February 8 , 1972
Minutes of the Regular Monthly Meeting of the Town Board of the Town of
Dryden held February 8 , 1972 , at the Town Hall , commencing at 7 : 35 P . M .
Present : Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and Webb ,
Zoning Officer Stewart and Attorney Amdur . Also present : Ronald Alexander ,
Ron Denniston , Ed Howser and wife , Professor Hartkoff , Mel Aiken and wife ,
Robert Schutt and Margaret Durland .
Meeting was called to order by Supervisor McCord ; and opened with the
Pledge Allegiance to the Flag .
, . -- Roll Call was by the Town Clerk .
A series of Minutes was offered for additions or corrections .
Motion was made by Councilman Gridley , seconded by Councilman Cotterill that
the Minutes of the Regular Board Meeting of December 14 , 1971 , be approved
• as submitted .
Motion was made by Councilman Cotterill , seconded by Councilman Gridley ,
that the Minutes of the Public Hearings of December 28 , 1971 , be approved
as submitted .
Motion was made by Councilman Gridley , seconded by Councilman Cotterill ,
that the Minutes of the Organizational Meeting of January 4 , 1972 , be
approved as submitted .
Motion was made by Councilman Cotterill , seconded by Councilman Gridley ,
that the Minutes of the Annual Audit of January 6 , 1972 , be approved as
submitted .
Motion was made by Councilman Gridley , seconded by Councilman Cotterill ,
that the Minutes of the Regular Board Meeting of January 11 , 1972 , be
approved as submitted .
At this time Supervisor McCord brought to the attention of the Board the
tabled issue of membership to the Association of Towns . This was discussed .
RESOLUTION # 37 ASSOCIATION OF TOWNS
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that the Town of Dryden join the Association of Towns and pay
the annual membership fee of $ 226 . 00 for 1972 .

Supervisor McCord - YES
Supervisor McCord announced that Gary Lee would be absent and , therefore ,
no county briefing was made .
CITIZENS PRIVILEGE OF THE FLOOR
Ronald Alexander was present to bring the Board up to date on the activities
of the Drug Council . They have established the ideal that they would not
advertise or become very vocal about the council . Students and parents are
being deluged with lots of material on drugs and the Council felt that as
a group it would be better to work with personal contact with the people
in the community . It was decided to implement a drop - in type of counseling
in a series of once a week open sessions at the Dryden school . A telephone
has been installed in Mr . Alexander ' s home with a line to the Amdur house
and hope to keep it maned on a 24 hour basis . They plan to take out an
ad in the local papers merely saying " Drug Problem - Call 844- 8424 " . ` They
• started out counseling six youngsters , down to three and one they are
having a very bad experience with . They have set a rate of $ 12 . 50 per hour
for the counselor . They are trying to establish families to take on a
regular neighborhood coffee hour approximately six times a year in hopes
this will open a channel of communication .
Ed Howswer was present to express the concern of the citizens of that
area ( Irish Settlement Rd . and Midline Rd . ) . He requested the town consider
a land disturbance ordinance . This request resulted because his neighbor
has dug a deep gravel hole close to his property line and he claimed this
will have an effect on private property values . Mrs . Howser said such an
ordinance is in effect in Tully,: Mr . Schutt recommended such an ordinance
and opinioned that zoning would be on much better ground as far as the
zoning ordinance was concerned . There was discussion that the gravel is not
being used for commercial purposes , and , therefore , the town had no control
over it . Mr . Aiken differed with that opinion . He said it is being used for
commercial purposes in that the man is using it on new homes he intends to

sell . Attorney Amdur said this could not be classified as commercial , since
h e was not involved in direct selling of the gravel . Mr . Howser and Mr .
Schutt requested immediate action from the Board . SupervisorlMcCord said
h e is not familiar with this type of ordinance and it would have to be
looked into . Discussion was had regarding enforcing such an ordinance
on a town - wide basis , and the fact that many farmers dig holes on their
property for gravel for their own use . Attorney Amdur said if a neighbor
creates some condition on his land which causes damage to the neighbors ,
they have recourse through the courts .
COUNCILMAN PRIVILEGE OF THE FLOOR
Councilman Gridley reported that he attended both the Villages of Dryden
and Freeville meetings . The Dryden Village Board is concerned with the
E ast Main Street culvert .
Councilman Cotterill brought up scheduling the snowmobile test , now • that
there is plenty of snow . Supervisor McCord advised Councilman \ Tarr to
set the date and call Mrs . Wallenbeck so that she could contact the people
Councilman Webb reported that the Zoning Committee met and working on. it .
ATTORNEY
Attorney Amdur reported that we got a decision from Judge Bryant on the
action we brought for a temporary injunction against Michael Pichel to
prevent him from further building , pending the outcome of the proceedings .
TOWN CLERK .'
Mrs . Stelick reported she has collected taxes in the amount of $ 343 , 246 . 04
and disbursed $ 335 , 021 . 19 to the supervisor .
ZONING OFFICER
Mr . Stewart reported that he issued two building permits . So far he has
set one public hearing for the 22nd of February at 7 : 30 P . M .
CORRESPONDENCE
Supervisor McCord read a letter from Ruth Munch , who submitted her resignation
as chairman of the election inspectors in District 1 ( Varna ) . She recommended
Mrs . Seewald to serve in this capacity for the forthcoming year . Their
feeling being that the chairmanship should be shared between the two
parties . Councilman Gridley suggested this letter be turned over to the
Republican Chairman, Greg Eades .
Supervisor McCord read a copy of a letter from Mrs . Richard Seelbass to
Mr . Parker , Superintendent of N . Y . S . Department of Transportation , regarding
• her dissatisfaction over the decision of the Transportation Dept . not to
reduce the speed limit on Ellis Hollow Rd .

RESOLUTION # 38 HIGHWAY BILLS
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that the Highway Bills numbered 49 to 82 in the total amount of.
$ 5 , 645 . 47 be paid as audited .
2nd Councilman Webb Roll Call Vote - all Voting YES
RESOLUTION # 39 GENERAL BILLS
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED , that the General Bills number 26 to 51 in the total amount of
$ 4 , 225 . 74 be paid as audited .

WATER DISTRICT # I Supervisor McCord reported that the City of Ithaca maintains there is a
" moratorium " on any new hook ups for water . He further explained that
there has been a " change " in policy whereby the man who normally signs
• the applications for new water hook ups is now instructed that the Board
o f Public Works must approve all such applications . At the present time
the BPW has neither approved ror disapproved the applications of two
✓ esidents in the water district . Supervisor McCord reported that he has
spoken to the BPW and asked for a statement in writing regarding this
" moratorium " , the conditions under which it was set up and why ; because
he believes this is what the terms of the contract with the City calls
for . He got no response . He said he spoke to Mayor Conley and the Mayor
tried his best to intervene and get some kind of settlement . The BPW still
maintain it isn ' t " moratorium " . Supervisor McCord reported that he has
talked with Attorney Amdur and they are prepared to take what legal
steps are necessary to settle the issue . Attorney Amdur said our agreement
w ith the City is that they are obligated to supply us with water unless
there is an anticipated water shortage at which time they are suppose to
n otify the town to give us ah opportunity to obtain an alternate source
of supply .
RESOLUTION # 40 WATER DISTRICT CONTRACT
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED , that this Board go on record that they are not happy with the
way the City of Ithaca is not abiding by the terms of the contract , and be it
FURTHER RESOLVED that this Board authorize Supervisor McCord to do what is
necessary .

RESOLUTION # 41 MC ARTHUR FUND
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that the Supervisor be authorized to obtain two bank drafts to
disburse the interest in the McArthur Fund to the two schools in the Town
of Dryden in the amount of $ 311 . 89 to Dryden Central School and the amount
of $ 23 . 48 to George Junior Republic for a total of $ 335 . 37 .

RESOLUTION # 42 EXTENSION PHONE FOR JUSTICE HOAGLAND
Supervisor McCord offered the following resolution and asked its adoption .
RESOLVED , that this Board authorize installation of a telephone extension
for the office of Justice Hoagland .
2nd Councilman Gridley Roll Call Vote - all voting_ YES
It was announced there would be a meeting with a man from the State
Retirement Insurance and the Town Board on March 13th at 12: 30 P . M . at
the Town Hall .
• Motion was made by Councilman Gridley , seconded by Councilman Cotterill ,
that this meeting be adjourned until the 22nd of February .
