LOCAL LAW # 1
Minutes of the Public Hearing held by the Town Board of the Town of
Dryden at the Town Hall May 10 , 1977 commencing at 7 : 30 PM
Supv McCord read the public notice that was published in the newspaper
stating the purpose of said hearing was to consider Local Law # 1 for the
year 1977 concerning written notification of defects and obstructions
o n town highways and sidewalks in the Town of Dryden .
Present : Supv McCord , Clw Graham , Clm Webb , Clm Tarr , Clm Cotterill
Z . O . Stewart and Atty Amdur .
Questions and / or comments . .
® Supv McCord stated that it is a local law providing for a written
n otification of defects and obstructions on town highways and sidewalks
in the Town of Dryden . This insures that if a pothole developes in the
town highway an individual can write to the highway supt . and they are
then officially on notice to take action to fix it within a certain
length of time . Without the written notice the town does not assume
liability for every pothole in the road .

Minutes of the Board Meeting held by the Town Board at the Town Hall
commencing at 7 : 45 PM on the 10th day of May 1977
Called to order by Super McCord
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk

Present : Supv McCord , Clw Graham , Clm Tarr , Clm Webb
Clm Cotterill , Atty Amdur and Z . O . Stewart
Motion was made by Clm Cotterill and 2nd by Clm Tarr that the minutes 1
o f the Board Meeting held on April 12 , and Public Hearing held on
April 26th 1977 be approved as submitted .
COUNTY BRIEFING
County Rep Watros reported on the dead animals along the highways .
Also reported on the abandonment of the LVRR between Freeville and
Cortland . 1 . - Farmers would like to see the land revert back to the
landowners so that they can eliminate the e $ ankment and till the land .
2 . - Recreational environmentalists would like to see bike trails and
hiking paths developed along the right - of - way . 3 . - Proposal from
Jim Frye that the right - of - way be utilized for a scenic railroad . These
are the 3 proposals before the county at this time .
Reported on SEQR as to how the county will handle the matter . The County
0 held a public hearing on a proposal presented by the planning and public
works committee . It has set forth policies which the county would proceed
in reviewing various projects . Class 1 action which is considered a major
IIproject such as an airport or a major disposal facility . These are listed
in the policy . Class 2 action would be anything other that is not listed,
as a Class 1 action which would not have a serious effect on the environment .
The County has delayed action for 2 weeks .
CITIZEN PRIVILEGE OF THE FLOOR
Anne Jones chairman of the Human Services Coalition was present to make
a request from the Dryden Town Board for $ 492 . 00 in the 1978 Budget .
Mrs Jones left information about the coalition with the board members .
Briefly . reported that the coalition reviews for the county and city all
the revenue sharing requests . Methods of keeping track of how people do
things and how people spend money and keep track of those who require
services and to g et this across to the agencies in the committee . There

are duplications of services but ' ° there are ways of combining services
which in the end would produce more service for the person who is on the
far end of the line . Elizabeth Orbach reported on the work that is currently
being done by the coalition . They feel that they are keeping tabs on
Human Services in Tomp . Co . They are trying to save the taxpayers money
by reviewing all the Human Services proposals that go to the city and
county and the United Way . To date the coalition has recommended against
these funders funding $ 393 , 000 worth of proposals . They have catergorized
and looked at all of the services that are being provided for in the
150 agencies . They are studying to see where duplications exists . The
e xecutive committee will finalize the first half next month , recommending
w here some 5 or 6 duplications exists . They have estimated that if
these were to be consolidated there would be an approximate savings
of about $ 65 , 000 . Ciw Graham wanted to knew if all the agencies were
funded by government money . Mrs Jones said that they are not all funded
by government money . The Coalition is working with 3 agencies , all of 40
w hom receive funds from the United Way , school dists , county and city .
In some cases they receive all their money from the government .
BarbanfLauber who lives at Riverside Manor Development in Freevillg ,
stated that there were now 10 houses in the development , 8 of which are
o ccupied . Mrs Lauber wanted to know the procedure to get their road paved .
Supv McCord sa $ d that by coming to the board meeting she had automatically
contacted the highway . Hwy Supt . Humphrey said that their road was on the
agenda and should be done in the next 3 . to 4 . weeks weather permitting .
Mrs Mastudaira gave a progress report on the Busy Bus . They started out
with running the Busy Bus on a full time basis but found that a part - time
3 day a week was puttIAg their money to better use during the winter months
and during the summer will work on a full time basis . They plan to stop
at Montgomery Park , W Dryden Comm Center , FreevillcP . O . or Freeville School ,
and the trailer parks . Mrs Mastudaira also showed the board members
some slides .
COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Tarr - nothing
Clm Webb wanted to know if Z . O . Stewart knew about a clam working over
in Fall CredR Z . O . Stewart said that he didn ' t , but would check on it .
Clm Cotterill requested that the Town Board go on record to request an
investigation that the cable be checked for meeting engineering standards
from Cortland to Dryden . There was much discussion .
RESOLUTION # 75 CHECK ON CABLE FROM CORTLAND TO
DRYDEN
Clm Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board send a letter to ' the State Cable Commission
stating that it has been alleged that the standards of the cane from
Cortland to Dryden does not meet proper engineering standards and would
like to have it checked and report to the Town Board . Also send the Town
Board a list of the specifications .

Supv McCord asked Clm Cotterill to draft a letter to the State Cable
Commission and send a copy of the letter to Sammons Communication . 411
Clw Graham wanted to know if there had been a meeting yet with the
Dryden School on the bling light . Also wanted to know if the Town
Clerk had heard from NYSDOT concerning the creek near NYSE & G . Wanted
to know the board members feelings about Tomp . Co . Hospfital becoming
a voluntary operation instead of government .

ATTORNEY
Atty Amdur reported that she had sent a copy of a letter to Supv McCord
that she had sent to Judge Lee , also gave a copy to the Town Clerk to
keep on file . Atty Amdur is waiting to hear from Judge Lee on his
decision on the Adult Book Store .
Also received permits on the 216 proposal which have to be signed by the
property owners . Z . O . Stewart will have to get the permits signed . Also
have to make application for permits from DEC .

RESOLUTION # 76 AUTHORIZE SUPV MCCORD TO
EXECUTE DEC PERMITS DUE TO
FLOOD DAMAGE
Clm Cotterill offered the following resolution and asked for its adoption . I
RESOLVED , that the Board authorize Supv McCord to execute DEC permits which '
may be required for repair of flood damage .

Reported on Keith ' s Pool Town . May 11th was the last day that Mr Lanphear
had to clean the property up . If it is not , the town has the right to start ;
with the clean up procedure . Atty Amdur said that if it can be done for
under $ 3500 it does not have to be put out for bid . After much discussion j
the Town Board empowered Hwy Supt Humphrey to handle the situation for under.
$ 35001, 00 . Atty Amdur left the order from Judge Bryant with the Town Clerk .
RESOLUTION # 77 LOCAL LAW # 1 FOR THE YEAR 1977
0 Clm Cotterill offered the following resolution and asked for its adoption .
RESOLVED , that the Town Board adopt Local Law # 1 for the year 1977 ,
providing for written notification of defects and obstructions on town
highways and sidewalks in the Town of Dryden .
BE IT ENACTED by the Town Board of the Town of Dryden as follows :
Section 1 . No civil action shall be maintained against any town
o r town superintendent of highways for damages or injuries to person or
property sustained by reason of any highway , bridge or culvert being
defective , out of repair , unsafe , dangerous or obstructed unless written
notice of such defective , unsafe , dangerous or obstructed condition of
such highway , bridge or culvert was actually given to the town clerk or
town superintendent of highways , and there was a failure or neglect within
a reasonable time after the giving of such notice to repair or remove the
defect , danger or obstruction complained of ; but no such action shall be
maintained for damages or injuries to person or property sustained solely
in consequence of the existence of snow or ice upon any highway , bridge
o r culvert , unless written notice thereof , specifliing the particular place , ]
was actually given to the town clerk or town superintendent of highways
and there was a failure or neglect to cause such snow or ice to be
✓ emoved , or to make the place otherwise reasonable safe within a
✓ easonable time after the receipt of such notice .
Section 2 . The town superindentent of highways shall transmit in
writing to the town clerk within five days after the receipt thereof all
written notices received by him pursuant to this local law and subdivision
2 of section 65 - a of the Town Law . The town clerk shall cause all written
notices received by her pursuant to this local law and subdivision 2 of
section 65 - a of the Town Law , to be presented to the town board within
5 days of the receipt thereof or at the next succeeding town board
meeting whichever shall be sooner . .
Section 3 . This local law shall supersede in its application to the
Town of Dryden subdivisions 1 and 3 of section 65 - a of the Town Law .
Section 4 . This local law shall take effect immediately upon its
filing in the office of the Secretary of State in accordance with the
provisions of section 27 of the Municipal Home Rule Law .

ZONING OFFICER
Reported 17 building permits $ 170 in permits , ZBOA 2 hearings $ 50 and
$ 25 for special hearing .
ZBOA granted a variance to Mr Baldwin in McLean for an addition to his
house . Also granted a variance to . Mr Werninck for a storage building on
Route 366 across from Bloom ' s Nursery .
HIGHWAY SUPT . .
Wanted to set a date with the board members for a tour of the town roads .

CORRESPONDENCE
NYSDOT regarding requests for speed changes .
Letter from Genung Circle residents regarding repair of the road /
Letter from James Lyon requesting the Town Board to check on the
Planning Board ' s request for the Health Dept . to check on the North Wood
Rd and West Dryden Rd area for possible violations which had been indicated
to the Planning Board at a mobile home meeting . Supv McCord requested
Z . O . Stewart to contact the Health Dept . to see if they have checked that
area for violations and to report back to the Town Board .

of court cases .

RESOLUTION # 78 ADVERTISE BID FOR ROAD SWEEPER '',
Clw Graham offered the following resolution and asked for its adoption .
RESOLVED , that the Highway Supt . be authorized to advertise for bids for
one used three wheel street sweeper not to exceed $ 15 , 000 . 00 .
