November 9 , 1971
Minutes of the Regular Monthly Meeting of the Town Board of the Town
of Dryden held November 9 , 1971 , at the Town Hall , commencing at 7 : 30 P . M .
Present were Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and
Webb , Zoning Officer Stewart and Attorney Amdur . Also present were Mr .
and Mrs . Ed Howser , Ed Sweetland and H . A . Hartkopf .
Meeting was called to order by Supervisor McCord , and opened with the
Pledge Allegiance to the Flag .
Roll Call was by the Town Clerk . _
B eing no additions or corrections , motion was made by Councilman Gridley ,
seconded by Councilman Tarr , that the Minutes of the September 21st
Public Hearing be approved as distributed by the Town Clerk .
Being no additions or corrections , motion was made by Councilman Gridley , 110
seconded by Councilman Tarr , that the Minutes of the Regular Board
Meeting of October 12th be approved as distributed by the Town Clerk .
Being no additions or corrections , motion was made by Councilman Cotterill ,
seconded by Councilman Gridley , that the Minutes of the adjourned Town
B oard Meeting and Public Hearing of October 26th be approved as distributed
by the Town Clerk . .
CITIZENS PRIVILEGE OF THE . FLOOR '
Mr . DeCelles was present to report on activities of Youth Court . He said
they are making efforts to contact everybody in the referral process such
as Justices , Police Chief , Probation Officers and other . Officials . They
are all in favor of this program and promise to refer appropriate cases
to Youth Court .
Mr . Howserwashpresent to complain about Mr . Hardesty ! s activities re
h is gravel bank . He claimed that he ( Hardesty ) has cut the bank down
along . Midline Road right up to their ( Howser ' s ) property line . He was
worried about .. ',the loss . in property value to his property . Mrs . Howser
said its getting to be quite an eyesore . Zoning Officer Stewart reported
that Mr . Hardesty is using the gravel for his own purpose and not
selling it . Supervisor McCord said as far as somebody using his own
property in that way , it is permissible . Mrs . Howser suggested that the
- town consider a Land Disturbance Ordinance similar to one enacted in
O nondaga '.County . She had a copy of the ordinance which she allowed the
Supervisor anci Attorney to read . Attorney Amdur reported that there is
an amendment under consideration regarding gravel beds and currently
at the County Planning Office for approval . Attorney Amdur said if he
is creating a private nu dance , then they have recourse through the
court if they can prove that there is any damage .
COUNTY BRIEFING .
Mrs . Schickel reported that they received a presentation by O ' Brien &
Gere , Engineers ., on Tompkins . County Sap taar_y ] i t st # 1 study . This will
take in the Towns of Lansing and Ithac a Ytte .. corner of the Town
of Dryden . County Review & . Appraisal : ' There will be a county -wide
appraisal of each property beginning very shortly by the Assessment Dept .
They will start with the villages , City ,of Ithaca , and . then the towns . It
is expected to * take 4 years . Equalization Rate : Will be 77 % . Last year
was 83 % . 1972 County Budget : Expect the budget will be passed on November
22nd after the ' public hearing of November 18th . Increased wages and •
Social Services accounts for major increases . College : Both counties
( Tompkins & Cortland ) have accepted construction documents of the
college and has been putout to bid . , Projected cost will . be 122million
for the building , whole cost will be 14 . 2 million . DeWitt : DeWitt Park
area has been designated as a historical site and some of the county
owned property in this area may be affected by this . Industrial Development
Agency : Five members have been appointed to this agency , as follows :
Harris Dates , James Graves , Gary Lee , John Murphy and Howard Stevenson .
D ata Processing : County has signed a contract with the Touchette Corp .
for electronic '' data processing for $ 765 , 080 for a 5 year period . It will
cover payroll , assessment department , social services and the hospital .
At this time Mrs . Schickel concluded her report and was open to questions .
Councilman Cotterill requested more information re county -wide review and
appraisal . Since it appeared that the questions asked could only be
answered by someone from the assessment department , Supervisor McCord
suggested that the Town - Clerk- along with Councilman Cotterill ' s help write

to Mr . Payne and invite him or one of his representatives to the
D ecember 14th board meeting .
COUNCILMEN PRIVILEGE OF THE FLOOR
Councilman Gridley reported that the Highway Superintendent received two
bids for a . truck and there was $ 82 difference . He said he will offer a
✓ esolution later . . He reported that he had talked to the Justices re
building plans at the Town Hall , but he did not have anything down on
paper yet . Supervisor McCord suggested that Councilman Gridley talk to
all users of the building including the Town Clerk , Town Board , Planning
Board , Zoning Board of Appeals , etc . and get a projected use of the
building .
Councilman Webb reported that the Fire Departments have been trying to
IIIwork with the county in use of county equipment . They have an agreement
• that the fire companies must use their town equipment first and then
the county equipment . The County Highway Superintendent has refused to
cooperate in this matter . He requested use of the town equipment if

insurance would cover and if the highway superintendent would cooperate ,
.
in this matter . Town Clerk was told to check into the insurance coverage
for the town and adjacent towns .
ATTORNEY
Attorney Amdur reported that Mr . Pichel has been allowed to winterize
his place with straw , but he is not allowed to extend it in any way as
the Restraining Order continues to be in effect . Report on the Furman ._
case : on the first complaint Mr . Furman appealed with an attorney and
plead not guilty and asked for a jury trial . They went to court and Mr .
Furman claimed that the Zoning Board of Appeals acted arbitrarily and
also claimed the zoning ordinance is unconstitutional and the Judge
made decision that the Zoning Board had not acted arbitrarily . Another
complaint has been put in and if he doesn ' t do anything, she will have to
get an injunction on him .
TOWN CLERK
Mrs . Stelick reported that the town directories. are not selling very
w ell and wanted to know what the Board would like to do about this
situation . Discussion re advertising in the Rural News and Shopper
took place .
RESOLUTION # 141 ADVERTISE AVAILABILITY OF DIRECTORIES
III Councilman Cotteril ] offered the following resolution and asked its adoption
RESOLVED , that the Town Clerk be- authorized to advertise the availability
o f the Town Directory at $ 1 . 00 a copy in the Rural News and Shopper .

ZONING OFFICER
Zoning Officer Stewart reported that he has issued 82 permits for a total
of 201 compared to 180 a year ago . Reported that the Zoning Board held
two hearings . He also reported that Crispell has built a house next to
h is business on Slaterville Road and there is no number available . This
w as discussed and it was decided that Mr . Crispell would have to use a
number or change the number of his business . He reported that the
billboard on the Hemingway property is still up and that Mr . Hemingway
got in touch with him November 1st and requested that they be allowed
to apply for another permit before they tore it down . Supervisor McCord
said the decision- was . reached :15y - the - Borrd " that the sign must come down .
CORRESPONDENCE
L etter from Jim Calhone indicated that it looks like Tompkins County is
g oing to be accepted in the Soil Conservation Assistance Program . Super -
0 visor McCord said that Superintendent Case will follow up with Mr . Calhone
about the towns needs for roadside seeding .
L etter from the Dryden Fire Department whereby they favor a full - time
Fire Coordinator for Tompkins County and requested the Town Board support
this motion through the County Board of Representatives .
RESOLUTION # 142 COUNTY FIRE COORDINATOR
Councilman Webb offered the following resolution and asked its adoption .
RESOLVED , that this Board notify Gary A . Lee and Marion Schickel , County .
Representatives , that the Town Board favors the adoption of a full - time -.
County Fire Coordinator .

L etter from Marie Petersen informing the Board of the deplorable conditions
which the Election Inspectors are forced to work under in District 4 at
West Dryden . She reported that the water was shut off , no bathroom

facilities , dirty , broken windows and they had to board up the windows to
preserve heat . . She also reported that they had to carry their own water
and that she had to clean up the pumpkin and broken glass scatte + ed all
over floor . She said she has resigned as election inspector . Jeanne
Vanderbilt was present and said that the water has to be turned off with
the approach of cold weather and they have had trouble with kids / break -
ing windows and Halloween pranks . She said John Morey should have gotten
hold of Ed DiGiaccomo to turn the water on . Councilman Gridley offered
some suggestions and SupervisoroMcCord turned the letter over to . him- to
look further into the matter .
RESOLUTION # 143 HIGHWAY BILLS
Councilman Gridley offered the following resolution and asked its adoptio
RESOLVED , that the Highway Bills totaling $ 24 , 249 . 01 be paid as audited .

RESOLUTION # 144 GENERAL BILLS
Councilman Cotterill offered the following resolution and asked its adopt ,
RESOLVED , that the General Bills totaling $ 2 , 847 . 05 be paid as . udited .

RESOLUTION # 145 TRANSFER FUNDS • - HIGHWAY I
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that $ 1000 from Highway Item # 1 in the Highway Fund Account The
, transfered to Health Insurance Account .

RESOLUTION # 146 TRANSFER FUNDS - GENERAL
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED , that $ 8000 from General Fund Town Outside be transfered to
Item # 1 in the Highway Account . .
2nd Councilman Tarr Roll call vote - all voting YES
Discussion took place re annual . dues . to the Association of Towns . The
latest annual bill is $ 226 up from $ 100 for last year . The charge is based
on assessment basis . I
RESOLUTION # 147 CANCEL MEMBERSHIP - ASSOCIATION OF TOWNS
Councilman Webb offered the following resolution and asked its adoption .
RESOLVED , that this Town Board cancel membership to the Association of
Towns for the year 1972 . 411

RESOLUTION # 148 ACCEPT BID FOR TRUCK
Councilman Gridley offered the following resolution and asked its adoption
WHEREAS , Brockway Motor Trucks of Elmira submitted the lowest responsible
bid for one Cl ) 1972 Model N361 LL Heavy Duty Double Reduction Tandem Drive
Truck with a dump body for the sum of $ 28 , 885 , less tires , now , therefore ,
be it
RESOLVED , that the bid of Brockway Motor Trucks of Elmira be accepted and
the Highway Superintendent be empowered to complete the transaction , and
be it
FURTHER RESOLVED , that the Highway Superintendent be authori ed and directed
to supply the necessary ten ( 10 ) tires at state price for the Brockway Truck .

PUBLIC HEARING
■
In the absence of Supervisor McCord , Councilman Tarr presided and called
the Public Hearing to order at 7 : 45 P . M . at the Town Hall , upon the
question of the enactment of propped amendments to the Snowmobile
Orainanbe regulating ` ; the operation of snowmobiles on public highways
. and places of the Town of Dryden .
— Present were Councilmen Tarr , Gridley , Cotterill and Webb and Attorney
Amdur . Also present were Warren Underwood and wife and sister- in- law
from Snyder Hill area Anthony Ceracche and his attorney David Gersh .
Absent : Supervisor McCord .
Councilman Tarr read the notice of hearing in its entirety that was
• duly advertised in the Rural News and Ithaca Journal .

Warren Underwood noted that Bes. emer Hill Road to the Town of Caroline
line was not included and ask if this was possible to be included .
Attorney Amdur said this could be done .
Attorney Amdur said there is no obligation that the Town post the roads .
It was noted that the designated roads should be posted by the snowmobilers
and that Highway Superintendent Case should designate where the signs
must be posted .
Mr . Gersh , representing Mr . Ceracche , wanted to know what prompted
dropping the distance to 300 feet around the antenna tower : This was
discussed and it was decided that another test would be welcomed by all
parties involved . Mr . Underwood requested that a member of the Town
. Board be present at this test to witness the results . - Mr . Underwood
contends that there is no difference in reception while running their
machines . He claimed that he has had poor reception in the summer and
no machines are running then . Mr . Underwood asked Mr. . Ceracbhe if he
had complaints Thanksgiving Day . Mr . Ceracche replied " no " . Mr . Under-
wood went bn to explain they had been riding their machines from 10 in
the morning on and some watched football on television that day and
, they experienced no change in their reception . After much discussion
it was decided to set Tuesday , D'ecemb:er 7th at 7 : 30 at the antenna tower
as the day for a test . If no snow , postphoned until Friday , December 10th ,
same time ', and place . Councilman Cotterill and Tarr agreed to attend . .
