HomeMy WebLinkAbout1976-06-08 114 PUBLIC HEARING JUNE 8 , 1976 AMENDMENT TO CABLE TV FRANCHISE Public hearing was called to order by Sypv . McCord at 7 : 30 PM . Suov . McCord read the public hearing notice which was for the amendment of a franchisewith S mmon Communications . Vice Pres . Mark Weber gave each board member a laown Map which showed where service was now in operation and the proposed area for cable service . Mr . Weber stated that extension would be made to the Route 38 and Beam Hill Rd area 6 months from the datecthat the amended franchise was adonted . 2 Clm Cotterill was still upset with the amount of time that it takes to get any response from Sammons Communication , which was from Sept ' 75 until May ' 76 on whether or not it would be feasible for an area to be serviced for cable TV . Mr Weber spoke about certain areas that are not feasible but he did not give the Town Board a good reason whp it should 41) take so long for an answer , but with the new franchise things should be much better . Mr . Weber did state that he had a slide rule figure for an installation charge The cost was $ 6 , 000 . 00 per mile for service to 30 homes . That would mean each home would be $ 200 . 00 , in the meantime if more new customers over the original 30 in that 1 mile area the customers would get a refund in the installation charge over a period of 5 years from the company . QUESTIONS : Lynn ; Wright from the Pleasant View Trailer Park wanted to know when he could expect cable service to his trir pk . Mr Weber could not give him a definite answer as to when . Supv . McCord closed the public hearing at 7 : 55 PM Town Clerk PUBLIC HEARING JUNE 8 , 1976 SPECIAL PERMIT - Merle " Ploss Public hearing was called to order by Supv McCord at 8 : 00 PM . Supv McCord read the public hearing notice which was for the removal o f gravel from Mr . Ploss ' s property . Mr . Ploss was the only one present for the permit . Neither the contractor n or anyone to represent the contractor was present . Mr . Ploss stated that the contractor wanted to remove 15 , 000 yards of gravel from his property . o n Rt 38 and Peruville Rd . • Clm Cotterill wanted to know if this was going to be done from year to year or just this one time . Mr . Ploss did not have with him which he had to file with the Town Board a statement of the proposed work , together with a sketch map showing a plot plan showing existing grades and contours and the grades and contours after the operation has been completed . He also did not have a bond with the Town Clerk in an amount sufficient in the opinion of the Town Board to secure the performance of the agreement . Supv McCord closed the public hearing at 8 : 10 PM ) Town Clerk 115 PUBLIC HEARING JUNE 8 , 1976 VARNA COMMUNITY CENTER SPECIAL PERMIT - Boyd Bennett Public hearing was called to order by Supv McCord at 8 : 15 PM Supv McCord read the public hearing notice which was for the purpose o f Mr . Bennett to operate a small engine repair shop ( 1 & 2 cylinder , engines ) . QUESTIONS : Clm Cotterill wanted to know what Mr Bennett met by : a small engine repair ~ - shop . Mr Bennett said 1 and 2 cylinder engines and also wondered if his o wn family could work on their own cars there . 1 Clm Graham wanted to know if he was going to erect a sign . Mr . Bennett said not right away . . 410 Letter was received by the Town Board from Mr & Mrs McNally of 467 W Dryden Rd not o } posing the small engine business for a retired person . Mr & Mrs Coon from 481 W Dryden Rd complained about the noise going o n now at the place of residence , with unlic vechicles bei; rigi driven up and down the road , loud TV noise late at night and working on one car for 45 days straight with a transmission overhaul . Supv McCord stated that the Town Board could do nothing about the noise or working o n his own car as long as he wasn ' t getting paid for the work . The situation would have to be worked out between them or the law enforcement . Mr Roberts from W Dryden Rd did not oppose the small engine repair shop but wanted to know if he would be working on motorcycles or snowmobiles and wondered if a time limit would be set for the operation of the business . Mr Aiken from 496 W Dryden Rd did not oppose the small engine business stating it was nice for a retired person to do . Supv McCord closed the public hearing at 8 : 25 PM _)L ocattn-L-L_ Town Clerk TOWN BOARD MEETING VARNA COMMUNITY CENTER JUNE 8 , 1976 Sunv McCord called the Town Board . Meeting to order at 8 : 30 PM at the Varna Community Center . Roll call was by the Town Clerk Present : Supv . McCord Clm Graham . Clm Cotterill Clm Webb III . Clm Tarr Atty Amdur Z . O . Stewart Motion was made by Clm Graham and 2nd by Clm Tarr that the Town Board Meeting minutes he annroved as submitted , from the May 11 , 1976 meeting . Carried COUNTY BRIEFING - Nothing to report CITIZEN PRIVILEGE OF THE FLOOR Richard Kibel from 383 Ferguson Rd , Dryden presented the Town Board with a petition to lower the speed limit from 55 MPH to 30 MPH and enforce the speed , on Ferguson Rd from Yellow Barn Rd . to the Dryden Village limits . He stated that Ferguson Rd appears to be a short cut to and from Rt . 13 to avoid the Village of Dryden 1 1 I 1 116 Cim Webb stated that there are still a lot of roads in the Town of Dryden - that the speed is to fast for the condition ' f the road . RESOLUTION # 82 REDUCE SPEED AND ENFORCE ON FERGUSON RD FROM YELLOW BARN RD TO THE DRYDEN VILLAGE LIMITS . Clm Cotterill offered the following resolution and asked for its adoption . RESOLVED , that this Town Board of the Town of Dryden request that the Department of Transportation investigate and recommend that the speed limit from Yellow Bard Rd to the Dryden Village 1 *thits on Ferguson Rd be lowered from 55 MPH to 30 MPH , and enforced . 2nd Cim Tarr Carried Eleanor Church from Varna wondered if there was any money left over from the Federal Revenue Sharing . Supv McCord told her if there was any the Town had it earmarked for the Town Highway Dept . because they needed new insulation and a cement floor in the garage . COUNCILMAN PRIVILEGE OF THE FLOOR Clm Cotterill presented the Town Board a list of the roads in the Town that Highway Supt . Humphrey had gone over and intends to improve weather permitting and if there is enough money . Also an inventory of the e quipment and the condition of such with the addition of the 2 new trucks that were just purchased . Clm Graham reported that she has not had any luck with finding 2 ✓ eplacements for the Planning Board . She had contacted 2 people . and 1 had declined . She also attended Grievence Day for 2 hours . Clm Webb had talked with Bill Bailey and said the fireman that was injured would be getting paid . Clm Tarr - nothing ATTORNEY Atty Amdur stated that shehhad gotten in touch wih Mr Cerracche on the expansion policy and as of yet he had not submitted the policy to the NYS Comm . but if any customer wanted an ~ extension to let them know . Also she drew up an Ordinance for removal or repair of unsafe or collapsed buildings and / or structures . The Town Board set up a Public Hearing date for June 29th at 7 : 30rPM in the Town Hall to adopt the proposed ordinance . Atty Amdur drated a letter for the Subdivision Ordinances and Zoning Ordinances which will give to the Town Clerk to mail out . Atty Amdur received a letter from Consolidated Gas Corp . stating that they are self insured on their jobs that they do . TOWN CLERK Reported that there would be a Tomp Co . Municipal Official ' s Assoc . meeting on June 23rd at Sylvan Hills with dinner at 7 : 00 PM and wanted to know who would be going . ZONING OFFICER 20 Building permits issued . Z . O . Stewart wanted to know ff a Special • Permit would be required for Bernard Cornelius to store 2 dump trucks , 3 hackhoes , office space and make his own septic tanks and to store ✓ eady made steps . The Town Board said that he would be required to apply for one . CORRESPONDENCE Letter from John Murphy stating he was appointed by the Tomp . County Municipal Official / s Assoc . to represent the Town & Villages in their n egotiations with the City of Ithaca , for the return of the sales tax money . Assembly report from Gary Lee Letter from Joseph Visalli , Director of Envi . romental Health on a complaint of refuse on Neimi Rd & Mohawk Rd . Cim Cotterill said that the Highway inn Sunt . has already gone over to check on it and has been cleaned up . Dept . of State stating that as of May 27 , 1976 Local Law # 1 was received and on file in their office . Letter from Tom Payne stating that new values of real orooerty will be released to property owners during Oct . , Nov . , and Dec . of 1976 . Informal hearings will be conducted to answer any taxpayers questions . RESOLUTION # 83 SUMMER RECREATION PAYROLL Clm Cotterill offered the following resolution and asked for its adoption . RESOLVED , that the Supervisor be authorized to process a payroll every 2 Weeks for the Dryden Summer Recreation Commission . Vouchers will be audited at the following Town Board meeting at the end of the program . 2nd Clm Tarr Carried IRESOLUTION # 84 APPOINT ELECTION CUSTODIANS Clm Tarr offered the following resolution and asked for its adoptcion . WHEREAS , it is imperative that the Southern Cayuga Lake Intermunicipal Water Commission purchase water meters as soon as possible for installation in the area covered by the intermunicipal water project , it being under - stood that sufficient funds are available for the purchase of said water meters , it is hereby resolved as follows : Section 1 - That the Town of Dryden authorize the Southern Cayuga Lake Inter - Municipal Water Commission to purchase water meters , new or used , at a cost now being negotiated by the Commission and the Commiss• sion is hereby authorized to use funds available to the Commission 41, for such purpose . RESOLUTION # 91 GRANT BOYD BFNNETT SPECIAL PERMIT TO OPERATE SMALL ENGINE REPAIR SHOP Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , that this board approve the special permit with the following restrictions . ( 1 ) That the business be only operated from 7 : 30 AM to 6 : 00 PM ( 2 ) 6 days a week not including Sunday ( 3 ) All material and equipment be kept in the building ( 4 ) All work done inside of the building ( 5 ) All engines being no more than 1 or 2 cylinder engines . ORDINANCE - REMOVAL OR REPAIR OF UNSAFE OR COLLAPSED BUILDINGS AND / OR STRUCTURES Pursuant to Section 130 of the Town Law of the State of New York , the Town Board of the Town of Dryden , Tompkins County New York , does ordain and enact as follows ; 1 . All unsafe buildings and collapsed structures in any district , residential , agricultural , commercial or industrial , that from any cause , may now be or shall hereinafter become dangerous or unsafe to the public , shall be removed or repaired , provided that : a . The Town Zoning Officer shall make an inspection of the premises and shall make a written report to the Town Board . b . In the event that the report finds that an unsafe or dangerous condition exists , a notice shall be served on the owner or some one of the owner ' s executors , legal representatives , agent lessees or any other person having a vested or contingent interest property , in the / either\ personally or by registered mail , addressed to the last known address , if any , of the owner or some one of the owner ' - executors , legal representatives , agents , lessees or other person having a vested or contingent interest in same , as shown by the ✓ ecords in the office of the county clerk , containing a descripti . n o f the premises , a statement of particulars in which the building . d/ or structure is unsafe or dangerous and an order requiring same to be made safe and secure or removed ; and if such service be made by ✓ egistered mail , for a copy of such notice to be posted on the premises . c . The person served with such notice shall have ten ( 10 ) days from the date of completion of such service to commence the securing or removal of the building . . and / or structure and 4 accumulated rubble and debris from the premises . d .- In the event of neglect or refusal of the person served with notice to comply with same , a survey shall be made by an inspector and an architect to be named by the Town Board and a practical builder , engineer or architect appointed by person noti - fied as above and in event of refusal or neglect of person so noti fied to appoint such surveyor the two surveyors named by the Town Board shall make the survey and report .. The notice shall state that in the event the building and / or other structure , and accumu - lated rubble and debris , shall be reported unsafe or dangerous und : r such survey , that an application will be made at a Special Term of the Supreme Court in the Sixth Judicial District in which the prop erty is located for an order determining the building and / or other structure and accumulated rubble and debris , to be a public nuisance and directing that the building and / or structure shall be repaired and secured or taken down and removed , together with the accumulated rubble and debris . e . A signed copy of the report of the survey and a report of the compensation due to the surveyors shall be posted at the premises and a copy shall be served on the owner in the manner established in paragraph ( b ) herein . f . All costs and expense incurred by the Town in connection with the proceedings to remove or secure , including the cost of actually removing said building and / or structure and accumulated rubble and debris , from the land on which said building and / or structures are located shall become a lien on the premises and if the same is not paid within thirty ( 30 ) days after notice is given in the manner established by paragraph (b ) herein , it shall be • S`0 " f i } certified to the Town Collector of Taxes , who shall place the same on the next real property tax bill , with interest and penalties allowed by law , and shall be collected as other town taxes are collected .. 2 , . This ordinance shall take effect immediately upon adoption . • - Adopted by the fryden Town Board June 29 , 1976 Published : 7 - 7 - 76 Effective : 7 - 17 - 76 • • • • • i 9 PUBLIC HEARING JUNE 29 , 1976 Minutes of the Public Hearing held by the Town Board of the Town of Dryden on June 29 , 1976 commenced at 7 : 55 PM Supv . McCord read the Public Hearing notice that was published in the newspaper stating , the purpose of said hearing was to adopt an ordinance in the Town of Dryden concerning the removal of unsafe or collapsed buildings and / or structures . Present : Supv . McCord , Clm Graham , Clm Webb , Clm Cotterill and Zoning Officer Stewart . Supv . McCord opened the floor for questions , statements or comments . Clm Graham wanted to know where it stated that a survey shall be made • by an inspector , what qualifications are necessary for a person to be named an inspector . Supv . McCord said the inspector would be the zontnq officer because he is currently the building inspector for the Town of Dryden and an architect would be named by the Town Board . Also Clm Graham wanted to know how you would define practical builder . The board said it would be someone who builds homes or has the knowledge of construction . The Town Board will have the decision to select the building inspector and architect . Clm Graham also wanted to know if the fees were going to be charged against the property or the property owner who is derelict of taking care of their unsafe building . Supv . McCord said all costs and expenses incurred by the Town in connection with the proceedings will he levied on the property . Clm Webb wanted to know if the property owner does not find his property as a hazard after the Town has cleaned it up who pays for the contractor . Supv . McCord said the expense would than be the towns . Clm Cotterill wanted to know if there was anything that stated the building has to be partially destroyed by some kind of disaster or does it mean lust a deteriorated building . Supv McCord stated that it was defined to the extent that the zoning officer shall make an inspection of the property and make a written report to the Town Board . In the event that the report finds that an unsafe or dangerous Condition to the public exists the owner will be notified . The ordinance is to allow the Town Board to exercise judgement on behalf of the Town to clean up property that has been determined as unsafe to the public . Consensus of the Town Board was to make a decision .
