BOARD MEETING
September 11 , 1973
Minutes of the Town Board of the Town of Dryden commencing at 7 : 30 at
Houtz Hall in Etna , New York , September 11 , 1973 • Present : Supervisor
McCord , Councilmen Gridley , Webb and Tarr . Councilman Cotteriil arrived
at 8 : 00 pm . Also present Attorney Amdur and Zoning Officer Stewart .
Approximately 14 citizens present . Called to order at 7 : 30 p . m .
Motion was made by Councilman Gridley , seconded by Councilman Tarr that ==
the Minutes• of the August 14 Regular Monthly Board Meeting be approved
as submitted .
COUNTY BRIEFING : Mrs . Schickel was unable to attend . Mrs . Schickel re -
ported that Mr . Murphy sent a letter to Mr . Stevenson regarding the
county owned property on Wood and Peruville Roads and requested
Stevenson to arrange an inspection and report his recommendations
to prevent future dumping .
CITIZENS PRIVILEGE OF THE FLOOR
Mrs . Dobson requested a traffic light be installed at Etna Lane and
Route 366 . Supervisor McCord reported that it is a difficult procedure .
He said he will make an attempt but not optimistic . Discussion .was had
regarding the posting of the 35 mph sign after the sharp curve but before
the railroad tracks . Opinion was that it should have been posted before
the curve .
Paul Whitted reported that he has been having trouble establishing a
pre - existing use for his trailer and establishing Whitted Road as a town
road . He contends that it is a legal road since no legal steps . have been
taken to legally abandon said road . He requested the Town Board to consider
establishing a new status of the road . He claimed he purchased the land
and trailer in the summer preceding the adoption of the zoning ordinance
in September , 1969 . He said his intent at that time was to put the
trailer on the lot and build a house . He was advised to get a temporary and building permit . The variance was issued and it was for
three years . The three years has run out and he has not built the house .
• ask the Board to establish his true right and leave the trailer on
h is property permanently . He said his situation has changed in that he
is divorced and does not have intentions of building a house there at
this time . Attorney Amdur questioned whether Whitted was ever a town
road and no abandonment proceedings would be necessary if this is the
case . Mr . Whitted claimed that 18 people use the road that own property
there . He reported that his attorney , Mr . Mecklenburg , allowed the sale
to go through . His property number is 525 Whitted Rd . Attorney Amdur
reported that there must be substantial construction to establish a pre -
existing use . A proposed use does not take the property out of the
zoning ordinance . He claimed $ 10 , 000 was spent before zoning was a law .
He had a trailer pad , well and septic system . He claimed 100 % investment
before zoning . Supervisor McCord said they would set up a special
meeting with Mr . Whitted and review all the records surrounding the
situation and come to a decision if it is a pre - existing use .
E llen Bonn inquired as to what happened to their request for a zone •
change in the Etna area . They presented a petition to the Board over
6 months ago signed by approximately 200 people requesting a more
restictive RC zone . Supervisor McCord said the Planning Board reviewed
this request and no decision has been reached yet . He said the Planning
Board will have a meeting in Etna sometime in October to review this
situation and where things stand at this point . •
Citizens expressed concern about the Fair . There are rumors circulating
that the Fair Association is going to have races . Attorney Amdur opinioned
that according to the zoning ordinance this would come under recreation
and would be an allowed use . Peter Curtiss advised the people to check
this rumor out with the Fair Association .
It was requested that the Clerk mail a copy of the Board Meeting Minutes
to the Etna Community Association in care or Richard Turecek .
Harold Case reported that the generator was brought back 9 / 10 and in
working order . They ( the Varna Fire Co . ) will keep it in running condition .
Supervisor McCord extended thanks to the Varna Fire Department .

Paul Perkins was present and reported that he is losing money on his
ambulance service . He said he has talked to the fire department and
they are not interested in having emergency aid and ambulances . He
said he has got to ask for a subsidy from the town . He reported that
his average charge is around $ 30 . 00 . He is restricted as to how much
he can charge medicare and medicaid patients . He is at the same fee
level of 1966 . He reported that the Tompkins County Hospital charges
the patient $ 35 . 00 and pays the ambulances in Ithaca $ 31 . 50 . This
service from Ithaca is available to people in Dryden but the time
element is vital in many cases . Supervisor McCord said it seems to be
a regional problem and the Board will support a recommendation to the
hospital . Mr . Perkins reported that he would need $ 50 - $ 60 per trip to
make it pay . Supervisor McCord told him to submit a budget to the town
and he will pursue it through the county .
COUNCILMAN PRIVILEGE OF THE FLOOR
Councilman Cotterill questioned the Clerk regarding a fee charged for
" going out of business " . Clerk Stelick reported that it is a state law
enforceable • by the town , city and village clerks to issue a license for
the purpose of " advertising " a " going out of business sale " . He also
questioned the zoning officer about the Saroka place . Zoning Officer
Stewart reported that he turned the violation over to Judge Hoagland .
They waited until Monday to hear from S & S Tree Service and nothing
happened so the violation will be served . Questions arose about Jim
Murray ' s decision to build without a permit . Zoning Officer Stewart said
he was in and talked with Judge Hoagland . Councilman Cotterill and Webb
said they did not like to see these violations pending 4 - 6 - 8 weeks and
n othing happens . They said this could set a recedent for other developers .
Zoning Officer Stewart reported that he had the packet for subdivision ;
and that he had preliminary and needeq fi.n9l approvalf 91t �tseaaick
reported that Mr . Murray made an effo e/ 8 lost bond/, But due o mis -
u nderstanding nothing came of it . Supervisor McCord suggested that
Councilmen Cotterill and Webb form a committee and draw up a set of
procedures - and consider adopting and publishing a set of rules . The
Supervisor also stated that we have been relatively lenient in enforcing
the ordinance and perhaps the time is to tighten up . Discussion of the
lack of Justice cooperation was had by Councilman Webb . Peter Curtiss
mentioned that perhaps NYS law prevails in violations . Mrs . Lancaster
said could not the people write the Justices stressing more punitive
measures . The answer was yes .
Councilman Webb suggested that a certified copy of the Board ' s resolution
✓ e Route 13 location be sent to the Planning Board . Clerk Stelick said
this would be done .
Councilman Gridley inquired of the Highway Superintendent whether the
* turn around is 50 feet on Ocean Drive . Highway Superintendent Case said
it meets with his requirements . Councilman Cotterill insisted that it
is not 50 feet . This is was discussed and Mr . Case maintained it was
big enough .
ATTORNEY
Discussion was had on the Haynes application and decision . Attorney Amdur
reported that Mr . VanBuskirk presented a copy of a petition to her office
✓ equesting another hearing . They contended that the health department
w ithdrew their approval . Attorney Amdur reported that she called Mr .
Donahue on the 31st and he said the approval was still in effect . Super-
visor McCord reported that Mrs . Hanford contacted Steve Herman today
and they did . make new perk tests and added morespecifications but they
did not alter the approval . Attorney Amdur reported that John Miller
advised entering' into a contract with the Etna Fire Company for the
balance of the year . There will probably be an additional premimum . It was
decided to set the public hearing on the 25th of Sept .
RESOLUTION # 128 PUBLIC HEARING - ETNA FIRE CO ..
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that this Board set a Public Hearing to contract with the Etna
Fire Dept . at 7 : 30 p . m . , September 25 , at the Town Hall .

Attorney Amdur reported that she has not received a -petition for the
extension of the Varna Sewer District . She further reported that she
could not find any condition to refuse water if not in a sewer district .
Nothing to report on Ringwood Road .

TOWN CLERK •
Clerk Stelick reported that it was time to make appointments to the
Drug Council . She reported that two members , Mr . ' DeCelles and Mr . Smith,
had moved out of the area . She contacted Mrs . Graham , recording secretary ,
and she reported ' that '. they had not had a meeting since March and suggested .
that the Board get together with Dr . Baurle , Rev . Reed and Leonard Snow .
Clerk Stelick reported that she had talked with Gene Muranti of Cortland
Video ( 9 / 11 ) and he reported that he had checked into the amount of houses
on South Knoll Drive and noted that another new road ( Catherine Dr . ) was
being built and wanted to know the projected number of houses . Clerk
Stelick was able to give him the information after talking with Mr '.
Cotterill . Mr . Muranti said they would not be able to do anything before
3gnfiary 1st but that their 1974 • budget would have this project in it . •
He said that the pr ject would not be proved before spring and voiced
concern about the high tension wires . Clerk-

Zoning Enforcement Officer Stewart reported that . he issued 24 permits for
this period : He has two hearing scheduled for the . Town Board on the 18th .
He reported that Mr . Lanphear brought in a copy of the Health Department
Certificate of . Completion and that he has removed his sign .

Letter from George B . Bailey Agency quoted cost for liability coverage

RESOLUTION # 129 HIGHWAY FUND BILLS
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that the Highway Fund Bills be paid as audited .

RESOLUTION # 131 ADVERTISE BIDS
Supervisor McCord offered the following resolution and asked its adoption .
RESOLVED , that this Board authorize the Highway Superintendent to advertise
for bids for a used 10 ton 3 -wheel roller not to exceed $ 6 , 500 . 00 .

OLD BUSINESS .
Request by John Miller for the - Town to support telephone service for .
McLean Fire Department was discussed . It WAS decided to put this in the
budget . .
D iscussion was had on the Keith Lanphear application for a special permit
Councilman Cotterill • said it is ridiculous • to build first and then ask
for a permit . He did not like the idea of having rules that are not en-
forced . He did not feel we. should limit pools with all the acreage he now
h as . Discussion of conditions was had . Councilman Webb opinioned that he
d oes not approve of the . apartment complex as it is not • compatible with
the commercial aspect. He also did not approve of building first then
asking for a permit . Councilman Cotterill - expressed concern about the
first floor becoming apartments . It was noted that he would have to
apply for a permit to make this possible . Consensus of the Board was to
d elete the time schedule of removal of the above ground pools but when
Supervisor McCord -pointed out. the safety factor , . the Board agreed to
leave the time schedule in the conditions . It was also noted that his -
original permit called for the aboveground pools to be surrounded with a
4 foot cyclone fence and this has not be done .

RESOLUTION # 132 GRANT SPECIAL PERMIT
KEITH LANPHEAR
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that this Board grant the Special Permit to Keith Lanphear
for 5 one - bedroom apartments on the second floor of his building and
three additional above ground pools , subject to the following conditions :
( a ) That the pools be located no closer to Route 13 than his
present inground pool and at least 20 feet from the western property
line , in accordance with the sketch map submitted with the application .
( b ) The pools must be completely enclosed by a 4 foot cyclone fence
and the pools filled with water .
( c ) The pools shall be removed from the premises between November
1st and February 28th of each year . '
( d ) Failure of the applicant to comply with any of the above stated
conditions will result in revocation of the permit .

D iscussion on cable service to Ellis Hollow Creek Rd . & Hickory Highlands .
It was reported that there is right - of -way problems on private property
and this was going to be talked over with Mr . Brown .
D iscussion was had on one fire rate townwide . A meeting will be set
with the Mayors of the Villages to review this matter . Said meeting to
be held after the public hearing with the Etna Fire Co . Councilman
G ridley instructed the Clerk to notify the Mayors .
RESOLUTION # 133 APPOINT DOG ENUMERATOR
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that Walter Westfall be appointed Dog Enumerator for the year
1973 .

RESOLUTION # 134 FILE FOR FEDERAL GRANT
VARNA SEWER DIST . PROJ . C - 36 - 412
Councilman Gridley offered the following resolution and asked its adoption .
WHEREAS , the Town of Dryden Varna Sewer District ( Tompkins County ) herein
called the AApplicant " has hereby determined that the construction of
certain works , required for the treatment of sewage , generally described
as PS , FM , INT , herein called the " Project " is desirable and in the public
interest .
WHEREAS , under the Federal Water Pollution Control Act , as amended , the
U nited States of America has authorized the making of grants to aid in
financing the cost of construction of necessary treatment works to prevent
the discharge of untreated or inadequately treated sewage or other waste
into any waters and for the purpose of reports , plans , and specifications
in connection therewith ; and
WHEREAS , the Applicant has examined and duly considered said Act , as
amended and the Applicant deems it to be in the public interest and to the
public benefit to file an application under this Act as amended , and to
authorize other action in connection therewith ;
NOW , THEREFORE , BE IT RESOLVED by the Town Board of the Town of Dryden ,
the governing body of said Applicant , as follows :
1 . That the construction of said Project is essential to and is in the
best interest of the Applicant ;
2 . That Charles G . McCord , Supervisor , is hereby authorized to file on
behalf of the Applicant an application ( in the form required by the
United States and in conformity with the Act as amended ) for a grant to
be made by the United States to the Applicant to aid in defraying the
cost of construction of the sewerage treatment works described above ;
3 . That if such grant be made , the Applicant agrees to pay all the
remaining cost of the approved Project , over and above the amount of the
grant ;
4 . That if such grant be made , the Applicant agrees to make provision
satisfactory to the United States Environmental Protection Agency for

assuring proper and efficient operation and maintenance of the treat -
ment • works after completion of the construction thereof ;
- 5 . That the said Charles • G .' - McCord , Supervisor , is hereby ° authorized to
accept any Federal Grant that may be offered ; to furnish such .infor -
mation and to take such other action as maybe necessary to enable
. . the Applicant to qualify for the grant , and
6 . That the "said Charles G . McCord , Supervisor , is hereby designated
as the authorized representative of the Applicant for the purpose of
furnishing to the . United States such information , date , and documents
pertaining to the application for a grant as may be required ; and
otherwise to act as the authorized representative of : the Applicant in
connection with this application and in - connection with any requirements
of any Federal grant which may be made ; .
7 . That certified copies of . this resolution be included as part of - the
application to be submitted to the United States , for a grant . -

PUBLIC HEARING
September 18 , 1973
Public Hearing was called to order by Deputy Supervisor Gridley at 7 : 35
p . m . at the Town Hall . Present : Deputy Supervisor Gridley ; Councilmen
Webb and Tarr ; Attorney Amdur and Zoning Officer Stewart . Also present :
Lester Canfield , Mr . and Mrs . Sears and Mr . and Mrs . Paxton . Absent :
Supervisor McCord and Councilman Cotterill .
Purpose of the hearing was upon the application for a special permit by
Lawrence Pexton of 850 Midline Road to operate an automobile and motor-
cycle repair and refinishing shop at said address .
Mr . Pexton reported that he will be operating a one -man shop and try
n ot to disturb anyone .
Mr . Canfield said the motors and grinders bother television reception . He
o pinioned that the motorcycles leads to trails and trying out at night .
He said he was 100 % against the motorcycle part of the business . Mr .
Pexton said he would restrict the hours if the Board so desired . Council -
man Webb suggested that the motorcycles use public highways and not
trails . It was discussed about the hours and decided that 9 - 6 would be
normal hours , b ut not on Sundays . This was agreeable to everyone .
Hearing declared closed at 7 : 45 P . M .
The Board decided to take action at this time . '
RESOLUTION # 135 GRANT SPECIAL PERMIT - PEXTON
Councilman Webb offered the following resolution and asked its adoption .
RESOLVED , that this Board grant the Special Permit to Lawrence Pexton
to operate an automobile and motorcycle repair and refinishing shop at
850 Midline Road , subject to the following restrictions :
( a ) Hours will be 9 a . m . to 6 p . m . daily except Sundays . .
( b ) Motorcycles must be ridden on public highways .

Public Hearing was called to order by Deputy Supervisor Gridley at 7 : 50
p . m . at the Town Hall . Present : Deputy Supervisor Gridley ; Councilmen
Webb and Tarr ; Attorney Amdur and Zoning Officer Stewart . Also present :
Robert Watros . Absent : Supervisor McCord and Councilman Cotterill .
Purpose of the hearing was upon the application for a special permit
by the Village of Dryden to erect a sign on the Hudson Sadd property
about 2 miles from the Village on Route 13 .
Mayor Watros , representing the Village , said it will be a " Welcome to
Dryden " sign on a 15 foot structure . Size of the sign is approximately
4 ' x5 ' . The signs have been made by the NYS Youth Camp . He said they plan
Ito have a sign on Route 13 west of the Village and Route 13 north of
the Village . Presently they just have the one location . The sign will
set 1 foot off the right - of-way . Attorney Amdur said we require thirty
feet from the edge of the right-of -way and , therefore , the request would
✓ equire a variance . Attorney Amdur said he would have to appeal to the
Zoning Board of Appeals for a variance .
Mayor Watros said he would talk to Mr . Shannon of the Dept . of Transportation
• and see what they would allow .
Councilman Webb opinioned that the closeness of the sign creates a
traffic hazard .
No action could be taken .

SPECIAL MEETING
September 18 , 1973

Special Meeting was called to order by Deputy Supervisor Gridley at 8 : 07
p . m . Present : Deputy Supervisor Gridley , Councilmen Webb and Tarr ;
and Attorney Amdur . Absent : Supervisor McCord and Councilman Cotterill .
D iscussion was had on contracting for the removal of abandoned vehicles
by the the Sheriff Department of Tompkins County .
RESOLUTION # 136 AGREEMENT
Councilman Webb offered the following resolution and asked its adoption .
WHEREAS , the Town of Dryden , a municipality in Tompkins County , desires
to execute a contract with the Sheriff , designating the Sheriff as its
Agent while removing and disposing of said abandoned vehicles in 'accor-
d ance with the provisions of Local Law No . 3 , - 1973 for Tompkins County ,
adopted April 30 , 1973 ,
NOW , THEREFORE , BE IT RESOLVED , that the parties hereto , in consideration
of the promises , covenants and agreements contained herein agree as
follows : -
1 . The Town of Dryden a municipality in Tompkins County , hereby
designates as its Agent the Sheriff of Tompkins County for
the removing and disposing of vehicles abandoned in said .
Town of Dryden .
2 . The said Town of Dryden hereby agrees that all provisions
of said Local Law No . 3 - 1973 , for the County of Tompkins
shall be applicable to the Town of Dryden .
3 . This contract will commence on the 18th day of September , 1973 ,
and continue for a period to December 31 , 1974 . . Said contract
may be terminated by either party upon thirty ( 30 ) days
written notice to the other . .
4 . That there shall be no cost to the Town of Dryden .

Clerk Stelick announced that the September 25th public hearing would
h ave to be rescheduled to October 2nd in order to have sufficient legal
publication of not less than 10 days . The September 27th meeting
originally scheduled with Mr . Whitted would be scheduled on the 25th at
7 : 30 p . m . The October 2nd date would also have an informational meeting
with the Mayor's of the respective Villages , regarding 'fire tax rate .

Councilman Tarr offered the following resolution and asked its adoption .
RESOLVED , that this Board reschedule the Public Hearing for contracting
with the Etna Fire Department to October 2 , 1973 , at the Town Hall . ( 7,' 3o 40. M )

COUNTY OF TOMPKINS
LOCAL LAW NO . 3 - 1973
A local law of the County of . Tompkins providing for the disposing of abandoned
vehicles within the County of Tompkins . .
BE IT ENACTED by the Board of Representatives of Tompkins County as follows :
Section 1 . For purposes of this local law , a motor vehicle shall be deemed to be
an abandoned vehicle if left unattended
A ( a ) with no number plates affixed thereto , for more than six hours •
on any highway or other public place ;
( b ) for more than twenty - four hours on any highway or other public
place , except a portion of a highway or public place on which
parking is legally permitted ; •
( c ) for more than forty - eight hours , after the parking of such
vehicle shall have become illegal , if left on a portion . of a
highway or public place on which parking, is legally permitted ;
( d ) for more than seven days on property of another if left initially
without permission of the owner .
Section 2 . The Sheriff of the County of Tompkins is hereby authorized to contract
with any municipality within the County of Tompkins for the purpose of
removing and disposing of abandoned vehicles . If such a contract is
executed between the Sheriff and the various municipalities , the Sheriff
shall be designated as the agent in said contracts of said municipalities
• while removing and disposing of vehicles abandoned in . said municipalities .
Any monies derived from the sale of said abandoned vehicles , less the
expense of removal , storage charges and sale , shall be held by the County
for a period of five years and thereafter paid into the general fund of
the county in the same manner as if the county were the municipality
entitled to the custody of the vehicle , as prescribed by Subdivision
five of . Section 1224 of the Vehicle and Traffic Law . .
) Section 3 . Information requests from local authorities .
•
( 1 ) Except as provided in Subdivision ( 2 ) of this section , when the
County obtains custody of an abandoned vehicle , it shall make an
inquiry concerning the last registered owner to the jurisdiction
which issued the number plates affixed to the vehicle , or to the
New York Department of Motor Vehicles , if there were no number
plates affixed . Such inquiry shall be made on Form DP - 208 , or on
such other form as may be required by the jurisdiction which
issued the number plates .

( 2 ) Inquiry concerning the last registered owner shall not be required
when the abandoned vehicle is one which was left without number
• plates affixed and which is of a wholesale value , taking into con -
sideration the condition of the vehicle , of $ 100 or less .

( 3 ) When the County has custody of a large number of vehicles it .
may , with the approval of the Commissioner of Motor Vehicles ,
submit the request for information in such other form as may be
. prescribed by the Commissioner . Requests for Such approval
should be mailed to Department of Motor Vehicles , Abandoned
Vehicles Unit , 504 Central Avenue , Albany , New York . 12206 .
Section 4 . Vesting of title and notice to owner . .
( 1 ) If an inquiry is required under Section 3 , and: the identity of
the owner is ascertained , a notice shall be sent to such owner .
• . ( and to any lien holder made known to the County by the State
licensing authority ) before title may be acquired by the County .
If such vehicle is unclaimed , title shall vest in the County
five days from the date such notices are mailed , Notice shall
be sent by registered or certified mail , return receipt re -
quested , in the form prescribed in subdivision (4 ) of this
section .
( 2 ) If an inquiry is required under Section 3 and the identity of
the owner cannot be ascertained , title to the vehicle shall vest
in the County without any . additional notice being required , when
notice of such fact is received .
( 3 ) If an inquiry is not required under Section 3 , title to the vehicle
shall vest in the County immediately . .

Section 5 . Disposition of number plates , ownership documents and vehicle • identifi -

( 1 ) Number of plates . .

The County shall remove and store number plates - for 30 days ,
after which plates shall be destroyed . A list of all destroyed
plates , with the name of the last registered owner of the vehicle ,
• shall be submitted monthly to the Department of Motor Vehicles .

Registration , title and other ownership documents shall be retained
by the County for a period of six months , after which they shall be

( a ) If a vehicle is sold for reuse on a public highway , vehicle
identification number plate shall not be removed .
( b ) The Vehicle identification number plates of all vehicles sold
for scrap or parts shall be removed by the County and forwarded
to the Division of State Police at the State Campus , . Albany ,
New York 12226
Section . 6 . Transfer of title .

( 1 ) . Whenever a . vehicle is sold pursuant to the provisions of Section
1224 of the Vehicle and Traffic Law , the appropriate official or
employee of the County shall issue , a bill of sale substantially in
the form prescribed in subdivision ( 2 ) of this section . Bills of
sale shall be numbered consecutively as issued , and a copy shall be
maintained by the County for one year after the date of sale .

RESOLUTION : FILE FOR FEDERAL GRANT RE : VARNA SEWER DISTRICT
Project C = 36 - 412
WHEREAS , the Town of Dryden Varna Sewer District ( Tompkins County )
herein called the " Applicant " has hereby determined that the
construction of certain works , required for the treatment of
sewage , generally described as PS , FM , INT , herein called the
" Project " is desirable and in the public interest .
WHEREAS , under the Federal Water Pollution Control Act , as amended ,
the United States of America has authorized the making of grants
to aid in financing the cost of construction of necessary treat -
ment works to prevent the discharge of untreated or inadequately
treated sewage or other waste into any waters and for the purpose
o f reports , plans , and specifications in connection therewith ; and
WHEREAS , the Applicant has examined and duly considered said Act ,
as amended and the Applicant deems it to be in the public interest
and to the public benefit to file an application under this Act
as amended , and to authorize other action in connection therewith ;
NOW , THEREFORE , BE IT RESOLVED BY the Town Board of the Town of
Dryden , the governing body of said Applicant , as follows :
1 . That the construction of said Project is essential to and is
in the best interests of the Applicant ;
2 . That Charles G . McCord , Supervisor , is hereby authorized to
file on behalf of the Applicant an application ( in the form
required by the United States and in conformity with the Act as
amended ) for a grant to be made by the United States to the
Applicant to aid in defraying the cost of construction of the
sewerage treatment works described above ;
3 . That if such grant be made , the Applicant agrees to pay all the
remaining cost of the approved Project , over and above the amount
o f the grant ; .
4 . That if such grant be made , the Applicant agrees to make
provision satisfactory to the United States Environmental Protection
Agency for assuring proper and efficient operation and maintenance
o f the treatment works after completion of the construction there -
o f ;
5 . That the said Charles G . McCord , Supervisor , is hereby authorized
to accept any Federal Grant that may be offered ; to furnish such
information and to take such other action as may be necessary to
o nable the Applicant to qualify for the grant and
6 . That the said Charles G . McCord , Supervisor , is hereby desig -
nated as the authorized representative of the Applicant for the
purpose of furnishing to the United States such information , date ,
and documents pertaining to the application for a grant as may be
required ; and otherwise to act as the authorized representative
o f the Applicant in connection with this application and in
connection with any requirements of any Federal grant which may
be made ;
7 . That certified copies of this resolution be included as part of
the application to be submitted to the United States , for a grant .
