person , firm or corporation who
shall violate any of the provisions of this local law or any rule or regulation
made pursuant thereto shall be guilty of a *violation , and upon conviction thereof
Oilmay be punished by a fine of not more than one hundred ( $100 . 00) . dollars , and each
day on which such violation continues shall constitute a separate offense .
Section 8 - - LOCAL LAW NOT APPLICABLE IN CERTAIN CASES . The provisions of
this Local gaol. shall not apply to the electrical installations in mines , ships ,
railway cars , automotive equipment , or the installations or equipment employed by
a railway , electrical or communication utility in the exersize of its function as
a utility , and located out doors or in buildings used exclusively for that purpose .
This Local Law shall not apply to any work involved in the manufacture , assembly ,
test or repair of electrical machinery , apparatus , materials and - equipment by a
person , firm or corporation engaged in electrical manufacturing as their principal
. business . It shall not apply to any building which is owned or leased in it entirety
by the Government of the United States or the State of New York . It shall not apply
to any construction unless a building permit is required by the Town of Dryden .
Section 9 - - NO WAIVER OR ASSUMPTION OF LIABILITY . This local law shall not
be construed to relieve from or lessen the responsibility of any person owning ,
operating , controlling or installing any electrical wiring , devices , appliances , or
equipment for loss of life or damage to person or property caused by any defect
therein , nor shall the Town of Dryden or The New York Board of Fire Underwriters be
deemed to have .-assumed any such liability by reason of -any inspection made pursuant
to this Ordinance .
® Section 10 - - SEPARABILITY :CLAUSE . If any part or provision of this local law
or the application: thereof to - any person orccircumstance be adjudged invalid by any
, . court of competent jurisdiction , such judgment shall be confined in its operation
IIto the part or provision or application directly involved in the controversy in which
such judg men_ t :,• shall have been rendered and shall not affect or impair the validity
of the remainder of this local law or the application thereof to other persons or
circumstances and the Town Board of the Town of. Dryden hereby declares that it would
have passed this local law or the remainder thereof had such invalid application or
invalid provision been apparent . .
. Section111 ' -- REPEALING 'PROVISIONS . All local law. and parts of local laws
or local Ordinances inconsistent with this Ordinance are hereby repealed .
Section 12 -- ' EFFECTIVE DATE . This local law shall take effect immediately
upon its approval and filing in the manner so provided by law .

construct a new building that is seperate from the present building for research and
development and administrative offices as designed on the application and comply with
Ariticle XIII of the Zoning Ordinance .

Supv Cotterill called the special meeting to order at 7 : 00 PM
Present : Supv Cotterill , CIm Webb , C1m Metzger and Atty Perkins

Supv Cotterill reported that he had received a letter from the SPCA with regard
to the SPCA/ TOWN/COUNTY liaison committe . Their porposal was that the SPCA not do
any dog enumeration and it would be the towns responsibility . The county would
reimburse the towns up to 75 cents per dog to h .ppay the cost . The proposal is
that the SPCA now or in the future no do the dog enumeration in any form .
Carol Hunter was present from the SPCA and stated that the dog enumeration was
basically the discussion at the meeting . The consensus was that it was easier for the
towns to hire their own enumerator since that person in the township is familiar with
the area and can work with the Town Clerk . . They really had problems hiring qualified
people .
Supv Cotterill said that was the towns reason . for the dog control officer to do the
enumeration because he had more . of a chance to keep track of the dogs more than what
we do .
Carol Hunter said that it was decided that the dog enumerator would go from door- to- door
and find out how many dogs there were licensed and unlicensed . The unlicensed dogs
would be given a promise to license form which gives them 5 days with which to license
the dog . If they do not comply within that 5 days than the Town Clerk would let us
know and we would then issue them a summons , and the Judge can pursue it from there .
Supv Cotterill felt that the SPCA should already issue them a violation notice and have
them into court . He felt that the only way we are going to get dogs licensed is to
send them to the Judge and fine them the first time they are caught with an unlicensed
dog . If you give them 5 days to license a dog there is no reason for anyone to license
their dog until they are caught . Within a year or so you will find that half of the
dogs in the town will be unlicensed unless you get tough and start fining the people .
What is the incentive for people to license their dogs if when you find them you give
them 5 days to license the dog with no fine .
Carol Hunter said that they did try to issue summons , but it w& s hard to find adults
at home . They have to be delivered in person and was impossible to find them .
Suvp Cotterill said that he assumed that the SPCA was asking the tcun to sign a county
contract in the next month .
Carol Hunter said that it would make it a lot easier to have a county contract then
to have about 10 different contracts .
Supv Cotterill felt that the most important part is to get all unlicensed dogs and
secondly to answer complaints . He would say that more than 50 per cent of the cost_
is getting the unlicensed dogs . To him the majority of the money should be spent on
dog enumeration . He felt that the . town should not be taking the responsibility of
finding the unlicensed dogs and just hiring someone to answer a few complaints . He
felt that the deg warden who has the authority should be checking for the unlicensed
dogs and write a ticket on every unlicensed dog that they find right then . We would
soon not have a problem of people not licensing their dogs . '
Atty Perkins wanted to know who ' s function it was to follow up on the summons once
it has been issued ?
Carol Hunter said that it would be up to the Judge .

Atty Perkins said that it would not be the Judge because he i thejprosecutor .
This is one of the real fundamental problems of the SPCA because they are not willing
to do the job that ' they are supposed to .
Carol Hunter said that the summons do not come from them .

Atty Perkins said that the SPCA can issue appearance tickets because they are peace
officers , but the problem is the SPCA does not want to do that .
Carol Hunter said that the problem with appearance tickets is that it might take them
10 days to find about 25 people to personally give that person an appearance ticket .
because it has to be issued in person . With the summons they can write them up within
less than an hour and have the Judge sign , date and send them. out .
Atty Perkins said that the SPCA is making the Justice do their job . You are making him
the one responsible for following up and getting these people into his court . You are
making him the prosecutor , judge and jury .
Carol Hunter said that when they first started to do the summons , which has been over
a year , they contacted every town justice in the county and that is the way that they
wanted it done , because the SPCA was having trouble getting appearance tickets delivered .

• (.� , Supv Cotterill did not know what the board wanted to do but was disappointed that
the town couldn ' t hire just one person to take care of the complaints and find the
unlicensed dogs .
Carol Hunter said that within the next 2 weeks a letter will be written as to how •
many unlicensed dogs they have found .
Supv Cotterill said that between now and the next board meeting they will have to
decide whether or not they are going to sign with the SPCA or look for a new dog
control officer . .
Atty Perkins reported that the Town Board will have to hold another public hearing
regarding the Local Law for the Electrical Code in the Town of Dryden because it
should be exclusive of the Villages of Dryden and Freeville in Sect . 2 .
CIm Metzger introduced Local Law # 2 1981 with regard to an Electrical Code in. . the !
Town of Dryden .

Suvp Cotterill scheduled a public hearing for June 9th at 7 : 00 PM for the electrical
code . .
Atty Perkins stated that the procedure , since all of the Board Members have received fr
the report , plans and map from Morrell Vrooman Engineers with regard to the sewer
districts is for this Board to enter an order into the minutes setting forth five
different items ; 1 - is the description of the boundaries of the proposed district ;
2- the maximum about to be expended ; 37 the proposed method of financing; 4 - a
statement that the map , plan and report are filed in the Town Clerk ' s Office and
they are there for public inspection ; 5- the time , date ,. and place`°for the public
hearing in which any interested person will be heard in connection with the establishment
of the district . Once this is done an order can be entered and can be moved and
adopted by this board by a consensus of a vote . There was some discussion and
decided to hold the public hearing on June 3rd at 7 : 30PM for Cortland Rd and on
June 4th at 7 : 15 PM for George Junior Republic and 7 : 30 PM for Werninckville .

description of the proposed George Junior Republic Sewer District will

set forth at length in the minutes of its meeting ; 2 ) The maximum amount
proposed to be expended is the sum of $ 90 , 000 . 00 ; 3 ) The proposed method
of financing of said district if conventional financing is sought will be
meet a thirty ( 30 ) year term with an anticipated interest rate of 8 pet
cent yearly payment of principal and interest $ 8 , 733 . 00 . If Farmers Home
Administration financing is available the cost will be amortized over a
forty ( 40 ) year period with an anticipated interest rate of 5 per cent
and yearly payments of principal and interest of $ 6 , 488 . 00 ; 4 ) That the

Atty Perkins said that the engineers study and plan is based upon the average
number of people per household or sewer lateral . The charges would be adjusted
accordingly . If you have a multiple resident they will not pay just one lateral
charge . Ailaundromat may have a 10 unit equivalent charge. 4$
Supv Cotterill said that the board members should be thinking about how the
district should be set up . It could go on a unit basis or assessed value . He
did not approve of the front -footage basis because people change properties and
roads are being changed and is very hard to keep up to date . He felt the best
assessed value and unit basis .
