PUBLIC HEARING
SPECIAL PERMIT - Ithaca Intersystems Inc .
October 14 , 1980
Minutes of the public hearing held by the Town Board on the 14th of October 7 : 30PM
Present : Supv Cotterill , Clm Tarr , Clm Webb , Cim. Metzger , Clm Jordan , Atty Perkins

Supv Cotterill read the notice that was published in the newspaper for the consideration
of the application of Ithaca Intersystems Inc for a special permit to expand their
building andlbusiness at 1650 Hanshaw Rd .
QUESTIONS AND/OR COMMENTS
Mr Otis Page , Chairman of the Board ; President of the Company Mr Hank Watson ; and
Mr Pankowski , Director of Manufacturing were present .
Mr Page stated that their company is fairly young and was formed in March 1978 , and
funded as a corporation in Nov of 1979 . They commenced to manufacture computers the
first quarter of this year in Nov of 1979 . At one point there was a decision to be
made as to whether to move the company to California , New Hampshire or stay in this
area . It was made very clear to him that the people wanted to stay here because they
liked this area . They presently have 65 employees in the company , and the space is
very conjested at this time . The present proposal on the building is to expand the
present building for manufacturing . The new building would provide space for
professional administrators and development and engineering staff . At present shifts
are staggered to minimize traffic .
Supv Cotterill stated that Z . O . Stewart had received a letter from the Health Dept .
John Anderson , that the present septic system is designed with a 1500 gal tank which
with no further approval or enlargement would be 'needed .
Debra Levin from 1608 Hanshaw Rd wanted to know if they owned the building?
Mr Page said that they did own the building and 7 acres of land around it . When they
acquired the property it had been vacant for some time .
Debra Levin wanted to know if they were planning on building a new building?
Supv Cotterill said that the application was for a proposed addition on the back of the
present building 100 ' x 50 ' immediately behind it and another building 150 ' x 60 ' to the
east of the driveway .
Mrs Lambert from 1676 Hanshaw Rd said that if they tire planning to go from 65 employees
to 100 employees that the increase in the amount of building is not in proportion to
the increase in amount of employees . This sounds like you are planning another sort of
operation .
Mr Pankowski said that what has happened is they have had to move their entire development
staff to downtown Ithaca . They have taken a short term lease on that building . The
current building would be for manufacturing': and the new building would be strictly
administrative and engineering development staff .
Mrs Lambert wanted to know how long the staff would stay at 100 employees ?
Mr Pankowski said that this is as far as they could see because it would be hard to
foresee into 1981 .
Mrs Catherine Brown from 515 Lower Creek Rd was interested in the zoning regulations ,
because they are in a RC zone . She does not see any permit possible for manufacturing
under RC allowed uses by a special permit . As long as this company is a laboratory ,
installation for research or development they may have a special permit . Only in a
RD zone is light manufacturing and assembl Q„" t

Z . O . Stewart stated that the town granted them the permit when they started and they
were just requesting and expansion . -
Mrs Brown wanted to know if they had just a permit for research and development and not
for manufacturing?
Supv Cotterill was not sure , there was a permit issued to Cayuga Industries which was a
warehouse .
Mr Pankowski said that when they purchased the property they did not change the character
of the building at all .
Supv Cotterill said that on the original permit it was issued for wholesale and retail
computers and service of electronic parts . At the time the permit was issued there was
discussion of about 15 employees which has grown since then . There were not any
restrictions in the permit granted in June of 1978 .
Mr Zimmer from 1620 Hanshaw Rd said that based on this information there is some
question as to wiaetheM the industry there now is within the confines df the restrictions
of that permit .

Mr Page said maybe the question would be was how do you define light assembly ?
As a main factor of the operation you would characterise it as light assembly and would
like to have people come in and visit to see what they do .
Supv CotterillTasked the people that live in the neighborhood if there was anything there
that has been bad for the area as far as what has happened in the past 2 years ?
It is much larger than when they started , but felt it was typical If they do well they
grow in size .
Mrs Brown said that wasn ' t the point , that this is a residential zone where other
development should be compatible with farm use , and where rural residential development
on large lots may be necessary to keep densities low in areas and actual light assembly
as I am trying to point out is allowed by permit only , not in the RC zone but the RD zone
Supv Cotterill said that is why he asked the question , has there been anything going
on there as being bad for the community or i-ricompatible and would like to hear any
comments .
Mrs Brown said they have Treyz Warehouse , a printer shop on the corner of Rt 13 and
Hanshaw Rd , Empire Advertising , - Ludgates roadside stand and now Ithaca Intersystems .
The question is how long does this continue , and if each one is to get permission to
expand how long would the neighborhood remain residential ?
Mr Pankowski said that this is the only parcel in the area that could expand like
this because across the road is all Cornell owned , and there is no free land outside
of their lot which is 7 acres . Behind them is the utility r-o- w and when they moved
in the place was a shambles and they have fixed it up , regraded and plan to make it
very presentable . He has received other feed back from other neighbors who are very
appreciative that they have fixed the place up .
Debra Levin said she would still like to register the comment that they are not within
the zoning ordinance .
Supv Cotterill said that the town has to get an interpretation from our attorney as to
what would be allowed . in our zoning . If it isn ' t , then the only other alternative would
be for them to go to the ZBOA , which they would have to make a decision as to whether
they feel something isn ' t an allowable use in the zoning ordinance .
Supv Cotterill said that regardless if this operation isn ' t a legal use , that is why
he asked the question if there has been anything going on in the last 2 years ?
He felt that 2 years experience tells him an awful lot about a business , are they
good for the community , are they doing a nice job in taking care of their property ,
are they an asset to us or are they a discredit ' to us ? He felt that he would
like to see some small business come into our town to help build the tax base up
and not take away from our town .
Mrs Lambert said that the Dog House Discotheque was there before the zoning took place .
When the warehouse took over as a commercial use the residents said fine with that
because it was a lesser of 2 evils . Now Ithaca Intersystems Inc is manufacturing , the
best you could have , on the other hand we would have preferred not to have them there .
Now they want to enlarge the present building which is unfortunate from our standpoint
as being a residential area . In a sense we didn ' t give them permission to build , but
we are happy that it is a nice company that is going to take the building over .
Min Creasy from 540 Lower Creek Rd wanted to know if the expansion was granted now and they
decide to go into other hardware or software or some other form of computers do they
have the frontage and the land to expand more ? Mr Pankowski said that they did .
Mrs Creasy - said if they were granted the special permit and the next time they wanted
to expand is it an automatic permission or do they have to come before ; the board ?
Supv Cotterill said that there would have to be another public hearing and they
would have to stand on their own merits .
Mr Page said that to a certain extent he understands their concern .
The people from the company love where they work ana zney love living in this area ,
We do plan to be good neighbors and have a tasteful desire and plan not to be
offensive at all - in the neighborhood . If the town does approve this permit they
plan to continue to be a good neighbor and hope to have an open house so that
residents can see who they are and what they do .
Mrs Brown was wondering about the septic system , if they had a sand filter ?
Supv Cotterill read the letter from the Health Dept . stating that their record showed
that a 1500 gal per day sewage system (sand filter) was installed on the property in
1969 to serve commerical use of the building . A site inspection on Sept 19th did not
reveal any problems . The additions that are planned would result in about 75 employees
at the site and no water is used in any process , all liquid wastes are the result of
toilet and sink use . Assuming the design flow of 20 gal per worker per day the building
would need a sewage system designed for 1500 gal per day . Since that is what is there
no further approvals from this office is needed , but do advise to have the septic system
pumped if they haven ' t done so recently .
Mr Page said that there would be another septic system installed for the new building .

Mr Zimmer wanted to know if there would be any increase in truck traffic ?
Mr Pankowski said that at the end of each working day they have a UPS or Federal
Express truck there to pick up the parcels which are about 42 lbs in weight and they
are about the size of a stereo unit . About twice a week thf would have a larger
truck come in to pick up the parcels that are to large for the UPS to handle , but most
of the shipping is done by UPS .
Mrs Brown said that they are located in the airport hazzard zone and they have certain
rules and regulations .
Mr Pankowski said that he has spoken with the Federal Aviations Administration . They
have a formula that requires for every 50 feet from the end of the runway you can only
have no more than 1 foot rise in height . Also they are more restrictive on public
places and private homes than they are on a commercial place .
Atty Perkins said that if the Town Board does grant the permit they may set any limitations
on the permit . There were no restrictions on the original permit .
Mr Zimmer wanted it made clear that in Mr Page ' s opening comments he indicated that
manufacturing had only begun in Nov of ' 79 so we are talking of a matter of only 6 months
and not 2 years .
Mr Pankowski said that was just the current products that they were manufacturing .
Mr Page said he hoped he hadn ' t mislead anyone on that point . The major product line
for which the company has been currently funded on has been in production since Nov ' 79
which is responsible for the companies growth . The computers that they are now
assemblyzn _ is about the size of a stereo receiver set and felt that it was going
to be a big success .

TOWN BOARD MEETING.

Minutes of the Town Board meeting held on the 14th of October .
Supv Cotterill called the meeting to order at 8 : 15 PM
Members and guests participated in the Pledge of Allegiance .
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Tarr , Clm Webb , Clm Jordan
Clm Metzger , Atty Perkins and Z . O . Stewart .
Approval of the minutes : Motion was made by Clm Metzger .and 2nd . by ` Clm Jordan that the
minutes of the Public Hearing and Town Board meeting held on Sept 16th be approvedzass.

COUNTY BRIEFING - absent
Supv Cotterill reported the flag that was presented to the Town of Dryden by Congressman
Gary Lee has been displayed in a new flag case in the board room .
CITIZEN PRIVILEGE OF THE FLOOR
Mr Les Cleland presented the Town Board the Town of Dryden Recreation 1981 budget .
Mr Cleland reviewed the budget and annual report . There are 7 members who work with
several recreation programs . There are 9 programs ; 6 of which they have direct responsibility
for and 3 they have supportive responsibility for . The 6 programs consist of youth
football , boys and girls youth basketball , girls softball , summer recreation , adult swim ,
and pre- school program called the Busy Bus . The 3 supportive are _Kiwanis' baseball ,
Sertoma soccer and the junior bowling program at Viking Lanes . The budget is the
same amount as last year at a total of $ 10959 . 00 .
Mr Cleland stated that with the 7 volunteers there are also 90 adult volunteers in the
community . Without their help and assistance this program would not be possible for
the 700 children . They operate on a complete volunteer basis with exception to the
summer recreation program .
Supv Cotterill wanted to. thank Mr Cleland. , the committee and all the volunteers who help
in this program , because he had just received a letter from the City of Ithaca asking for
help with the youth program there . They spend around $ 600 , 000 . 00 to $ 800 , 000 . 00 per
year and the Town ;. of Dryden spends about $10 , 000 per year . He felt that the town owes
Mr Cleland and his committee a gratitude of thanks .
Mr4Herbert Snow from 949 Dryden Rd was concerned about his water bill with Bolton Point .
His water bill with the City of Ithaca for the first total year was $ 365 . 00 and included
sewer . His first bill for the total year with Bolton Point water was $ 526 . 70 . He brought
this up to the Bolton Point Water Commission in March of 1978 . They agreed at that time
to look into it and give him a descision . He did not hear from them until June 1980 .
He went back to them and gave them the same set of facts and figures . In March 1978 they

told him that due to over runs and estimates etc . were all master meters . Mr Snow said
he has a master meter for 6 units and was approved on the city water . He was billed
from the city on a master meter and billed for the water used . Now he is billed for a
1 " meter - 6 units from Bolton Point , at the rate of $111 per ,quarter regardless of
the amount of water used unless he goes over the minimum . Bolton Point will not adjust
his bill in any way .
Supv Cotterill asked if he was talking about a single unit dwelling or an apartment ?
Mr Snow said that he has a 6 unit apartment and they have been billing him on a 1 "
master meter which is in his place . His next door neighbor has a 3/4 " meter and an
apartment in his own building and he is being billed a 1 meter charge on a 3/4 " meter .
Mr Snow did not think that this was fair .
Supv Cotterill said that the Town of Dryden does have 2 representatives on the Bolton
Point Water Commission . The commission is going to set a standard and is going to
be used by Bolton Point to whatever they accept . We can hear your comments but
this town does not have any jurisdiction . He felt they have analyzed 'his complaints
and made a decision .
Mr Snow said that he had received a letter from Noel Desch which he read that the
water commission has continued to research the multiple dwelling water billing
policy . Overall system usage has not increased sufficiently to enable us to adjust
the rate schedule in favor of a master meter siutation . It is not likely that we
will be able to significantly change the billing approach for at least the next
2 or 3 years . I know this is not the answer you are looking for and I am willing to
discuss that matter with you further .
Mr Snow read from the rules and regulations . It shall be understood that any premises
with additional meters for submetering will receive only 1 billing per quarter per-water
service line based on the readings from SCLIWC only . Mr Snow said that they are not
reading his meter . This is his complaint and feels the board should be interested in it .
Supv Cotterill felt that they have a set policy of a minimum per unit in a multiple
dwelling .
Mr Snow wanted to know why his next door neighbor who has a rental unit in his house is
paying a l meter charge on a 3/ 4 " meter ; and he has a 1 " meter and paying a 6 unit charge
which is a different charge ?
Supv Cotterill said that he couldn ' t debate this with him . He understands what
Mr Desch is saying that they have a budget to meet and felt that the debt limit in
2 years might change beneficial in their district which will allow them to change
procedures someday and still meet their expenses , but any change now would change
the rate because of the debt limit .
Mrs Caldwell wanted to know if Bolton Point would have any way of knowing if a
single family house is converted to a multiple dwelling because in the census they
found a lot more dwelling units than permits were issued for ? CIm Tarr said that he
did not know .
Mrs Snow read the notes that she had taken at the last Bolton Point Water meeting .
After the minutes of the previous meeting were read and approved Mr & Mrs Snow were
given the floor . Mrs McElwee asked Mr Snow to explain why he wished to talk to the
members . He presented his case . Mrs McElwee inquired as to the number of apartments
owned by Mr Snow , which is 5 rentals and 1 owner . Mr Desch explained why he felt we
were concerned/ . He explained that the practice of the Bolton Point Water Commission
is to charge apartment complex owners with master meters a minimum meter charge per
unit regardless of the amount of water used . " Their feeling seems to be that the
debt level was such that it was necessary to charge this . The cost for a single
family owner would be to great if the policy were not followed . He stated that this
condition' -vfill continue at least until the debt level is reduced . Mr Snow questioned•
the commissions thinking to permit owners of a single family house with an apartment
in said house to be charged for single family usage both Mrs McElwee and Mr Desch
admitted that this is the situation and did admit that it may not be fair . They
stated that they do not consider an apartment in a private home the same as an
apartment complex . Mr Desch stated that there has. been discussion as to what can
be done to make the situation more equitable . There is no consideration to delete
any portion of a quarterly charge in case of vacancies in any unit . Mrs Snow said
that this is one of the things that hurts . Mrs McElwee suggested that the water
charge be passed on to the tennant but did not present any equitable method to
determine the charge . We were excused at 7 : 55 with the statement that the budget
coiwuittee would meet and that the Bolton Point Water Commission would be giving us
a written statement by September 1980 . Mrs - Snow said that Bolton Point does know
about the problem .
Supv Cotterill said that Clm Tarr is the representative there and they are aware of
the problem .
Mr Snow said that he has no objection to paying the minimum meter charge and all
water used , however , if he has an empty apartment which he has , he still has to
nay the minimum charge . It has been empty for 11 months and he called Bolton Point
and asked for a reduction which he did not receive '. He feels that this is grossly
unfair and thought that this Town Board can recommend something in being part owner .
Supv Cotterill said that he could recommend this , but the question is what solution could
he recommend that is acceptable to Bolton Point .
Mr Snow said that people with extra apartments in their houses pay for a 2 meter charge
the same as he is doing and there are thousands of those on the Bolton Point water that
will more than make up the difference in his bill . Mr Snow said that there was a public
meeting held in Varna before this water district was changed and we were supposed to
have a representative from the tax paying members of the Varna Water Dist as a member
of the Bolton Point Commission .
Supv Cotterill said that Mr Harold Case is the representative .
Mr Snow said that they do not have a representative now . Supv Cotterill said that he has
filled in for Mr Case , and since he could no longer do it Clm Tarr is the representative
when Mr Case cannot make the meetings .
Mr Snow said the reason he is pointing this out is that they have no one to go to in Varna .
Supv Cotterill said that we are open for suggestions from the district and he would be
willing to meet with them . Right now Clm Metzger and Clm Tarr are our representatives .
until Mr Case can attend the meetings .
Mr Snow said that it limits the number of people eligible according to the public meeting .
As the meeting states they must be tax paying members of the water district .
He gathered from Mr Desch ' s letter that property owners with additional apartments are
being dicriminated against until this debt limit is reduced and this is what he feels
is unfair .

Mr Frank Liguori from the County Planning Board showed slides on a proposed corridor
for Route 13 .
CORRESPONDENCE . .
Supv Cotterill read a letter from NYSDOT with regard to the intersection of Rt 13 and
Rt 38 stating that they had received the resolution from the Town of Dryden but before
they began their study it is requested that the Town of Dryden supply more detailed
information . regarding . our - concern so that they can fully incorporate them in their
planning . Supv Cotterill - didn ' t know what they wanted us to do , whether they wanted us
to bring them -here between 7AM and 9AM so they can see for • Ehemselves the conjestion
or whether -they want us to design a state highway intersection .
Mr Liguori said that he had a meeting in Syracuse and would talk with Mr Powers and
Mr Novak .

RESOLUTION #128 APPOINT SUB-ELECTION INSPECTORS
CZm. Metzger offered the following resolution and . asked for its adoption .
RESOLVED , that this Town Board appoint Thomas Lane , Viola Lane , Roy Huntley as Democrate
election inspectors and Ruth Sweetland as Repubilican election inspector .

RESOLUTION # 129 RECORDS. "RETENTION AND DISPOSTION SCHEDULE

Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , by the Town Board of the Town of Dryden that Records Retention and Disposition
Schedule # 19- TC- 1 issued pursuant to Part 185 , Title 8 of the Official Compilation of
Codes , Rules and Regulations of the State of New York and containing minimum legal retentions
periods for town records , is hereby adopted for use by the Town Clerk of this town ;
FURTHERRESOLVED , that this Board hereby authorizes the disposition of records in accordance
with the minimum legal , retention periods set forth in Records Retention and Disposition
Schedule # 19- TC- 1 ;
AND FURTHER RESOLVED , that the Town Clerk be , and hereby is , directed to furnish a
certified copy of this Resolution to the Commissioner of Education .

ATTORNEY
Mr Barry Cooper from Peaceful Drive wanted to know if the Town Board was going to make
any decision on Peaceful Drive ?
Supv Cotterill said that he has received several letters from residents expressing their
opposition to abandoning part of Peaceful Dr . The Town Board decided that it was not
the proper time to abandon a road until there was another part of the road to take its
place . They will not make any decision or discuss the matter until that time .
Mrs Barbara Caldwell , said that the Planning Board felt that there would be an update
on the whole project and have all people represented . It will be discussed at their
November meeting . Mrs Caldwell wanted the decision tabled until that time .
Supv Cotterill said that he was not interested in tableing the decision , but interested

in making a resolution to reject any action at this time . When the Planning Board
does approve further development and the road is dedicated to the town that is time
enough for the town . board to take action . . . : • ,
The Town Board took no -action with regard to Peaceful Drive abandonment .
ZONING OFFICER
23 permits for the month of September . 6 - one family ; 3 additions ; 7 mobile homes
2 of which __were replacements and 2 were replacing old houses ; 1 garage ; and 6 storage
buildings .
ZBOA held 3 hearings . 1 - Walter Pintner on Nottingham Drive wanted to build a house
on 12 acres with only 100 ' 'road frontage . This' was granted . 2- Finger Lakes Stone
applied for a certificate of compliance for a house . They only had 75 ' road frontage .
Mr Dolph wanted to sell the house that was started , since the property was divided it
didn ' t have the road frontage required . This was granted with the stipulation that
there would be no services from the town . 3- Edward Olmstead wanted a storage building
on Spring House Rd with less than the 25 ' setback . This was granted .
Z . O . Stewart wanted to . know if there is a limit with regard to Ludgate Produce Farm ?
Supv Cotterill said that agriculture produce is an allowed use but there is no limit
to size .
Atty Perkins said that he would like to review the building permit application from
Ithaca Intersystems Inc before any decision is made .
There was some discussion and the board decided to table decision until next meeting .
Supv Cotterill said that he received a letter from the City of Ithaca Youth. Bureau
requesting the Town of Dryden to attend their meeting and help with their budget .
RESOLUTION # 130 1980 PROJECT BUDGET AMENDMENT FOR THE
TOWN OF DRYDEN RECREATION
Clm Metzger offered the following resolution and asked for its adoption .
RESOLVED that his Town Board approve the 1980 project budget amendment for the
Town of Dryden Recreation as presented .
