O . Stewart Supv Cotterill read the notice that was published in the newspaper stating the purpose of said hearing was to consider the application of Bernard Cornelius of Freeville for a special permit to conduct his business of casting and sales of concrete products and used equipment sales . The parking and a dispatch location for dump trucks and pumping trucks owned by the Corneliuses used in their septic tank service at 2215 Dryden Rd . QUESTIONS AND/OR COMMENTS y.. Mr Bernard Cornelius said the reason he was applying for the permit was that he wanted to scale down his business . • Supv Cotterill . wanted to know if he had purchased the property . Mr Cornelius said that he was in the process of purchasing the property . The road frontage is 350 feet . Clm Metzger wanted to know if he had Health Dept approval . Mr Cornelius said that there is an approved septic system in there now and the well is about 250 feet deep . He had planned to build a steel building behind the existing building . Supv Cotterill wanted to know what he planned to do with the building that is there now . Mr Cornelius said that he was going to use one room as an office and he plans to rent out the upstairs to a student . There is 1 bedroom , bathroom and kitchen upstairs . Supv Cotterill wanted to know if there is a septic system now where the sketch shows ? Mr Cornelius said yes and that it is a pump system . There used to be a trailer on the property and the system was designed to accomodate the trailer . When the house was built all the sewage there goes into a tank and is pumped up to the septic system . Supv Cotterill wanted to know if he was proposing a 120 ' x 60 ' building behind the present building . Mr Cornelius said that he was . Clm Metzger wanted to know if it would be an 8 : 00AM to 5 : 00 PM operation . Mr Cornelius said generally yes that it would be but , periodically there are trucks that will leave at 5 : 30AM or 6 : 00AM and they would return by 6 : 00 or 7 : 00 PM . Supv Cotterill wanted to know if all adjoining property own ers had been notified . Z . O . Stewart said that all the names are on the list that he had sent notices to which are adjoining property owners . Supv Cotterill wanted to know what it is zoned as . Z . O . Stewart said that it is zoned commercial with a special permit . R- D Zone which is high density Agricultural - Residential - Commercial . Closed public hearing; 7 : 40PM RESOLUTION ## 78 GRANT SPECIAL PERMIT TO BERNARD CORNELIUS TO OPERATE A BUSINESS OF CASTING & SALE OF CONCRETE PRODUCTS & USED EQUIPMENT SALES AT 2215 Dryden Rd . Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board grant a special permit to Bernard Cornelius to operate his business of casting & sale - of concrete products and used equipment sales . Also , the parking and dispatch location for dump trucks and pumping trucks owned by the Corneliuses used in their septic tank service at 2215 Dryden Rd . The operation being limited to the manufacturing operation of the concrete products to 8 : 00AM to 5 : 00Pm Monday thru Saturday . 2nd Clm Jordan Roll call vote - all voting YES STOWN BOARD MEETING May 13 , 1980 Minutes of the Town Board meeting held on the 13th day of May - - Supv Cotterill called the meeting to order at 7 : 45 PM __ Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Tarr , Clm Webb , Clm Metzger Clm Jordan , Atty Perkins and Z . O . Stewart Approval of the minutes : Motion was made by Clm Tarr and 2nd by Clm Metzger that the minutes of the April 8th meeting be approved as submitted . COUNTY BRIEFING - absent CITIZEN PRIVILEGE OF THE FLOOR Mr Gary Chabot , from Kimberly Circle was present and wanted to know when Kimberly Circle was going to be paved ? Hwy Supt Humphrey said that he planned on paving it sometime in June , weather permitting . Mr Robert Carpenter wanted to know about the intersection of Irish Settlement Rd and Ferguson Rd . The county has been there surveying and putting stakes in his property . Supv Cotterill said that he could understand his concern . The town has been after the county for about 2 years now to alleviate the 2 curves and there has not been anything done , except for a few poles . The County Engineer has designed this plan and that is why they are out in your field , which the town had not even visulaized they would need to do . At the present time there has not been any decision made . Supv Cotterill felt that it 'will not involve his property , but if it does he will let Mr Carpenter know as soon as he finds out . Mr John Shultz from West Dryden Rd wanted to know if the town was going to put in a new bridge on Caswell Rd . , Right now , it is being used as a drag strip for motorcycles during the day , night and on weekends . Hwy Supt Humphrey said that several years ago when they cut the brush there was state aid available which , had run out when the town wanted to get the aid . At that time , they thought of taking the bridge out and putting in a pipe which would cost about $11 , 000 . 00 . Both Supv McCord and Hwy Supt Humphrey felt that there was not enough traffic to justify an $11 , 000 . 00 bridge . Mr Shultz felt that if the bridge was not going to be fixed could the town close the road at West Dryden Rd , because it is just a garbage dump down there now . Supv Cotterill was wondering if it would be feasible to close it oof at the West Dryden end . Hwy Supt Humphrey said that he has dumped a load of gravel on each side of the bridge and there already/as road closed sign posted there . Supv Cotterill asked Hwy Supt Humphrey to get some figures for a bridge and upgrading the road so that it will be - passable . Mr Robert Russell Jr said that he has purchased the property from his father on Short Rd . He has been out of state for 21 years and now wants to make a residence here . He has improved the property and what he wanted to know is if he could get some type of minimum maintenance on the road from the town for fire trucks . Supv Cotterill said that several years back Z . O . Stewart granted a permit , and after some discussion realized - that it was not a town road and not on the town map . Legally the permit should not have been issued : - . There was a hearing by the ZBOA and they granted a variance so that the trailer could stay there . Supv Cotterill wanted to know if there had been any furhter developments or permits issued . Z . O . Stewart said that Mr Russell Sr had applied for a • variance for the property that he is on , which is all the same piece of property but divided . Supv Cotterill wanted to know when the second variance was applied for . Z . O . Stewart said in August of 1978 . Supv Cotterill said this would be would be since the time the town granted the first variance . Z . O . Stewart said yes . Supv Cotterill -" I said that this is where we are getting into trouble because we are having boards granting variances that are not on public roads -and he did not know this . Apparently they granted a second variance to allow another trailer in 1978 with the agreement that the residents understood and agreed that the Town of Dryden has no obligation to maintain or plow Short Rd or any portion thereof , since it not being an official town : road . - Mr Russell Jr said that the permit was issued to him just last , week . . Supv Cotterill wondered if it was based on the variance back in 1978 , which was applied . for then . Atty Perkins was wondering if there would be a statute of limitations , like a year . • Z . O . Stewart said that there is a 1 year limit °.ion a building permit but not a variance . There was some discussion . Atty Perkins said that the variance would be granted so that a permit could be issued , which permits are good for 1 year . Since there was some question about the length of time Atty Perkins wanted to know if the variance was issued for this permit : which was just issued . Z . O . Stewart said that it was . The • variance was applied for by Mr Russell Sr for his son- in- law for a trailer .. Supv Cotterill asked at the time the first permit was issued the ZOBA granted a variance to allow the trailer to stay there . He wanted to know if there had been any •• other permits issued since that time ? „ Z . O . Stewart said that the permit issued today was on the variance that was granted in 1978 . There is only 1 trailer there now and with this permit there will be 2 trailers and a house on Short Rd . Mr Russell Jr said that his brother- in- law never developed the land , which the variance was granted for and he has now bought the property and is developing it . This is why he came in and applied for the permit on the variance that was granted in 1978 . Supv Cotterill said that the board needs a ruling on whether or not we can issue a permit on the variance that was granted in 1978 . 3g � Atty Perkins said that he would check into the matter to see whether or not it is legal for the permit to be issued . Supv Cotterill said that if it is legal then it is out of the boards hands , but if it is illegal than the board has an obligation to enforce the zoning ordinance and not allow further construction . Z . O . Stewart said that he was told at one time that once a variance was issued it was good indefinetly . Supv Cotterill said personally he did not want to be in a position of issuing anything outside of the zoning ordinance until the road was brought up to town specifications and in the town ' s control . r Atty Perkins said that the issuance of the permit and variance wouldn ' t have anything to do with the road . Supv Cotterill said no , but it had been . ruled , at some point that it was not a public road . Any time the property owners on that road bring it up to the town specifications it will then become a town road . Supv Cotterill said that the town A cannot maintain the road at all until it is made a public road . We cannot put any town equipment on any road that is not a town road . This was ruled not a town road many years ago . Mr Russell Jr said that it was /town road many years ago . Supv Cotterill said that we have been through that and to his knowledge it has not been on any town or county map in the 60 ' s or 70 ' s , and we have not received any state aid for highway use in the last 20 years . It was ruled by our Atty that back in the 70 ' s when the first permit was issued it was not a public road and that is why the statement was signed by the property owne owners , and the first resident had to get a variance to stay there . Mr Russell Jr said that he purchased the property while he was out of the county and did not realize that it was not on a town road . Atty Perkins said that his predecessor put in for a variance so he is automatically put on notice just as if you are on a town , county or state road . There is no affirmative duty on behalf of the town to notify you . You have to be on notice of any official town map or terms of the variance . Mr John Hunt from Snyder Hill Court said he had received the engineers report and there was not any mention about a sewer report . He would like the board to be aware that since the _ last Town Board meeting the residents from the Snyder Hill area held a meeting on their own to discuss any problems that the people there had with • water . 13 households were present out of 60 . They have surveyed all the residents to see whether anyone had any problems and see what could be done in terms of local expertise . The informal survey was put out 2 weeks ago and today there has not been any response . Mr Hunt said that he would like to make the point again that if there is a water district there should also be a sewer district in that area . Supv Cotterill said that there was a . report received back from the engineers which gave several ideas . He asked Mr Underwood to talk to the people from the Town of Ithaca line and let them know the status . In return for them to come to the Town Board and give • their input . As of this date there has been no response . If the 10 or 15 houses involved do not come and request a water district - the Town of Dryden is going to drop the matter . If they do want to consider a water district then the town will notify the people involved and hold a public hearing . Mr Hunt and Mrs Williamson who live in the area and would be involved are not in favor of a water district . COUNCILMAN PRIVILEGE OF THE FLOOR RESOLUTION # 79 APPOINT PLANNING BOARD MEMBER- John Hunt Clm Tarr offered the following resolution and asked for its adoption : RESOLVED , that this Town Board appoint John Hunt , 16 Snyder Hill Court , Ithaca to the Planning Board who ' s term expires in 1986 (December) 2nd Clm Metzger Carried Clm Tarr reported that he had spoken with Mr Suhanovsky from Ceracche TV and he indicated that the extension on Virgil Road would be about October of this year at the earliest . ATTORNEY Atty Perkins said that Mr Suhanovsky. called him to see ; if the town had any standing or Ad Hoc Committee to work on the county cable commission model franchise . Atty Perkins told him he was not aware of any and would present it to the Town Board for consideration . Clm Tarr said that there is a county cable commission franchise adopted , but it is not binding by any one town . The county cable commission is only an advisory board , but this model franchise has to be tailored to each town for their problems or needs . Clm .Tarr would like a committee and discuss this with Ceracche so the town can get one standard contract with the town . Clm Tarr said that the town has adopted aline extension franchise with Sammons and Mr Suhanovsky said that it would become invalid when Ceracche took over Sammons . Atty Perkins said that they have to honor Sammons Franchise policy . Clm Tarr said that the County Cable Commission was going to meet within the next couple of weeks to see what can be done as a county on line extension . . . . . 30 . Supv Cotterill appointed Clm Tarr , Clm Jordan and Atty Perkins to go over the model franchise and meet with Ceracche to :come up with some agreement . Atty Perkins reported on the proposed games of chance . It must be a majority vote of ' the members of the Town Board ; it must be submitted to a general or special election in the town ; it must be approved by a majority of qualified voters who vote . The time restrictions involved are the following : If the local law is introduced by a member of the Town Board at tonights meeting , it cannot be passed until it has been on the desks of the board members for at least 7 days . The public heating must be conducted before the Town Board and must have at least 5 days legal notice in the newspaper . Within 10 days :of when the Town Supv is presented with the law he must set a public heating and that date cannot be more than 20 days from the date he receives the proposed local law . The notice in the paper would have to be no later than May 23rd and the last date for the public hearing would be June 2nd . The proposed local law if adopted by the Town Board and filed with the Sec of State after the general or special election P` will be operative within a village if after adoption the Board of Trustees adopt a local law or resolution subject to a permissive referendum authorizing the issuance of licenses by the Town Clerk for games within the village . Clm Jordan introduced the following proposed local law to the Town Board . LOCAL LAW PROVIDING FOR THE CONDUCT OF GAMES OF CHANCE IN THE TOWN OF DRYDEN PROPOSED LOCAL LAW # 80- 1 BE IT ENACTED by the Town Board of the Town of Dryden as follows : §1 TITLE . This local law shall be know as the Town of Dryden Games of Chance Law . § 2 DEFINITIONS . (a ) "Authorized Organization " shall mean and include any bona : -fide religious or charitable organization or bona fide educational , fraternal or service organization or bona fide organization of veterans or volunteer firemen , which by its charter , certificate of incorporation , constitution , or act of the legislature , shall have among its dominant purposes one or more of the lawful purposes as defined in this article , provided that each shall operate without profit to its members , and provided that each such organization has engaged in serving one or more of the lawful purposes as defined in this article for a period of three years immediately prior to applying for a license under this article . No organization shall be deemed an authorized organization which is formed primarily for the purpose of conducting games of chance and which does not devote at least seventy- five percent of its activities to other than conducting games of chance . No political party shall be deemed an authorized organization . (b) " Games of Chance " shall mean and include only the games know as "merchandise wheels " and such other specific games as may be authorized by the State of New York Racing and Wagering Board , in which prizes are awarded on the basis of a designated winning number or numbers , color or colors , symbol or symbols determined by chance , but not including games commonly know as " bingo or lotto " which are controlled under article 14- H of the General Municipal Law and also not including " slot machines " , " bookmaking , " "policy or numbers games " and " lottery " as defined in section 225 . 00 of the penal law . No game of chance shall involve wagering of money by one player against another player . . § 3 . GAMES OF CHANCE AUTHORIZED . Authorized organizations , may upon obtaining the appropriate license from the Town Clerk conduct Games of Chance within the Town of Dryden as provided in Article 9-A of the General Municipal Law and as further provided in this local law . Such Games of Chance shall be conducted in accordance with all of the laws of the State of New York State Racing and Wagering Board and as further provided in this local law . § 4 . RESTRICTIONS . The conduct of Games of Chance shall be subject to the restrictions imposed by §189 of Article 9-A of the General Municipal Law and of the •rules and regulations of the New York State Racing and Wagering Board . § 5 . SUNDAY GAMES . Games of Chance may be conducted on Sunday pursuant to this local law except for Easter Sunday . No Games of Chance shall be conducted on Christmas Day or New Year ' s Eve . § 6 . ENFORCEMENT . The chief law enforcement officer of Tompkins County shall exercise control over and supervision of all Games of Chance conducted under a duly authorized license . That chief law enforcement officer shall have all those powers and duties as set forth for the enforcement of Article 9-A of the General Municipal Law . § 7 . EFFECTIVE DATE . This local law shall take effect upon its passage by at least the majority affirmative vote of the total voting power of the Town Board of the Town of Dryden and after a proposition therefor is submitted at a General or Special Election in the Town of Dryden and approved by a vote of the majority of qualified electors in the Town of Dryden voting thereon , and upon its filing with the office of Secretaries of State and upon the compliance with all of the provisions of the General Municipal Law and Municipal Home Rule Laws of the State of New York . 39 , Supv Cotterill scheduled the public hearing for May 27th at at 7 : 30 PM TOWN CLERK $ 54 , 618 . 00 left to be paid to the Supervisor . and about $192 , 000 . 00 uncollected . There will be a Tomp Co Municipal Association Meeting on June 18th . ZONING OFFICER 9 building permits for the month of April 2 new homes ; 1 mobile home ; 3 additions ; 2 farm structures and 1 pool . ZBOA granted a variance to Phil Rumsey for an auto sabs to go along with a special permit that was granted in 1978 for a garage & body shop . HIGHWAY SUPERINTENDENT Wanted the Town Boards permission to advertise for bids for a used 1969 truck not to exceed $ 8 , 000 . 00 RESOLUTION # 80 ADVERTISE FOR BIDS FOR 1 USED 1969 TRUCK Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize Hwy Supt Humphrey to advertise for bids for 1 used 1969 truck not to exceed $ 8 , 000 . 00 2nd Clm Metzger Roll call vote - all voting YES Hwy Supt Humphrey reported that Cortland Asphalt has received the county bid for 6i1 prices . If you pay your bill 10 days after date of invoice you receive 1 percent discount . The oil price now is $1 . 20 per gallon with a 34 cent per gallon. increase escalation clause per month up to Sept of 1981 , which is guaranteed in the bid . Last year the price was 74 cents per gallon . Hwy Supt Humphrey asked if he/makedone purchase of 100 , 000 gallons at the price of $1 . 20 per gallon without the escalation clause , but he has not received an answer yet . RESOLUTION # 81 ADVANCE PAYMENT FOR OIL PURCHASE Clm Metzger offered the following resolution and asked for its adoption : RESOLVED , that Supv Cotterill be authorized to pay in advance of the audited claims the oil purchase to take advantage of the discount . 2nd Clm Tarr Roll call vote - all voting YES Supv Cotterill requested Hwy Supt Humphrey to get some information for fixing the wall in back of the Town Hall . CORRESPONDENCE Copy of Local Law re : bikeways from the Town of Ithaca Letter from Sandy Payton thanking the Town for the use of the building to train census workers . NYS Assoc of Magistrates re : increase fees to Towns & Villages . RESOLUTION # 82 RELATING TO INCREASING FEES PAID TO TOWNS AND VILLAGES FOR VARIOUS SERVICES RENDERED IN RELATION TO CRIMINAL ACTIONS AND PROCEEDINGS Clm Metzger offered the following resolution and asked for its adoption : WHEREAS town and village courts hear and determine cases involving violations of state law , and WHEREAS fines and penalties collected by such courts are paid to the state iri recognition of the fact that such violations are state offenses , and WHEREAS in recognition of the services provided by such local courts , the State of New York has provided in section 99 - 1 of the General Municipal Law that towns and villages shall be reimbursed for services rendered in such cases in the amount of $ 5 . 00 per case , and - -- WHEREAS , the amount of $ 5 . 00 was originally set forth in the Code of Criminal Procedure , section 740- a, by Chapter 737 of the Laws of 1939 , and has remained unchanged for the past 41 years , and WHEREAS , the per case costs of the operation of local courts have increased substantially since 1939 while no increase in reimbursement by the state to local governments for court services has been granted , and WHEREAS , the net result is that the burden of the said additional cost of administering this state operation is borne by taxation of local real property rather that by general taxation , NOW THEREFORE BE IT RESOLVED , that this body does hereby strongly urge the Legislature and the Governor to act favorably on pending legislation which would increase the amount returned to towns and villages to $15 . 00 instead of the present . inadequate $ 5 . 00 limit as set by the present provisions of law (Senate 2397 -A ; Assembly 10900 ) , and be it further - RESOLVED , that a copy of this resolution be forthwith forwarded to the Hon . RESOLUTION # 83 AUTHORIZE THE ITHACA - TOMPKINS COUNTY TRANSPORTATION COMMISSION TO SPONSOR AND FILE APPLICATION TO FEDERAL AND STATE FUNDING AGENCIES FOR FUNDING ASSISTANCE FOR RURAL/SUBURBAN TRANSPORTATION DEMONSTRATION PRORAMS AND TO MANAGE SUCH DEMSONTRATION PROGRAMS ON AN AD HOC BASIS Clm Tarr offered the following resolution and asked for its adoption : WHEREAS , the Ithaca - Tompkins County Transportation Commission is preparing a project for increased opportunities for rural / suburban transportation in Tompkins County , and WHEREAS , the Commission has requested permission from the municipalities which created the Commission to authorize the Commission to make application to Federal and State funding agencies to initiate a program for a two or three year Rural /Suburban Transportation Demonstration Program , and WHEREAS , the Commission has agreed to submit the project plan to the municipalities for review and comment prior to acceptance of any grant offers from funding agencies , and that the individual municipalities will be kept involved in the process to insure a unified cooperative approach , therefore be it RESOLVED , that the Dryden Town Board does encourage and authorize the Ithaca - Tompkins County Transportation Commission to file application for funding assisstance for said program and to generally administer , expend funds , and establish policy during the demonstration period , keeping each municipality informed as to progress . 2nd Clm Webb Carried it There was some discussion about dogs barking , and was decided that /already is in the dog ordinance under Sec . 2c . Z . O . Stewart reported that he had spoken with Mr McKee and he was not selling any of his soil , that he was just moving it around and sometimes trading a load of soil for a load of gravel . Present : Supv Cotterill , Clm Webb , Clm Metzger and Clm Jordan . Absent : Atty Perkins and Clm Tarr Supv Cotterill read the notice that was published in the newspaper to consider a proposed Local Law # 1 - 80 entitled Town of Dryden Games of Chance Law providing for the conduct of games of chance by authorized organizations in the Town of Dryden pursuant to Article 9-A of the General Municipal Law and this local law . QUESTIONS AND/OR COMMENTS There was only one resident present at the hearing who was Mr Ed Couch from Etna . He wanted to know if a raffle would be considered under the games of chance . There was some discussion and the Town Board tabled making any decision since the Town Attorney was not present and would consider making a resolution at the June 13th Board meeting .
