Minutes of the Town Board meeting held on the 11th of December
Supv Cotterill called the meeting to order at 7 : 30 PM
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk : Present : Supv Cotterill , Clw Graham , Clm Metzger
Clm Tarr , and Atty Perkins Z . O . Stewart
Approval of the minutes : Motion was made by Clm Tarr and 2nd by Clm Webb that the
minutes of Public Hearing on November 8th for Federal Revenue Sharing , Sewer Dist
# 1 & # 2 and Water Dist # 1 ; Preliminary Budget Hearing and Town Board Meeting held
on Nov 13th be approved as submitted .
COUNTY BRIEFING
.- � Co Rep Tillapaugh reported at the last county meeting there was a resolution to approve
a comprehensive plan for 1980 for the County Youth Board . He asked for a delay because
he had some concerns that he wanted to discuss . One of the questions was what are the
projects or programs that the state allows funding for under the Division for Youth
Bureau funds . He felt that there is a misunderstanding what the County Youth Bureau is .
It really is the County Youth Services Bureau , and it has been thought of in the past
as a recreational type program . It also appears most of the programs that are approved
of are basically the City of Ithaca programs . It is a county wide youth bureau and
we are not getting equal distribution throughout the county . All these programs are
centered around the City of Ithaca , even though it states on them that they are available
to youth throughout the county .
Co Rep Tillapaugh reported that he has not seen the representative attend one of the
Town Board meetings and feels there is a lack of communication between the town that
they represent and the member , which should be looked into . They should come tb the
board meetings and get your feelings on certain things . Co Rep Tillapaugh thinks that
there should be an evaluation to see whether or not it is worth while or not . There was
some discussion on the County Youth Bureau with the Dryden children being asked to
contribute to activities in Ithaca .
COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Webb reported that the plan has gone to the Committee of Planning of Public Works
with regard to Route 13 . They will have to make a recommendation to the full board .
Their decision will have to be with the environmentalist and ag district or with
the Village of Dryden and the Dryden School . Each of the 2 routes will effect one or
the other . Supv Cotterill said that he had received a copy of their resolution that
the Village of Freeville passed on Dec 4th .
Clw Graham reported that Mr Dorst would like to use lot # 7 as a wood lot in his
sub- division since it was not a good building lot . The residents were concerned
that if the trees were cut down it might effect the flow of water coming down the hill ,
Mr Winn and Mr Harkness were concerned about their sub- division off Rt 38 in regard to
lot # 24 where the driveway should be placed because of the turn around needed . Final
approval was given based on the contingency that certain restrictions would have to be
met first .
Mr Sutton wanted a continuance for his development near Hunt Hill Rd .
Mr Hawkins was concerned about trailers being put on individual lots and the depreciating
values to other homes in the area .
Reported on Lucente sub- division on Caswell Rd . , the Health Dept sent a letter stating
the lot sizes should be 2 to 5 acres .
There was some discussion about a moratorium on mobile homes in the town . Supt/ Cotterill
requested that Clw Graham ask. the Planning Board as to whether or not they oppose or
favor a moratorium for trailers on individual lots and give the Town Board an answer
one way or the other .
ATTORNEY
Atty Perkins reported ' lon LVRR abandoned property to increase the town ' s offer from
_ $ 200 . 00 per acre to $ 250 . 00 per acre . Atty Perkins said that the town can obtain the
property and reserve the right to run water and sewer lines and other public utility
lines if necessary . The town can sell the property when they no longer have any use
or need for it upon terms or conditions you deem appropriate . There are no agreements
at this time with the property owners . Atty Perkins said that it would be improper to
get the agreements before you get the land . Supv Cotterill wanted to know if the
town did purchase the property and record easements , does the town have the right to
sell to an individual without putting it up for bid . Atty Perkins said that it would
not have to be put up for bid . Supv Cotterill felt that we should go ahead and purchase
the property at $ 250 . 00 per acre . It the town does get title and easements recorded
we can notify the people that the town does have title and hold a public hearing or
meeting to get their opinions as to what should be done . Then the town will be free
to decide what to do with the property .

Supervisor Cotterill offered the following resolution and asked for its adoption :
WHEREAS , this Town Board has on October 9 , 1979 , adopted Resolution No . 136
pertaining to the revised Rules and Regulations for Bolton Point Water Rate
Schedules , and
WHEREAS , it is the intent of this Town Board to clarify and confirm such resolution ,
NOW , THEREFORE , be it
RESOLVED , that this Town Board adopt the Rules and Regulations as promulgated by
the Southern Cayuga Lake Intermuniciapal Water Commission and last revised May 8 ,
1979 .

RESOLUTION # 153 WATER RATE SCHEDULE FOR SOUTHERN
CAYUGA LAKE INTERMUNICIPAL WATER
COMMISSION
Councilman Metzger offered the following resolution and asked for its adoption :
WHEREAS , this Town Board has on October 9 , 1979 , adopted Resolution No 136
pertaining to the revised Rules and Regulations for Bolton Point Water Rate
Schedules , and
WHEREAS , it is the intent of this Town Board to clarify and confirm such
✓ esolution ,
NOW THEREFORE , be it
RESOLVED , that the Schedule of Rates for water service furnished by Southern Cayuga
Lake Intermunicipal Water Commission is hereby adopted by this Town Board , such
✓ ates to be applicable to the use of such water within the Town of Dryden water
district .

RESOLUTION # 154 PURCHASE R-O-W ABANDONED PROPERTY
FROM LVRR
Clm Metzger offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board authorize Atty Perkins and Supv Cotterill to make the
n ecessary transactions to purchase the abandoned r - o-w property from LVRR at $ 250 . 00
per acre from Dryden Village to Freeville Village and Freeville Village to the
Ithaca Town Line .

TOWN CLERK
Authorize Town Clerk to purchase envelopes out of dog monies collected to send dog
licenses back in the mail .
Invited Board members to Christmas Party Dec 18th .
Wondered what the Town Board was going to do about a committee for the 1980 census .
Supv Cotterill said that the Federal Govt is asking the town to appoint a committee
to publish news releases and to work about 1 month before the census is taken to
encourage people to get their census filled out and mailed back . The census will be
mailed out ; some will be asked to fill it out and mail back and others will be picked
up by a census taker and asked additional questions .
Supv Cotterill reported on fireman ' s workman ' s comp . According to the state auditor
it is illegal for the town to pay workman ' s comp for the two villages . Atty Perkins
has written to NYS Dept of Audit and Control for a written statement to see what is
illegal or legal as far as the town is concerned with workman ' s comp . The reason we
have done this is that the town still has one year to go on the contract with the
fire companies . If it is proven that it is illegal than we will • have to do something
to amend the contract .
ZONING OFFICER
6 building permits for the month of November . 2 one family homes ; 1 addition ;
2 garages ; and 1 storage building . No ZBOA meeting .
HIGHWAY
Hwy Supt Humphrey asked permission to sell 2 overhead doors , gas heaters and boiler .
RESOLUTION # 155 ADVERTISE TO SELL OVERHEAD GARAGE DOORS
HEATERS AND BOILER
Supv Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board authorize Hwy Supt Humphrey to advertise to sell
anything that he has no use for ; once he has done this he will then have the power to
dispose of it any way he deems necessary .

Atty Perkins reported on proposed Snyder Hill Water Dist . Lozier Engineers have sent
a letter of preliminary report and proposed map . Copies have been sent to 4 members
from the Snyder Hill area and have been asked to report back to the town early in
January in time for the Board Meeting .
CORRESPONDENCE
Letter from NYS Assembly with a proposed bill allowing local governments to determine
what non- profit organizations can be granted tax exemptions .
L etter from Dryden Fire Dept thanking the Dryden Town Board for their support toward
the new ambulance .
Thank you note from Dryden Ambulance in memory of Mrs Helen Amdur .
L etter from Village of Dryden requesting that the Town of Dryden enforce their dog
control law . When the town signs their contract specify that the Village of Dryden
needs patrol on Wednesday night because of garbage collection . Supv Cotterill reported
that the county is trying to draw up a contract that will meet the requirements of the
towns . As of yet there is no agreement . Supv Cotterill has expressed concern that
the town would want to include a statement that the SPCA would definitely do a dog
enumeration on a yearly basis for the complete town and check for any unlicensed dogs .
Also , that the villages within our town would have to be covered with the money that
we have provided through dog fees .
L etter from ZBOA requesting that the sign ordinance be revised . Clm Metzger suggested
that the Planning Board review the sign ordinance and report back to the town board
with a recommendation . Supv Cotterill felt that the Planning Board and ZBOA should
discuss the matter .
There was some discussion about the reappointment for ZBOA member and was tabled until
next month . There is also a vacancy on the Planning Board .

RESOLVED , that this Town Board authorize the Supv to transfer $ 750 . 00 from appropriated

Clm Metzger offered the following resolution and asked for its adoption .
RESOLVED ; that this Town Board authorize Hwy Supt Humphrey to advertise for bids for
( 2 ) pick- up trucks , deisel or regular with and without trade in also ( 1 ) ton dump
truck
Supv Cotterill reported that he went to a County Planning meeting at their request
concerning Irish Settlement Rd and Ferguson Rd . intersection . To this date there is
still no figure or any alternatives . They just had a traffic count and will now do
some studies and get some figures . •
RESOLUTION # 160 ABANDON SECTION OF IRISH SETTLEMENT ROAD
Clm Webb offered the following resolution and asked for its adoption .
RESOLVED , that this Dryden Town Board notify the County Planning Committee and County
Highway Superintendent that the road between Mr Paul Cook ' s house and barn ( section of
Irish Settlement Road ) , should be abandoned and realined east of the buildings from Irish
Settlement Road west .

Clm Webb wanted to know if there was a light in the flag pole . There is one but
does not work any more . Clm ) Metzger said that he would have someone look at it .
Also reported he had received a complaint on Ferguson Rd Ext . near Cook ' s property
where gravel is being washed out from someone ' s driveway onto the road .
Supv Cotterill made a motion to show the Town Board ' s appreciation to Janet Graham
for her 4 years of serving on the Town Board .
