BOARD MEETING
APRIL 13 , 1976
Minutes of the Board Meeting held by the Town Board of the Town of
Dryden at the Town Hall commencing at 7 : 30 PM on the 13th day of April
1976 . Called to order by Deputy = Supv . Cotterill .
Members and guests participated in the Pledge of Allegiance to the Flag .
Roll call was by the Town Clerk .
Present : Councilman Graham , Cotterill , Webb , and Tarr .
Absent : Supverisor McCord and Attorney Amdur
Motion was made by Clm Graham and 2nd by Clm Tarr that the Board
Meeting minutes of March 9 , 1976 be approved as submitted .
COUNTY BRIEFING
County Rep . Kidney was present to report . County Rep . Kidney stated
that the county had spent a lot of time debating Boardman House . He
voted against the renovation of Boardman House for several reasons .
1 . The county taxpayers are now faced with a 23 million dollar plus
hospital . 2 . An airport master plan that could run into millions of
dollars . 3 . They have already given to Historic Ithaca $ 800 , 000 . 00
for the renovation of the *old Court House . He is concerned with where
the taxpayers money is going to come from when the :; people are hit with
all the high taxes . It is inevitable they are going to come when you
have to support a $ 23 million Hospital Bond and an airport master plan .
He has tried to get across to the County Board of Rep : that the people
are pushed to the limit . County Rep . Kidney , Watros and John Murphy
would like to set up a meeting with the Town Board to discuss the pros
and cons of the tax refund . County Rep . Kidney said that the Town could
be losing close to $ 6 , 000 . 00 in interest if the town takes it all at once .
CITIZEN PRIVILEGE OF THE FLOOR
Mr . & Mrs . King , Mrs . Tehan and Mrs . Messenger from Etna wanted to
request a lower speedtlimit on Upper Creek Rd . and Etna Rd . to Wood Rd .
It has been reduced by the State from 55 MPH to 45 MPH but is still to
fast for the road . The procedure would be to get a petition signed by
the people in the area and the Town Board can request the County and
State for a different speed limit . The Town has no authority to change the
speed , it is up to the State .
Harold Case wanted to know who owned all the unlicensed vehicles
at the Town Highway Barns . They have been there a long time and should
be removed . After some discussion Highway Supt . Humphrey said that he
would see to it that they would be removed .
YOUTH COURT
Youth Court Advisor Megan Tallmer reported that they have had some
problem this year with the lack of cases which Ithaca shares with Dryden .
She had talked to different judges for the last several weeks trying to
find out what is going on . The judges told her nothing has come in and
the Attorney seemed to be skeptical about sending cases to the youth
court . Jimmy Carlin the county representative who directs the publicity
• has been trying to get some radio spots on and has kept up the good
relations . The youth court had 2 hearings and 1 trial this year . Ms Tallme '
had offered the course in the fall , 1 girl passed and was sworn in by
Judge Sweetland . She is offering the course again in 5 or 6 weeks in
hopes that they will have a few more people because some of the seniors
will be leaving .
TOWN YOUTH COMMITTEE
Bud Thorne has been chairman of the Youth Comm . Program for several
years and has asked to be relieved of his duties . He has recommended 2
or 3 to take his = place . Jim Thorpe , Gary Sheeley and Ray Raker . They
have all been working along with him for sometime . After much discussion
the Town Board felt it would be better to appoint the committee and 1Pt
them decide on their chairman .

RESOLUTION # 66 APPOINT YOUTH COMMITTEE
Clm Tarr offered the following resolution and asked for its adoption .
RESOLVED , that the Board appoint Jim Thorpe , Gary Sheeley and Ray
Baker for the Youth Committee in the Town of Dryden .

COUNCILMAN PRIVELEGE OF THE FLOOR
Clm Tarr - nothing
Clm Webb stated that the ambulance service is getting more attention
and local government must get involved if we are going to have
ambulance service .
Clm Graham went to the Village Board Meeting and was asked to find
out if the Town Board still wanted to buy a tree . The price for a Amh
Crimson Maple is $ 65 . 00 for a 21/2 ° - 3 " and $ 110 . 00 for a 4 " - 5 " /
Clm Cotterill said he was told $ 30 - $ 35 , so will talk with Ed Bell
or find out a better price for the tree .
Clm Cotterill stated that he has gotten a lot of comments about
Cortland Video since it has now been 5 months . Even with the Resolution
from the Town Board we have not received a letter from Cortland Video
saying yes it is or notit is not feasible for the extension . After much
discussion Clm Cotterill said he would take the time and talk with them
and see if they can come and give the Town Board some kind of action on
the matter . Bill Fellows spoke to him about the firemen and firemen ' s
compensation . The Town carries Fireman ' s Compensation on the firemen
in the Town of Dryden . One fireman had an accident and there is some
question whether it has been covered or not . In all the discussion and
hearings about this they have found things in the Municipal Law that
states that the firemen can ' t do anyting without filing a report to the
Town Board 30 days in advance that they are doing an activity and the
Board has a chance to say no we will not cover your people for that type
of acttuity . If the firemen don ' t do this they are ►lot legal . I feel
that we should have some of the fire directors , our Insurance
Agent and Attorney meet with the Board and find out where we really
stand . Maybe we are paying out a lot of money that isn ' t doing us
any good , because we aren ' t living by the rules and when a problem
arises they can find a loop hole that we haven ' t done things proper
and the Town Board is spending thousands of dollars for the firemen and
they aren ' t being covered . I think we should find out the details
whether we need to request the firemen to make out the reports . We need
to look at the possibility of having a different type of insurance or
give the firemen the money and let them by their own insurance .

HIGHWAY SUPERINTENDENT
They finally have their grader repaired after 3 weeks . They have
repatted the bridge on Yellow Barn Rd . No word yet from the Federal
Gov ' t . on the communication system . The Town Board set the date
of April 24th at 8 : 00 AM to look at the roads in the Town of Dryden
with the Highway Supt . There was some discussion to put a concrete
floor down in the highway building this summer .
CORRESPONDENCE
Letter from the Tomp . Co . Office of the Aging stating that they are
sending volunteers to all 9 towns on Tues . April 20th from 10 : 30 - 2 : 30
to help older residents apply for partial tax exemption on real property .

RESOLUTION # 67 JOINT HEARING AT MCLEAN
FIRE HALL TO ESTABLISH A
NEW FIRE DISTRICT
Clm Webb offered the following resolution and asked for its adoption .
RESOLVED AND DETERMINED , pursuant to Article Eleven of the Town Law
o f the State of New York , and subject to and conditioned upon a determina =
tion of the Town Board of the Town of Groton to the same effect
✓ elative to the territory embraced in the Town of Groton , as follows :
( a ) That the establishment of the McLean Fire District embracing
the territory within the Town as hereinbelow described is in the
public interest ;
( b ) That the boundaries of the territory as described in notice
o f hearing area hereby altered in order that all the property and
. property owners of the Town of Dryden benefited are included within
the limits of the proposed district , and all the property and property
• owners within the proposed district are benefited thereby ; and it is
further
RESOLVED , that this Board in all respects approves the establishment
o f the territory which lies within the boundaries of the Town of Dryden ,
and it is further ,
RESOLVED , THAT this resolution , within 10 days after the taking effect
of the resolution of the Town Board of the Town of Dryden altering
the boundaries of its existing Fire Protection District to exclude
therefrom the hereinabove described territory ( which resolution shall
take effect within thirty, days after its adoption , unless a petition
for a referendum shall be submitted ) , certified copies of this
resolution , in duplicate , shall be filed in the office of the State
Department of Audit and Control at Albany , New York , together with an
application by this Board , in duplicate , for permission to create
such application shall be executed and verified by and in behalf of the
Town Board by the Supervisor of the Town .

RESOLUTION # 68 ALTER BOUNDARIES OF THE FIRE
PROTECTION DISTRICT
Cim Tarr offered the following resolution and asked for its adoption .
RESOLVED AND DERTERMINED as follows :
( a ) That it is in the public interest to alter the boundaries
of the Fire Protection District of the Town of Dryden by excluding
therefrom the following described territory , to wit :
( b ) That the territory of the Fire Protection District of the
Town of Dryden shall embrace only the territory within the Town of
Dryden , with the exception of the Village of Dryden , the Village of
Freeville , and the territory described in ( a ) hereof .
( c ) This resolution shall not take effect untill thirty ( 30 )
days from the date hereof , and it is subject to a permissive referendum .

RESOLVED , that this Board authorize the pay of the Election Inspectors
. at the rate of $ 2 . 20 per hour for the year 1976 .

RESOLUTION # 72 GRANT SPECIAL PERMIT TO
DAVID BOYLAN
Clm Tarr , offered the following resolution and asked for its adoption .
RESOLVED , that this Town Board issue the special permit with some
restrictions . If the restrictions are not met the permit will
immediately be revoked by order of the Town Board . The restrictions
are as follows : 1 . No Sunday work . 2 . 8AM - 6PM , 6 days a week only .

3 . Limit the use of th ? permit to only Mr . & Mrs . David Boylan as
long as he resides there , with no transfer to new owner , or lease
the business to someone else . 5 . Limit the cars sitting outdoors
to 2 plus the ones in the garage in addition to their own . 6 . Limit
of 60 days for a car sitting outdoors .

RESOLUTION # 67
WHEREAS ; pursuant to the provisions of Section 170 of the
Town Law of the State of New York , the Town Boards of the Town
of Groton and Town of Dryden . , upon their own motions , passed a
resolution to hold a joint public hearing on March 8 , 1976 , at
8 : 00 p . m . at the Fire Hall , McLean , New York , on whether or
not a new fire district embracing territory in each of the said
Towns , should , be established , said district to be known as the
McLean Fire District , and
WHEREAS , a notice of such hearing in due form , containing a
description of the proposed fire district and specifying the
when and and the place where the Town Board of Dryden , together" with
the Town Board of Groton , would meet to consider the question and
to hear all persons interested in the subject concerning the same ,
was duly published and posted as required by law , and
WHEREAS , pursuant to such notice , a joint public hearing was
duly held by the Town Board of the Town of Dryden and the Town -
Board of the Town of Groton on the 8th day of March , 1976 , com -
mencing at 8 : 00 p . m . , at the Fire Hall , McLean , New York , Tompkins
County , New York , being within the limits of the proposed McLean
Fire District , and
WHEREAS , all persons interested , who desired to be heard ,
were duly heard , and due deliberation having been had ,
NOW , upon the evidence given at such public hearing , and on
motion of Councilman Merton Webh , seconded by Councilman Henry
Tarr , it is hereby

NOTICE IS HEREBY GIVEN that the Town Board of the Town of
Dryden , County of Tompkins , New York , at a regular meeting there -
of , held on the 13th day of April , 1976 , duly adopted , subject to

a permissive referendum , a resolution , an abstract of which is as
follows :
Pursuant to the provisions of Section 172 - C
of the Town Law of the State of New York , the Town
Board resolves to alter the boundaries of the Fire
Protection District of the Town of Dryden , which
Fire Protection District presently encompasses the
entire Town , except the Villages of Dryden and
Freeville , to exclude therefrom certain territory
to be included in a new fire district , to wit :
the McLean Fire District , having territory in both
the Town of Dryden and the Town of Groton , said
excluded territory being described as follows :

WHEREAS , pursuant to the provisions of Section 172 - C of the
Town Law of the State of New York , the Town Board of the Town of
Dryden on its own motion passed a resolution setting up a public
hearing to consider and take action oh the alteration of the
boundaries of the Fire Protection District of the Town of Dryden ,
which Fire Protection District presently encompasses the entire
Town , except the Villages of Dryden and Freeville , such alteration,
to consist of the exclusion therefrom of certain territory to be
included in a new fire district , to wit : the McLean Fire District ,
having territory in both the Town of Dryden and the Town of
Groton , and
WHEREAS , a notice in due form was duly posted and published
as required by law specifying the manner in which it is proposed
to alter the boundaries of the district and the time when the
Town Board would meet to consider the petition and hear all
persons interested in the subi.ect concerning the same , and stating
in general terms the purposes of the hearing ; and
WHEREAS , pursuant to such notice , a public hearing was duly
held by said Town Board on the 9th day of March , 1976 , commencing
at 7 : 35 p . m . at the Town Hall in said Town , and
WHEREAS , all persons interested who desired to be heard were
duly heard , and due deliberation having been had ,
NOW , on motion of Councilman Henry Tarr , seconded by
Councilman Merton Webb , it is hereby , •
RESOLVED . AND DETERMINED as follows :
( a ) That it is in the public Interest to alter the boundaries
of the Fire Protection District of the Town of Dryden by excluding
therefrom the following described territory , to wit :

COMMENCING a.t a point in the Tompkins - Cortland County Line at its
intersection with the Groton - Dryden Town Line ; thence running
westerly along the said Groton - Dryden Town Line to a point in
Peruville Road where the extension, of the westerly line of pre -
mises of Floyd Morter , Sr . and Floyd Morter , Jr . ( 3 - 24 - 1 - 2 )
intersects with said Peruville Road ; thence southerly along the
westerly boundary of said Morter premises to the southwest corner
thereof ; thence easterly to a point marking the northwest corner
of premises of L . V . Lamott ( 3 - 24 - 1 - 4 ) ; thence southerly along the
westerly boundary of said LaMotte premises to a point where the
westerly line of LaMotte intersects the northerly boundary of
premises of Ronald L . and Carol H . Beck ( 3 - 24 - 1 - 6 ) ; thence west -
erly along the northerly line of said Beck premises to a point in
the easterly right of way of Town Route # 12 ( Ed Hill Road ) ;

ALL REFERENCES to property owners and the boundaries of the school
district hereinabove were taken from the tax rolls for the Town of
Dryden established as of May 1 , 1974 . All references to tax map
parcel numbers were taken from said tax rolls and from the real
property tax maps as prepared by the Tompkins County assessor and
as in existence as of January 1 , 1975 .

( b ) That the territory of the Fire Protection District of
the Town of Dryden shall embrace only the territory within the
Town of Dryden , with the exception of the Village of Dryden , the
Village of Freeville , and the territory described in ( a ) hereof .
( c ) This resolution shall not take effect until thirty ( 30 )
days from the date hereof , and it is subject to a permissive
referendum .

AUTHORIZIN : AN INCREASE IN THE SALARY
OF THE HIOHYAY SUPERINTENDENT
RE IT ENACTED , by the Town Board of the Town of Dryden ,
Tompkins Count ', , New York , that the compensation for the office
of the Highway Superintendent of the Town. of Dryden be increased
from the Sum of Nine Thousand Five Hundred Dollars ( $ 9 , 500 . 00 )
per annum to the Sun of Ten Thousand rive Hundred Dollars
( $ 10 , 500 . 00 ) per annum for the year 1976 . This local Law shall
be subject to a permissive referendum in accordance with the
Municipal Home Rule Law € 24 Q2h .

1 . I hereby certify that the local law annexed hereto ,
designated as local law No . 1 of 1976 of the Town of
Dryden was duly passed by the Town Board of the Town;
of Dryden on March 30 , 1976 in accordance with the
applicable provisions of law .
