Supv Cotteral .read the notice that was published in the newspaper stating the purpose of said hearing was to allocate $ 30 , 000 . 00 to Highway Fund from Federal Revenue Sharing monies for repairs and improvements . QUESTIONS AND / OR COMMENTS Wanted to know what the restrictions were on the money by the Federal Government . . Supv Cotterill said that they allow money for any construction or improvements for highway use . The boards point of view is that the cost of oil , crushed stone and black top are going up so much that if the Highway Supt can find the time to do more paving this year that the town would be ahead with the $ 30 , 000 . 00 , then waiting until next year to do it . Closed Public Hearing : 7 : 35 PM RESOLUTION # 122 ALLOCATE FEDERAL REVENUE SHARING MONEY FOR HIGHWAY REPAIRS & IMPROVEMENT Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that the Supv be authorized to allocate $ 30 , 000 . 00 from Federal Revenue Sharing money for highway repairs and improvements . 2nd Clm Webb Roll call vote - all voting YES TOWN BOARD MEETING September 11 , 1979 Minutes of the Town Board meeting held on September 11th Supv Cotterill called the meeting to order at 7 : 40 PM Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Webb , Clm Tarr , Clm Metzger , Clw Graham , Atty Perkins and Z . O . Stewart . Approval of the minutes : Motion was made by Clw Graham and 2nd by Clm Tarr that the minutes of the 3 Public Hearings and Town Board meeting held on August 14th be approved as submitted . COUNTY BRIEFING - Absent CITIZEN PRIVILEGE OF THE FLOOR Mr John Todd from Dryden Harford Rd , owner of Sunflower Pottery was wondering about the size of his sign . What he has now is a 12 foot long sign about 11 inches high hanging on the side of his house , which is hardly noticeable from the road . The Zoning Officer has classified his business as a home occupation which only allows a 2 foot square sign , as the regulation sign for the ordinance . Z . O . Stewart suggested to Mr Todd that if he felt the regulation size was to small and he wanted a bigger one he would have to approach the Town Board to see about the possibility of changing the regulation size . Supv Cotterill said that the Zoning Officer and Town Attorney would have to determine what the classification of property it and then the zoning would have to be enforced equally town wide . If it needs changing then the board will have to make a proposal , hold a public hearing to change this particular section on signs and hear the peoples input to see if the proposed change would be in the best interest for the people in the town . At this particular point the Zoning Officer will have to enforce this section on signs that is in the town ordinance . Snyder Hill Water Dist ; Atty Perkins said that on Aug 16th he wrote to the Ad Hoc Committee for . the Snyder Hill Water Dist . formation . Atty Perkins asked them to survey the sentiments amoung the residents in the Snyder Hill area to see if the projected cost of the project still made it a feasible project as far as they were concerned . This would be about $ 185 . 00 per year per unit based upon receiving a Farmers Home Administration grant . It would be exclusive of the cost of water . There were about 30 people from the Snyder Hill Rd area . - Mr John Hunt was in favor of the water district only if there was sewer made available at the same time . Mr Jeffrey Lee was against the water district . 37 . „ .: a r There was much discussion and most were in favor of the water district . Mr Underwood said that a lot of people wanted to know how much it would cost to go from the main line into their house , also if the tap would already be on the main line so that there is a shut off , or do they have to tap and pay for tapping on the line . Supv Cotterill said that these were questions that the board is not qualified t o answer . Mr Underwood thought that there might be an engineer at the meeting to answer these questions . Clm Metzger said that Bolton Point does put a curb box on the line . The ✓ esidnets would also like Lozier Engineers to study the feasibility for a sewer line . Supv Cotterill read a letter from Bolton Point stating some figures concerning amounts for water . There would be a one time connection charge ( $ 80 . 00 ) per hook-up . There will be assessed to the Town of Dryden a transmission charge to help retire the Town o f Ithaca water debt which would be about $ 8 . 00 per unit , per year , including undeveloped ✓ oad frontage at 100 feet per unit and / or undeveloped acreage . The amount is about 1 / 3 of the benefit charge assessed to the Town of Ithaca customers on the same formula . • There will be also be a surcharge for maintenance of the towns system equivalent to 10 per cent of the water bill to the district quarterly . This should be added to the customers water bill collected by the town clerk and payable to the Town of Ithaca . The surcharge money is used by the Town of Ithaca for painting reservoirs , repairing water breaks , painting and flushing water mains etc . Atty Perkins said that the town had passed a resolution last fall authorizing $ 1 , 000 t o be spent towards the preparation of a general map and a general study by the engineers . This was subject to a permissive referendum . The engineers have indicated that they cannot begin to do a study for this amount of money , it will take substantially more . It is now up to the Snyder Hill residents to decide whether or not they want the town to form a water district . If there is a water district formed the charge for the study will be assessed against the water district . Right now it is just a general town charge . It will not commit the residents to get the water but would be just for the study . Lozier Engineers gave a rough estimate of $ 950 . 00 for a basic hydraulic study , analyze the project with a written report , a map , an estimate of the project cost , bond schedule , and boundary description and attend a public hearing . Supv Cotterill said that the Town Board will spend what has been allocated for the proposed water district and send the residents notification when the town has heard from the engineers . COUNCILMAN PRIVILEGE OF THE FLOOR Clm Webb reported on Rt 13 , that all the municipalities have voted for the northern route for the relocation of Rt 13 , but the opposition is the environmentalist and the agricultural district . Supv Cotterill reported that it has been over 1 year since there had been a request for the County Planning Board to study the intersection of Irish Settlement and Ferguson Rd intersection . They are just now putting up a traffic counter and then after they get the count , maybe they will send a man up there to see which way the cars are turning , left or right when they come out of the intersection . ATTORNEY Atty Perkins reported that he had written to the county concerning the property which was formerly Elstram Developers . Atty Perkins felt that the Town Board should contact our County Representatives first and request a response to the town ' s inquiry . Supv Cotterill authorized Atty Perkins to contact our County Representatives . Atty Perkins reported on the Prince property in Etna . There is now a new owner and Atty Perkins has spoken with their attorney concerning cleaning up the property . Atty Perkins felt that since several weeks has passed it is now time to write the owner to clean it up by the end of the month . - Also reported that he had received a proposed contract with LVRR . The area between the Village of Freeville line on the north in the Town of Dryden - Town of Dryden line . and the Town of Groton line has been released from their preferential rights . The area between Lake Rd south of Dryden and the Village of Freeville line is for sale and - the area between East Ithaca and Freeville Village is for sale . We have a proposed contract and a verbal committment subject for approval with the trustee in bankruptcy in the U . S . District Court which is governing the reorganization . The town can buy the East Ithaca line to the Freeville line for " $ 200 . 00 per acre . Atty Perkins said that he has the contract and the town just has to sign it and send it back with the towns good faith and deposit . They proposed _ that the Town of Dryden purchase the area between West Lake Rd and the Village of Freeville at $ 5 , 000 per mile , which is approximately 4 . 7 miles at $ 23 , 500 . The best offer to date that LVRR has received is approximately $ 400 . 00 per acre . Atty Perkins was not sure how many acres were involved in this 4 . 7 miles . LVRR would rather sell the property by the mile . The problem that the Town of Dryden is facing is that one property owner in the Village of Freeville has offered an amount which was equivalent to about $ 3 , 000 to $ 4 , 000 per acre for land in the Village of Freeville . This is why the line will be more expensive . . . • Mt . ' RESOLUTION # 123 AUTHORIZE ATTY PERKINS TO OFFER LVRR $ 200 . 00 PER ACRE Supv Cotterill offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize Atty Perkins to offer LVRR $ 200 . 00 per . acre from Spring House Road to Freeville Village and Freeville Village to East Ithaca . This will be the boards final offer . 2nd Clm Webb Carried RESOLUTION # 124 APPOINT DOG ENUMERATOR FOR 1980 Peter J Deering Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board appoint Peter J Deering as dog enumerator for the year 1980 . 2nd Clm Webb Carried Supv Cotterill reported on dog control . The towns did want to set a uniform fee of $ 5 . 00 for a spayed and neutered male and $ 10 . 00 for a female and unneutered male , county wide . Also the towns keep 50 cents for every license issued to cover clerical costs , and that the courts keep $ 5 . 00 of every fine for court costs . All of the • fees other than clerk fees and court costs be turned over to the county to cover the cost of dog control . The SPCA would also agree to enumerate the dogs once a year . RESOLUTION # 125 TAX WARRANT FOR 1980 re KEITH POOL TOWN Supv Cotterill offered the following resolution and asked for its adoption . RESOLVED , that this Town Board hereby directs the Tompkins County Assessment Department to place on the 1980 Tax Warrant , the amount of $ 375 . 00 on parcel # 3 - 39 - 1- 17 . 41 listed in the name of Keith ' s Pool Town . 2nd Clm Webb Roll call vote - all voting YES RESOLUTION # 126 PURCHASE SAVIN COPIER Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that this Town Board purchase a Savin Copier from XCP 1725 Dryden Rd . , which is a state contract price in the amount of $ 3633 . 00 . There is a 1 year warranty on the maintenance , drum and parts . The Town will receive a second year service contract for the SCM 142 copy machine . 2nd Clm Metzger Roll call vote - all voting YES RESOLUTION # 127 TRANSFER FROM APPROPRIATED FUND BALANCE TO BUILDING 1620 . 2 Clm Tarr offered the following resolution and asked for its adoption . WHEREAS , the Town of Dryden , with the Village of Dryden as the lead applicant herein called the " Applicant , " after thorough consideration of the various aspects of the problem and study of available data , has hereby determined that the construction of certain works , required for the treatment of sewage , generally described as STEP I FACILITIES PLANNING FOR THE VILLAGE OF DRYDEN , VILLAGE OF FREEVILLE , AND TOWN OF DRYDEN jointly and identified as Project Number C- 36 ( not yet assigned ) , herein called the " Project , " is desirable and in the public interest , and to that end it is necessary that action preliminary to the construction of said Project be taken immediately ; and WHEREAS , under Public Law 92- 500 , the United States of America has authorized the making o f grants to aid in financing the cost of construction of necessary treatment works to prevent the discharge of untreated or inadequately treated sewage or other waste into any waters and for the purpose of reports , plans , and specifications in connection therewith ; and WHEREAS , the Applicant has examined and duly considered Public Law 92 - 500 and the Applicant deems it to be in the public interest and to the public benefit to file an application under this Act and to authorize other action in connection therewith ; NOW , THEREFORE , BE IT RESOLVED BY the Town Board of the Town of- Dryden 1 . Supv Cotterill read the notice that was published in the newspaper stating the purpose of said hearing for or against the adoption of a proposed amendment to the Town of Dryden Dog Control Ordinance to read as follows : SECTION II . License fees . Pursuant to Section 110 of the New York Agriculture and Markets Law , the annual fee for each dog license issued pursuant to Section 109 of said law shall be : ( a ) $ 5 . 00 for each spayed or neutered dog ; ( b ) $ 10 . 00 for III ' each unspayed or unneutered dog .
