PUBLIC HEARING
March 11 , 1980
• Special Permit - Robert Geiger & Son for a woodworking
shop and showroom
Minutes of the public hearing held by the Town Board on the 11th of March commenced 7 : 30 PM
Present : Supv Cotterill , Clm Tarr , Clm Metzger , Clm Webb , Clm Jordan and Atty Perkins
Supv Cotterill read the notice that was published in the newspaper stating the purpose
of said hearing was to consider the application of Robert Geiger & Son of 142 West
Malloryville Rd , Freeville , NY to have a woodworking shop and showroom at 298 Cortland
Rd (corner of Livermore Rd , Simms Hill Rd and Rt 13 ) .
QUESTIONS AND/OR COMMENTS ,
Supv Cotterill read a letter from the Tomps Co Health Dept stating that the Health Dept
did have on file a sewage disposal permit for the exisiting building , parcel # 3 - 36- 1 - 12 . 1
and 12 . 3 . The proposal of a woodworking shop employing Mr Geiger and his son would be
acceptable . Any plans of expansion would result in a sewage flow in excess of 150 gallons
per day and could not be approved because of the limited lot size and dimensions .
Supv Cotterill read a letter from Tomp Co Dept of Planning , Mr Liguori , stating that this
special permit would have no significant deleterious impact on intercommunity , county
or state interests . Therefore , no recommendation is indicated by the Co Planning Dept
and the town is free to act without prejudice .
Supv Cotterill wanted to know if Mr Geiger owned the property or was going to rent it . •
Mr Geiger said that he has a purchase offer pending the outcome of tonights public hearing ,
so he would be the owner and not the renter .
Mr Gary Mullen wanted to know what he would be making there . Mr Geiger said that he
would be making small furniture , woodboxes , clocks , end tables , guitars and any custom
furniture . There will not be any wood refinishing or stripping .
Supv Cotterill wanted to know if he would be having anything outdoors . Mr Geiger said
that everything would be inside . Mr Geiger did want to kno , f-11ei could hang a sign
outside where there is already a post on the property . Supv Cotterill said that we
do have a sign regulation in the zoning ordinance and Z . O . Stewart would have to tell
him the specifications that are allowed .
Clm Metzger wanted to know how many people were going to be working there . Mr Geiger
siad that he was only going to employ his son .
Mrs Fran Mullen wanted to know if the building were to be sold agina would the new owner
have to come back to the Town Board for another permit , to decide if it would be an
allowed use . Supv Cotterill said that is one of the stipulations that the Town Board can
put in the special permit that it will not be transferable to another owner or person .
Clm Webb wanted to know if it would be open to people of all ages . Mr Geiger said that
it would be .

RESOLUTION # 63 GRANT SPECIAL PERMIT TO ROBERT GEIGER
AND SON FOR A WOODWORKING SHOP & SHOWROOM
Clm Metzger offered the following resolution and asked for its adoption .
RESOLVED , that Town Board grant a special permit to Robert Geiger and Son for a woodworking
shop and showroom at 298 Cortland Rd . with the stipulation that the permit is issued for
this purpose only and it is not transferable . If the property is sold or leased the
new owner will have to come to the Town Board for another special permit on their own
merit . Also , the showroom will be open to people of all ages .

Minutes of the Town Board meeting held on the 11th of March
Supv Cotterill called the meeting to order at 7 : 45 PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Tarr , Clm Webb , Clm Metzger
Clm Jordan , Atty Perkins and Z . O . Stewart
Approval of the minutes : Motion was made by Clm Metzger and 2nd by Clm Jordan that the
minutes . of the February 12th meeting be approved as submitted .

COUNTY BRIEFING
Co Rep Tillapaugh reported that he had attended the meeting concerning the intersection
of Ferguson Rd and Irishsettlement Rd .
Also reported on the Co Youth Bureau cuts from Gov . Carey . The Town of Dryden ' s 1980
allocation was $ 5608 . 00 . Under the new proposed cuts the maximum amount would be $ 2676 . 00 .
This would be a $ 2913 . 00 or ' a cut of 52 per cent .
Reported that the town has not appointed anyone to the Co Youth Bureau .
RESOLUTION # 64 APPOINT COUNTY YOUTH BUREAU - Dave Morrisey
Supv Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board appoint Dave Morrisey to the County Youth Bureau as
the Town Cf Dryden ' s representative . ,

COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Tarr reported thRTthe Planning Board would like to know the Town Boards feelings
about nuclear waste . Supv Cotterill said that it has not been discussed . It was
however brought up at the last Tomp Co Municipal meeting and was their feeling that
state and interstate highways were built for transportation of trucks and we would
be starting something when we tell people who could use them . Someone had raised
a question that Cornell Univ . had more nuclear waste that was not properly disposed
of and wondering if they were going to close Cornell down . Also there was more
danger of a propane gas truck on the highway or gas truck that might cause serious
disaster from using the highway .
Supv Cotterill felt that whatever the towns decide it can still be over ridden by the
Federal Govt .
Clm Jordan felt that a gasoline or propane truck is a thousand times more hazardous
than a nuclear waste truck because the packages are tested under extreme conditions .
The Town Board decided that they do not feel that they are interested in passing a
resolution banning the use of the highway for nuclear waste material .
Clm Webb reported for John Coghlan who was absent . There was not any matter of direct
concern to the town that was discussed at the Feb . meeting . John Ettinger was elected
Chairman and Jim Mason was elected Vice Chairman . Most of the discussion was devoted
to mass transit problems and possible approaches . Dave Arbeit from the Co Planning '
staff presented a preliminary study . There was a proposal for consideration of
funding agencies for the May submission . There was also discussion dealing with
rush hour traffic . A proposal for Warren Rd improvements is expected to be
forwarded to the state in April which would be from Rt 13 north . The Transportation
Commission is now the Traffic Safety Board . Sheriff Howard was reelected Chairman and
Chief McEwen was reelected Vice Chairman . A committee headed by Fran Wright from
Danby was appointed to prepare a report to the state ( at the states request ) of
ourstanding problems in traffic safety in the county . The state has furnished what it
has found on a state wide basis .
Clm Jordan reported that he had attended the last sewer meeting . They are still looking
for an archeologist. Their next meeting will be March 26th at 7 : 30 PM .
ATTORNEY
Atty Perkins reported that he had spoken with a representative of the trustee in
bankruptcy for the railroad . LVRR and the trustee would agree to give the town the
option to buy all the abandoned railroad property in the Town of Dryden at the price
we had discussed for a period of 18 months . The consideration of the option would
be 10 percent down ( $ 2950 . 00 ) and if the option were exercised the 10 percent down
would be applied to the purchase price . There is some interest from adjacent
property owners within the village and town to buy the property . Atty Perkins felt
that it would be possible for the town to market the property either to a
municipality , individual or sewer dist .
RESOLUTION # 65 PURCHASE OFFER FOR ABANDONED LVRR
PROPERTY IN THE TOWN OF DRYDEN
Clm Webb offered the following resolution and asked for its adoption .
RESOLVED , that this Dryden Town Board exercise the option to purchase the abandoned
LVRR property and authorized the Supervisor to make a payment of $ 2950 . 00 to be
applied toward the purchase price .

Atty Perkins reported that there will be an informational meeting held on March 25th
at 7 : 30 PM at the Town Hall with regard to the proposed Snyder Hill Water Dist .
There will be a representative here from Lozier Engineers to answer and questions .
There was some discussion about local games of chance . Atty Perkins said that the
legislator in 1976 adopted an article to the General Municipal Law , called Games of
Chance Licensing Law . This sets up a local option for municipalities to adopt a local
law permitting certain games of chance run according to article 9a of General Municipal
Law . There are restrictions on how often they can be run , who can run them , who can be

in charge of them , and what happens to the proceeds . All the proceeds must be funneled •
for religious , educations , charitable , or similar purposes and are so restricted . It
is overseen by a licensing scheme and by the State and Wagering Board . There are
restrictions on how much can be bet , who can bet , when they can be run , how often ,
how many the kinds of games that can be run and who can . supply _ the . material for running
the games . The town has the option of adopting the local law . It must be submitted
to the voters at a general election or special election and will not become effective
until that time . The town would have time to submit one for the general election in Nov .
The question came up because the Tomp Co Auxiliary was going to have their ball at
TC3 and they usually have a raffle to raise money , which would be illegal in the Town
of Dryden . The local law shall be operative in any village if after the adoption of
the local law by the town , the Board of Trustees would have to adopt a local law
subject to a permissive referendum authorizing the issuance of licenses by the town
for games to be conducted within the village .
• RESOLUTION # 66 ACCEPT OFFER OF DEDICATION OF BRIDLE LANE
Clm Metzger offered the following resolution and asked for its adoption .
WHEREAS , the Town of Dryden Planning Board has approved the subdivision plat for
" The Country Trace " , and
WHEREAS , the road to be designated as " Bridle Lane " on said map has been constructed
according to Town specifications and has been approved by the Town Highway Superintendent
and
WHEREAS , the sufficiency of the title and the instruments conveying the same to the
Town have been examined by the Town Attorney and found to be in order , and
WHEREAS , the filing of the subdivision plat in the Tompkins County Clerk ' s Office
constitutes an offer to dedicated such property shown as " Bridle Lane " to the Town
of Dryden ,
NOW THEREFORE , BE IT RESOLVED, by this Town Board that the road shown on said subdivision
plat , filed in the Tompkins County Clerk ' s Office , and more particularly described in
a deed to the Town of Dryden dated November 15 , 1979 , and recorded December 10 , 1979 ,
in Liber 574 of Deeds at page 857 in the Tompkins County Clerk ' s Office , be and hereby
is accepted as a Town Road , and the same is to be added to the official Town map and
the Town Highway Superintendent is authorized to place the appropriate road signs
thereon and take any and all steps necessary to maintain said Bridle Lane as a Town
Road from this day forward .

CORRESPONDENCE
Letter from Assemblyman MacNeil and Senator Smith with regard to the Civil Service Law .
Letter from Co Youth Bureau concerning the Youth program .
Notice from the state that they are tranfering some county roads to state roads . The
road from Lansing to Peruville will be 34B and the road from Dryden to Virgil will be
NY 392 , as of April 1st 1980 .
Letter from Mrs Seiverts concerning proposed water district .
Received letter from SPCA stating that they would change the wording to say that they
would do the Town of Dryden dog enumeration door to door once a year . Supv Cotterill
said that copies have been given to the Village of Dryden and Freeville asking them
what kind of dog control they would like and it will be attached to the Town of Dryden ' s
contract .
The Board of Directors from the Dryden Fire Co have requested the Town Board members
and the Village Board of Trustees to attend a meeting March 24th at 7 : 30 PM at the
Fire Hall.•, It was- decided to invite the fire companies to the April 8th board meeting .

Request .from the - P1 nning Board to pay milage to attend meetings . Suvp Cotterill said
Lall• that it is illegal to pay milage to attend a meeting , but would be proper to pay
milage if they have to attend a special meeting or go look at some property that is
in question for a hearing .
Clm Tarr wondered if it would be possible for the Planning Board and ZBOA members to be
paid a nominal fee for attending meetings . Atty Perkins said that a special account
would have to be set up and it is a little late for this year since the budget has
already been set up .
RESOLUTION # 67 PAY PLANNING BOARD MEMBERS AND ZBOA
MEMBERS MILAGE OTHER THAN REGULAR MEETINGS
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board authorize the Supv to pay the Planning Board and Zoning
Board of Appeals members mileage for any extra mileage for checking on any property for
a hearing or projects that is town business at a rate of 20 cents per mile .

ZONING OFFICER
Reported 2 building permits for the month of February . 1 was for an additon on a home .
2 - was a replacement for a mobile home that had burned . ZBOA held a hearing for
Robert Eastman to have a printing shop at 1145 Dryden Rd , where Layaw had a grocery store .
Co Rep Tillapaugh was wondering if something could be put in the towns ordinance
about people putting in fill on their property , that it should be so many feet from
the adjoining property owner . This creates a problem of spring run- off water , or if
there is a bad storm .
