Minutes of the Regular Monthly Board Meeting of the Town Board of the Town of Dryden held at the Town Hall on the 14th day of October , 1975 , commencing at 7 : 30 P . M . Present : Supervisor Charles G . McCord , Councilman Merton Webb Councilman John J . Joubert Councilman Clinton Cotterill Councilman Lewis Gridley arrived at 8 P . M . Rural New Report Ithaca Journal Reporter County Representative Robert I . Watros Approximately 8 citizens • Absent : Town Attorney Helen Amdur • Supervisor McCord lead the members and guests in the Pledge Allegiance - to the Flag . Roll call was by the Town Clerk . - Motion was made by Clm Cotterill , seconded by Clm Webb , that the Minutes o f the Public Hearings of August 26th and the Minutes of the September 8th Regular Monthly Board Meeting be approved as presented . COUNTY BRIEFING County Rep Watros spoke relative to the preparation of the county budget=: -' He stated that as of yet nothing has been submitted for ambulance service. . to the health committee =, Watros spoke relative to the auditing being done by the state with regard to sales tax distribution . It is being sought to find if errors ' of wrong filing have taken place and the City of Ithaca possibly receiving more than their share . He expects this audit may take some time in order to ascertain if the distribution has been proper . Watros spoke relative to a survey being conduted concerning senior citizen housing and other needs . He will be working with Barbara Caldwell ; o n this matter . ` CITIZENS PRIVILEGE OF THE FLOOR George Hajney spoke relative to the petitions for the formation of the McLean Fire District . He said the petitions are being checked by their attorney and they were not ready to be presented to the Town Board until the attorney had it all okayed . They wanted to be able to submit the petitions just as soon as possible . Supr McCord told Mr . Hajney to pre - sent the petitions to the Town Clerk . Mr . Hajney said only one person refused to sign and they have approximately 82 % of the land owners signatures . Supr McCord said as soon as they get the petitions , Z . O . S tewart will schedule a public hearing . Mr . Philip Johnson representing the Tompkins County Office for the Aging . He spoke relative to the need for coordinating communications in d rawing up proposals for 1976 . He stated that they are developing objectives and mission statement ( copies of such presented to all board members ) . He said there are 946 people over the age of 65 in Dryden . Mr . Johnson said the Town Advisory Committee would like to establish such a 410program in Dryden and to provide feedback to the Office of the Aging if any . He requested the Board to schedule a public hearing in November , Supr McCord spoke relative to the activities of the Community Centers in the town and said that they might be a source as they provide many activities for senior citizens now . - COUNCILMAN PRIVILEGE OF THE FLOOR Clm Cotterill - nothing to report . Clm Webb - nothing to report ' Clm Gridley - nothing to report . Clm Joubert - nothing to report . ATTORNEY : Absent 58 TOWN CLERK Clerk Stelick reported that it was necessary to call on some other people to work for registration and it is necessary to appoint them as substitute election inspectors . RESOLUTION #142 APPOINT SUBSTITUTE ELECTION INSPECTORS Clm Joubert offered the following resolution and asked its adoption . RESOLVED , that this Board appoint the following as substitute Election Inspectors to be paid at the rate of $2 . 00 per hour : Democratic : Katherine Grady ; Eleanor Emerson ; Donna Lemon ; Vicki Dabes and Emily Young . Republican : Dora Chase 2nd Clm Cotterill Roll callvote - all voting YES Clerk Stelick also reported on the progress that was being made on the • town directory , expect to be typing it soon . ZONING OFFICER Z . O . Stewart reported that he issued 21 permits for the period . He has collected $250 . 00 in fees . Discussion was had on the name change of Ringwood Court to Ringwood Court South and Ringwood Courtliest . The Board g ave the Zoning Officer the authority to change the name . S upr McCord appointed Clm Joubert to sign the highway bills . CORRESPONDENCE Receipt of Federal Revenue check in the amount of $ 13 , 605 . 00 . Invitation to attend Tompkins County Board of Reps . at 7 : 30 P . M . October 15th at the Court House . Letter from Local government re : Industrial Development Agency , discussion at the City Counsel Chambers on October 30th at 10 A .M . Letter from Attorney General Lefkowitz office regarding legislature in - volving conservation law . E lectrical and plumbing _ problems at the town hall . Letter from Omega E lectric explaining the problems and that there is a problem with the circuit breakers not operating properly that is to the heat in the meeting room . This letter was to be sent on to Bear Electric by Attorney Amdur . Petition requesting a reduced speed on Mill Street in Freeville area . RESOLUTION #143 LOWER SPEED LIMIT ON MILL STREET Clm Joubert offered the following resolution and asked its adoption . RESOLVED , that this Town Board of the Town of Dryden request that the Department of Transportation establish a lower maximum speed on Mill Street between the Freeville village line and West Dryden Road . 2nd Clm Webb Carried . Clm Webb opinioned that many of our roads are not up to standard and, should have lower speed limits . Letter fromMr . Phillips of George Road commenting on the paving of said road and cutting of brush and expressed thanks . Request to lower the speed zone on Route 38 in the George Junior Republic area , essentially a school area . RESOLUTION #144 LOWER SPEED LIMIT ON ROUTE 38 GJR Clm Joubert offered the following resolution and asked its adoption . RESOLVED , that this Town Board of the Town of Dryden request that the Department of Transportation establish a lower maximum speed on Route #38 between the Freeville village line and George Road , where Route 38 bears east . 2nd Clm Cotterill Carried . RESOLUTION # 145 FINANCIAL TRANSFER Clm Webb offered the following resolution and asked for its adoption . RESOLVED , that the Supervisor be and hereby is authorized to transfer $ 1 , 261 . 14 from Item #la to Item #1 in the Highway Account . 2nd Cim Cotterill Roll call vote - all voting YES RESOLUTION #146 BID FOR TRUCK Cim Gridley offered the following resolution and asked for its adoption . RESOLVED , that the Highway Superintendent be authorized to advertise for bids for a used truck not to exceed $9 , 500 . 00 . 2nd Cim Joubert Carried . Discussion of request for a resolution from the fire departments re jurisdiction over the fire company of the fire department serving • territory outside cities , villages and fire districts or in relation to town fire departments . Board decided to hold on this resolution until Atty Amdur can read it over . Request from Judge Sweetland to amend resolution appointing Mary Bachner as Court Clerk to October 31 and that the probationary period be extended to the end of the year . RESOLUTION # 147 EXTEND PROBATION PERIOD - COURT CLERK Cim Cotterill offered the following resolution and asked its adoption . RESOLVED , that this Board extend the probationary period of the appointment of Mary Bachner as Court Clerk to the end of December , 1975 . 2md Cim Joubert Carried . RESOLUTION # 148 AUDIT HIGHWAY BILLS Clm Gridley offered the following resolution and asked its adoption . RESOLVED , that the Highway Bills be paid as audited . 2nd Clm Cotterill Roll call vote - all voting YES RESOLUTION # 149 AUDIT GENERAL FUND . BILLS Clm Joubert offered the following resolution and asked its adoption . Rev . $ 926 . 20 ; Expenses $24924 . 44 Highway Fund : Revenues $ 1 , 375 . 89 ; Expenses $75143 . 49 JUSTICE REPORTS Judge Newhart $ 1 , 319 . 00 Judge Sweetland $ 1 , 190 . 00 BUDGET DISCUSSION Councilmen Joubert , Cotterill and Webb expressed dissatisfaction with reduced salary for the highway superintendent . Clm Cotterill said it . was to high for the service that we were getting , but we can not realistic agree that its a good salary . He said he is anxious to hear from the public in this regard . Clm Webb said he would not vote for the figure of $9 , 500 as a final budget figure . Discussion of the fire contracts was had . Clm Cotterill proposed that a figure be set for McLean and go along with a contract for now and set a hearing later . RESOLUTION # 150 ADOPT PRELIMINARY BUDGET Clm Gridley offered the following resolution and asked its adoption . RESOLVED , that this Town Board adopt the preliminary budget as compiled even thought it does not include the special districts and fire districts . Said budget to be placed on file in the Clerk ' s office for viewing . 2nd Clm Cotterill Carried . 6U RESOLUTION # 151 PUBLIC HEARING ON BUDGET Clm Cotterill offered the following resolution and asked for its adoption . RESOLVED , that this Board hold a public hearing on the Budget for the coming year . Said hearing to be scheduled for November 6 , 1975 , ' ' at 7 : 30 P . M . at the Tbwn Hall . 2nd Clm Gridley Carried . HIGHWAY SUPERINTENDENT POSITION • . { Supr McCord asked the Board ° how they felt about making the highway superintendent position appointed rather than elected . Clm Cotterill and Clm Joubert were very much in favor of this change . Supr McCord said it would be subject to a permissive referendum . . RESOLUTION #152 APPOINT HIGHWAY SUPERINTENDENT 411 Clm Cotterill offered the following resolution and asked its adoption . WHEREAS , the office of town superintendent of ' highways in this town is an elective office at this time , now , therefore , pursuant to the authority conferred by the provisions of Section 20 , Subd . 6 , of the Town Law of the State of New York , be it RESOLVED , that effective January 1 , 1978 , and thereafter the office of town superintendent of highways in this town be an appointive office . 2nd Clm Joubert Carried Roll call vote - all voting YES , Discussion was had relative to the toilet leaking in the ladies room . Board was at a loss as to what to do . Clock Cotterill said its a guess if its surface water and it sounds like a ' leak from the toilet . It was decided to use dye in the toilet and slop sink to see if anything shows up and the zoning officer was instructed to do this task . Meeting adjourned 9 : 05 P .
