Present : Supervisor McCord , Councilman Graham , and Cotterill . Councilman Webb arrived at7 : 45 P . M . RESOLUTION # 1 RULES OF PROCEDURE Spvr McCord offered the following resolution and asked for its adoption . RESOLVED , that this Board continue to use Robert ' s Rules of Procedures . `. 2nd Clm . Cotterill Carried RESOLUTION # 2 SALARY SCHEDULE Spvr McCord offered the following resolution and asked for its adoption . RESOLVED , that the salaries of the Town Officials be set for the year 1976 as scheduled in the budget . Supervisor $ 2 , 800 . 00 Councilman ( 4 ) 900 . 00 each Highway Superintendent 10 , 500 . 00 Town Clerk 5 , 200 . 00 Town Justice ( 2 ) 3, 600 . 00 each 2nd Clm Cotterill Roll call vote - all voting YES RESOLUTION # 3 SALARY PAYMENTS Spvr McCord offered the following resolution and asked for its adoption . M . /, • Susanne Lloyd Town Clerk T . � $ S . . . 0 TOWN BOARD MEETING January 13 , 1976 Minutes of the Board Meeting held by the Town Board of the Town of Dryden at the Town Hall commencing at 7 : 40 P . M . on the 13th day of January 1976 . Called to order by Deputy Supv . Cotterill Members and guests participated in the Pledge of Allegiance to the Flag . Roll call was by the Town Clerk . Present : Coundilman Graham Councilman Cotterill Councilman Webb Attorney Amdur Absent : Supv . McCord Motion was made by Deputy Supv . Cotterill and 2nd Clm Webb that the Board Meeting minutes of December 9 , 1975 be approved as submitted . COUNTY BRIEFING County Rep . Watros was present to report . County Rep . Watros stated that the latest position as far as the committee was concerned on the County Ambulance was that the County Medical Examiners Office removals at this point after considerable amount of discussion , the , ! majo * ty : oftthe ` ' Heatth Comm . are not infavor of entering in any contractual arrangement with any single individual or the funeral directors in out lying area . County Rep . Watros stated that he had discussed it with them at length many times and was in the minority in the final decision . It did not come to any formal sort of motion before the comm . but the consensus was in view of the fact that they had limited funds as well as the implications that could be involved with having one individual in given areas remove the remains to the hospital that the Health Comm . didn ' t want to get involved with . County Rep Watros talked with Bradley Perkins after the meeting and suggested that he talk w ith other_ funeral directors in the county and ask them to approach their ✓ espective representatives on the subject . It seems that the only one that demonstrated any interest in this was Bradley Perkins , consequently the other representatives in the county were less motivated than I was to improve the situation and also with the new committee now being formulated this coming year the philosophy might change in favor of the proposal that was suggested from this Board and I carried to the County . At this point I did not exceed in getting any resistance to the problem and hopefully in the comming year more interest can be demonstrated by the funeral directors themselves that we can ge' some action . We are negotiating w ith the county employes and there has been some job actions on a limited basis . The county had a hearing Jan . 12th which many people turned out and after the hearing the chairman suggested that we delay and board action on the matter in hopes that through negotiations they might reach a solution . • QUESTIONS AND ANSWERS Clm Cotterill wanted to know if County Rep Watros could give the board any indication how other towns , dollars per thousand of assessment increase . County Rep . Watros siad he had information that he would be glad to give to the board but didn ' t have it with him , that has a break down by the township in the county that shows the equalization rate and the effects on e ach township . The Town of Dryden was in the average range . Clm Cotterill also asked if the dollars in sales tax less apparently now or about the same as it has been in the past . County Rep . Watros stated that this year they were a little more conservative in budgeting the sales tax receipts because of experience in 1975 -: It was the first time the sales tax ✓ evenues ran behind the budget figures . Normally they were 5 - 10 % over the AO o ne quarter . County Rep . Watros didn ' t know how the final figures would be when they ci+ dsed the final year , but the third .: quarter they were behind 5 % which was a significant numberof dollars . So for that reason they took a conservative approach in budgeting revenues for this coming year and hopefully again it will exceed wh •: t they budgeted but it was certainly a factor . Normally they have been growing at a very regular ✓ ate every year so that they have been able to count on more dollars . The e qualization had the biggest impact on the communities . Clm Webb wanted to thank County Rep . Watros for the work he has done on the ambulande situation but will still fight for it and will work with Bradley Perkins in hopes that th board get further action from the county . Clm Webb also wanted to know how the City of Ithaca was dividinf o the sales tax money that they o wed the county . If it was ever straight - d out , if the towns did get any more money . County Rep . Watros state± -that it hasn ' t been resolved yet but the board can anticipate some . Audits are still being made and it is extremely hard to fdsgure out exactly what proportions belong to the city and towns because of deliveries and sales . RESOLUTION # 384 APPOINT TOWN COUNCILMAN ClmmWebb offered the following resolution and asked for its adoption . RESOLVED , that this Board appoint Henry Tarr as Town Councilman until the general election , which will be for 1 year . 2nd Clm Graham Carried Judge Sweetland wanted to Ask County Rep . Watros if it would be at all possible to appoint a Town Constable because the town is having trouble with the SPCA picking up the dogs after the courts process the dog delinquent list . Last year there were about 35 people who refused to buy licenses even after summons were sent out . Supposedly the SPCA were to pick up the dogs which didn ' t work out so 35 people got away with it . In o rder to have some hold on this I think we should have somebody pick up our own dogs . I don ' t believe we should say that we are going to e nforce the law and then not be able to do it . County Rep . Watros • read part of the contract which provides for the SPCA to pick up all unlic . dogs within certain hours . It varys but states the hours Mon . - Fri . 9 - 4 and Sat . 9 - 12 to detain or destroy them if necessary . After much discussion the board felt that since we were under a contract with the SPCA we should request them only a certain length of time to pick up the delinquent dogs and let the judges know when they have been picked up . RESOLUTION # 39 DELINQUENT DOGS & SPCA Clm Cotterill offered the following resolution and asked for its adoption . RESOLVED , that this Board authorize the Town Clerk and Court Clerk � to write a letter to the Board of Representatives stating that the Town o f Dryden is concerned with the inaction that they are receiving from unlic dogs of previous years and our County Rep . has informed us that the contract reads that the SPCA will pick up any unlic . dogs . 2nd Clm Tarr Carried Arty Amdur brought up the matter about the flood plain legislation and passed resolution and that it will eventually have to pass ordinances . Part of the ordinance will . be no building permits will be issued for any n ew construction in the flood area until there is proof that the elevation is proper . It really is an engineering problem and a suggestion was made that the permit should be submitted to someone in the county level maybe Frank Liguori or someone else to evaluate the proper elevation and materials before a building permit is issued . County Rep . Watros said he would talk with Mr . Liguori about this matter . CITIZENS . PRIVILEGE OF THE FLOOR Mrs . Margaret Hayes from Lower Creek Rd . in Etna read a proposal for a " Before and After School Child Care Program in the Dryden Schools " and said that they would mail the Town Board a copy of the full proposal . COUNCILMAN PRIVILEGE OF THE FLOOR Clm Tarr - nothing RESOLUTION # 40 NO SMOKING DURING TOWN BOARD MEETINGS • Clm Graham offered the following resolution and asked for its adoption . RESOLVED , that this Board ask the people to abstain from smoking during the Town Board Meetings . 2nd Clm Tarr Carried Clm Graham wanted to know what would be a good time to get in tough with the Highway Supt . Supt . Humphrey said that he was in and out of the o ffice all day but that the person could leave their phone number and he would contact them . Clm Webb wanted to know if Supv McCord contacted the NYSE & G on the Tight for the corner of Rt 13 and Gulf Hill Rd . Highway Supt . Humphrey stated that he had received a letter from the state and they were .going to paint a double solid line on Rt 13 and Gulf Hill Rd . and also gave the Town of Dryden pemission to install a street light on their right - of - way . Highway Supt . Humphrey is now waiting for a man to come from NYSE & G so they can install the street light . 82 Cim Cotterill asked Atty Amdur how the progress was on the petition from the people on Rt 38 for Cortland Video . The Board had made a ✓ esolution and requested an answer . Atty Amdur stated that she had delivered the petition to the manager and vice president of Sammons Communication but no answer as of yet . It is on record , and that both Sammons and Ceracche asked for an increase and with the increase there would be extensions . There will be a representative before the Board sometime in the future . Clm Cotterill was still not satisfied w ith the answer and wanted an answer from Sammons on what their reaction ' is to this petition and whether or not they are going to service this area or not . Clm Cotterill feels that the Town Board is justified with an answer from them . ATTORNEY Atty Amdur spoke with respect to the McLean Lighting District , that w as originally submitted was not proper in form . In order to dissolve - a district we have to follow the proper form . We did however cancel the contract as of the end of the year . I do have a form petition now which I will give to Clm Webb to give to someone in the McLean area so that they can take it around and get the names and address o f property owners . We have to get 2 of the assessed valuation . It can be done with a subscribing witness who has to sign at the same time the party signs . If the property is owned by both husband and w ife they both sould sign . The subscribing witness should bring the petition into me and I will notorize it , and then bring to the Town • Board which will then have to set up a Public Hearing . Clm Cotterill asked Atty Amdur if a private organization could use the Town Meeting room . Atty Amdur stated that the Town could not and if the Beard wanted any clearer answer she would dive it . There are restric - tions on public organizations using the meeting room . Atty Amdur completed the proposed Sub - Division Regulations and gave copies to e veryone on the Planning Board and the Town Board , also seat . a copy to Frank Liguori . TOWN CLERK Town Clerk Lloyd reported that at the Special Election as to whether o r not the Highway Superintendent position should be an appointed one o r an elected one held on December 15 , 1976 . The result was 59 YES ✓ otes and 467 N.O- . votes to keep it an elected position . Also there will be a meeting of Associations of Towns held in New York , February 16 , 17 , and 18 and if there would be any delegate going . ZONING OFFICER Z . O . Stewart reported that Dec . was a slow month with only 6 permits . 3 new homes and 3 additions on homes . , REPORT ON BID OPENING After much discussion and Highway Supt . Humphrey looked over the bids that there was not much difference in all of the bids . Ryerson Motors was the low bid . • RESOLUTION # 4l ACCEPT BID FOR 2 PICKUP TRUCKS FOR TOWN HIGHWAY Clm Webb offered the following resolutions and asked for its adoption . RESOLVED , that this Town Board accept the bid from Ryerson Motors for 2 pickup trucks for the highway in the amount of $ 8798 . 36 . 2nd Cim Tarr Roll Call - all voting Yes Clm Cotterill YES Clm Webb YES Clm Tarr YES Clm Graham YES ( with reservatthon ) CORRESPONDENCE Request from a resident of the City of Ithaca who lived on Turkey Hill Rd . asking for a reduced speed limit sign . Request from a resident on Kirk Rd . in the Town of Dryden asking for a school crossing sign to be put up on Rt 13 and Kirk Rd . After much discussion the board decided to have the Town Clerk write a letter to both people asking them to get a petition from the area ✓ esidents before the board could take and action on the matter . 84 RESOLUTIONS # 42 DISBURSE MCARTHUR FUND INTEREST Clm Tarr offered the following resolution and asked for its adoption . RESOLVED , That the Supervisor be and hereby is authorized to obtain two bank drafts to disburse the interest in the McArthur Fund , plus adjustments recommended by the State Auditor to make the net amount in the fund conform with the amount given in the will , to the two schools in the Town of Dryden in the amounts of $ 287 . 29 to Dryden Central School and $ 21 . 62 to George ? Junior Republic for a total of $ 308 . 91 leaving a balance of $ 2 , 922 .: 90 in the fund . 2nd Cim Webb Carried RESOLUTION # 43 ANNUAL REPORT Clm Cotterill offered the following resolution and asked for its adoption . RESOLVED , That the Supervisor be and hereby is authorized to fire a 0 copy of his annual financial report to the State Comptroller with the Town Clerk by March 1st in lieu of his annual financial report due February 1st . 2nd Cim Webb Carried RESOLUTION # 44 FINANCIAL TRANSFERS Clm Graham offered the following resolution and asked for its adoption .
