HomeMy WebLinkAbout1980-07-08 TQWN BQMRD MEETXNG July 8 , 1980 Minutes of the Town Board meeting held on the 8th of July Deputy Supv Metzger called the meeting to order at 7 : 30 PM Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : Present : Deputy Supv Metzger , Clm Tarr , Clm Webb Clm Jordan , Atty Perkins , and Z . O . Stewart Absent : Supv Cotterill Approval of the minutes : Motionzwas made by Clm Tarr and 2nd by Clm Jordan that the minutes of the Public Hearing and Town Board meeting held on June 10th be approved as submitted . COUNTY BRIEFTING Co Rep Tillapaugh reported that they are in the process of organizing a committee to do an evaluation study of the County Youth Bureau . . Clm Webb wondered why the assessment couldn ' t be done over a 4 year period instead of the 2 year period . There was some concern on his part since they had passed a law last year . The idea was , that they were going to freeze the assessment , but the law read they were only going to freeze land only , so what the assessment dept . did was to add the assessment on the buildings , which is a very simple thing to do . It has ruined the whole effect of the law and they are legally within their rights . CITIZEN PRIVILEGE OF THE FLOOR Mr Nelson Davall presented the Town Board with a petition from about 50 residents who live around Dryden Lake that since due to the increase in noise and disturbance during the evening hours and continuing until early in the morning around and near Dryden Lake especially on the west side of the lake , request that the lake and surrounding state- owned areas be officially closed to the public at a reasonable hour each evening - and remain closed until a reasonable hour in the morning . Mr Davall said that he has also ' sent a copy of the petition to the Conservation Dept . and they have promised to do something about it . Atty Perkins said that the town is powerless to act because it is out of our jurisdiction . It is under the jurisdiction of the law enforcement agencies . . Mr Davall said that they have contacted the Sheriff ' s Dept and the State Police Dept . but they have not done anything about it . Atty Perkins thought that the Town Board could ask the Dept of Environmental Conservation to monitor the situation and send a copy td the local law enforcement agencies . RESOLUTION # 105 DRYDEN LAKE PETITION RE : PARTIES LATE AT NIGHT Clm Tarr offered the following resolution and asked for its adoption : RESOLVED , that this Town Board accept the petition and request the NYS Dept of Environmental Conservation to increase patrol , monitor the activities at Dryden Lake and keep it under control . 2nd Clm Webb Carried Petition from residents on Spring House Rd to reduce speed limit on Spring House Rd because of narrowness of the road and one lane bridge . RESOLUTION # 106 REDUCE SPEED LIMIT ON SPRING HOUSE ROAD FROM 55 MPH TO 30 MPH . Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that the Town Board accept the petition from the residents on Spring House Rd and request the NYSDOT to investigate and recommend that the speed limit on Spring House Rd between Route 13 and Route 38 be reduced from 55 MPH to 30 MPH . 2nd Clm Webb Roll call vote - all voting YES . . COUNCILMAN PRIVILEGE OF THE FLOOR Clm Webb wanted to know if the county has done anything to the property that was formerly owned by Frank Robinson . Co Rep Tillapaugh said nothing has been done yet . '. - ATTORNEY Reported on Ceracche TV and the request for cable service from the residents on Ringwood Rd , Midline Rd and Hunt Hill Rd . Atty Perkins said that he had written to the general manager sending a copy of the petition and invited him to attend the meeting tonight to dicuss a time table for this line extension . The reply Atty Perkins received was that they would begin the ini .tial _-engineering process to determine the feasibility for line extension but would prefer to postphone meeting with us until such a time that the recently formed Cable Commission Committe can meet and discuss line extension policies and requirements . Atty Perkins , Clm Tarr and Clm Jordan set a date for the Cable Commission Committee to meet with Ceracche TV on Aug . 6th . 410 / Atty Perkins said that he has done some preliminary work regarding large gatherings : There are some local laws adopted by other towns around the state . Atty Perkins said that he could present the town with a draft of something that has been successful in other parts of the state . The Town Board felt that Atty Perkins should go ahead and come up with some type of ordinance for large gatherings in the town . TOWN CLERK . • RESOLUTION # 107 APPOINT . DEMOCRATE ELECTION ' INSPECTOR Clm Webb offered the following resolution and asked for its adoption . RESOLVED , that this Town Board appoint Eleanor Alexander as Democrate Election Inspector 2nd Clm Tarr Carried ZONING OFFICER 10 permits for the month of June : 3 houses , 1 garage , 4 additions and 2 storage buildings . ZBOA held 2 hearings . 1 - for Lloyd Cotterill to build a house with only 60 feet of road frontage and 29 acres . This was granted . 2- for Robert Alcorn for a meat processing plant on Cortland Rd . The board held a decision on this hearing pending more information . Mrs Barbara Caldwell reported that she and Z . O . Stewart checked over the census in the remainder of the town , other than the villages . They cross checked the printout to make sure they were in the right enumeration district . They took the base number from - 1970. and added in all the building permits for dwellings , apartment units , and new mobile homes . The census bureaus preliminary figure showed a greater number of units presumably based on places that have been converted to apartments . They checked the enumeration by each district and checked the number of dwellings and the vacancy rate which seemed normal . They checked the head count which would be the number of people per unit . The only discrepancy they found was at the mobile park in Varna , where they had figured 196 people where the ratio was 1 . 96 per unit which they felt was low compared with the other areas . Z . O . Stewart checked with the owner and their count as of April 1st was 47 people higher . Mrs Caldwell felt that that number is worth reporting and she has the form to report this information . There was a deadline of 10 working days to check this over and would have to be filed by July 15th : CORRESPONDENCE Letter from the State Assembly regarding Justice fees Open letter from Supv Cotterill to all the fire companies regarding ambulance service and responding to fire calls . RESOLUTION # 108 SUMMER RECREATION ' PAYROLL Clm Jordan offered the following resolution and asked for its adoption . RESOLVED , that the Supv be authorized to process a payroll every 2 weeks for the Dryden Summer Recreation Commission . Vouchers willbe audited at the Town Board meeting following the end of the program . 2nd Clm Tarr Roll call vote - all voting YES RESOLUTION # 109 ACCEPT PROPOSAL FROM STEEL • STRUC.TURE FOR OLD PORTION OF ' HIGHWAY BUILDING Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that this Town Board accept a proposal from Steel Structures , Don Keith for pouring concrete on an old portion (100 feet ) of the highway building retaining wall for a price not to exceed $ 41, 000 . This work is to be completed approximately November 1 , 1980 . 2nd Clm Webb Roll call vote - all voting YES RESOLUTION # 110 AUDIT HIGHWAY BILLS Clm Jordan offered the following resolution and asked for its adoption . RESOLVED , that the highway bills be paid as audited . 2nd Clm Metzger Roll call vote - all voting YES RESOLUTION # 111 AUDIT GENERAL FUND BILLS Clm Tarr offered the following resolution and asked for its adoption .
