TOWN BOARD MEETING
JUNE 12 , 1979
Minutes of the Town Board meeting held on June 12th
Suvp Cotterill called the meeting to order at 7 : 30 PM
Members and guests participated in the Pledge of Allegiance
rese t :
Roll call was by the Town Clerk : upv Eotterill , Clw Graham , Clm Webb , Clm Tarr ,
Clm Metzger , Z . O . Stewart and Acting Atty Perkins
Absent : Atty Amdur
Approval of the minutes : Clw Graham made the motion and 2nd by Clm Metzger that the
minutes of Public Hearing # 1 - Cross Connection Control Ordinance and Public Hearing
# 2 - Larr Caskey and Town Board Meeting held on May 8th be approved as submitted .
• COUNTY BRIEFING
Co Rep Watros reported on German Cross Rd bridge which the Planning of Public Works
has been studying . There will be some decision made at their next meeting held in July .
Supv Cotterill wanted to know if the County Board has taken any action on the dog
proposal . Co Rep Watros said no action has been taken at this time .
There will be another meeting on Rt 13 on June 18th at the Dryden Village Hall at 7 : 30PM
RESOLUTION # 90 APPROVE FRANCHISE AMENDMENT WITH
AMERICAN TELEVISION & COMMUNICATIONS CORP .
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Dryden Town Board approve the franchise agreement between - the
Town of Dryden and Ceracche Television Corporation granted December 30 , 1961 , as
amended and subsequently transferred to American Television and Communications
Corporation (ATC ) by the New York State Commission on Cable Television September 27 ,
1977 , upon the sale of Ceracche Television Corporation at ATC , is hereby amended
as follows :
1 . - ATC is hereby authorized to charge $ 2 . 00 per month per outlet for a converter
and / or descrambler rented by the subscriber from ATC for the purpose of receiving
either additional broadcast channels and / or premium programming . This fee is in
addition to charges for basic 12 channel cable service and premium programming . The
service provided by the converter and descrambler are incremental to the basic 12
channel service , and no customer is required to subscribe to these services as a
condition to receiving the basic service .
2 . - Except as specifically added or modified herein , all other provisions of the
cable television franchise , as amended , remain in full force and effect .

Co Rep Watros was concerned about the residents ( 26 ) at Willow Brook Manor , getting
hooked up the cable TV . They have called for hookups . . The company, `,has„started .. :
this week which has been 1 per-day . This does not seem feasible when they could all
be hooked up at the same time . They were told it was they way the work orders come
off the computer Co Rep Watros was wondering why . these` hookups couldnit `.. be done
in one trip instead of waiting 2 weeks for a hookup which they have been told .
Mr Lee said that the orders did not come of a computer and they they certainly would
like to do all the hookups in 1 day , but it is hard to tell who would like service ,
and what type of service they would like , also when they would be home . The office
waits for the phone calls to come in . Mr Lee said that he would see what he could
do so that they will all be hooked up at the same time .
Clw Graham was wondering about the letter that residents in Dryden received and wanted
• to know if the $ 30 . 00 is a security deposit for HBO for those customers who want it .
Also , wanted to know if there will be another letter concerning the additional channels
that was spoken about in March , that for the Dryden Village residents there would be
no additional installation fee , just a rental fee for an additional $ 2 . 00 per month .
Mr Lee said that was correct .
CITIZEN PRIVILEGE OF THE FLOOR
Mr Cy Ortin from Dryden Rd in Varna wanted to know who owns the railroad . Supv Cotterill
stated that LVRR still owns the property , but the town has made a purchase offer .
Mr Ortin said he would like to know so he would know who to sue , because since February
1977 the water from the railroad property , evidently the drainage ditches have been
plugged up . Where it used to go down the gully to the left or Mt Pleasant Rd on the
right no longer goes that way , but comes over the hill right into my back yard . My
parking lot is full of sand and I haveAditch about 12 feet deep , it - has to pushed in
a wall of my new building . The cost so far will run about $ 50 , 000 . 00 . ? Ir. Ortin was
worried about was that it will happen again unless something is done to the drainage
ditches . Supv Cotterill said the town has no authority since we do not own the
property , but suggested that Mr Ortin get permission from the railroad to clean the
drainage ditches .

Mr Thorns Litwin , 73 German Cross Rd , spoke to the Town Board concerning the German
Cross Rd bridge . Their objections to the proposed 2 lane bridge were that the County
had failed to consider the safety hazard due to increased traffic volume , safety
hazard due to faster traffic flow , increased risk of flood damage to homes near
Six Mile Creek , the impact on the lives of those most affected by the project and the
✓ elevant information on traffic , current bridge condition , accident histories and
stream flow to plan such a project . Mr Litwin requested to stop the project until
information can be gathered and impacts assessed , gather relevant information and
hold a public hearing . Mr Litwin presented the Town Board with a petition opposing
the construction of a 2 lane bridge .
Mr Richard Booth , representing the residents opposing the bridge on German Cross Rd ,
stated that this has been a poorly planned project . The County has not developed by
any means the barest minimum information that should be developed by a public body
before it spends . in excess of $ 100 , 000 . 00 . The County has')lan-- ed
this bridge without seeking the opinions of who would be most impacted by it .
Mr Booth said to his knowledge the County at this time does not give any indication
t o hold a public hearing for pros and cons on this matter . Mr Booth said that there
are 2 legal concerns that the Town of Dryden should consider . 1 - Who owns the land •
joining German Cross Rd . How wide is the r- o-w . There is no deed filed in the
Town Clerks Office for this particular road . If there is no deed it could be
e stablished by description or public use . If the road is established by public use
than the question is how wide is the road ? Is the Town acting within their proper
✓ ights in building an access to this bridge outside of the width of the existing road .
2- SEQR Act which came into effect Nov 1st 1978 . It requires that the Town of Dryden
to make certain assessments before undertaking this proposed project . The original
assessments has to be whether or not this proposed project may have significant impact
on the environment . If it is determined than the Town of Dryden will have to prepare
a draft environmental impact statement and circulate it for public comments both by
the citizens and other interested public agencies . Mr Booth also , stated that their
argument is with the County Board of Representatives . 1- They have requested that the
county retract any existing authorization for building the bridge at this time .
2- That prior to making any decision in the future in regarding to building the bridge
that the Town of Dryden hold a Public Hearing that will give everyone an opportunity
t o speak . 3-Prior to any decision that the Town Board require the County Highway Dept
to present a full assessment of the need for a new bridge . Including information
✓ egarding existing traffic levels , volumes and speeds , constructual integrity of the
existing bridge , the history of past accidents on the bridge , and volumes of flood
waters on Six Mile Creek .
Mr Pete Bryant approached the Town Board concerning a Rock Concert he would like
to hold on the carnival grounds on Rt 38 by the Telephone Co . building . The Town
Board said that they would have to hold a public hearing for a special permit .
Mr Bryant felt that about 700 to 1500 people would attend .
Mr . Robert Wells approached the Town Board concerning a sewer line coming along East
Main St , which would provide service to him and his apartment house across the road ,
but would also provide service to the Town Highway and Town Hall . Mr Wells would like
the Town Highway to supply the equipment and labor to install the manholes and laterals .
Mr Wells would supply the material to hook into the sewer line . There was much
discussion . Supv Cotterill said the town should be sharing the cost because eventually
we would be hooking onto the sewer line and the town would benefit .
Atty Perkins said that the town could not do it because it would be benefiting a
private owner . The town will be able to hook in when the private line is deeded to
Dryden Village , after the moratorium is lifted . The town will be allowed to hook up
when it is considered to be a public line and not a lateral .
Motion was made by Clw Graham for the town to supply the labor and equipment for the
sewer line . There was no 2nd to this motion .
COUNCILMAN PRIVILEGE OF THE FLOOR •
RESOLUTION # 91 $ 50 . 00 MEMBERSHIP FOR COUNTY TV
CABLE COMMISSION
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board pay their $ 50 . 00 membership for County TV Cable
Commission .

RESOLUTION # 92 ACTING TOWN ATtORNEt
Supv Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that this Board appoint Mahlon Perkins as acting Town Attorney for the
balance of the year .

ATTORNEY
Atty Perkins reported on Snyder Hill water dist . The next step would be to get a
proposal , plan , map and report from Lozier Engineers under 209C Town Law , and file
this with the Town Clerk before a public hearing can be scheduled .
Supv Cotterill asked Atty Perkins to contact Lozier Engineers to get an estimate .
Co Rep Tillapaugh reported that the countys concern is that the bridge should be
✓ eplaced . There was some work done on the bridge in 1960- 1962 with extra girders
: put on for support . There were several girders that were almost or completely rusted
o ff and deterioration on some of the others . There also , were extra steel plates
• that had been welded on for extra support . The abuttment to the bridge is in bad
shape . There should be careful consideration as to how long the bridge will last .
Also , it is the countys responsibility to residents of the community to make sure
t he bridge is kept safe to the public . There is also the problem of flooding .

Clm Metzger offered the following resolution and asked for its adoption .
RESOLVED , that this Board appoint John Morey , Democrat and Joseph Petersen Republican ,
as Custodians of the voting machines at a fee of $ 350 . 00 each .

ZONING OFFICER
24 building permits for the month of May . ZBOA held 2 hearings . One was granted
t o . Morse on Lower Creek Rd for a Craft Shop . One was denied to Clark ' s on South
Knoll Drive to run a retail business .
There was some discussion on the energy code . How will it be enforced in towns
where there is no building department ? The Public Service Commission expects that
the utilities will enforce the code .
CORRESPONDENCE
Letter from NYSDOT in regard to painting state highways .
RESOLUTION # 98 RAISE AGED EXEMPTION
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board raise the aged exemption from $ 7200 to $ 8000 . 00

Letter from the Finger Lakes Runners Club with regard to the r - o-w on LVRR
L etter from Mr William Deming , with regard to the r -o-w on LVRR
There was a meeting at NYSE &G and NYSDOT concerning the installation of a light on
the corner of Yellow Barn Rd and Rt 13 . They have agreed to have a light installed
on Yellow Barn Rd as an experiment . The state says that no light can shine on a
state highway . -
L etter from Mr Noseworthy , LVRR , in regard to r- o-w . They would like the Town to
offer $ 200 . 00 per acre from Etna to the Town Line in Ithaca . There was some discussion
and the Town Board decided to authorize Atty Perkins to contact the property
owners to see if they would be willing to buy the portion adjoining their land
at $ 200 . 00 per acre .
RESOLUTION # 99 AUTHORIZE TOWN ATTORNEY TO CONTACT
PROPERTY OWNERS - LVRR R- O-W
Clw Graham offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board authorize Atty Perkins to contact the property
owners to see if they show sufficiant interest . If there is enough interest then
Atty Perkins be empowered to offer LVRR $ 200 . 00 per acre for the property from
Dryden Village , to Freeville Village , from Freeville Village to Etna and from
E tna to the Ithaca , Town Line .

Received letter from NYSDOT that they will make a survey for a no -passing zone
on Rt 13 from Ringwood Rd to Pinewoods Rd .
RESOLUTION # 100 SIMPLEX FIRE ALARM SYSTEM
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board authorize Hwy Supt Humphrey to have a fire alarm
system installed at the Town Garage at a cost of approximately $ 1800 . 00 and tie
in the Town Hall if it is feasible .
