M . Present : Supervisor Charles G . McCord Councilman Merton Webb Councilman Lewis Gridley Councilman Clinton Cotterill Councilman John J . Joubert County Representative James Kidney Zoning Officer Sibley Stewart News media from Ithaca Journal , Rural News and WTKO • Approximately 8 guests Absent : Attorney Helen Amdur SPECIAL ELECTION There was an informational meeting regarding the special election on the question as to whether the position of the highway superintendent be appointed by the town board or elected by the people of the town . Question and answer session was held until 8 : 00 P . M . Meeting called to order by Supervisor McCord at 8 : 00 P . M . Supr McCord led members and guests in the Pledge Allegiance to the Flag . Roll call was by the Town Clerk . Motion was made by Clm Gridley , seconded by Clm Joubert that the Town Board Meetings of October 14th and November 11th and the Public Hearings of November 6th , that the minutes be approved as submitted . Carried . COUNTY BRIEFING County Rep Kidney stated that he was strongly opposed to the county budget . along with some other representatives , but to no avail . He further stated that he is opposed to paid parking at the airport . He said if the Board feels that it is their responsibility as elected officials of the town to express their feelings regarding paid parking at the airport , then they should get a letter to him . Questions & answer session : Harold Case ask Mr . Kidney if Dr . Safadi is running a private office at the Hospital . County Rep Kidney replied that that question has been asked many times and they are sure that he is . Clm Webb asked if Dr . Safadi ' s budget went through and if there was anything in there for the removal of deceased people . Mr . Kidney replied that he was not sur , but they could get an answer from Rep . Watros as he knows more about this budget . CITIZENS ` : PRIVILEGE OF THE FLOOR Representatives from McLean Fire District spoke relative to the formation of said district . Petitions were filed with the Town Clerk of Dryden a week ago . They requested that the Town Boards of Dryden and Groton hold a joint public hearing . Consensus of the board was that they were opposed to holding a public hearing outside the limits of the Town of Dryden . Supr McCord read a memo addressed to the Town Board from Attorney Amdur indi - cating that the Town of Groton is agreeable to setting up a hearing on She question on its own motion , in lieu of proceeding on the petitions . the memo further stated that such public hearing must be held jointly with the Town of • Dryden , in the event that the Dryden Town Board. also decides to : proceed on its own motion . The Board agreed to meet with the Town Board of Groton at a public hearing , but also wanted to schedule a public hearing in Dryden for the Town of Dryden residents who propose to be in this district . There was a question as to whether or in fact the Board can hold their own public hearing if they go along with Groton which they have to do under this set of circumstances . Supr McCord said he would take to Atty McDermott and raise the question to him and get an answer . RESOLUTION # 176 PROPOSED MC LEAN FIRE DISTRICT HEARING Clm Cotterill offered the following resolution and asked its adoption . RESOLVED , that this Board authorize Supr McCord to set up the hearing according to what the law will allow ; and if it will allow us to have a separate hearing for the residents of the Town of Dryden , then Supr McCord arrage and set up the hearing . 2nd Clm Gridley Carried . 72 Discussion was had regarding notification to the people more than the normal required legal notice in the newspaper . Supr McCord said that the zoning officer could send the people involved a post card . COUNCILMAN PRIVILEGE OF THE FLOOR Councilman Gridley - nothing to report . Councilman Cotterill - Presented a reproduction of the " History of Dryden " from the Bicentennial Committee of ' 76 . It was decided to leave the book in the Town Clerk ' s office for viewing by the public . Clm Cotterill spoke relative to having a joint meeting with the Planning Board , Zoning Board and Town Board to go over the new subdivision ordinance . If everything is satisfactory , then a public hearing should be set as soon as possible after the first of the year according to Clm Cotterill . After considerable discussion it was decided to schedule a meeting on the 23rd or 30th of December and for Clm Cotterill to set up the meeting and make the contacts . Clm Webb - nothing to report . • Clm Joubert - nothing to report . ATTORNEY Attorney Amdur was absent but left some business to be taken care of according to Supr McCord . One item of business was that Atty Amdur received a petition requesting cable TV from the residents along Route 38 . The Board decided to have Atty Amdur Amdur act on it with Sammons Communication so that the Town Board can get an answer before the next board meeting . COUNTY SEWER DISTRICT # 1 COMMISSION Letter from- Frank Liguori with regard to an appointment of a member of the Commission effective January 1 . Since the Commission meets in the afternoon , the Board appointed Janet Graham . RESOLUTION # 177 APPOINT JANET GRAHAM - DRYDEN REPRE - SENTATIVE ON COUNTY SEWER DISTRICT # 1 COMMISSION Supr McCord offered the following resolution and asked for its adoption . RESOLVED , that this Board appoint Janet Graham as the Dryden Representativ to the County Sewer District # 1 Commission commencing January 1 for a term expiring June 30 , - 1 977 . 2nd Clm Joubert Carried . TOMPKINS COUNTY FIRE MUTUAL AID PLAN RESOLUTION # 178 JURISDICTION OVER FIRE COMPANY OR FIRE DEPARTMENT Clm Joubert offered the following resolution and asked its adoption . RESOLVED , that this Board encourage the participating by the Town of Dryden in Tompkins County Fire Mutual Aid Plan as now in force and as amended from time to time and certifies to the Tompkins County Board of Representatives through its County Fire Coordinator that no restriction exists against " outside service " by such fire company ( fire department ) within the meaning of Section 209 of the General Municipal Law which would affect the power of such fire company ( fire department ) to partici - pate in such plan . An be it FURTHER RESOLVED , that a copy of the resolution be filed with the County Fire Coordinator . 2nd Clm Gridley Carried . TOWN CLERK Clerk Stelick reported that it was necessary to get some substitute election inspectors to work at the upcoming special election scheduled for December 15th . RESOLUTION # 179 APPOINT SUBSTITUTE ELECTION INSPECTORS Clm Gridley offered the following resolution and asked its adoption . RESOLVED , that this Board appoint Jean Carpenter , Dor ,la Parker and Nellie Fulkerson as substitute Democratic Election Inspectors at $ 2 / hr . 2nd Clm Webb Carried . Clerk Stelick ask members if any of them would be attending the Tompkins l County Municipal Officials ' a-ssoc . meeting of December 17th ; please let her know so that reservations can be made . ri Also the matter of the key to the Varna Community Center building was brought up . According to Clerk Stelick everytime the building is needed for election purposes , the key will only be let out to someone for a fee of $ 2 . 00 to Eleanor Church and they must turn the key back in immediately in order to get their $ 2 . 00 refunded . It has turned in to being a big hassle for the election inspectors . Harold Case said he would discuss this matter with Mrs . Church and see what could be worked out . ZONING OFFICER Z . O . Stewart reported that it was a slow month . He issued 11 building permits ; collected $ 100 . 00 in fees . He reported to the Board that he has checked with four different printers with regard to prices for print - ing the town directory . He quotes prices as follows : Rural News $ 1278 . 75 ; Cortland Democrat $ 1181 . 00 , Gnomon $ 840 . 00 and ICS $ 625 . 00 for 500 copies . ICS further quoted 1000 copies for $ 925 . 00 . Clerk Stelick mentioned that it would be a nice gesture on the part of the town if they could afford to come up with enough copies , which would lower the cost per booklet , gli• and be given to the people as a bicentennial gift . After much discussion the Board decided to have ICS Press print 1500 copies of the directory and give 1 per household . CORRESPONDENCE Letter from Councilman John J . Joubert submitting his resignation . He stated that he is unable to hold this position and accept the appoint - as Tompkins County Airport Manager . He further stated that it has been a pleasure to serve the people of the Town of Dryden . His resignation as Councilman to be effective 12 / 31 / 75 . Clm Joubert recommended that Harold Case be appointed to fill the vacancy as Harold is a most active citizen and attends all town meetings . Supr McCord said it was necessary to authorize him to sign a renewal of a bond anticipation note for the Intermunicipal Water District in the amount of $ 200 , 000 . 00 . Clerk Stelick read the prepared resolution . RESOLUTION # 180 RENEW BOND ANTICIPATION NOTE SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER PROJECT . Clm Gridley offered the following resolution and asked for its adoption . RESOLVED , that Supervisor McCord be authorized to sign the renewal of a Bond Anticipation Note in the amount of $ 200j= 000 . 00 for the joint activity of Project # 1 of the Southern Cayuga Lake Intermunicipal Water Project , and to confirm any and all actions taken by him with respect to the foregoing . 2nd Clm Cotterill Roll call vote - all voting YES TRANSFER FUNDS RESOLUTION # 181 TRANSFER FUNDS - TOWN CLERK ACCOUNT Clm Joubert offered the following resolution and asked for its adoption . RESOLVED , that the Supervisor be and hereby is authorized to transfer $ 650 . 00 from the Contingency Account to the Town Clerk ' s Personal Service Account for labor assistance with the directory . 2nd Clm Gridley Roll call vote - all voting YES AUDIT BILLS RESOLUTION # 182 AUDIT HIGHWAY BILLS Clm Gridley offered the following resolution and asked for its adoption . To Clm Lewis Gridley , our genuine thanks for the many years he has served the Town , and appreciation to Clm Joubert for his services on the Town Board . 2nd Clm Webb Carried RESOLUTION # 184 THANKING HIGHWAY SUPT . RICHARD CASE Supvr McCord offered the following resolution and asked for its adoption : . RESOLVED , that the Town Board also extend our thanks and appreciation for long years of service to our HWY Supt . Richard Case . 2nd Clm Cotterill Carried Greg Humphrey _stated that he would like to use a = Town truck. . fo ,r _ trans - portation instead of his own . . . Since the ( Town does not now have one that he can use , he would like to get a pickup truck and a carryall for the men to take out to the jobs from the garage . Following discussion , the Board asked Greg to look around and bring back some firm figures to them . RESOLUTION # 185 INVESTIGATE PURCHASE OF 2 VEHICLES FOR TOWN HWY DEPT Supvr McCord offered the following resolution and asked its adoption : RESOLVED , that the Town Board request Greg Humphrey investigate the purchase of 2 vehicles for the Town Hwy Dept . which would be used by the Supt . and his Deputy and to present to the Board a specific pro - posal with price quote as soon as possible for the special meeting on Dec . 23 , 1975 . 2nd Clm Gridley Carried Discussion with Greg Humphrey about a new highway communications system and a Motorola contract followed . RESOLUTION # 186 PREPARE BID SPECIFICATION FOR NEW HWY COMMUNICATION SYSTEM Clm Gridley offered the following resolution and asked its adoption : RESOLVED , that the Town Board authorize Greg Humphrey to draw up bid specifications and prepare bid documents for the complete radio package to be presented to the Town Board „ purchase to be made from the Federal Revenue Sharing . it 2nd Clm Joubert Carried RESOLUTION # 187 AUTHORIZE PAYMENT - TOWN CONSTABLE Clm Gidley offered the resolution and asked its adoption : . December 23 , 1975 Minutes of a special meeting of the Town Board of the Town of Dryden held at the Town Hall on the 23rd day of December , 1975 commencing at 7 : 30 P . M . Present Councilmen Webb , Cotterill and Joubert . Councilman Joubert offered the following resolution and asked its adoption . RESOLVED , that the Highway Superintendent , elect , be authorized to advertise for bids for two light trucks not to exceed $ 10 , 000 . 00 . 2nd Clm . Cotterill Carried . • • _• RESOLUTION ESTABLISHING CONDITIONS FOR USE OF TOWN SEWER SYSTEM BY THE TOWN OF DRYDEN ( IN BEHALF OF DRYDEN SEWER DISTRICT # 1 ) \ , A . WHEREAS , the Town of Ithaca ( herein also ITHACA ) has constructed , operates and maintains , at its own exnense , a Tbw;n sewer system . The Town of Dryden ( herein also DRYDEN ) has e stablished Dryden Sewer District No . 1 ( herein DISTRICT ) in the area of Dryden east of Sapsucker Woods Road . Dryden is presently u sing the Ithaca system to convey sewage from the lands in the DISTRICT through the Ithaca sewer system to the Village of Cayuga Heights system . . B . ITHACA and DRYDEN ( on behalf of said Sewer District ) recognize the need for formalizing the aforesaid use by entering into an agreement ( i ) to regulate the use of the sewer system by t he Town of Dryden and ( ii ) to establish the rights and obligation - o f both Towns with respect to charges , repair , maintenance , addi- t ions to and enlargement of the Town of Ithaca Sewer System , and ( iii ) to state the duration , modification and revisions of the agreement , and ( iv ) to establish the charges whicheDryden must pay for such use , and ( v ) to define such other provisions as the Town o f Ithaca shall require . . C . In the meantime , it is necessary for DRYDEN to be informed of the charges it must pay to ITHACA for the calendar year 1978 so that DRYDEN can make the required assessment within the time period required by law , . D . The Town of Dryden understands that it will be re - quired to pay to the Town of Ithaca for such use of the Ithaca sewer facilities for the calendar year 1978 a total charge eauiva - lent to $ 15 . 00 per unit as hereinafter defined multiplied by the number of benefited units in the ' Dryden Sewer District , such amoun to be paid not later than the last day of February , 1978 . ` ` r 1 - 2 - E . The unit formula referred to above is as follows ; for the year 1978 : 1 . Single Family Home : 1 ' unit 2 . Single Family Home ( with one apartment ) or any residential dwelling with 2 dwelling units : 2 units . 3 . . Multiple residential dwelling , as defined in the Town of Ithaca Zoning Ordinance ; 1 unit per dwelling unit ( or apartment ) in such dwelling . . 4 . Any structure which does not come within the above classification : the units for any such structure shall be in accordance with the unit formula which is in effect for the year 1978 in the Town of Ithaca . NOW ,. THEREFORE , IT IS RESOLVED AS FOLLOWS : S ection 1 . The charges which the Town of Dryden is obligated to pay for the year 1978 shall be computed in accord - ance with the provisions of paragraphs D and F of the Preamble . Such charges shall be paid prior to March 1 , 1978 . S ection 2 . DRYDEN shall furnish to ITHACA , with the 1978 payment , a statement , certified by the Town Supervisor , listing e ach benefited property in the DISTRICT using the sewer , and the t ax parcel number , address , name of the owner , and the number of units therein . S ection 3 . DRYDEN shall comply with all applicable pro - ✓ isions of any code , law , ordinance or regulation of the Village o f Cayuga Heights and the Town of Ithaca relating to the use of their respective sewer systems . Without limiting the foregoing , t he Town of Dryden shall make any and all repairs or additions to its system which may be required to comply with the foregoing codes , etc . and shall pay for all repairs and damage caused to t he ITHACA or Cayuga Heights System attributed to use of the system by DRYDEN , or if it is necessary to enlarge or construct a main in ITHACA if the sewage flows of ITHACA and DRYDEN exceed t he capacity of ITHACA sewer mains , ITHACA will do such work and DRYDEN will be obligated to pay the cost thereof . DRYDEN Will install meters to measure the flow into ITHACA if required by • * L 0 • S yt am. 3 any State or Federal agency and will make and/or pay for any corrective measures required by such metering . S ection 4 . If the Town of Dryden shall default in the performance of this agreements the Town of Ithaca may enforce the provisions of this resolution in. any proceeding or action . S ection 5 . Acceptance of this resolution by DRYDEN , without modification , shall be deemed to be a contract between DRYDEN and ITHACA . S ection 6 . The Town Attorney with the Town Supervisor and the Town Engineer shall prepare and negotiate a formal agree - ment with DRYDEN regulating the continued use of the ITHACA system . In the meantime , this resolution and the acceptance thereof shall continue in effect until January 1 , 1979 or until t he execution prior to said date of said formal agreement except t hat the unit charge shall remain at $ 15 . 00 per unit for the year 1978 . S ection 7 . Nothing in this resolution shall be inter - preted in any way to deprive the-Town of Dryden of r its rights and powers to determine the manner of raising the funds required to be paid to the Town of Ithaca . . * * * , • .) • • . . . . •- :Ws. 3 .
