FEDERAL REVENUE SHARING
VARNA COMMUNITY CENTER
JULY 12 , 1977
Minutes of the following Public Hearing held by the Town Board of the
Town of Dryden at Varna Community Center on July 12 , 1977 commencing
at 7 : 30PM . Present : Deputy Supv Cotterill , Clw Graham , Cim Webb ,
Atty Amdur and ZO Stewart . Absent : Supv McCord and Clm Tarr
Deputy Supv Cotterill read the Public Hearing notice that was published
in the newspaper stating the purpose was to consider revenue sharing funds .'
QUESTIONS AND / OR COMMENTS
411 1 Wanted to know what the Revenue Sharing money could be used for .
Clm Cotterill stated that the town was restricted on the way the money
was to be spent and this was the first year that the state required a
public hearing . In the past the town could use the Federal money at the
towns discreation that was allowed by Federal Law .
2 Wanted to know the criteria for Senior Citizen with the Federal Rev .
money . Atty Amdur reported that there is a corp . for Senior
Housing . There is an option on property in the Village of Dryden . The
housing will be available to evpNone in Tompkins County .

ROGER BENNETT & ROBERT WING SR
OPERATE AUTO REPAIR SHOP
Deputy Supv Cotterill read the notice that was published in the newspaper
stating the purpose of said hearing was to consider the application of
Roger Bennett and Robert J Wing Sr , 700 Wood Rd . to operate an Auto Repair
Shop at 258 Bone Plain Rd . , Freevil & e , NY
QUESTIONS AND / OR COMMENTS
Clm Cotterill read a letter from George Guest of the Health Dept stating
that no sewage or waste disposal is needed at this time . An application
has been filled out for a sewage system to handle sewage , wash water
and floor drains .
Clw Graham wanted to know if there would be a sign . Mr Bennett said yes
there would be a sign which he has applied for from NYS . Mr Peter Curtiss
wanted to know if there would be any screening or fencing . Mr Bennett
said that they are back 250 ' from the road and anything he would be doing
would only be about a 1 or 2 week project . There are trees and shrubbery
on the property now .
Cim Cotterill wanted to know how many unlic or unreg vehicles there would
be on the property or just cars to be repaired . Mr Bennett said that they
would be customer cars that needed repair work . Clm Cotterill wanted to
know how long a car would be there for repair . There was some discussion
and it was felt that 15 to 30 days would be the limit for a car . Clm
Cotterill wanted to know if there would be any cars stored that they would
• take parts from . Mr Bennett said there would not be any cars like that .
Clw Graham wanted to know if there was any objection from the adjoining
property owners . Clm Cotterill said that all property owners were notified
of the hearing .

JULY 12 , 1977
Minutes of the Board meeting held by the Town Board of the Town of Dryden
at Varna Community Center commenced at 8 : 05PM
Called to order by Deputy Supv Cotterill
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk
Present : Clm Cotterill , Clw Graham , Atty Amdur
Clm Webb and ZO Stewart
Absent : Supv McCord and Clm Tarr
Motion was made by Clm Webb and 2nd by Clw Graham that the minutes of •
the Public Hearing and Board Meeting held on June 14th and Special
Meeting held on June 26th be approved as submitted .
COUNTY BRIEFING - Absent
CITIZEN PRIVILEGE OF THE FLOOR
Mr Reed inquired about the possibility of making Mt Pleasant Rd one - way
down from Turkey Hill Rd to Route 366 . Atty Amdur said that he would
have to get a petition from the people in that area and bring it to the
Town Board for their endorsement to send it to the county .
COUNCILMAN PRIVILEGE OF THE FLOOR - Nothing
ATTORNEY
Atty Amdur reported that she had received a decision from Judge Lee on
the Adult Book Store and stated that the Town of Dryden was entitled to
a preliminary injunction . Atty Amdur has sent the order to the -ergo & ve-
and is waiting for the order to be received before it can be enforceable
Clm Webb wanted to know more about the closing of the Book Store .
Atty Amdur put a clause in the order which she hopes Judge Lee will
sign to the effect that she will be able to go to any authorized law
enforcement agency to enforce the order without making any further
application . Thts would work with the out of state corp . All principals
are out of state except the person that is employed at the store .
Keiths Pool Town property is now cleaned up and looks nice .
Atty Amdur received a letter from DEC regarding property that was sold
to them from the Town of Dryden which stated there was a bus on the
property that was appraised at $ 400 . 00 , which didn ' t belong to the
Town of Dryden and the town was unjustly- enriched to that amount of
money . The state would like the money returned . Atty Amdur spoke with
Mr Karsch Jr stating that the Town never gave DEC a bill of sale for
anything on wheels and it is not considered a permanent fixture and was
not included in any of the appraises . Mr Karsch Jr apologized that it
was their attorneys mistake and the bus was not included in the
appraisal and the town was not unjustly enriched .
Atty Amdur also had received the new revised contract from Bolton Point /411
RESOLUTION # 90CREVENUE ANTICIPATION NOTES
FOR SOUTHERN CAYUGA LAKE
INTERMUNICIPAL WATER COMMISSIOP
Clm Webb offered the following resolution and asked for its adoption .
RESOLVED , that the Chief Fiscal Officer of the Town of Ithaca is hereby
authorized to borrow , on behalf of the Towns of Lansing , Ithaca , and
Dryden , and the Villages of Cayuga Heights and Lansing , on Revenue
Anticipation Notes , a sum not to exceed $ 330 , 000 , only as needed , for
a period of one year , for the purpose of paying retainage due contractors
between now and December 7 , 1977 , under the 5 % retainage provision of the
contracts , the need for such borrowing arising out of ( 1 ) loss - of water
revenue due to late start - up of the system , ( 2 ) the 7 . 8 % interest due
February 10 , 1977 on second year Bond Anticipation Notes of $ 8 , 000 , 000
and ( 3 ) principal and interest payment due August 15 , 1977 on $ 7 , 000 , 000
bonds .

ZONING OFFICER
24 building permits for the month of June . ZBOA held 2 hearings and
granted variance to Mrs Van Pelt on Ringwood Rd and Mr Gary Parker
from Ringwood Rd . Gave letter to the Town Board concerning Frank Robinson .
property . There was some discussion .
Requested to take the last week in July for vacation .

concern 2nd class towns . This does not apply to the Town of Dryden .
Letter from the County Health Dept regarding the discontinuing of service
of sewer and water approval on transfer of property of home buyers .

HIGHWAY SUPERINTENDENT - Absent
Mr Munch from Varna reported that he had called the Highway Supt . several
times to see if the ditch could be cleaned out on Freese Rd since the
flood last year between Rt 366 and the bridge . He reported that the
sluice is not the same size that is under the main highway and it just
cannot handle all the water . Clm Cotterill said that he would contact
the Highway Supt about the ditch .

Clm Cotterill offered the following resolution and asked for its adoptton .
RESOLVED , that the Highway Bills be paid as audited .

Clw Graham offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board allocate- Transportation - Operation - $ 7500 - Equip
Capital outlay - $ 30 , 000 - Total $ 37 , 500 . Culture - Rec . - Varna : - Equip - Capital
outlay $ 3500 Etna - Equip Capital . outlay $ 4 ,. 000 Total $ 7500 . Home Community
Services - Senior Citzen Center Equip - Capital outlay $ 5 , 000 Total - $ 5 , 000
Grand Total $ 50 , 000 .

RESOLUTION # 94 GRANT SPECIAL PERMIT
Cim Webb offered the following resolution and asked for its adoption .
RESOLVED , that this Board grant a Special Permit to Roger Bennett and
Robert Wing Sr with the following stipulations . 1 - Mon thru Fri 8 AM to
6 PM - Sat 8 AM to 12 Noon . 2 - Not open on Sun . 3 - Limit to customer cars
only . 4 - No car shall be kept no longer than 30 days . 5 - Premises should
be kept in an orderly fashion .

PUBLIC HEARING
HOUTZ HALL , ETNA , NY
SPECIAL PERMIT TO OPERATE A RESTAURANT AND
GIFT SHOP - Francois Carlo Boeres
August 9 , 1977
Minutes of the following Public Hearing held by the Town Board of the
Town of Dryden at Houtz Hall , Etna , NY on August 9 , 1977 commencing
at 7 : 30 PM . Present: Supv McCord , Clw Graham , Clm Cotterill , Clw Tarr ,
Clm Webb , Atty Amdur and ZO Stewart .
Supv McCord read the notice that was published in the newspaper stating
the purpose of said hearing was to consider the application of a Special
Permit for Mr Boeres to build a restaurant and gift shop on Rt 13 north
o f Dryden between Rt 13 and the Old Dryden Rd .
QUESTIONS AND / OR COMMENTS
Mr Donald McKee showed the Town Board a blue print of the proposed
✓ estaurant and gift shop and museum . Mr Boeres runs L ' Auberge Alpine
Restaurant in McGraw . The blue print legend 1 - = Restaurant and lounge
100 seats , front and rear porch , split level 2 - Snack Bar and Gift Shoppe
3 - Covered eating area 4 - Covered display area ; antiques and carriages
5 - Blacksmith Shop 6 - Existing barn , remodeled into museum for old farm
implements 7 - Antiques , wood burning steam boiler 8 - Court yard with
brick pavers , gat lights and well 9 - Existing farm shed .
Clw Graham wanted to know who owned the property south of the proposed
✓ estaurant . ZO Stewart stated Armando Natale .
Mr McKee stated that he thought that it would be more of a tourist
✓ estaurant with European Style . A main restaurant , the L - shaped would be
w here people could get ice cream or hot dog . In the old existing barn
w ould be a blacksmiths shop and display area . The property is 3 . 7 acres .
Clw Graham stated this wasn ' t just a restaurant and gift shop as stated
in the Public Hearing notice and permit applied for .
Mr Schenck wanted to know the entrance and exit to the restaurant .
Mr Julian stated he owns property in Dryden and Virgil and about 3 years
ago he went to a Town Board meeting in Virgil . Mr Muncey , the Town Highway
Supt . informed the property owners living on the old Dryden Rd that
e ventually the road between Mr Schenck ' s house and Rt 13 would be abandoned
because it would hot be feasible to repair . Clm Cotterill asked Highway
Supt . Humphrey who maintained that portion of the road . Mr Humphrey stated
that the Town of Dryden maintanied the road . Mr Julian said the reason the
question came up was that the property owners were getting 2 different
towns for snow removal service . Mr Muncey said they might as well get used
to Virgil because the Town of Dryden was going to abandon that section of
the road . Mr Julian wanted to know if this was true . Supv McCord stated as
far as he knew it was not going to be abandoned .
Mr Boeres stated that he had a nice clientel with no roughness , because
he would not tolerate such a thing to happen . He stated that it would be
like a Museum Village with a Blacksmith Shop , and Wagon Shed . The
✓ estaurant would serve from 75 to 95 people . Clw Graham wanted to know •
if there would be a bar . Mr Boeres said there would be a service bar .
He felt that the restaurant would be a compliment to the community .
Mr Honan wanted to know if he would have musical type entertainment .
Mr Boeres said no that he had not given it any thought at this time .
He felt this type of musical entertainment is not very profitable in
this type of restaurant . Mr Honan wanted to know the hours that his
✓ estaurant would be open . Mr Boeres stated from 11 : 00 AM to 11 : 00 PM
Mr Schenck thought the Old Dryden Rd was very narrow and not well maintained .
Clw Graham wanted to know how this would be advertised . Mr Boeres
said only by word of mouth and no advertising at the moment .
Mr Julian was very much concerned becaused there ,areihbout 30 children
in this area and felt that there would be an increase in traffice to this
✓ estaurant . This is why the residents in the area have moved for the safety
