HomeMy WebLinkAbout1979-02-13 an TOWN BOARD MEETING FEBRUARY 13 , 1979 Minutes of the Board Meeting held on February 13 , 1979 Supv Cotterill called the meeting to order at 7 : 30 PM Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : Present : Supv Cotterill , Clw Graham and Clm Metzger Absent : Clm Tarr , Clm Webb , Atty Amdur & ZO Stewart Approval of the minutes : Motion was made by Clw Graham and 2nd by Clm Metzger that the minutes of the Board Meeting held on January 9th be approved after the addition is ' S made of Jan 2nd for the Organizational Meeting . Supv Cotterill appointed Clw Graham and Clm Metzger to audit the General Fund and • Highway Fund Bills . COUNTY BRIEFING - Absent ATTORNEY - Absent Supv Cotterill reported that the Attorney for the Prince property in Etna requested an adjournment for 1 or 2 months , which was not granted by the Town . Atty Amdur has received the court order . If nothing is done by the March 13th Board Meeting the Town will proceed with the court order . Supv Cotterill reported on the TV contract which Ceracche requested , which would be allowing for a $ 2 . 00 increase for some type of extra channel . Atty Amdur suggested that the Town Board schedule a public hearing for the next board meeting . RESOLUTION # 49 SCHEDULE PUBLIC HEARING FOR CERACCHE TV Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board schedule a public hearing to be held on March 13th , 1979 at 7 : 30 PM to consider the application of American Television and Communications Corporation in the matter of a proposed . to the Cable Television Franchise granted by the Town of Dryden to Ceracche Television Corp on December 30 , 1961 , as amended and subsequently transferred to the American Television and Communications Corp by the New York State Commission on Calbe Television , September 27 , 1977 which is as follows : 1 . - To authorize the American Television and Communications Corp to charge $ 2 . 00 per month per outlet for a converter and / or descrambler rented by the subscriber from American Television and Communications Corp for the purpose of receiving either additional broadcast channels and / or premium programming . This fee is in addition to charges for basic twelve channel service , and no customer is required to subscribe to these services , as a condition to receiving the basic service . 2 . - All other provisions of the franchise as amended , shall remain in full force and effect , except as specifically modified hereinabove . 2nd Clw Graham Carried Supv Cotterill reported on Varna Fire contract . Atty Amdur will update the words in their contract . Supv Cotterill read letter from Varna Fire Co . stating that they feel it is not a good move for them and attach the letter to the contract while the contract is in force . TOWN CLERK Reported she had collected $ 633 , 011 . 86 in taxes to date . Reported that . 277 dog summons were mailed out with 377 dogs left to license . RESOLUTION # 50 AUTHORIZE TOWN CLERK TO PURCHASE ONE VOTING MACHINE • Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize the Town Clerk to purchase 1 voting machine with printed return mechanism and the Supv be empowered to make the necessary transaction not to exceed $ 3 , 000 . 00 2nd Clw Graham Roll call vote - all voting YES Mr Bill Brothers from the SPCA spoke to the Town Board about a contract . As long as the Town has a dog ordinance , and if the Town did sign a contract with the SPCA , they could issue appearance tickets to dog owners that are a nuisance . It now involves a person to come into the clerks office and fill out a complaint form against the dog owner . With the appearance ticket it would not involve neighbors . Supv Cotterill reported that the Village of Dryden was not interested in any more coverage but the Village of Freeville would like more coverage . For the Town of Dryden a contract would cost the Town about $ 4 , 500 . 00 . Mr Brothers reported that . the SPCA does have a contract with the County , which only gives them the authority to pick up unlicensed dogs , or dogs chasing deer or livestock . If the dog is wearing a valid license the SPCA has no authority to seize the dog . Supv Cotterill wondered if the SPCA would be interested in enumerating the dogs for the following year ? Mr Brothers stated that they might be interested , but contact them later on in the year . 3 a HIGHWAY • Clm Metzger wondered about the possibility of getting Town of Dryden boundary signs put up in the Town . Hwy Supt Humphrey said that there would not be any problem . Hwy Supt Humphrey reported that the new truck is supposed to arrive some time this week . CORRESPONDENCE No information yet on Sapsucker Woods Rd and Hanshaw Rd intersection / Ambulance report for the State of New York Hwy Supt Humphrey was wondering about a street light erected at the intersection of G eorge Rd and Rt 38 . Supv Cotterill said if at all possible there should be a light there and to make some arrangement for one . Supv Cotterill read letter from Court Clerk Mary Bachner in regard to her resignation . RESOLUTION # 51 ACCEPT RESIGNATION FROM MARY BACHNER Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board accept the resignation of Mary Bachner . Carried • 2nd Supv Cotterill EISOLUTION # 521APPOINT SUE GENTZ FOR COURT CLERK Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that this Town Board appoint Sue Gentz , 40 Lee Rd , Dryden as Court Clerk to replace Mary Bachner effective Feb 13th , and that she be paid by voucher until the 21st of Feb . 2nd Clm Metzger Roll call vote - all voting YES RESOLUTION # 53 TRANSFER FROM SURPLUS TO COURT JUSTICE PERSONAL 1113 . 1 Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board transfer $ 181 . 50 from Surplus to Court Justice Personal 1113 . 1 2nd Clw Graham Roll call vote - - all voting YES D ISCUSSION Railroad r- o-w was tabled until next Board Meeting • RESOLUTION # 54 REAPPROVAL OF JOINT SEWER STUDY Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that this Town Board reapprove the Dryden - Freeville Village Joint Water Study with an updated figure . ( see Resolution # 197 ) 2nd Clm Metzger Carried Bolton Point - Lansing approval of joining - was tabled until the matter is checked with Atty Amdur in regard for a public hearing . Judge Newhart recommended that there be some type of emergency lighting when the power g oes off in the Town Hall . Supv Cotterill reported that the local government programiat Cornell made a study last year of matters that local government might or might not need . They have come up with schedules for Sat morning 9 to 12 on Feb 24th , March 24th and April 21st . The first session will be about insurance programs . Clm Webb reported that he would attend . Reservations have already been made for 2 representatives from the Town of Dryden . Clm Metzger said that he would try and attend the meeting . '' RESOLUTION # 55 APPROVE ANNUAL AUDIT Clw Graham offered the following resolution and asked for its adoption . RESOLVED , WHEREAS this Town Board has reviewed the several accounts of the Supervisor ' s records in compliance with the Annual Audit for 1978 , NOW THEREFORE BE IT RESOLVED , that this Town Board approve the records of the financial status of the Town of Dryden for the year 1978 2nd Clm Metzger Carried • Zoning Officer Stewart arrived about 9 : 00PM and reported 1 building permit was issued for the month of January . There was some discussion about the State Energy Conservation Code . RESOLUTION # 56 AUDIT GENERAL FUND BILLS Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that the General Fund bills be paid as audited . 2nd Clm Metzger Roll call vote - all voting YES RESOLUTION # 57 AUDIT HIGHWAY BILLS Clm Metzger offered the following resolution and asked for its adoption .
