HomeMy WebLinkAbout1978-05-11 264 ' BOARD MEETING May 11 , 1978 Minutes of the Town Board meeting held on May 11th instead of May 9th due to a power failure . Supv Cotterill called the meeting to order at 7 : 30 PM Members and guests participated in the pledge of allegiance . Roll call was by the Town Clerk . Present : Supv Cotterill , Clm Tarr Clm Metzger and Z . O . Stewart Absent : Clm Webb , Clw Graham and Atty Amdur Approval of the minutes : Motion was made by Clm Tarr and 2nd by Clm Metzger that the minutes of the public hearing and the town board meeting held on April 11th and the public hearings held on April 27th be approved as submitted . COUNTY BRIEFING - absent II CITIZEN PRIVILEGE OF THE FLOOR There was some discussion on the enforcement of the zoning ordinance . Supv Cotterill stated that he had received several complaints . If Z . O . Stewart does see a violation he should send the owners a violation letter and then let the judge take it from there . It is clear in the ordinance that you can only have 1 unlic . inoperable vehicle on your property . It is not clear as to what is considered trash or junk . The Town Board requested the Planning Board to analyze the zoning ordinance to see if the wording of trash , rubbish and junk could be clarified or a definition could be made for trash , rubbish or junk . COUNCILMAN PRIVILEGE OF THE FLOOR - nothing TOWN CLERK - $ 9245 . 24 collected in April for taxes of which $ 181 . 30 in penalty . RESOLUTION # 79 AUTHORIZE THE TOWN CLERK TO ATTEND TOWN CLERK SCHOOL AT CORNELL Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , THAT this Town Board authorize the Town Clerk to attend Town Clerk ' s school and pay expenses on June 5th and 6th to be held at Cornell . 2nd Clm Metzger Roll call vote - all voting YES ZONING OFFICER 11 building permits for the month of April . ZBOA had 3 applications for variances . 1- for a garage less than 70 feet from the road center . 2 - for a home with less than the required road frontage . 3- Town Board ' s request for sewer emergency generator in Varna . The variances were all granted . Supv Cotterill stated that the Town Board did request a variance to house the generator . Since that time he had spoken to Mr Jim Ray , who owns Taggin Waggon Trailer Park in Varna . Mr Ray had agreed to rent to the town space in his storage shed at $ 100 . 00 a year . The Town Board felt that this would be a lot better and the chance of vandalism would be less . Mr Ray has agreed to send the town a contract . RESOLUTION # 80 DELAY ACTION ON GRANTING SPECIAL PERMIT FOR BERLON JACKSON Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that the Town Board defer action to grant the special permit to Berlon Jackson until the June 13th meeting when all the board members would be present . 2nd Clm Tarr Carried ATTORNEY Atty Amdur had drawn up a dog control ordinance , for the Town Board to consider . There was some discussion and decided to have a public hearing at the June 13th board meeting at 7 : 30 PM IIIRESOLUTION # 81 DOG CONTROL ORDINANCE PUBLIC HEARING Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board schedule a public hearing for a dog control ordinance on June 13th at 7 : 30 PM 2nd Supv Cotterill Carried h .60 ✓ Clw Graham wanted to know if the permit was to be issued if it could be just for this one application as long as he was living there . Closed Public Hearing - 8 : 20 PM The Town Board deferred action on the special permit application for Berlon Jackson until their regular board meeting to be held on May 9th . RESOLUTION # 77 GRANT SPECIAL PERMIT - Robert Foote 1285 Dryden Rd ( parcel # 52 - 1- 25 . 2 ) Clw Graham offered the following resolution and asked for its adoption . RESOLVED , that this Town Board grant the special permit to Robert Foote , 1285 Dryden Rd . , parcel # 52- 1- 25 . 2 for the purpose of extending the Plantation Inn as proposed in the IIIapplication . This is in accordance with the zoning ordinance and is compatible for this area . 2nd Clm Metzger Roll call vote - all voting YES • RESOLUTION # 78 GRANT SPECIAL PERMIT - Stephen Sautter 325 Cortland Rd ( parcel # 26 - 1- 9 . 2 ) Clm Webb offered the following resolution and asked for its adoption . RESOLVED , that this Town Board finds that the proposed use will be compatible with the allowed uses ' 'in the neighborhood and the zoning ordinance which permits commercial uses on Route 13 and the health , safety and general welfare of the community will not adversely effected , grant the special permit to Stephen Sautter , 325 Cortland Rd . , parcel # 26- 1- 9 . 2 for the purpose of operating a service station equipment sales and self - service gasoline station as proposed in the application upon the following conditions : 1- that there be some type of shrubbery for screening between the property line of the Anderson property and the property in question on the building permit to be at least 20 feet from the highway . 2- that the storage tanks be at least a distance of 100 feet from the property line of the Anderson property on the north side . 3- the gasoline island has to meet the setback requirements . 4- that the buildings on the east side of the road are to be used only for storage of equipment . 5 - If there is any violation of any condition of this special permit the Town Board shall have the right to revoke the permit . 2nd Clm Tarr Roll call vote - Supv Cotterill YES Clm Webb YES Clm Tarr YES Clm Metzger YES Clw Graham NO GI-o- - 4L9At'Q---- Town Clerk Adjourned : 8 : 45 PM • • III Ci Lb p,, D RESOLUTION # 82 RESURVEY PROPERTY FOR TOWN & ARROWSMITH Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that the town resurvey the triangular portion of property needed for the town street for an amount not to exceed $ 250 . 00 . The survey will be a perimeter boundary line survey only with an indication of how far the new line is from the existing garage and will not be an occupational survey . 2nd Clm Metzger Roll call vote - all voting YES HIGHWAY SUPERINTENDENT Supv Cotterill and Hwy Supt Humphrey had shown Mr Bill Mobbs the bridge on George Rd . and the condition that it was in . Mr Mobbs wanted to know why the bridge belonged to the county , because it was not over a creek . Supv Cotterill said that according to the Town Attorney all bridges over 25 feet in length belong to the county to maintain , and that does not specify what the bridges are over . Supv Cotterill had not yet received anything in writting from the county on who ' s responsibility it was to maintain . RESOLUTON # 83 PERMIT TOWN OF DRYDEN TO REMOVE THE IIIITRACKS , GRADE AND PAVE CROSSINGS Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that this Town Board allow Hwy Supt Humphrey to remove the tracks , grade , and pave the crossings to improve the riding qualities of Stevenson Rd , Mt Pleasant Rd , Monkey Run Rd , Pinckney Rd , Kirk Rd , Ed Hill Rd , Red Mill Rd , and Malloryville Rd , under the following terms and conditions : 1- The Town will , at its sole cost and expense , remove or cause to be removed the crossing , track , and other necessary railroad appurtenances , and store the rail and other materials on adjacent railroad right - of -way . All removed materials are to remain the property of the Railroad . 2- The Town will , at its sole cost and expense , remove or cause to be removed the warning devices at the crossing indication to the highway user the presence of a rail-highway grade crossing and store the devices on adjacent railroad right - of -way . All removed materials are to remain the property of the Railroad . 3- The Town of Dryden would assume no liability for the warning devices or rail which is removed and placed on railroad right - of -way . 4- All advance warning sighs and pavement markings will be removed or obliterated by the Town at its sole cost and expense . 5- All necessary reports concerning the closing of grade crossings to rail traffic shall be made to Mr . William Galloway . BE IT FURTHER RESOLVED , with Attorney Amdurs ' s approval . 2nd Clm Tarr Carried . RESOLUTION # 84 ADVERTISE FOR BIDS ON A MAINTENANCE AND STORAGE BUILDING FOR THE TOWN HIGHWAY Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that this Town Board authorize Hwy Supt Humphrey and Clm Metzger to prepare the bids for a maintenance and storage building for the town highway . 2nd Supv Cotterill Carried RESOLUTION # 85 AUDIT HIGHWAY BILLS Clm Metzger offered the following resolution and asked for its adoption . RESOLVED , that the highway bills be paid as audited . 2nd Clm Tarr Roll call vote - all voting YES RESOLUTION # 86. AUDIT GENERAL FUND BILLS Clm Tarr offered the following resolution and asked for its adoption .
