PUBLIC HEARING
Minutes of a public hearing held by the Town Board of the Town of Dryden
at the Varna Fire Hall commencing at 7 : 45 P . M . , March 5 , 1974 . Present :
Supervisor McCord , Councilmen Webb , Cotterill , Gridley and Joubert and
Attorney Amdur . Also present about 30 people .
Hearing was called to order. by Supr McCord at 7 : 45 p . m . for the purpose
o f the consideration of the increase and improvement of facilities of
Water District No . 1 . At this time Supr McCord introduced the members
o f the town board . He reported that this is a proposed intermunicipal
water project that is a joint project with the Towns of Dryden , Ithaca ,
Lansing and Village of Cayuga Heights . He explained the past difficulties
in getting additional water from the City of Ithaca . According to the
City they have a " limited " supply . This effects other municipals like -
w ise . There are two projects proposed : # 1 essentially the water supply
( intake from the lake ) $ 4 , 150 , 000 ; project # 2 is the transmission faci -
lities $ 1 , 930 , 000 . Share apportioned : water actually used and apply a
percentage to that - by Varna 2 . 338 % ( water consumed ) of the total for
Project # 1 ; Ithaca 55 . 065 % , Lansing 27 . 013 % and Village of Cayuga
Heights 15 . 584 % . Of the total for water consumed for Project # 2 - by
Varna 3 . 94 % , Ithaca 75 . 225 % , Lansing 0 . 291 % and VCH 21 . 29 % . Project 1
at 2 . 338 % principal and interest for first year would be $ 6 , 311 . 90 based
on 307 units in water district ; for Project 2 P & I for first year
at 3 . 94 % would be $ 4 , 679 . 21 for a total of $ 10 , 991 . 11 . The cost for
*hats in the ground would be $ 13 , 823 . 98 for a total budget need of.
$ 24 , 815 . 09 . Supr McCord cited an example : single family dwelling
assessed at $ 15 thousand with 200 ' road frontage under the present
rate : The charge would be 44 . 90 for assessment ( 30 % )

Supervisor McCord said this will essentially double the cost . The cost
of water will remain at the rate andoone - half charge as they are paying
to the City . Supr McCord said if the Town of Dryden is going to expand ,
we have to look for an alternate source . The costs can not exceed the
amount in the bond .

Considerable discussion was had by the people present on the cost , and
if this was necessary and why , extending the district and lack of
notification to the people in the district of the town ' s intentions .
Walter Schwan , Supr of the Town of Ithaca , was present and explained
the situation to the people . He cited the Kenilworth project that went
to court in order that the City provide it with water . The Judge ruled
that the City can turn off the water anytime that the supply to their
city people is in jeopardy . Mr . Schwan opinioned that is the situation
we are all faced with being that the City supplies the Towns of Dryden ,
Ithaca , Lansing and Village of Cayuga Heights with water . The inter -
municipal Water District will have two commissioners from each town and
village to serve on the Board . Supervisor McCord said that we will be
buying a new source of water which will cost this district approximately
twice what they are now paying for water taxes . Supr McCord said we
have • two choices ; ( 1 ) join as a full partner or ( 2 ) remain a customer .
If we remain a customer , the water rate is going to be double and other
costs could rise . He stressed the importance of water supply for the
future of the town . Chuck Johns said he does not want to pay the cost
for the future development . He stated that he was opposed to this project .
Robert Relyea noted that all the adjacent lands is owned by Cornell and
they know the cost of putting water out beyond Varna and the cost is
prohibited . He said their problem should not be Varna ' s problem . He
said water rate would have to be a lot more than they are paying now to
give them reason for going this route . Attorney Amdur stated that Varna
is not a self - sustaining district and we could end u¢ paying the same
anyhow . The plant is designed for 6 million gallons of water but can be
increased to 8 million . Transmission mains will be the only pipes put in .

Mr . Schwan predicted that the bond would be completely paid for by
1985 and the only cost would be the water charge . Mr . Relyea asked for
figures to back up that statement and Mr . Schwan replied that we will
be 100 % growth .
Many of the people felt they should have time to get together and
review the project . They requested the figures .
Attorney Amdur explained that the Board can pass a resolution tonight
and it is not subject to a referendum . The agreement must be signed
by the Board and no referendum is required or allowable .
It was requested ' that in the event the agreement is signed , that one
of the commissioners is a taxpayer from the water district .
A show of hands was requested in favor : 2 . The request for a show of
hands who were not in favor never materialized as people were leaving .

Public Hearing
Public Hearing was called to order by Clm Gridley who chaired the
meeting in the absence of Supr McCord and Deputy Supr Webb .:. Hearing
commenced at 7 : 32 p . m . at the Town Hall . Present : Councilmen Gridley ,
Cotterill and Joubert . Absent : Supr McCord and Cim Webb .

P urpose of the Hearing was the application of Keith Lanphear to add
two - one bedroom apartments in the basement of his existing building
on Johnson Road .
Mr . Lanphear reported that it will be studio apartments . He has health
department approval for 5 apartments upstairs and 4 stores on bottom
floor . His property consists of approximately 80 acres . His stated that
the present apartmentsare 90 . % complete . He does not have occupants yet .
Floor was opened to the public .
Mrs . Lance spoke relative to the 8 trailer - toll trucks and thousands
of cinder blocks stored on the premises . She questioned if this might
be wholesale storage or a salvage yard and whether it would require a
special permit . Mr . Lanphear replied that the trucks will be licensed
or sold and the cinderblocks are his property and not for sale . He further
reported that l or 2 of the vehicles is junk and he plans to get it out .
H e said that he plans to use the cinderblocks for a future building . Mrs .
Everett spoke relative to the general appearance of the corner and said
it looks in poor shape with the truck parked there and cinderblocks
stored there . Mrs . Lance stated that he has not made any attempt to
landscape and his present building is not ready for occupancy and inquired
as to whether he can justify more undertaking when his present building
isn ' t finished . Consensus of the Board was to have the Zoning Officer
check into these complaints and have Mr . Lanphear clean up . Attorney
Amdur said the unlicensed vehicles ist not allowed use ; and the Zoning
O fficer should investigate this situation and make a determination . Clm
Joubert said the Zoning Officer should check the complete property for
any and all violations .
D iscussion was had on health department approval . Mr . Lanpher said it
will be presented after he gets approval from the town . Zoning Officer
Stewart , at the request of the Board , checked his file re health dept .
approvals . It was determined that his health dept . approval does not
cover the 2 additional apartments . Attorney Amdur requested that Mr .
Guest sent a letter re updated septic approval . Mr . Lanphear will get
it .

Minutes of the Regular Monthly Meeting of the Town Board commencing at
8 : 00 p . m . at the Town Hall . Present : Councilmen Gridley , Cotterill and
Joubert . Absent : Cim Webb . Supr McCord arrived at 8 : 55 p . m .
O pened with Pledge of Allegiance . Roll call by the Town Clerk .
Motion was made by Clm Cotterill , seconded by Cim Joubert that the
Minutes of January 29 Public Hearing , February • 5 Public Hearings and
February 12 Regular Board Meeting be approved as submitted .
COUNTY BRIEFING
Cty Rep Lee
y p was present to report . Route 13 Task Force was appointed and
it will include Supr . McCord and the Village Mayors . The County has held.
a . ' series of meetings with the DOT re Route 13 corridor . He reported
that the Triphammer overpass was grossly exagerated . The steepest grade
to the ramp will be 6 % . Pedestriam cross places and lights will be put .
County has agreed to upgrade Triphammer Road . Estimate that the Pyramid
will generate 15thousand more cars a day . Triphammer is a county road
and will design it for the utmost safety . Airport : Instrument landing
system is being put in . Landfill : Announced that the fire is out . It was
like a coke fire that took in 4 to 5 acres several feet deep . The site
is turned over to the Department of Environmental Conservation for
monitoring and policing . They tested the water but not on Route 38 .

AGRICULTURE DISTRICT : Cty Rep Lee announced that a public hearing will be
h eld in Lansing re Agriculture District . BOARDMAN HOUSE : Waiting for
the judge to render his decision . TC3 : 95 % complete . Admissions office
w ill move there in March . Expressed concern re decrease in enrollment.
HOSPITAL : Hired Levatich , Hoffman , etc . , Architects . . A core plan first
and portion that could be remodeled . If cost closes in to 15 million ,
then they will go to a new building . No commitment yet . Opened to
q uestions : Clm Cotterill inquired about county recreation proposals .
Mr . Lee replied that he would like to see established a county recreational
coordinated program , but there are no plans yet . Clm Cotterill spoke
relative to the dam rebuilding by the state and said he would like to see
more than just dam rebuilding ; but some form of recreation develop there
such as picnic tables , etc . Mr . Lee mentioned that Leighton Hope in
Cortland is a state recreation member and it might be worthwhile to get
in touch with him . Discussion was had re county re - evaluation program .
CITIZENS PRIVILEGE OF THE FLOOR : Clm Gridley asked the residents of
Varna to make their presentation re Water District when Supervisor
McCord arrive at 9 p . m .
COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Cotterill spoke relative to zoning clean up . He suggested that pressure
be put on violators . He said that the complaints of junk cars is increasing
and not decreasing . He felt that the zoning officer should make an effort
to serve some violations and encourage them to sell to the steel market .
Clm Joubert made inquiry re official newspaper . Attorney Amdur will check
this out . .
Clm Gridley appointed Clm Cotterill to General Bills .
ATTORNEY
Attorney Amdur spoke relative to a feasibility study for water and sewer °
by Lozier Engrs . for the Pentaf project . This would be a district and
w ould have to pay their own cost .
TOWN CLERK
Total amount of taxes collected to date $ 460 , 470 . 03 . Clerk Stelick report -
ed on the real property tax enforcement public hearing in Binghamton held .
by the State Comptroller ' s Committee . Discussion at the hearing was had
o n uniform penalty rate for all taxing districts ( i . e . school , cities ,
✓ illages , towns and counties ) . Clerk Stelick reported that she favored this
idea and thought it should be high enough to discourage late payment of
taxes . Also on the agenda was a proposal to re - levy all delinquent taxes
( including village , school and town and county ) ; identify re - levied items
separately on tax bill ; for a three year period ; after such time the
County would auction off the property . During this period the owner would
be sent a certified letter each year from the county treasurer . Clerk
Stelick reported that she did not favor this procedure as it would place
a burden on the taxpayer to have to pay three years of combined taxes in
o ne lump sum and that it would increase the work load of the county treasurer
and town tax collector .
ZONING OFFICER
Z . O . Stewart reported that he issued 6 permits for the period . Zoning
B oard granted 1 variance . A request for a special permit to sell fill
w as made by Cornell University . It was decided to schedule this hearing
o n the 26th at 7 : 15 p . m . in Etna .
RESOLUTION # 60 PUBLIC HEARING
Clm Cotterill offered the following resolution and asked its adoption .
RESOLVED ; that this Board schedule a public hearing for a special permit
by Cornell on the 26th of March at 7 : 15 pm at Houtz Hall in Etna .

INTERMUNICIPAL WATER DISTRICT
Attorney Amdur briefed those
y present with regard-, to the contract with
the City of Ithaca for water . She stated that the City is obligated to
furnish - the water district with water but if the BPW determines that
there is danger to the use of water , by its own residents , they could
cut off our supply of water : Discussed the sewer agreement . No agreement
in writing . with the Town of Ithaca re transportation charge , but they
can charge a reasonable fee . ; for . the transportation of water through
their pipes . ' Gary. Lee represented the residents of Varna and reported
that they • held a meeting with about 50 people and they now have a better
understanding of the circumstances . He contacted Walter Schwan and he
was able to get the figures from him . He then wrote the complete summary
chart on the chalkboard to better explain it to those present . From the
Water District were Harold Case , Francis Munch , Chuck Johns , Herbert
Snow , Robert Relyea and Mr . and Mrs . Duane Church . Lee reported that
the logic of this project . ip to , insure the future sources for - water
for the Town of Dryden . Discussion was had re operation and - maintenance
by the City of Ithaca . Mr . Lee requested that the summary chart be
put on paper and photocopied to be distributed to the residents of the
district . Herb Snow requested a written statement from Atty Amdur re j
explanation of water and sewer contracts . Supervisor McCord said he
would have the summary statement Thursday . Chuck Johns requested that
one of the representatives on the water commission be from the water
district . Supervisor McCord stressed that the figures presented tonight
are only estimated figures , the only true figure is 6 , 080 , 000 debt . Mr .
Lee requested that the Board delay decision for 7 - 10 days so that these
people can see the figures of the summary chart . It was decided that
the Board would meet on the 21st to make a decision .

The following resolution was offered by Councilman Gridley ,
who moved its adoption seconded by Councilman Joubert , to- wit :

• RESOLUTION DATED MARCH 21st , 1974 .
' A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION
TO THE PROPOSED INCREASE AND IMPROVEMENT OF THE FACILITIES
OF WATER DISTRICT NO , 1 OF THE TOWN OF DRYDEN , TOMPKINS
COUNTY , NEW YORK .
WHEREAS , the Town Board of the Town of Dryden , Tompkins County ,
New York , has duly caused to be prepared a map , plan and estimate
of the cost for the increase and improvement of the facilities
of Water District Noe 1 in said Town , which map and plan provide
for furnishing of a comprehensive water improvement including
a water treatment plant , transmission main and pump station for
an intermunicipal water supply facility for the Towns of Dryden ,
Ithaca and Lansing and the Village of Cayuga Heights , all in Tompkins
` c County , New York , for the joint use and operation by the said four
. municipalities pursuant to an agreement of municipal cooperation
to be entered into by and between the said Towns and the said
Village , pursuant to Article 5 -G of the General Municipal Law ,
at an estimated cost of $ 4 , 150 , 000 ; and
WHEREAS. , the proposed method of financing of the aforesaid

cost pursuant to said agreement of municipal cooperation consists
of the incurring of joint indebtedness by the aforesaid four
lit municipalities to be evidenced by joint serial bonds to be issued
jointly to mature in annual installments over a period not exceeding
forty ( 40 ) years , and the share of said cost to be allocated to
the Town of Dryden pursuant to said agreement of municipal
cooperation shall be determined on the basis of benefits received
or conferred , or to be received or conferred from the aforesaid
improvement in said Town , which amount is presently estimated
to be $ 98 , 000 . 00 ; and
WHEREAS , said Town Board duly adopted an order on February 12 , 1974
1974 , calling a public hearing to consider said proposed increase
and improvement and estimate of expenses , to be held at Varna
Fire Hall , in said Town , on the 5th day of
March , 1974 , at 7 : 30 o ' clock P . M . , Eastern Daylight Saving
Time ; and
WHEREAS , notice . of said public hearing was duly published
and posted in the manner provided by law and proof thereof has been

submitted by said Town Board ; and
WHEREAS , said public hearing was duly held at the time and
place aforesaid , at which all persons interested were duly heard ; and
WHEREAS , said Town Board has duly considered all of the
evidence given at said public hearing ; NOW , THEREFORE , BE IT
RESOLVED , by the Town Board of the Town of Dryden , Tompkins
County , New York , as follows :
Section la Based upon the evidence given at the aforesaid
lip public hearing it has been found and determined to be in the
I public interest to provide for the aforesaid increase and
improvement of the facilities of Water District No . 1 of the
Town of Dryden , Tompkins County , New York , as described in the
preambles hereof , at an estimated cost of $ 4 , 150 , 000 and the
entry into the aforesaid agreement of municipal cooperation _
under which said improvements will be authorized is hereby

approved and the participation by said Town of Dryden , Tompkins
County , New York , in said agreement is hereby authorized . The amount
of said costs allocated to the Town of Dryden shall be borne by
the aforesaid Water District No . 1 by the assessment , levy and

collection from the several lots and parcels in said District
in just proportion to the amount of benefit which the water
• . improvement shall confer upon said lots and parcels .
Section 20 This resolution is adopted subject to the execution
of the aforesaid agreement of municipal cooperation among the
aforesaid Towns and Village ,
. Section 3 . This resolution shall take effect immediately .
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call , which resulted as follows :

\ A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION
TO THE PRO7POSED INCREASE AND IMPROVEMENT OF THE FACILITIES
OF WATER DISTRICT NO 0 1 OF THE TOWN OF DRYDENr , TOMPKINS
COUNTY , NEW YORK °
WHEREAS , the Town Board of the Town of Dryden , Tompkins County ,
New York , has duly caused to be prepared a map , plan and estimate
of the cost for the increase and improvement of the facilities
of Water District No . 1 in said Town , which map and plan provide
for furnishing of comp ehensive water improvement including
water transmission mains9 booster stations and storage tanks for
an interntunicipal water supply facility for the Towns of Dryden ,
Ithac • and Lansing and the Village of Cayuga Heights , all in Tompkins
County , New York , for the joint use and operation by the said four
municipalities pursuant to an agreement of municipal cooperation
to be entered into by and between the said Towns and the said
Villages , pursuant to Article 5 °4G of the G = neral Municipal Law ,
at an e timated cost of $ 1 , .930 , 000 ; and
WHEREAS , the proposed method of financing of the aforesaid
cost pursuant to amid agreement of municipal cooperation consists

of the incurring of joint. indebtedness by the aforesaid four
municipalities to be evidenced by joint :Serial bonds to be issued
jointly to mature in annual installments over a period not exceeding
forty ( 40 ) years , and the share of said cost to be allocated to
the Town of Dryden pursuant to said agreement of municipal
cooperation shall be determined on the basis of benefits received
or conferred , or to be received or conferred from the aforesaid
improvement in said Town , which amount is presently estimated
to be $$62 , 000 . 00 a and
WHEREAS , said Town Board duly adopted an order on February 12 , 1974
1974 , calling a public hearing to consider said proposed increase
and improvement and estimate of expenses , to be held at Varna ...__o_
Fire Hall in said Town , on the in . 5th day of
March , 1974 , at 7 : 30 o ' clock F . ! 1 , , Eastern Daylight Saving
Time ; and .
WHEREAS , notice of said public hearing was duly published
and posted in the manner provided by law and proof thereof has been
submitted by said Town Board ; and
WHEREAS , said public hearing was duly held at the time and
place aforesaid , at which all persons interested were duly heard ; and
WHEREAS , said Town Board has duly considered all of the
evidence given at said public hearing ; NOW , THEREFORE , BE IT
RESOLVED , by the Town Bo -: rd of the Town of Dryden , Tompkins
County , New York , as follows :
Section to Based upon the evidence given at the aforesaid
public hearing it has been found and determined to be in the

public interest to provide for the aforesaid increase and
improvement of the facilities of Water District No . 1 of the
Town of Dryden , Tompkins County , New York , as described in the
preambles hereof , at an estimated cost of .5,' 1 , :930 , 000 and the
entry into the aforesaid agreement of municipal cooperation .
under which said improvements will be authorized is hereby -
approvred and the participation by said Town of Dryden , Tompkins
County , New York , in said agreement is hereby authorized . The amount
of said co =ts allocated to the Town of Dryden shall be borne by
c the aforesaid Water District No & 1 by the assessment , levy and
`( collection from the several lots and parcels in said District

in just proportion to the amount of benefit which the water
improvement shall confer upon said lots and parcels °
Section 20 This resolution is adopted subject to the execution
of the aforesaid agreement of municipal cooperation among the
aforesaid Towns and Village o
Section 30 This resolution shall take effect immediately ,
