Supv Cotterill read the notice that was published in the newspaper stating the purpose of said hearing for or against the adoption of a proposed amendment to the Town of Dryden Dog Control Ordinance to read as follows : SECTION II . License fees . Pursuant to Section 110 of the New York Agriculture and Markets Law , the annual fee for each dog license issued pursuant to Section 109 of said law shall be : ( a ) $ 5 . 00 for each spayed or neutered dog ; ( b ) $ 10 . 00 for each unspayed or unneutered dog . QUESTIONS AND / OR COMMENTS There was no one from the Town of Dryden to oppose the increase in license fees . RESOLUTION # 130 ADOPT AMENDMENT FOR DOG LICENSE FEES Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that this Town Board adopt the proposed amendment to the Town of Dryden Dog Control Ordinance to read as follows : SECTION II . License fees . O . Stewart Absent : Clm Tarr - Atty Perkins arrived at 8 : 35 PM Approval of the minutes : Motion was made by Clm Metzger and 2nd by Clm Webb that the minutes of the Special meeting held on October 2 , 1979 after the addition is made to the resolution to read for the 1980 dog licenses only . Motion was made by Clm Metzger and 2nd by Clm Webb that the minutes of the Public Hearing and Board Meeting held on Sept 11th be approved as submitted . COUNTY BRIEFING - Absent COUNCILMAN PRIVILEGE OF THE FLOOR Clw Graham reported that Mr Dorst from the Ellis Hollow area approached the Planning Board because he was interested in developing some land in that area . Clw Graham reported that the Planning Board did not have a quorum and that they are vacant 1 member to fill out the term for 1979 . Supv Cotterill suggested the name of Gary Whitmarsh for Clw Graham to contact and see if he would be interested . Mr Robert Keech submitted a sketch to the Planning Board for developing 6 lots on Mineah Rd . of 1 z to 2 acreas . Mr M Hawkins was at the Planning Board meeting with concern about trailers on seperate lots . TOWN CLERK BIO-TELEMETRY RADIO COMMUNICATIONS SYSTEM RESOLUTION # 131 EMERCENCY MEDICAL SERVICES - ENDORSEMENT OF APPLICATION Clm Webb offered the following resolution and asked for its adoption . RESOLVED , on recommendation of the Public Safety and Corrections Committee , that the . Supvervisor be and hereby authorized and directed to execute a grant application to New York State for a E . M . S . Bio- Telemetry Radio Communication System for use in traffic safety and related medical emergencies arising out of accidents and disasters , it being understood no Town funds are included . 2nd Clm Metzger Carried ZONING OFFICER 10 Building permits issued for the month of September . 4 one- family ; . 3 mobile homes ; 2 additions to homes ; and 1 structure ( slurry ) . D ISCUSSION � - Z . O . Stewart wanted to know if there had ever been a request for a traffic light at the corner of Rt 13 and Rt 38 . Clw Graham said that the Village of Dryden has made a request . There has not been any information received yet since the counters were put at the corner of Irish Settlement Rd and Ferguson Rd . CORRESPONDENCE L etter from the City of Ithaca in regard to Youth Bureau and services . L etter from State Insurance Fund in regard to compensation for ambulance service to the Town of Virgil . The Board decided to table the decision until next board meeting . RESOLUTIONS # 132 ADDITION TO 1980 TAX ROLL FOR UNPAID SEWER DISTRICT # 1 CHARGES Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize the addition of the following to the 1980 tax roll : 1 . - William 0 Camp Jr . , 67 Sapsucker Wood Rd . , Ithaca , NY Tax map # 3- 43- 1- 4 in the amount of $ 72 . 00 plus $ 6 . 12 penalty for a total of $ 78 . 12 2 . - Robert Stewart , 21 Sapsucker Woods Rd . , Ithaca , NY Tax map # 3- 43- 1- 14 . 1 in the amount of $ 180 . 00 plus $ 15 . 30 penalty for a total of $ 195 . 30 for unpaid Sewer District # 1 charges . 2nd Clw Graham Roll call vote - all voting YES 56- 1 RESOLUTION # 133 DRYDEN KIDDS INC - REIMBURSALBE FUND ' Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that the Dryden KIDDS Inc contribute to the Town of Dryden the sum of $ 1 , 000 . 00 for each quarter for a total of $ 4 , 000 . 00 and the Town will reimburse Dryden KIDDS , Inc . to whatever extent the Town receives from NYS Division for Youth . 2nd Clm Metzger Roll call vote - all voting YES RESOLUTION # 134 APPROVE PROJECT APPLICATION & BUDGET FOR TOWN OF DRYDEN RECREATION PROGRAM Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this . Town Board approve the project application and budget for the Town of Dryden Recreation Program as presented . 2nd Clw Graham Roll call vote - all voting YES RESOLUTION # 135 TRANSFER FUNDS FROM UNAPPROPRIATED FUND BALANCE TO ZB8010 . 4 Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize the Supv to transfer $ 25 . 00 from unappropriated fund balance to ZB8010 . 4 for contractual purposes . 2nd Clm Webb Roll call vote - all voting YES ATTORNEY Atty Perkins reported that he had the preliminary map which he has checked with Hwy Supt Humphrey , concerning George Road relocation . The problem is with the underlying title of property . GJR bought the property in 1966 and apparently they were represented by an attorney at that time , but there are a number of titles in question which appear . Atty Perkins is in the process of straightening this out , he has some of the corrected deeds back and an affidavit which has been furnished . Atty Perkins feels that the questions have been resolved to his satisfaction and does not foresee any problem . He does want to get . the papers and quick claim deeds o back to create a record . He does not see any problem with Hwy Supt Humphrey going ahead to start work on the road . There is still no change in the Prince property in Etna or the Robinson property don the Freeville Groton Rd . RESOLUTION # 136 REVISED RULES & REGULATIONS FOR - %a-‘ BOLTON POINT WATER RATE SCHEDULE Clm Metzger offered the following resolution and asked for its adoption . _ RESOLVED , that this Dryden Town Board adopt the revised rules and :regulations as proposed by Bolton Point for the water ra.tefschedule in the Town of Dryden . 2nd Clm Webb Roll call vote - all voting YES Supv Cotterill appointed Clw Graham to audit the highway bills . Susanne Lloyd Town Clerk Executive meeting October 29 , 1979. A special meeting between the Town Officials and The Village of Dryden officials began at 7 : 30 P . M . in the Dryden Town Hall . P resent : Supervisor Clinton . E . Cotterill , . Clm . Henry Tarr , Mert Webb , Jon Metzger , Clm , Janet Graham , Highway Superintendent Gregory Humphrey , Village Mayor Al Stevens , ✓ illage Board members , Joe McGuire , Michael Lane , Jean VanAlstine and from the D epartment of Public Works , Ed Bell . Village Board member Ron Alexander arrived at 7 : 50 P . M . Mayor Stevens : We are here to discuss Item # 3 in the Highway Budget and to ask for exemption from Item # 4 for snow . removal , weeds and brush and misc . expenses which are being paid by the Village for Town roads , but the Town does not pay the same in the Village ; therefore the Village residents are being taxed twice . The Town is allowed to exempt the Village from Item # 3 and 4 , if so desired . There is a bill in committee which would require this , I believe . Supv . Cotterilli Do you agree there is a State law which says the Village residents are liable for those taxes ? Mayor : Yes , we must pay unless you give us an exemption . What does the Town *Board feel about giving us this exemption ? Supv . : It is very clear what the law says . In my point of view , I believe the cooperation and services we provide are of a greater importance and there is no n eed to make this a public issue . The only people to get hurt are the Village ✓ esidents , if this is opened up . Freeville has indicated they want no part of this request . Mayor : : It ' s legal now , but what if this law passes ? Now we are just requesting exemption from Item # 4 . Supv . : I would rather see the cooperation for the benefit of the taxpayers of the whole area which I feel we have had in the past . Lane : How is the Village resident going to be hurt ? Supv. : Are you going to request the same of the County and State ? Mayor : The State only allow Towns to give the exemption not the County or State . Supv . : The State mandated Town governments whereby Village governments were set up by the residents of the Village - not mandated . Graham : If you are granted this exemption , will you be expending more money for Item # 3 for equipment ? Lane : We are not asking for Item i# 3 . Alexander : In preliminary discussions , we originally discussed both Item 3 & 4 , but we are only now asking for Item # 4 . Mayor : We are now paying approx . 13 % or $ 11 , 000 . 00 toward Item # 4 out of a total budget of $ 89 , 500 . 00 : What about next year ? Supv . : The whole budget for Item # 4 will be up to about $ 135 , 000 . 00 because of increased cost for fuel and wages . This would mean your share would be about $ 17 , 000 . 00 for the year 1980 . If we exempted you , would you still expect all services to still be provided ? Mayor : What are these services exactly ? Supv : Machinery and personnel use , Village justice court and compensation for the Firemen 's district . These are not all item # 3 . Legally we have the right to bill the Village for all of these services we provide for you . We will probably not exempt you without billing you for these services . We have been doing this as a cooperative measure , and it is in the best interest to continue doing so , if possible . Mayor : I understood we had been trading services . Supv : . I would not consider our_S an equal trade . Item # 3 is not close to what services we provide . McGuire : What will Item # 4 amount to if used against # 3 ? Humphrey: From Jan - Oct . 1979 , personnel and equipment ( based on State contract Prices ) , and not including usage of the machinery on Fridays in the summer , comes to approx . $ 12 , 882 . 50 . These prices would be doubled or more if you hired a private contractor . We have used the village equipment for a total of $ 726 . 00 . McGuire : This is precisely why we came , to find out these facts . We do not want to ruin this type of relationship . Supv : . . You may have already done so . Alexander : We would like a breakdown of the figures in the budget before we make any decision . Supv : These are available from the bookkeeper during office hours . There was some discussion of the Firemen ' s compensation and budget . Webb : Are you formally requesting exemption from Item # 4 ? Mayor : No , this has not been formally voted on . Supv : When you make your decision , present it in writing to the Board and we will make our decision . There was some discussion on the new dog control law to take effect in 1980 .
