PUBLIC HEARING February 5 , 1974 A Public Hearing was called to order by Deputy Supervisor Webb at the Town Hall at 8 : 17 p . m . Present : Deputy Supr Webb , Councilmen Joubert , Cotterill and Gridley , Zoning Officer Stewart and Attorney Amdur . Also present : Robert Everett . Purpose of the Hearing was the application of Taggin Wagon Park , Inc . for a Special Permit to store mobile homes . at the Island Grove Farm on Kirk Road . No one appeared to represent the Taggin Wagon Park . Mr . Everett spoke relative to two trailers parked in the RB area of said land and requested they be moved . Attorney Amdur reported that we have no control over an unoccupied trailer . . Consensus of the Board was that it should be a storage area only and not a sales area . Also felt it should have a time limit such as a year Illor two . RESOLUTION # 49 GRANT SPECIAL PERMIT - TAGGIN WAGON Clm Joubert offered the following resolution and asked its adoption . RESOLVED , that the Special Permit be granted as originally submitted for temporary storage in the designated area for a period of two years on the condition that all mobile home units , new and used , owned by Taggin Wagon Park , Inc . , situated on this property , and not occupied : or set up for sales and /or showing purposes be stored in the designated storage area only : . 2nd Clm Cotterill Roll call vote - all voting YES Adjourned 8 : 4,0 P . Present : Deputy Supr Webb , Councilmen Joubert , Cotterill , Gridly , Zoning Officer Stewart and Attorney Amdur . Also present : Mr . Werninck and son . • Purpose of the Public Hearing was to consider the application of L . Werninck & Sons Supply Co . , Inc . for a Special Permit to build and extend their business at 173 Main St . , Freeville . Mr . Werninck reported that the size of the structure will be 100 x 200 feet and at the back of the present building . Deputy Supr Webb read a letter from Tompkins County Planner Liguori stating that the proposal will have no significant deleterious impact on intercommunity , county or state interests , and , therefore , the town was free to act without prejudice . IIINo one appeared to question the applicant . RESOLUTION #50 GRANT SPECIAL PERMIT - L . WERNINCK & SONS • councilman Cotterill offered the following resolution and asked its adoption . RESOLVED , that this Board grant a Special Permit to L . Werninck & Sons to build a building 100x200 for storage and sales at 173 Main St . , Freeville . 2nd Clm Gridley • • Carried . Merton Webb - Deputy Supervisor Rosemary Stelick - Town Clerk 345 February 12 , 1974 r - Minutes of the Town Board of the Town of Dryden commencing at 7 : 44 p . m . at the Town Hall on the 12th day of February , 1974 . Present : ' Supervisor McCord , Councilmen Gridley , Cotterill , Webb and Joubert . Meeting was called to order by Supervisor McCord . He led the members and guests in the Pledge of Allegiance to the Flag . Roll call was by the Town Clerk . Motion was made by Clm Gridley , seconded by Clm Cotterill that the Minutes of December 18 , 1973 ( Public Hearing ) , January 3 , 1974 ( Organi - zational Meeting ) and January 8 , 1974 ( Board Meeting ) be approved as submitted . COUNTY BRIEFING : At this time Supr McCord introduced County Representative Watros as the new representative for the 14th district ` in the Town of Dryden . Mr . Watros reported that the county board passed at resolution to hire architects re plans for a new building ( hospital ) or a core to the present hospital facility . They expect to know in about six months . Route 13 : They have gone on record as opposing the DOT selection of the existing route 13 and that the county favors the northern route . TC3 : 90 % complete and on schedule . Expect occupancy by early March . Opened to the public for questions . Mr . Lawrence expressed concern about the fire that has been burning badly since November 1973 . He wanted to know what the county can do about this problem ; Mrs . Yvonne Warner said the smell takes in a wide territory . She opinioned that there be no dumping until it is extinguished as this keeps it going . Mr . Watros said there has not been any discussion regarding the dump burning . Supr McCord cited a similar incident with the Collins dump and the county health department closed him down for the same reason . County Rep . Watros said he would pursue this . Discussion was had re Route 13 . Clm Cotterill wondered if we should be questioning their proposal re Route 13 . They ( the , county ) should be encouraging it for the people who will be using it as a expressway and improve it for the oPher people who are local traffic and promote it for the future of a nonexcess highway according to Clm Cotterill . Clm Webb felt that he would rather have nothing if it wasn ' t a four lane all the way and he is 100 % behind the county recommendation . Supr McCord requested of Cty Rep Watros that they appeal the local law # 1 of 1970 relative to taxable status dates re Special Districts . Supr McCord said their feeling is to eleminate it and let the Town Board deal w ith it . CITIZENS PRIVILEGE OF THE FLOOR : Nothing COUNCILMAN PRIVILEGE OF THE FLOOR : Cim Joubert reported that he had requested a schedule from the highway department re plowing and cindering roads and he has been unable to get it . He opinioned that they are not plowing on Snyder Hill until after ,. :. , the storm . Highway Supr . Case arrived at this time and briefly explained the schedule for that area . He said they have 7 plows to cover the whole town . Mr . Joubert also questioned the share of the recreation fund to community centers . He reported that when Mr . Yonkin has asked for it and has been given a flat " no " . Supr McCord said it is budgeted $ 250 . 00 for each center for equipment or counselor and is restricted to summer recreation . The requests are subject to the approval of the ✓ ecreation director , Mr . Thorpe . Councilman Gridley spoke of a - special census . Supr McCord appointed Clm Gridley to look into it . Clm Cotterill felt we could gain something by participating in the Municipal Association . Supr McCord read a letter from Hicks Down with ✓ egard to a meeting March 20 at the Valley House . It was decided to join the association . RESOLUTION # 51 JOIN MUNICIPAL OFFICERS ASSOC . Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED , the the Town of Dryden Officers join the Tompkins County Municipal Officers Association for an annual fee of $ 30 . 00 for 1974 . 2nd Clm Gridley Roll call vote - all voting YES I' ( I� 13 ;1 1 'LI� II w , ' 346 Attorney Amdur reported regarding Perkins Ambulance Service . She said there is a legal problem in that it is illegal to subsidize a private owned ambulance service . She said that we will have to go into the ambulance service and set the fee and collect it . Ref . Sec . 122b Gen . Mun . Law . She said that maybe we have no choice but to go into the ambulance service . It can include villages ( 1956 opinion ) . Mr . Perkins said an emergency coach service is different from an ambulance service . Attorney Amdur said she would check further into this if the Board desired . Clm Webb informed Highway Supt Ease that the road sign on Hile School Road is down on both sides . Cim Webb felt a resolution was in order supporting the county ' s position re Route 13 proposal . Clm Cotterill said he would be in favor if the resolution contains a statement that that we would like to see some improvement on Route 13 regardless of the outcome of the present proposal . RESOLUTION # 52 ROUTE 13 PROPOSAL Clm Webb offered the following resolution and asked its adoption . RESOLVED , that the Town Board of the Town of Dryden supports the Tompkins County Board of Representatives on their Route 13 corridor proposal , and be it FURTHER RESOLVED , that this Town Board is opposed to the State ' s proposal of relocation of Route 13 corridor alone , but would like to see some improvement on existing Route 13 in the interim . 2nd Clm Cotterill Roll Call vote - all YES RESOLUTION # 53 CONTRACT WITH PERKINS AMBULANCE SERVICE Clm Cotterill offered the following resolution and asked its adoption . RESOLVED , that the Town Board of the Town of Dryden enter into a contract with the Perkins Funeral Home of 55 Main Street , Dryden , to provide invalid and / or:.. emergency ambulance service to residents of the Town of D ryden not to exceed the total amount of $ 4 , 520 . 00 for the year 1974 • Said contract to be in effect from 1 / 1 / 74 to 12 / 31 / 74 . 2nd Cim Joubert Roll Call vote - all YES Clm Webb spoke relative to the amount of meetings and felt we should try to cut down on our meetings . He said he would like to see the public h earings for zoning remain being scheduled for the 4th Tuesday . Supervisor McCord said that he was at fault as he felt it would be better not to h ave so many on one night . SIGN ORDINANCE SESSION D iscussion was had re setting a date at Mr . Levatich ' s office with Cim Cotterill and Clm Webb re sign ordinance . Supervisor McCord will call them . LOST ROAD Petition was presented to the Town Board signed by Emmett B . Wagner and Georgianna E . Schutt to abandon Lost Road in the Town of Dryden . High - way Supt . Case said he is fully in favor of this request . It was noted that Lost Road is partially in the Town of Dryden and Town of Caroline . Proceedings for abandonment are being investigated for said road in the Town of Caroline . Discussion was had re qualified abandonment . Attorney Amdur will check into this further . CATHERINE DRIVE Attorney Amdur reported that she has the deed to Catherine Drive in the Cotterill subdivision . A profile map will be filed with the deed . RESOLUTION # 54 ACCEPT CATHERINE DRIVE Clm Gridley offered the following resolution and asked its adoption . RESOLVED , that this Town Board accept Catherine Drive as a town road . 2nd Clm Joubert Roll call vote : Supervisor McCord - YES Clm Gridley - YES Clm Webb - YES Clm Joubert - YES Clm Cotterill - ABSTAIN . . 347 % ,- RINGWOOD ROAD Attorney Amdur reported that she has talked to Mr . Haight and the cost is higher than the petition . It appears as though this will have to be redone . INTERMUNICIPAL WATER DISTRICT Attorney Amdur reported that she has not received a formal notice of h earing from the bonding attorney . It was decided to schedule a public h earing for March 5 at the Varna Fire Hall . ( Copies of the Order attached to the Minutes ) . ZONING OFFICER . Zoning Enforcement Officer Stewart reported that he issued 5 permits for r ' the period . ZBA had two hearings for variances , approved one . CORRESPONDENCE ' Receipt of a letter from Mayor Marcham of Village of Cayuga Heights . Letter from Howard Stevenson relative to reduction on town and state h ighways now back to 55 mph . Supr McCord said he will respond to this . in view of our request for a 45 mph speed limit . RESOLUTION # 55 APPROVE HIGHWAY FUND BILLS Clm Cotterill offered the following resolution and asked its adoption . RESOLVED , that the Highway Fund Bills be paid as audited . 2nd Cim Joubert Roll call vote - all voting YES RESOLUTION # 56 APPROVE GENERAL FUND BILLS Clm Gridley offered the following resolution and asked its adoption . RESOLVED , that after all bills are properly certified , the General Fund. Bills be paid as audited . 2nd Clm Webb Roll call vote - all voting YES RESOLUTION # 57 TRANSFER FUNDS Clm Joubert offered the following resolution and asked its adoption . PUD Discussion was had relative to the questions and criticism heard at the public hearing of January 29th . According to members of the board , their ( the people ) main concern was on the question of the Town Board holding a second public hearing re application of a Planned Unit Development . The Board thought the first hearing should be held by the Planning Board and the second hearing with the Town Board and with the option that it could be sent back to the Planning Board for alterations . As for the restriction of being on state and county highway , Supervisor McCord said he felt it was reasonable and that the town does not want to get into road rebuilding . Clm Cotterill and Joubert felt it should not be limited that tight . RESOLUTION # 58 APPROVE PUD AMENDMENT . Clm Webb offered the following resolution and asked its adoption . RESOLVED , that this Board approve the amendment to the town zoning ordinance entitled " planned Unit Development Districts " as presented at a public hearing 1 / 29 / 73 , with the addition of an additional public hearing be held by the town board under section 2207 . 2nd Cim Gridley Roll call vote - all voting YES 348 ETNA ZONE CHANGE It was decided to schedule a public hearing re zone change in the Etna area as the Planning Board has proposed . Said meeting set for March 26 , 7 : 30 p . m . at the Houtz Hall in Etna . FIRE CONTRACTS : There is still a contract out . According to Attorney Amdur there is some question . MEETING Supr McCord reported that Prof Larry Hamilton is involved with conservation realtive to Fall Creek and has been called a recreational river . He would like to visit with members of the town board . Supr McCord will notify the board when such a meeting can be scheduled . RESOLUTION # 59 DUMP BURNING Supr McCord offered the following resolution and asked its adoption . RESOLVED , that theTown Board of the Town of Dryden goes on record as being unhappy with the inability of Tompkins County to control the fire that has been burning at the Sanitary Landfill Site # 3 for the last 8 months . We note that it was when a similar circumstance occurred with a private operator that his service was closed to the public immediately , THEREFORE , BE IT FURTHER RESOLVED , that the Town Board of the Town of Dryden request that the County Sanitary Landfill Site # 3 be closed immediately until the fire is completely extinguished . We think this is in the best interest of the health and welfare of the residents of the surrounding communities . 2nd Clm Cotterill Carried Attorney Amdur will check into further action that can be taken against the county regarding the burning dump .
