PUBLIC HEARING # 1 - '
SEPTEMBER 13 , 1977
Special Permit - Robert Hamilton
Minutes of the following Public Hearing held by the Town Board of the
Town of Dryden on September 13 , 1977 commencing at 7 ; 30PM .
Present : Supv McCord , Clw Graham , Clm Cotterill , Clm Tarr , Clm Webb ,
Atty Amdur and Z . O . Stewart
S upv McCord read the notice that was published in the newspaper stating the
purpose of said hearing was to consider the application of a Special Permit
for Robert Hamilton , 615 Lake Rd . , Dryden , NY to convert and extend a
building at 325 Cortland Rd . for storage and office space for the sale
of sheet rock , roofing and siding .
QUESTIONS AND / OR COMMENTS
S upv McCord stated that it is an allowed use in that zone with a •
Special Permit .
Clm Cotterill wanted to know if Mr Hamilton was expecting to purchase all
t he property on the west side of the road where the house is located .
Mr Hamilton stated yes , and right now he was going to try and rent the
h ouse .
Clm Cotterill wanted to know if he was going to use the shed or garage
north of the house for storage .
Mr Hamilton stated yes and that he would be extending onto it about twice
the size that it is now .
Clm Cotterill wanted to know if there would be one or two entrances onto
t he highway .
Mr Hamilton stated 2 because he planned on a circular driveway and they
h ave to get a permit from the state before they can do anything .
Clm Cotterill wanted to know if there was going to be any water or
sewage involved with the permit .
Mr Hamilton stated that at this point he had plans , but wanted to get the
Special Permit before he went to the Health Dept .
Clw Graham wanted to know if the business would be open to people of all ages .
Mr Hamilton stated that it would be .
Mr Cliff Todd stated that he had no objection to the business as such but he
d idn ' t want it to devalue his property . It was zoned residential - agricultural .
S upv McCord stated that it was basically agricultural zoned .
Mr Todd wanted to know if this business was considered agricultural .
S upv McCord stated that it was not .
Mr Todd was concerned about how close Mr Hamilton would be com :i;ng to his
property line , what restrictions would be done about outside storage .
Mr Hamilton stated that was why he was going to build a big warehouse so
that he could store everything inside . There would be no equipment
stored outside .
Clm Webb wanted to know if he objected to stating business hours in the
permit .
Mr Hamilton said no , but he personally kept odd hours for himself .

REVENUE ANTICIPATION
NOTE RESOLUTION
SECTION 1 . The Town Board of the Town of Dryden hereby
authorizes the issuance of a revenue anticipation note in an
amount not to exceed $ 7 , 620 . 00 .
` SECTION 2 . Such note shall be issued in anticipation of
the collection and receipt of revenues , other than real estate
taxes or assessments , specifically revenues , including water
rents , from the sale and distribution of water to consumers in
the Town of Dryden , Water District # 1 ( Varna ) in said municipality ,
which are due and payable in and for the fiscal year 1977 .
SECTION 3 . The full faith and credit of the Town of Dryden
is hereby pledged to the punctual payment of and interest on any
and all notes issued pursuant hereto .
SECTION 4 . The power to authorize the issuance of and
execute the above note , including any renewal of such note , is
hereby delegated to the Chief Fiscal Officer of the Town of Dryden .
Such note shall be of such form , contents and terms and shall be
sold in such manner as may be prescribed by said Chief Fiscal
Officer , but subject to the provisions of this resolution and con -
sistent with the provisions of the Local Finance. Law .
SECTION 5 . This resolution shall take effect immediately .

Revenue Anticipation Note of the To of Dryden in the County of
Tompkins , New York
NO . 1
The Town of Dryden in the County of Tompkins , State of New
York , hereby acknowledges itself indebted and for value received
promises to pay to the bearer of this note , or if it is to be
registered , to the registered holder of the note , the sum of
$ 7620 . 00 on the day of , 1978 , together with
the interest thereon from the date hereof at the rate of Six ( 6 )
Per Centum per annum , payable at maturity . Both principal of and
interest on this note will be paid in lawful money of the United
States of America at the Tompkins County Trust Company , Ithaca ,
New York .
The Town of Dryden reserves the right to prepay this obli -
gation in full or in part and thus to redeem this note in full or
in part at any time without notice . Interest shall be due and
payable only on unpaid principal .
1 .. This note is the only note of an authorized issue in th •
amount of $ 7620 . 00 . .
2 . This note is issued pursuant to the certificate of the
Chief Fiscal Officer of the Town of Dryden , dated September , 197 ' ,
filed with the Town of Dryden .. . The authority to issue this note
or series of notes was delegated to the Chief Fiscal Officer of
the Town of Dryden pursuant to the provisions of a resolution
entitled " Revenue Anticipation Note Resolution " , duly adopted by
the Town Board of the Town of Dryden on September , 1977 .
3 . The faith and credit of the Town of Dryden are hereby
irrevocably pledged for the punctual payment of the principal of
and interest on this note according to its terms .

4 . It is hereby certified and recited that all conditions
and acts and things required by the Constitution and the statutes
of the State of New York to exist , to have happened and to have
been performed precedent to and in the issuance of this note ,
exist , have happened and have been performed , and that this note ,
together with all other indebtedness of the Town of Dryden is
within every debt and other limit prescribed by the Constitution
and laws of the State of New York .
5 . IN WITNESS WHEREOF , the Town of Dryden has caused this
note to be signed by its Supervisor and Chief Fiscal Officer and
its corporate seal to be hereunto attached and attested by its
Town Clerk and this note to be dated as of the day of
1977 ..

AUTHORIZING ISSUANCE OF REVENUE
ANTICIPATION NOTES
Section 1 . This certificate is executed pursuant to the
authority granted to me by the Town Board of the Town of Dryden .
Section 2 . I authorize the issuance of a Revenue Anticipa -
tion Note in an amount not to exceed $ 7620 . 00 .
Section 3 . Such note is issued in anticipation of the
collection of revenues other than real estate taxes or assessments
the specific type of revenues being the revenues derived from the
sale to consumers of the Town of Dryden , Water District # 1 ( Varna )
of water from the Southern Cayuga Lake Intermunicipal Water Projec , . ,
including revenues designated as water rents , which are due and
payable for the fiscal year 1977 .
Section 4 . The note which is issued shall be due and pay -
able not later than one year from the date of issue and such note
shall be sold at either public or private sale at the best inter -
est obtainable by me provided that the interest does not exceed
any limitation imposed by law .
Section 5 . According to the budget adopted by the Southern
Cayuga Lake Intermunicipal Water Commission , it is estimated that ;
the uncollected revenues , against which this note is authorized
to be issued , are $ 7 , 620 . 00 on an annual basis , of which the sum
of $ 7 , 620 . 00 remains to be collected for the fiscal year 1977 .

PUBLIC HEARING # 2
Special Permit - Lynn Schenck
Supv McCord read the notice that was published in the newspaper stating
the purpose of said hearing was to consider the application of Lynn Schenck
18 Old Dryden Rd . to operate a lawnmower repair shop at 18 Old Dryden Rd .
QUESTIONS AND / OR COMMENTS
Mrs Lynn Schenck was wondering in the ordinance , what was the difference
between the home occupation and what they were applying for . Do they need
the Special Permit ? Supv McCord stated yes to operate a commercial business .
Atty Amdur stated that fixing lawnmowers was not considered a home occupation .
If you have a real estate , doctors , lawyers or hairdressers office , something
:
o f that nature and you live on the premises but if you are using your garage
. for repairs of equipment or small repairs she would consider that to require
a special permit . Clm Cotterill stated that a home occupation is entirely
w ithin the residence where you live not in any outside building . Someone that
does typing commercially in their home . Atty Amdur stated that they have
specified hairdressing , tailoring , teaching , carpentry , electrical and
plumbing work . Professional offices , doctor , lawyer , architect and licensed
✓ eal estate brokers . Clm Cotterill wanted to know if they just do work in
their garage and if he repaired any small engines not just lawnmowers .
Mr Schenck stated lawnmowers , chain saws , snowblowers , any small engines were
✓ epaired in his garage . Clm Webb wanted to know if he objected to stating
business hours in the permit . Mrs Schenck stated that they wouldn ' t object
and they would post them where people could see them because they come at
o dd times for repairs .

Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk
Present : Supv McCord , C1w Graham , Clm Cotterill , Atty Amdur ,
Clm Webb , Clm Tarr and Z . O . Stewart .
Motion was made by Clm Cotterill and 2nd by Clm Tarr that the minutes of
the Public Hearing and Board Meeting held on August 9th and Special Meeting
o n August 16th 1977 be approved as submitted .
COUNTY BRIEFING - Absent .
CITIZEN PRIVILEGE OF THE FLOOR - nothing

C1w Graham wanted to know if it would be possible to include tax map
n umbers on legal notices for public hearings .
RESOLUTION # 103 APPOINT PLANNING BOARD MEMBER
C1w Graham offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board appoint Deborah Levin to the Town Planning
Board to replace Michael Proulx , who ' s term expires in 1979 .

S upv McCord offered the following resolution and asked for its adoption .

There was some discussion about the town road where Crystal Drive and
S outh Knoll Drive connect at the top of the hill . The question being ,
d eeding the turn around from the town back to the Cotterill property and
also getting a deed from Mr William Wood for a corner section of his
property to follow - a line along the section of the road -
RESOLUTION # 105 SOUTH KNOLL & CRYSTAL DRIVE
S upv McCord offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board authorize Attorney Amdur to engage George
S chlecht to survey and draw up legal description of the corner of the
William Wood property and turn around area and corner of the road .

RESOLUTION # 106 APPOINT DEPUTY TOWN CLERK
Cim Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board appoint Kathleen Roberts as Deputy Town
Clerk to be paid in a range not to exceed $ 2 . 50 per hour .

RESOLUTION # 107 APPOINT ELECTION INSPECTOR
Clm Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board appoint Betty House as a Democrat election
inspector in Dist . # 9 for the term 7 - 1 - 77 to 6 - 30 - 78 at the rate of
$ 2 . 30 per hour .

Reported 23 building permits . ZBOA held 4 hearings . Denied Mr Black from
Dryden Rd for a commercial garage because it is in a RB - I zone . Granted
Mr VanArkel a variance for a carport ; Mr Cranell a garage and mudroom ,
and the Love Inn for a sign for the purpose of identification of their
parking lot . $ 230 . 00 building permits $ 75 . 00 Special Permits and
$ 100 . 00 ZBOA hearings .
The Town Board requested the Planning Board to review the clarification
of swimming pool language .

Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board grant Robert Hamilton the special permit
to convert and extend a building at 325 Cortland Rd . for storage and
o ffice space for the sale of sheet rock and siding with the restriction
o f operating hours for business from 7 AM to 6 PM - 6 days a week , Mon
thru Sat . Some type of shrubbery between the Hamilton and rodd property .

the Town Board hears the decission from the court on commercial use in
that area .
